The Harnett County Board of Commissioners met in regular session on I
Monday,- November 18, 1991, in the County Office Building, Lillington,
North Carolina, with the following members present: Mack Reid Hudson,
Bill Shaw, Walt Titchener, Beatrice Bailey Hill, and Chairman Lloyd G.
Stewart presiding. Others present were Dallas H. Pope, County
Manager; W. Glenn Johnson, County Attorney; Vanessa W. Young, Finance

PUBLIC HEARING ON Chairman Stewart called to order a public hearing on the Fayetteville
FAYETTEVILLE URBANIZED
AREA THOROUGHFARE PLAN Urbanized Area Thoroughfare Plan. George Jackson, Planning Director,
briefed the group that 12 citizens attended an informal drop-in
meeting which was held November 5, 1991, at the Anderson Creek Senior
Citizens Center concerning the Fayetteville Urbanized Area I
Thoroughfare Plan. Mr. Jackson stated the purpose of this public
hearing is to obtain comments concerning the Plan. Mr. Dan Thomas,
Statewide Planning, NCDOT, and Mr. Rick Heicksen, Transportation
Planner, Cumberland County Joint Planning Board, provided details of
the Plan and answered questions about how the Plan will affect Harnett
County. Chairman Stewart opened the meeting for public comments. The
following citizens provided comments concerning the Fayetteville
Urbanized Area Thoroughfare Plan:

RESOLUTION RE: FAYETTE. Commissioner Shaw moved for adoption of a resolution co~cerning the
URBANIZED AREA THOROUGH- Fayetteville Urbanized Area Thoroughfare Plan. Commiss1oner Ti tchener
FARE PLAN seconded the motion and it passed with a unanimous vote. The
resolution is copied in full at the end of these minutes as Attachment
2.
I PUBLIC HEARING ON Chairman Stewart called to order a public hearing on application for
ZONING CHANGE REQUEST zoning change for Agnes McDonald and Ishmael McDonald, from RA-40
Zoning District to RA-30 zoning District, 35 acres located in Anderson
AGNES MCDONALD C=eek Township on SR 1131. George Jackson, Planning Director,
presen~ed the application and briefed the group that the purpose of
the public hearing was to obtain comments from the public concerning
the zoning change application. Chairman Stewart opened the meeting
for public comments. No comments were offered and Chairman Stewart
closed the public hearing. Mr. Jackson presented the application for
consideration by the Board. The Planning Board recommended approval
of the zoning change request. Commissioner Shaw made a motion to
approve the zoning change request for Agnes McDonald and Ishmael
McDonald. Commissioner Hill seconded the motion and it passed with a
unanimous vote.
SUBDIVISION PLAT Tom Taylor, Chief Planner, presented for the Board's consideration a
subdivision plat for McAdams Acres, Phase II, owned by Hubert J.
McADAMS ACRES, PHASE II Montague, 8 lots on 500' cul-de-sac located in Black River Township on
SR 1440. Commissioner Hudson moved for approval of the subdivision
plat. Commissioner Hill seconded the motion and it passed with a
unanimous 'vote.'
COUNTRY SQUIRE ESTATES Tom Taylor, Chief Planner, presented for the Board's consideration a
subdivision plat for Country Squire Estates, Section II, addition of
lots :7-21 requesting a variance from 80' required road frontage,
revision on lots 27-32 and 37-39, ownad by W. S. Wellons Corp.,
located iil h~derson Creek Townshi~ on SR 1120. Commissioner Shaw
noved ~or a?7XOval of the subdivision plat. Commissioner Hudson
seconded t~e motion and i~ passed with a unanimous vote.
George Jackson, Planning Director, briefed the Board on a proposed
resolution regarding the Joint Compatible Land Use Study.
Commissioner Shaw made a motion that a new resolution be drafted which
would indicate continued support for the planning activities
associated with the recently completed Joint Compatible Land Use
Study. Commissioner Hill seconded the motion and it passed with a
unanimous vote.
REQUEST FOR SUPPORT Ms. Gail Snyder', resident from the southern area of the county, made a
RE: BRIDGE ON SR 2031 presentation concerning a request for support in construction of
guardrails and bridge replacement on SR 2031 located on the Harnett
County-Cumberland County line. Commissioner Shaw made a motion that a
resolution be prepared in support of Ms. Snyder's request to be
considered at the next regular Board meeting. Commissioner Hill
seconded the motion and it passed with a unanimous vote.

