The Harnett County Board of Commissioners met on Tuesday, September 8, 2026 at 9:00 am, in the
Commissioners Meeting Room, Harnett County Resource Center and Library, 455 McKinney Parkway,
Lillington, North Carolina.

Chairman Jaggers called the meeting to order at 9:00 am.
Commissioner Morris led the Pledge of Allegiance and provided the invocation.
Amy Noel, Assistant Veterans Services Director, presented information regarding the Harnett County
Heroes Remembrance recognition. We are recognizing and honoring veterans that appear on our Wall of
Heroes. These individuals have received awards for acts of individual heroism, not as a unit. Ms. Noel
read Warrant Officer One Ricky C. Brown’s citation. Chairman Jaggers presented Ms. Deborah Parker
with a certificate.
Commissioner Morris made a motion to approve the agenda as published. The motion was seconded by
Vice Chairman Nicol and carried unanimously.
Chairman Jaggers opened the public comment period and the following people spoke:

Brent Trout, County Manager, introduced Cindy Atkins with the America 250 Committee. The America
250 Committee has been doing a number of activities in order to recognize our 250th Anniversary of our
founding of our country. One of the things we decided to do was to create this shadow box. The shadow
box has, I believe, 55 names of individuals that served on the patriot side during the Revolutionary War
that were from Harnett County. They are dedicating this shadow box to the County for us to put up in
this building in order to recognize those patriots that served back in that time.
Commissioner Matthews read the Harnett County School Attendance Awareness Month Proclamation.
The Harnett County Board of Commissioners proclaim September 2026 as: ATTENDANCE
AWARENESS MONTH IN HARNETT COUNTY and encourages schools, families, community
agencies, and local organizations to work together to remove barriers, strengthen connections, and
ensure every student feels seen, supported, and welcomed at school. A copy of the Proclamation was
presented to Harnett County Schools staff members.
Ruby Bryant, Executive Director, presented information to the Board of Commissioners regarding
Johnston-Lee -Harnett Action Group programs. Judge Addie M. Rawls serves on the Board of Directors
as Board Chair, stated we wanted to say thank you personally for the services you continually to assist
us with and shared all programs are reimbursed funding but some require that they actually have to be
paid up front to receive those services back. We are constantly looking for ways to provide these
services in our communities, and we are seeking support from time to time from our County
Commissioners and other agencies.
Janice Lane, Human Resources Director, presented a summary of employee exit survey data collected
over the past six months (specifically 1st and 2nd quarter of 2026). The presentation highlighted key
trends and common reasons for separation. (Attachment 1)
Discussion regarding the UDO Appendix B of the fire code. Chairman Jaggers stated I was the one that
asked for this to be put on and it is dealing with the water flow capacity that we are requiring when
doing subdivisions and other things, that you have at least 500 gallon per minute flow. The system was
put in way back and it was designed as a potable water, not fire suppression. We do not have a lot of
solutions to this, other than making the lines bigger. I talked with Mr. Trout and my first thoughts were
that we would get a contractor that had land or people who were trying to do things on their own
property, I do not like changing it below the 500, but I understand that until we get solutions we need to
do something. If the contractor would put the water line in between whatever area he had to do it,
anybody else who ties into that, pays their tap fees, the county enters in contract when that contractor
puts in that water line, that designation that anyone who taps in there, then we will contract with the
person that put it in originally and determine a fee we would give them back while these people tied
onto the line. Christopher Appel, Senior Staff Attorney, provided information regarding statutory
authority. Additional discussion included decreasing the gallon per minute flow rate pros and cons and
promoting commercial properties. Mr. Trout stated one way we could look at those who can’t meet the
500 gallon per minute flow, could be by looking at a conditional zoning item.
Desiree Patrick, Communications and Marketing Director, requested approval of an updated Internal
Social Media Policy for Employees. This is the first update in six years. The updated policy reflects
clear standards and guidelines for employees who use personal social media accounts, as well as

