ITEMS FOR DISCUSSION & CALENDARING FOR SEPTEMBER 22, 2026
Rezoning / Map Amendment
RZ-26-03
1210 Chicken Farm Road
Senior Planner Stephanie Goodrich presented Rezoning Request RZ-26-03. The property
owner of 1210 Chicken Farm Road is seeking to change the zoning classification from
Industrial back to R-20 Residential. She noted that the property had been rezoned from R-
20 to Industrial as part of a Citywide rezoning effort in 2017. The Planning Board heard the
matter and is recommending denial.
City Manager Justin Hembree shared his perspective, noting that preserving industrially
zoned land is becoming increasingly important for municipalities like Dunn that are
experiencing and anticipating growth. He drew a comparison to the legislative push to
protect farmland, suggestingthat a similar argument could be made for preserving industrial
property. He further noted that this particular parcel has been actively marketed for
industrial development by Harnett County's Economic Development arm, that it has
potential railroad access, and that it sits within a reasonable distajee_of 1-95.
Ms. Goodrich clarified that the applicant's original n

IF
for the Stoney Run Gampground, located on NC-55 adjacent to Rooms To Go. The property
is currently zoned I VO, and the applicant is seeking to add an RV campground as a
Permitted Use through a Conditional Rezoning / Map Amendment. Ms. Goodrich explained
that the applicant had received a Conditional Use Permit (CUP) for the same use back in
2021, but that permit expired without the project moving. Because the City no longer issues
CUPs, the Conditional Rezoning process is the most appropriate path forward. The Planning
Board heard the application and is recommending approval.
Council Member Alan Hargis expressed supportforthe concept, notingthat a short-term RV
Campground would bringvisitors into town and benefit local commerce. Discussion turned
to the question of preventing long-term or permanent occupancy of the campground.
Council Member Raquel McNeil and others expressed concern about campers eventually
building additions onto their units and turning the site into something resembling a
permanent community — drawing comparisons to White Lake and similar beach -area
campgrounds.
City Attorney Tilghman Pope confirmed that, because this is a Conditional Rezoning, the
Council may attach conditions that the applicant must accept in writing. He suggested that
a condition prohibiting accessory structures attached to campers might address the
Council's concerns. Ms. Goodrich noted that some similar campgrounds address long-term
occupancy by requiring campers to remove their vehicles for at -least 24 hours before re-
entering for another week's stay.
Council Member Raquel McNeil googled suggested `conditions for campgrounds and
suggested quiet hours, wildlife and plants, stay limits campfires, development levels, site
types, basic gear, ground safety distance from water and climate impact,, Council Member
Dr. David Bradhamalso suggested that they provid'ethe numberallowedper campsite —and
pay for every additional person, etc. '
Council directed staff to reach out to the applicant ahead of the September 22nd Public
Hearing and request a copy of their propose - d rental agreement or lease terms, so that the
Council can review what conditions they-inend to apply to their guests. Mayor Elmore
encouraged any Council member with proposed conditions,,to contact Ms. Goodrich in
advance so the board would be aligned and prepaed'fortWhearing.