Wastewater Facility Plan Amendment, as Supplemented-Cape Fear Regional
Wastewater Facilities project-(County of Harnett)". Commissioner
Hudson moved for adoption of the resolution. Commissioner Shaw
seconded the motion and it passed with a unanimous vote. The
resolution is copied in full at the end of these minutes as Attachment
4.
Chairman Stewart stated that the Board would now consider a resolution
sitting in its capacity as the governing body of the Buies Creek-Coats
Water and Sewer District of Harnett County. John M. Phelps, II,
Public Utilities Attorney, presented a resolution titled "Resolution
Implementing Selected Alternative of Northeast Harnett County, North
Ca4oli~a 20: Wastewater Facility Plan Amendment, as Supplemented-Cape

Commissioner Shaw moved that Dallas H. Pope, County Manager, be
DALLAS H. POPE APPOINTED appointed as chairman of the Emergency Services Council. Commissioner
CHAIRMAN OF EMERGENCY Hill seconded the motion. After brief discussion, Commissioner Shaw
SERVICES COUNCIL amended his motion to read that Dallas H. Pope, County Manager, be
appointed to serve as chairman of the Emergency Services Council tintil
a successor is elected and qualified. Commissioner Hill seconded the
amended motion and it passed with a unanimous vote.
~EW POSITION IN PUBLIC Commissioner Shaw moved for approval of a new position for the Public
UTILITIES Utilities Department with title of Operator and classification of 61A,
with effective approval date of November 18, 1991. Commissioner Hill

NORTH CAROLINA,
HARNETT COUNTY.
RESOLUTION CONCERNING THE FAYETTEVILLE
URBANIZED AREA THOROUGHFARE PLAN
WHEREAS, the city of Fayetteville, cumberland County, Harnett County, town
of Hope Mills, town of Spring Lake, and the Planning and Environmental Branch,
North Carolina Department of Transportation are actively involved in
transportation planning for the Fayetteville urban area~ and
WHEREAS, each municipality and the Department of Transportation are
directed by North Carolina General Statutes 136-66.2 to reach agreement for a
street system that will serve present and anticipated volumes of vehicular
traffic i, and aro~n~ the municipality~ and
WHE~, ~ae Fayetteville urban area has an existing throughfare plan dated
June 8, 1977, and North Carolina General Statutes 136-66.2(d) provide for the
revision of this plan~ and
WHEREAS, the Technical Coordinating Committee and the Transportation
Advisory Committee for the urban area have prepared a revised long-range
thoroughfare plan for the urban area~ and
WHEREAS, it is recognized that the proper movement of traffic within and
through the Fayetteville urban area is a highly desirable element of the
comprehensive plan for the orderly growth and development of the urban area~ and

WHEREAS, after full study of the revised plan, the Board of Commissioners
of Harnett County feels it to be in the best interests of the County to adopt
said plan and recommend its adoption to the North carolina Department of
Transportation:
NOW THEREFORE, BE IT RESOLVED: That the Fayetteville Urban Area I
Thoroughfare Plan as shown on a map dated September 23, 1991, and prepared by
the Technical Coordinating Committee, the Transportation Advisory Committee, and
the Pl~ning and Environmental Branch, North Carolina Department of
Transportation, be approved and adopted as a guide in the Fayetteville urban
area and the same is hereby recommended to the North Carolina Department of
Transportation for its subsequent adoption.
Duly adopted this 18th day of November, 1991.

RESOLUTION AUTHORIZING RESALE OF REAL PROPERTY
PURCHASED AT TAX FORECLOSURE SALE BY
NEGOTIATED OFFER, ADVERTISEMENT AND UPSET BIDS
THAT WHEREAS, the County of Harnett (hereinafter "County")
purchased that certain lot hereinafter more fully described at a
tax foreclosure sale held on May 29, 1987 for the sum of $883.09
which constituted the outstanding County taxes, interest and cost
of fare.C'losl"C'e; and

William prentis Walker et also, 85 CVD 0666; and
WHEREAS, the taxpayers and/or members of the family of the
taxpayers have not approached the County officials with an offer
to buy said lands or made any other contact with the County
concerning the lands; and
WHEREAS, the lands are presently vacant; and
WHEREAS, the County has received some inquiry from members of
the general public as to the purchase of said lands; and
WHEREAS, the lands are more fully described as follows:
BEGINNING at a stake on the West side of the Postal
Telegraph Road, same being the Southeast corner of the
Catherine Byrd Lewis 163 acre tract, and runs as said
tract South 82~ degrees West 200 feet to a stake; thence
North l6 degrees East lOO feet to a stake; thence North
82lJ degrees East 200 feet to a stake in said Postal
Tele<,draph Road; thence down said road South 16 degrees
~ast 100 feet to t)e point of BEGINNING and being a lot
con';:aining a frac~ional part of an acre.
Being that certain parcel described in a deed from I
Robert Maynor and wife, Lula Maynor to William Mitchell
Walker, Sr. and wife, Vada M. Walker, dated December 20,
1948 and recorded in Book 367, Page 243, Harnett County
Registry.
For further reference, see Commissioners Deed from
E. Marshall Woodall, Commissioner to the County of
Harnett dated October 1, 1987 and recorded in Book 84l,
Page 473, Harnett County Registry; and
WHEREAS, the lands are not needed by the County for any public
purpose and it would be in the best interest of the County to sell
the same and cause the lands to be placed on the tax books for
taxation; and,..,