employees who manage official Harnett County departmental social media accounts. The policy has
updated guidelines regarding meeting the Federal Government digital accessibility requirements under
Title II of the Americans with Disabilities Act (ADA), the use of artificial Intelligence (AI), and
expectations for appropriate social media use. The goal of this policy is to ensure all Harnett County
social media accounts remain accessible for all to access and for employees to understand the
expectations of social media use as they represent Harnett County in their various roles. We would like
this policy distributed to all employees and signed. Vice Chairman Nicol made a motion to approve the
updated Internal Social Media Policy for Employees. The motion was seconded by Commissioner
Matthews and carried unanimously.
Amy Noel, Assistant Veteran Services Director, reviewed a request to accept $70,000 from Alliance
Health for Veterans Treatment Court participants. Funds will cover treatment and assessments from
Coastal Therapy and Southern Regional Area Health Education Center. Vice Chairman Nicol made a
motion to approve the acceptance of $70,000 from Alliance Health for Veterans Treatment Court
participants. The motion was seconded by Commissioner Matthews and carried unanimously.
Barry A. Blevins, General Services Director, requested the Board of Commissioners consider and
approve the North Carolina Department of Transportation (NCDOT) FY2027 5311 Administrative grant
agreement in the amount of $424,331; total County match is $63,651 as well as the FY2027 5311/5339
Combined Capital grant agreement in the amount of $330,615; total County match is $33,062. These
grants provide funding for the Administrative and Capital expenses associated with providing public
transportation to the citizens of Harnett County. The Board of Commissioners approved the application
on September 15, 2025. Approved Fiscal Year 2027 budget contains the County match. Vice Chairman
Nicol made a motion to approve the North Carolina Department of Transportation (NCDOT) FY2027
5311 Administrative grant agreement as well as the FY2027 5311/5339 Combined Capital grant
agreement. The motion was seconded by Commissioner Matthews and carried unanimously.
Mr. Blevins also reviewed a request to consider and approve staff to seek and submit a pre-application
for USDA Housing Preservation Grant (HPG) funding. HPG provides grants to organizations for the
repair and rehabilitation of housing owned/occupied by low-and very-low income rural citizens. Eligible
expenses are repairing or replacing electrical wiring, foundations, roofs, insulation, heating systems and
water/waste disposal systems. Staff anticipate applying for $100,000 with $0 for matching funds. HPG
projects have a two-year project duration. Commissioner McKoy asked where the work would take
place and how the money would be disbursed. Mr. Blevins shared we would take applications and serve
low to very-low income rural residents, focusing on life safety first and environmentally. Commissioner
Matthews made a motion to approve the submittal of a pre-application for USDA Housing Preservation
Grant (HPG) funding. The motion was seconded by Vice Chairman Nicol and carried unanimously.
Mr. Belvins also reviewed a request for approval to apply for Fayetteville Area Metropolitan Planning
Organization (FAMPO) 5310 Capital Grant program. Funding is provided by the Federal Transit
Administration (FTA) through FAMPO for use within the FAMPO region. HARTS recommends using
the funds for the capital purchase of a lift-equipped minivan to be used exclusively within the FAMPO
region. Passenger ‘pickup’ and ‘drop off’ must be in the FAMPO designated region in order to be
eligible for funding. The recommended 5310 capital program grant application is in the amount of