Special Use Permit
SUP-26-02
804 South Clinton Avenue
City Manager Justin Hembree and Senior Planner Stephanie Goodrich introduced this item,
informing the Council that an application has been filed for a Special Use Permit to allow a
small event venue at 804 South Clinton Avenue — a property formerly occupied by an
antique and thrift shop, that was now vacant, located across the street from Wardrobe
Cleaners. No zoning change is involved; the proposed use is allowable within the existing
zoning classification but requires a Special Use Permit. ,
Mr. Hembree took care to remind the Council that Special Use`Permits are quasi-judicial
matters. As such, the decision must be made based solely on,evidence presented during
the formal hearing, and Council members were advised nott -to engage in outside
deliberations or discussions about this specific applicationbeforethe.^.evidentiary hearing.
Ms. Goodrich confirmed that adjacent property own r e s and businesses would be formally
notified, and that Public Notice would be placed'in,the newspaper.
This item is calendared for the September 22, 2026•RegularMeeting.
Sale of Residential Structure
at 400 East Townsend Street '
Assistant City Manager Billy Ray G dwin presented a requeWfrom staff for Council
authorization to declare the residential structure atw400 East T wnsend Street as surplus
property and to initiate the Public Upset Bid Process -under -NC General Statute 160A-269.
He reported that the City`has received an offe of $10,000 to purchase and relocate the
structure, with the buyerresponsible for removing it from the land within sixty (60) days of
closing. Adopting the-resolutionwouldnot constitute acceptance of the offer but would
direct the City Clerkto publish notice.in the newspaper and formally solicit competing bids.
Mr. Godwin,further_noted that•a"For Sale",sign' citing the Upset Bid Process had been posted
on the property that veryuday, andthat a similar sign was being prepared for the Magnolia
V I"Street,,property, for which informaroff'ers had also begun coming in.
Council Member Atari Ha g smoved to table the matter for thirty (30) days, arguing that
$10,000 is well below the Value of the structure and that the sign had only gone up that
afternoon, giving`theapublf no real opportunity to learn about the offering. He contended
that waiting thirty (3)O,days would allow more interest to develop, potentially yielding
significantly higher bids°before the upset bid clock even begins. He also suggested the sale
be promoted through the City's Government Channel in addition to the newspaper.
Mayor Pro Tern April Gaulden opposed the delay, reminding the Council that the Upset Bid
Process itself is designed to generate competing offers, and that the Council had already
voted at the previous meetingto move forward. She expressed concern about the pattern of
revisiting settled decisions.
Council Member Raquel McNeil used the discussion to revisit her previously unanswered
question of whether the structure could remain in place, be renovated, and serve as a
community event space connected to Codrington Park. Mayor Elmore responded that the
narrow frontage of the lot, combined with the obstruction the house creates, would limit
parking and prevent the park from feeling open and accessible from the neighborhood. He
also noted that the renovated school building nearby already offers rentable space for
events, including the cafeteria.
The residential structure at 400 East Townsend Street is being offered for sale at a current
offer price of $10,000, though Council members noted the structure's value is likely in the
range of $60,000-$80,000 or more. This is a one-time revenue -generating transaction, with
the proceeds accruing to the City. The stated long-term purpose of clearing the site is to
improve access and visi bility for Cod rington Park, supported part by a previously awarded
$500,000 state grant. The Council's rationale for tabling wass to allow broader public
exposure to generate a more competitive bid, thereby rrl" imizing the return to taxpayers.
No formal oversight metrics were discussed, but the 60=dayremoval requirement is written
into the proposed upset bid terms to ensure timely pie ution.
Motion by Council Member Alan Hargis, second by Council Member Raquel McNeil to
table this item for thirty (30) days and return it tothe Coun`c lkwith updated information,
with the sale to be advertised via the City's GovernmentChannel in addition to signage.
The motion carried 5 to 1, with Mayor Preem April Gaulden castingthe lone dissentingvote.
Juniper Creekj j
Streambank Restoration
Assistant City Manager Billy -Ray Godwin presented this item, explaining that significant
,cur .
streambank erosion isfoccurrmg along the west bank of Juniper Creek in the area adjacent
to the Canterbury subdivision. The erosion has`progressed to the point where a major sewer
outfall line — the main' line.,runniing to the Treatment Plant — has become exposed in the
creek bed, placing it at serious, risk of k eingdermined during storm events.
City Manager Justin Hembree underscored the urgency, noting that if the outfall line were to
be compromised, the City could be -facing a major sewer project far more costly and
complex than anything in'recent memory. He noted that the stormwater Engineer, Dory
Sabeh of WithersRavenel„,had assessed the site in February and determined that the
presence of this"public infra`s_tructure makes the project eligible for a State Grant and Loan
Program that would not of brwise be available for typical streambank erosion.
Council Member J. Wesley Sills acknowledged the issue is part of a broader pattern of
,w
streambank erosion throughout the city and questioned what would be done about the rest
of the problem. Mr. Godwin and Mr. Hembree acknowledged the wider challenge but noted
this particular project rises to a different level of urgency because of the exposed outfall line.
The item before the Council was simply a request to authorize WithersRavenel to apply for
the State grant and loan funding on the City's behalf. No funding is obligated at this stage.
The specific cost of the Juniper Creek Streambank Restoration project has not yet been
determined, but the authorization allows WithersRavenel to pursue a State Grant and Loan
program on the City's behalf. Staff expressed hope that the project would be funded at or
near 100% through grant dollars, with any loan component potentially forgivable upon
project completion depending on how the application scores.
Motion by Council Member Alan Hargis, second by Council Member J. Wesley Sills to
authorize WithersRavenel to apply for State Grant and Loan Funding for the Juniper
Creek Streambank Restoration project. The motion carried unanimously. A copy of the
Resolution authorizing WithersRavenel to apply for the State grant and loan funding on the City's behalf (R2026-
26) is incorporated into these minutes as Attachment#3)