WHEREAS, the North Carolina General Statutes provide that
lands purchased by the County as a taxing unit can be resold in the
manner as provided by law for sale of other real property owned by
the County [N.C.G.S. Sl05-376(c)] and that further the County may
dispose of its real property in accordance with procedure contained
in Article 12 of Chapter l60A of the General Statutes (N.C.G.S.
S153A-176); and
WHEREAS, the aforesaid lands are not located within the
boundaries of another taxing unit; and
WHEREAS, the County has received an offer to purchase said
lands for $1,250.00 from Elsie C. Lee having received a cashier's
check in the amount of $200.00 as a deposit on said offer; and
WHEREAS, N.C.G.S. S160A-269 authorizes the County to receive
an offer to purchase County lands and advertise the same for upset
bid; and
WHEREAS, members of the County Board of Commissioners are of
the opinion that said offer should be received and advertisement
made for upset bid.
NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS:
FIRST: That the offer from Elsie C. Lee to purchase the
aforesaid described lands for $1,250.00 cash be received;
SECOND: That the offeror's cashier's check in the amount of

at least 10% of the offer ($200.00) shall be received and held as
a deposit on said bid;
THIRD: That the Clerk shall publish a Notice of the offer
in the Harnett County News newspaper in Lillington, North Carolina
as authorized and directed by the provisions of N.C.G.S. S160A-269;
FOURTH: That upon the receipt of an upset bid, the Clerk
shall proceed with readvertisement until no further qualifying
upset bid are received, all as authorized pursuant to the above
statutory provision;
FIFTH: Upon the receipt of a high bid with no further
qualifying upset'bids, the Clerk shall report the high bid to the
Board for consideration of acceptance or rejection thereof;
SIXTH: County officials are hereby authorized to do and
perform all acts necessary to carry out the purpose of and actions
proposed by the foregoin~ resolution.

Resolution Implementing Selected Alternative of
Northeast Harnett County, North Carolina
201 Wastewater Facility ~!~n Amendment, as Supplemented
-Cape Fear Regional Wastewater Facilities project-
(County of Harnett)
THAT WHEREAS, the County of Harnett together with the Buies
Creek - Coats Water and Sewer District of Harnett County and the
Town of Angier are in the process of implementing the Cape Fear
Regional Wastewater Facilities Project, and in connection therewith
a 201 Wastewater Facility Plan Amendment, which includes four
supplEments thereto, has been prepared; and
l'IHEREAS, it is the desire of the Board of Commissioners of the
County of Harnett to agree to implement the selected alternative
which is designated and described hereinbelow.
NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners
of the County of Harnett that:
The County of Harnett shall and hereby does
agree to implement the selected alternative as
identified in the above referenced Northeast
Harnett County, North Carolina 201 Wastewater
Facility Plan Amendment, as Supplemented, to
wit: Alternative No. 4 (Modified) by
Supplement No. 4, to the Northeast Harnett
County, Nort.h Carolina 201 Wastewater
Facilities Plan Arne ncirnent, proposed Subregional
System; the same b6~ng a wastewater treatment
facility consisting of an activated sludge
oxidation ditch process with an influent,
pumping station and residual solids storage
facilities located on the north side of the
Cape Fear River adjacent to the Harnett County
Airport with interceptors along East Buies
Creek and West Buies Creek to serve the County
of Harnett, the Town of Angier, the Town of
Coats and the, Village of Buies Creek.
Duly ado~ted this 18th day of November, 1991, upon motion

THAT WHEREAS, the Buies, Creek - Coats Water and Sewer District
of Harnett County together with the Town of Angier and the County
of Harnett are in the process of implementing the cape Fear
Regional Wastewater Facilities Project, and in connection therewith
a 201 Wastewater Facility Plan Amendment, which includes four
supplements thereto, has been prepared; and
WHEREAS, it is the desire of the Board of Commissioners of the
County of Harnett, sitting as the governing body of the Buies Creek
- Coats Water and Sewer District of Harnett County to agree to
implement the selected alternative which is designated and
described hereinbelow.
NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners
of the County of Harnett, sitting as the governing body of the
Buies Creek - Coats Water and Sewer District of Harnett County

does agree to implement the selected
alternative as identified in the above
referenced Northeast Harnett County, North
Carolina 201 Wastewater Facility Plan
Amendment, as Supplemented, to wit:
Alternative No. 4 (Modified) by Supplement No.
4 to the Northeast Harnett County, North
Carolina 201 Wastewater Facilities Plan
Amendment, Proposed Subregional System; the
same being a wastewater treatment facility
consisting of an activated sludge oxidation
ditch process with an influent pumping station
~nd residual solids storage facilities located
on the north side of the Cape Fear River
adjacent to the Harnett County Airport with
interceptors along East Buies Creek and West
Buies Creek to serve the County of Harnett,
the Town of Angier, the Town of Coats and the
Village of Buies Creek.
Duly adopted this 18th day of November, 1991, upon motion
made by Commissioner Shaw , seconded by Commissioner
Hill and adopted by the following vote:
