phase request Subdivision From:Billy & Work [bm-ramdev@nc.rr.com] Sent:Wednesday, December 17, 2008 1:07 PM To:Jay Sikes Subject:FW: Oakmont Jay I am writing you in regards to Oakmont Subdivision that we are going to develop off of Doc’s Road in Harnett County. Scott Brown of 4-D is our engineer and we have a submitted and approved preliminary for the first 122 lots. I believe the expiration date of our 2 years is August 20, 2009. As I trust you are aware the real estate market conditions are tough at best. My question is concerning our ability to put in less than the 122 lots within this time frame. Per our phone conversation it is my understanding that we can install less than the total number of lots (6 or more) and still not loose out vested interest in the engineers design of the size of lots and any other changes in development standards. Can you please confirm if this is correct and what we have to do to not have to install more lots than the market can absorb while also not loosing our engineered plans and approved development standards? Thank you for your attention and understanding. With kind regards, Billy Maxwell 910-818-6906 1