West Broad Street
City Manager Jbstin Hembree! reported on a community meeting held September 1st with
property owners and=business operators along the West Broad Street corridor —the stretch
commonly known as -the "Kim's area." The meeting was described as well attended, with
strong representationrproperty owners including Bozie Tart, Gerald and Linda Hayes,
theAutoZone property owners from Charlotte, and others. Hembree said the meetingserved
two (2) purposes: informing stakeholders about the project's progress and explaining why
the City has not simply gone in and repaved the road immediately.
Mr. Hembree said the near -universal sentiment from property owners was that while they'd
love a smooth road tomorrow, they'd rather wait and have it done right rather than risk
making flooding worse for Kim's Barbecue and neighboring businesses. The study is
expected to be completed by early 2027, after which design alternatives will be presented.
Council Member Dr. David Bradham raised the point that the general public — not just
property owners — deserves to understand why the road still looks the way it does and
suggested the City's communications team do more to get that message out. Council
Member Alan Hargis proposed a newsletter insert in water bills as an additional outreach
tool, noting that not everyone follows social media. Council Member J. Wesley Sills advised
this would cost $600. Mr. Hembree acknowledged that social media outreach has increased
significantly in recent months with the assistance of Sandra Osman, the Downtown
Director, who is now also helping with Public Information duties.
Additionally, Mayor Elmore noted that property owners along the c-b ridor had asked the City
to help with code enforcement behind their buildings, specificatlyregarding overflowing and
poorly maintained dumpsters in the back of the shopping center. The owners expressed
willingness to cooperate and the City intends to engage through. nforcement rather than
expense.

Council Chambers
City Manager Justin Hembree gave a brief update' n the Council Chamber noting that the
Last Municipal Court Session was held there at the endfof `June. Public Works staff has
removed the jury box dividers and chairs to open upthepace. It was also discovered that
the judge's raised dais at the rearis, poured concrete\rather than wood, which will
complicate its eventual removal. Mr. Hembree said the immediate next step would likely be
new carpeting to improve the appearance and, breaks>in the flooring, though he
noted the order of operations with the concrete dais would need to be worked out carefully
to avoid double work. \\ /17

Mr. Hembree als shared the good news that the City has been formally notified of a
$500,000 Parks and -Recreation Trust Fund grant award from the Governor's office for the
N.. J
Codrington Park project. This is in addition to a previously received $500,000 accessibility

funding to be set aside in the coming fiscal year. A Federal Grant Application — potentially
worth up to another$250,000 to $500,000—is also being prepared by McAdams, with award

Background
RZ-26-03 is a rezoning request submitted by June Johnson Green for 1210 Chicken Farm Road
PIN# 1516-23-0863.000. The request is to rezone from 1-100 Industrial to R-20, Residential.
The subject property was part of a City-wide rezoning effort in 2017 that changed the property

that mitigates impacts to transportation infrastructure.
• The proposed map amendment would not change the density in which the area is
developed

Request: Zoning Map Amendment from Industrial 1-100 to Residential

The applicant requests a zoning map amendment from Industrial District 1-100 to Residential District R-
20.

SIZE: The subject properties total 15.09 acres
EXISTING ZONING: Industrial 1-100
EXISTING LAND USE: The subject parcel is being used as agricultural with one single family dwelling
10
SURROUNDING LAND USE:
OTHER SITE CHARACTERISTICS:
The subject property is bound on the northeast side by a gas line easement that can't be built up, and to
the south by a creekbed.
In 2017 the city initiated a city-wide large-scale rezoning and this property was rezoned from
residential/agricultural to Industrial. Either zoning district would be appropriate in the long range land use
plan, but if considering the fact that the parcel would be difficult to develop as industrial given the site
constraints and the fact that it has not been a consideration of the ownerto change the land use, restoring
the residential low density district that it was prior to the city initiated rezoning is appropriate.
FUTURE LAND USE PLAN CLASSIFICATIONS:
The Future Land Use Map has no designation for this property since it is in our Extra Territorial Jurisdiction.

1) The amendment, if small scale, is reasonable based upon surrounding conditions.
2) The impact of zoning is in the public interest and does not significantly harm the
surrounding properties.
3) The amendment is warranted due to changed or changing conditions in the area.
4) The amendment achieves the purpose and is consistent with the Land Use Plan.
purchased this property 6/9/2016, and it was zoned Residential-R20. In a recent
visit to the Harnett County Tax Office I was informed that several years ago the City
of Dunn rezoned this property to I (Industrial)-100. The Tax Office stated this
rezoning has resulted in my paying higher property taxes for this property.
For at least the past 75 years, this properly has been used for farming. I plan to
continue farming this property, as I have since I purchased A.
Since purchasing the property, Piedmont Natural Gas obtained an easement to
put an underground gas pipeline on 1.6 acres of the property, making these acres of
the property unusable for structures. A stream runs on the opposite side of the
property from the pipeline, making this area unusable for structures. There is also
one house built in 1920, which I rent out, that is on the far edge of the property near
the stream.
The areas adjoining this property are used for Mining, so rezoning to R20 should
not be a detriment to these properties. This property is a part of Harnett County's
Land Use Plan and is a part of the deferrment program.
Thank you for your consideration of my request.

INSTRUCTIONS FOR FILING A REZONING APPLICATION
1) A petitioner for a zoning change must complete this application in full. This application
will not be processed unless all information is provided.

of the property proposed for rezoning must accompany the application. The survey must be
completed by a registered land surveyor or professional engineer, and shall describe the subject
property by metes and bounds.
4) The justification statements under Item "C" should be typed or written legibly to answer each
condition that applies to the request. Substantial weight is given to the answers provided. Please
consider your answers carefully and be prepared to address your answers at each public hearing.
5) The application must be signed by the owner or by an authorized agent of the property to be

2) A couple years ago the Planning Board and City Council approved the creation ofRA40 District This district was
created for the ETJ to we for larger tracts of land that are residential but also agricultuial:'The RA40 District has
not been implemented is this area on the zoning map and should be in place where applicable.

Ordinance Amendment—OA-06-17
Chapter 15,.Parks and Recreation
Council Member Tannage stated the updating of the Parks and Recreation Commission to an Advisory Board was an
ordinance and bylaws for the government process. As a Council Rtpres entativa on the Advisory Board, there is a lack of
atteadance-of members -and .lick of scope and focus of the Advisory Board andhas been a detriment to the. group. add the
Director. We as a Council must fret select Advisory Board members willing to make the commitment to attend meetings,
serve the citizens of Dunn and participate in the plaaning for the future Parks and Recreation Facilities and activities for our
children. The new direction is proposed far the Advisory Board to idvio the Director and Council on Parks and Recreation'
future requirements assess the feasibility, develop and consider funding approaches. Additionally, the Advisory. Board rust
work with other City Departments, Boards and groips when developing long range plans, specifically to Sections 15-32 and
15-33 of the ardicznco presented u might'Council Member Tannage recommends to allow far the sevenmemtiers with no
alt6stes. The reason for the proposed two alternates ism ensure a quorum for meetings in order to approve an action:
I would like it to be enfoice that the Advisory Board seek to the attendant ofscheduled meetings and members ieliaquish
their seat on the Board if they miss two consecutive meetings, as sorted in the ordinance.
Council Member Mef.ean stated he would like to hear from the Director and City Manager:
Recreation Director McNeill stated the changes being iecornmeaded is the ordmence is to update the ordinance from wherek
was as the Recreation Commission m'the early 1970's to rhitrhe,Board would iepreient today. The main cwncems are
mcluding out of town residents to be able to apply far positions -on the$oard..The Board and'I feel a qualified individual
whether living in the City limits or ouiside:can provide a good perspective of things that could improve our programs and
parks. They could'also help build relationships and parmersbips outside the City limits.
Regardlagthe alternate members, we have been having issueswithhaving a quorum at the meetings. The last Meeting was
April 2017. We me raniameti ing alternate membieis, which. they: are able to vote in the absence of a regular member. They
would not have a vote when all ovular members are present: We would Irkc to reduce the board size down to five regalu
members with two alternates, beraose of the quonw issues. We arc also recottrme¢diag:to add m.an atteadaoce policy,
where we requirea member to relinquish their seat if they miss two consecutive meetings.
Council Member Maness inquired as to Low: many members are on the Recreation Commission.
Recreation'UirectorMcNeill stated seven positions..
Council Member Maness asked if there were other mmicipalides that, bave: provisions for people who live onside their
municipallimits.
Recreation Drettor.hfcNeill stated I.illington requires to Lave two positions for no¢ -resident. What [ am recommending is
far the ability for nowmsidents to apply. The Town of Smithfield require one position far out of town and they also require
the position. for a high school student to,brmg in a youth perspective.

REGULAR BUSINESS:
Commercial Maintenance Code:
Planning & Inspections Director Wullenwaber addressed the board and reminded that this had
been discussed previously. She presented a document that was the final draft, which was been
sent to the city attorney for final revisions and proofing.
30
Even though it is not zoning, it does deal with planning .and now that we are Planning, &
Inspections, under one department officially we are really trying ,to grow and do things. This will
help repair some of the commercial buildings that are not up to code. It is, calledthe
Commercial Maintenance Code.but the, official name'is Non -Residential Building' Maintenance.
Code. It is similar to the Minimum Housing Code but for commercial buildings. It covers trash
not being properly contained, storm drainage, and parking lots with big potholes. A building
can be condemned or deemed unfit. One waiting period was 2 years and another was 5 years.
If it is condemnable, we will condemn it and demdlish it. However, if it is just unfit once we
enter an ordinance on the property, we have to wait foe two (2) years for just a normal retail
property. If it is a warehouse, we have to wait five (5) years. That two and five years has been
the standard for all the codes Mrs. Wullenwaber has seen while researching this matter.
A motion was made by Joe Miriello and seconded by Doug Heath to recommend approval of the
commercial maintenance code to city Council.

Presenter(s): Stephanie Goodrich, Senior Planner

Action Item: Yes
Attachment(s): 1) Public Hearing Notice
2) Staff Report
3) Application
4) Approved Conditional Use Permit from 2021
5) Letterfrom applicant regarding site conditions
6) Site Plan Sketch
7) Response to Council Questions on length of Stay
Background
The applicant is requesting a zoning map amendment to the parcel 1526-25-9378.000 and
1526-26-4072.000, located at 11285 NC 55 E and CP&L Road, currently zoned 1-100,
Industrial to include the use of a Recreational Vehicle Campground.
This site has been in research and reviewfora number of years and was successfully granted
a Conditional Use Permit (CUP) in 2021. Since 2021, the CUP expired and the new procedural
method to grant a conditional use is through a rezoning with conditions. City Management
and staff has met with the applicant and it is our belief that adding a campground for
Recreational Vehicles to the existing zoning most closely aligns with the intent of the original
approval of the Conditional Use Permit.
The subject properties are pending consideration by Council for annexation.
The applicant has received approval on a preliminary site plan and is in the process of getting
a full site plan review upon annexation approval.
The Planning Board held a public hearing on September 1 and is recommending approval.

Parks And Protected Lands: This designation applies to parks, p[public recreational areas, conservation
areas, and floodplains. Uses include active and passive recreation (including trails and greenways),
wildlife management, environmental restoration/mitigation/preservation, and educational uses.
Structures that support or are associated with the intended uses are typically permitted.
Associated plan goals and policies that may be considered include the following:
Future Land Use Plan:
Policy 1: Manage future growth and encourage quality development through implementation of the
Strategic Vision Plan, the Land Use Bank, the Unified Development Ordinance (UDO), and other plans and
regulations adopted by City Council.
1.1: Review development proposals for consistency with the Future Land Use Map.
Policy7: Utilize river and stream corridors for active and passive recreation.
7.2: When available, take advantage of opportunities to protect lands in and adjacent to stream
corridors, including Stony Run and Jupiter Run.
Policy 12: Minimize land disturbance in wetlands, floodplains, and stream corridors, and encourage
riparian buffers.
BACKGROUND INFORMATION ON THIS ZONING REQUEST:
In 2021, Council approved a conditional use permit for this property (attached). At the time, recreational
facilities were allowed in Industrial districts.
Duringthe Unified Development Ordinance update in 2023, these uses were removed.
The site plan and conditional use permit has since expired, and a new preliminary site plan has been
reviewed priorto this application.
Staff and management felt that renewing the plan's approval byway of conditional rezoning is the easiest
wayto get the project moving again, since the Conditional Use Permit expired.
These properties are currently undergoingthe Annexation process.

CI
Stony 'Run Campground
Dunn, North Carolina
Item Not. The use requested is listed among the conditional uses in the -district
for which the application is made.
The existing zoning of the property is 1-100 Industrial. The Unified Development Ordinance allows
consideration of site -specific uses through the Conditional Zoning process. The property's location
adjacent to interstate 95 and NC Highway 55 supports highway -oriented and travel -serving development.
With the proposed buffering, access, landscaping, and site design, the proposed RV campground is
compatible with surrounding industrial development and cohsistentwith_ the blending envisioned by the
Land Use Plan for the Interstate corridor area.
Item No.2 The requested use is essential or desirable to the public convenience
or welfare.
The property:is located adjacent to Interstate 95 and NC Highway 55 which provides an excellent location
for a RV campground, as this is a major travel corridor carrying significant volumes of regional and
interstate traffic. The RV -campground provides an alternative overnight accommodation option for
travelers, recreational vehicles'(RV) users, and visitors passing through the City of Dunn, thereby serving
public and supporting tourism activity.
The availability of recreational lodging options contributes to the overall welfare of the public by
expanding travel and recreation choices.
Item No. 3 The requested use will not impair the integrity of character of the
surrounding .or adjoining districts, nor be detrimental to the health, morals 'or
welfare.
The RV campground will actually support and enhance the character of the surrounding districts by
preserving much of the existing character of the tract of land. First the lake which ezists.on the property
is to remain and be enhanced by cleaning up unwanted vegetation and creating'Mewscapes' that will
enhance the view from the roadways and adjacent properties.
Health and welfare of the public are taken into consideration by providing public water and public sewer
systems for the RV campground, protecting the RV campground user as well as the adjacent properties.
Solid waste will be stored in bulk containers and then disposed of on a regular basis.
Item. No. 4 The requested use will be in conformity with the land.development
plan.
The proposed Stony Run Campground is consistent with the goals and recommendations of the City
of Dunn Land Development Plan because it supports the Plan's vision to business development,
economic development planning, and fostering a community where people want to live, visit, play, and
do business. The proposed RV campground provides compatible traveler -oriented accommodation
use, promotes economic activity, utilizes existing infrastructure, and advances the goals of the Land
Development Plan while the remaining conditions ensure compatibility with surrounding
development.
By preserving much of the existing character of the tract of land with the existing lake conforms with the
Parks and Protected Lands according to the Future Land Use Map. The property is to remain and be
enhanced by cleaning up unwanted vegetation and creating'viewscapes' that will enhance the view from
the roadways and adjacent properties.
Item No. 5 Adequate .utilities, access roads, drainage, sanitation and other
necessary facilities have been or are being provided.
Water and sewer that will serve the RV campground will tie into the City of Dunn water and wastewater
system. Access to the property will be from NC Highway 55 therefore NCDOT will permit and inspect the
access point improvements to the property. NCDOT will determine if turn lanes will be required. Any
roadway improvements will be designed and constructed to NCDOT standards. Storm water conveyance,
storage and treatment will be designed to meet the City of Dunn's stomwater requirements. Solid waste
will be placed into commercial solid waste containers and removed on a regular basis transferring the
waste to a landfill or recycling facility.

Ropestar Events, LLC (mailing address ill West Main Street, Suite 202, Garner, NC 27529-3250) has applied for
a Conditional Use Permit to develop a Recreational Vehicles (RV) Park / Campground at property identified as
PIN 1526-25-9378.000 and PIN 1526-26-4072.000, parcels of land between NC 55 East and 1-95. Access to the
property is via NC 55 East. The property is 55.22 acres +/- and consists of a field, woods, some wetlands, and 22
acres+/ - of a,pond. These parcels are zoned 1-100, Industrial District.
This matter was duty noticed for the May 11, 2021 public hearing in advertisements in a newspaper of general
circulation April 20 and 27, 2021. Signs were posted on the property April 20, 2021 and kept there until after the
public hearing.
At the.Public Hearing May 11, 2021, the following were sworn in to give testimony:
From City staff:
• George Adler, Planning Director
• Steven Neuschafer, City Manager
The following testified forthe applicant:
• Donnie Adams, of Adams & Hodge Engineering PC
• Brian Barefoot, Ropestar Events LLC
The following members of the public offered testimony on the subject or asked questions about the
project, which were responded to by one or more of the above witnesses:
• None
The following parties opposed the project and provided testimony as such:
• None
4-
After receiving the staff report, staff testimony, and the submission of documents from any party; and hearing
the testimony of all witnesses; the Dunn City Council makes the following FINDINGS OF FACT:
1) The application submitted was complete.
2) The use requested —RV Park/Campground-is listed among the conditional uses in the Dunn City
Code at Section 22.461(11)(a).
3) The requested use Is essential or desirable to the public convenience or welfare. The properties are
located between 1-95 and NC 55, providing easy access to 1-95Exit 73 less than a mile away via NC 55.
Approximately half the property is 22-acre pond. This location on 1-95, between population centers to
the north and Florida to the south Is well situated as a resting place for the RV traveling public. The
closest RV parks currently are approximately 10 miles to the north near Benson and 14 miles to the south
near Wade. An RV park at this location in Dunn will enhance public convenience and should increase
tourism that will benefit local businesses in Dunn.
4) The requested use will not Impair the integrity or character of the surrounding or adjoining districts,
nor be detrimental to health, morals, or welfare. An RV campground will not detract from the character
of the adjoining districts and should preserve the rural feel of the area. The pond will remain and,
combined with proposed improvements, create "viewscapes" to enhance the view from roadways and
adjacent properties. The parcels' wooded areas will be altered only enough to establish the campsites
and road system, leaving a large portion for walking trails and buffering. Extra buffering will be required
between the RV park and adjacent residential parcels.
5) If completed as proposed, the requested use will conform with the land development plan and the
Dunn City Code.TheFuture Land Use Map anticipated the area east of 1-95 in the vicinity of the property
to remain agdculturallopen space in 2030. But the Future Land Use Map, completed in 2005, couldn't.
foresee the changes the economy would go through. The zoning was changed to 1-10D in 2013 to amend
the zoning map to reflect the current use of properties and the 2030 land use plan. An RV park is a
permitted conditional use in the 1-100 Industrial District. The preliminary site plan developed for the RV
park, as of April 23, 2021, conforms to the requirements in Chapter 22, Article Vill: Travel Trailers and
Trailer Campgrounds and meets all requirements to allow for a conditional use permit.
6) Adequate utilities, access roads, drainage, sanitation, and other necessary facilities have been or can
be provided. City water is accessible:to the site from a water line near 1-95; sewer as well. Access to the
property will be from NC 55, where a NCDOT approved drive way access currently is. Storm water
conveyance, storage, and treatment will be designed to meet the City of Dunn's storm water
requirements. Solid waste will be collected by private company. Access to all utilities currently exist
or can be provided.
Based on the preceding FINDINGS OF FACT,'the Dunn. City Council concludes that the Conditional Use Permit
should be granted as set forth herein and has voted to approve the same following the public hearing.
The Conditional Use Permit is effective upon the signing of the same, the giving of notice as required, and the
filing of the same with the Planning Department.
This is the 81"day of June, 2021.

Dear Members of the Dunn City Council,
Re: Stony Run Campground Site Plan Application — Response to Council Questions on Length of Stay
Thank you for your time and consideration during the review of our application for the proposed Stony
Run Campground site plan. We understand that Council members raised questions about the intended
length of stay for our guests, and we welcome the opportunity to clarify our plans in writing so that the
Council has a clear and complete picture of how the property will be owned and operated.
From the outset, our intention has been to create a short-term destination property, not a residential
community. We will offer daily, weekly, and monthly rates designed for travelers passing through the area
and for guests with short-term needs, such as workers on temporary assignment or guests who wish to
visit or revisit the area for an extended period. We do not intend to accept permanent residents, to allow
guests to receive mail at the property, or to permit permanent structures on individual sites. These limits
will be written into our site rules and enforced as a condition of every stay.
Our business model is built around operating a high -end property. We intend to invest in the grounds,
amenities, and upkeep of the campground so that it appeals to guests who are willing to pay a premium
rate for their stay — and who, in turn, expect a well -maintained, well -run property in return. That
expectation works in the Council's favor: guests seeking a short getaway or a temporary stopover, not a
place to settle permanently, are the guests our pricing and positioning are designed to attract.
To protect that standard, we will maintain and enforce strict site rules covering permanent structures, the
number of vehicles per site, and the number of overnight guests per site, among other provisions. We
believe that clear rules, consistently enforced, are what allow a campground to run smoothly. They also
tend to be self-selecting: guests who value a clean, well -managed, rule -abiding community are the ones
who return year after year, while those looking for a permanent or unregulated living situation will look
elsewhere.
It is our goal to build a property and a guest culture that we, as owners, are proud of — and one that the
City of Dunn can be proud of as well. We believe a well -run, high -end short-term campground will bring
visitors and their spending to local restaurants, shops, and services, creating a positive and lasting
economic impact for the City of Dunn for years to come.
We appreciate the Council's careful review of our application and are happy to answer any further
questions. Myself and my business partner, Brian Barefoot, will be in attendance at the September 22,
2026 City Council meeting to address any additional questions that may arise, and please do not hesitate
to contact us in the meantime.
Sincerely,

RE: 804 S Clinton Avenue, Dunn, NC 28334 — Special Use Permit — Statement of Justification
Hello,
The Owner of the 0.19-acre property, located at 804 S Clinton Avenue, Dunn, NC 28334, would like to change
the land use from a General Commercial (50,000 square -feet and under) to Banquet Hall / Event space. This
property is located within the City of Dunn's zoning C-3. Per the City's UDO, Article 5 — Table 5.06 states that the
Banquet Hall / Event space is allowed within this zoning; however, the Owner must apply for a Special Use
Permit. The requested use will be in conformance with the City's Land Development Plan.
The Owner has mentioned that the existing 1,827 square -foot building was originally leased for commercial
purposes and would now like to use it as a rentable space for events. This space can be utilized by local
businesses and citizens looking for space to have an event. The proposed use will not negatively impact the
surrounding area, and the Owner will abide by any noise ordinances that the City has in place.
The Owner also owns the 0.16-acre property to the east of the property where he intends to improve and use it
for parking for the event space. Per the City's LIDO, Article 6 — Section C, there is not a specific parking
requirement for Banquet Hall / Event space, therefore the "All Other Commercial Uses" (1 stall per 500 square -
feet) parking requirement was used to determine the required parking. For the 1,827 square -foot building, the
total parking required would be 4 parking spaces. The Owner is proposing to have 29 parking spaces, 2 of which
will be handicap stalls.
It is not anticipated that utility service (water, sewer, etc.) upgrades will be required for the proposed use. The
existing driveway entering the property will remain as the primary ingress and egress to the site. Drainage
patterns will follow the historic pattern of the property. The parking lot asphalt improvements are proposed at
the front half of the property while the back half of the parking lot is proposed to be gravel to help reduce the
overall imperviousness.
Here Civil Consultants, LLC. Special Use Permit 804 S Clinton Ave — Dunn, NC
The Owner welcomes any input from the City as well as neighboring property owners and is willing to
compromise with any reasonable requests for the change of use. The change of use would give the Owner more
flexibility for the building space and could potentially help grow his business.
Sincerely,
Ravin Nanpatee, P.E.