$81,600; the 5310 application requires 80% federal funding with a 20% local match and thus a county
match of $16,320. FY27 contingency funds are available for the match. The Section 5310 Grant
Program provides critical funding for public transportation projects specifically planned, designed, and
carried out to meet the special needs of seniors and individuals with disabilities. This funding is vital for
enhancing mobility and independence when standard public transportation options are unavailable or
insufficient. This grant funding does not replace current operations but enhances with special trips
scheduled for off hours/days, such as weekends. Commissioner McKoy made a motion to approve staff
to apply for the Fayetteville Area Metropolitan Planning Organization (FAMPO) 5310 Capital Grant
program. The motion was seconded by Vice Chairman Nicol and carried unanimously.
Brad Abate, Harnett Regional Jetport Director, presented information regarding a request to adopt a
resolution requesting the abandonment of a portion of Airport Road for the Corporate Area Expansion
and pursuant Airport Road relocation. This request is a follow up to the August 3rd, 2026 request. NC
Department of Transportation has requested a Resolution by the Board of Commissioners approving the
partial abandonment of SR 2076 (Airport Road) from the State System if the Harnett County Board of
Commissioners concurred with the Department of Transportations’ recommendation. Vice Chairman
Nicol made a motion to adopt a Resolution to partially abandon SR 2076 (Airport Road) from the State
System. Commissioner Matthews seconded the motion. Motion carried unanimously. (Attachment 2)
Mr. Abate also reviewed a request to enter into a lease agreement and SASO agreement with Veloce
Planes, LLC for the hangar identified as 559 Airport Rd, Erwin, NC 28339 to operate an aircraft
manufacturing business. Commissioner Matthews made a motion approve entering into a into a lease
agreement and SASO agreement with Veloce Planes, LLC for the hangar identified as 559 Airport Rd,
Erwin, NC. The motion was seconded by Vice Chairman Nicol and carried unanimously.
Larry Smith, Emergency Services Director, reviewed a request for the approval of the Fireworks
application from Pyro Shows, Inc, for Campbell University's football season fireworks display. Pyro
Shows East Coast Inc, meets all safety requirements related to fire code compliance. The event will take
place on September 19th at 9:00 p.m. Commissioner Matthews made a motion to approve the Fireworks
application from Pyro Shows, Inc, for Campbell University's football season fireworks display. The
motion was seconded by Vice Chairman Nicol and carried unanimously.
Kayla Shamaly, Opioid Task Force Coordinator, reviewed a request for the approval of the Updated
Harnett County Opioid Task Force Strategic Plan (SOLVE 2.0). If approved, the updated strategic plan
will establish priorities for opioid prevention, treatment, recovery, harm reduction, and public safety
initiatives in Harnett County. Approval of the strategic plan is also a required step toward unlocking
additional funding opportunities available through Exhibit B of the North Carolina Opioid Settlement
Memorandum of Agreement. Ms. Shamaly also provided a quick update on items accomplished in
SOLVE 1.0, restructuring of subcommittees and provided an overview of SOLVE 2.0. (Attachment 3)
Vice Chairman Nicol made a motion to approve the updated Harnett County Opioid Task Force
Strategic Plan (SOLVE 2.0). The motion was seconded by Commissioner McKoy and carried
unanimously.
Christopher Appel, Senior Staff Attorney, reviewed a request to approve the updated Vehicle Policy.
Attorney Appel reviewed proposed changes (Attachment 4). Additional discussion included smoking in

county owned vehicles. Vice Chairman Nicol made a motion to approve the updated Vehicle Policy.
The motion was seconded by Commissioner Matthews and carried unanimously.
Attorney Appel also reviewed a request for approval of the conveyance of 85 Elmon Gilchrist Lane,
Erwin (PID: 070589 0026 01) to Roy Campbell of 321 Griffin Road, Lillington. The Board of
Commissioners adopted the Resolution to Convey Certain Real Property on August 3, 2026. The
advertisement for the proposed sale was published in The Daily Record on August 11, 2026 for the ten
day required period. No upset bids were received; therefore Mr. Roy Campbell's bid was successful. The
property listed at $10,550.00 less the $527.50 deposit plus the cost of publication of $248.98, which
leaves a remaining balance of $10,271.48 due at the time of signature of the Special Warranty Deed.
Commissioner Matthews made a motion to approve the conveyance of 85 Elmon Gilchrist Lane, Erwin
(PID: 070589 0026 01) to Roy Campbell of 321 Griffin Road, Lillington. Vice Chairman Nicol
seconded the motion and it carried unanimously.
Brent Trout, County Manager, shared Harnett County Animal Shelter received a $20,000 grant to assist
with the cost of spay and neutering; $15,000 in services will be covered 100% by Second Chance and
then the next $10,000 they will split 50/50 between Second Chance and Harnett County. Mr. Trout also
shared information regarding the Harnett County Lead Program.
Vice Chairman Nicol made a motion to approve the budget amendments as requested by the Finance
Officer. Commissioner Matthews seconded the motion and it carried unanimously. (Attachment 5)
Commissioner Matthews made a motion to authorize the Chairman to sign a contract for Trio
Community Meals that exceeds the manager’s signature threshold. The motion was seconded by Vice
Chairman Nicol and carried unanimously.
Commissioner Matthews made a motion to approve the tax rebates, releases and refunds as requested by
the tax administrator. The motion was seconded by Vice Chairman Nicol and carried unanimously.

Commissioner Matthews made a motion to adopt a Resolution requesting NC Department of
Transportation (NCDOT) add Tactical Drive, Honor Lane and Valor Circle in Gwen Oaks Subdivision
to the State’s Secondary Road System. The motion was seconded by Vice Chairman Nicol and carried
unanimously. (Attachment 7)
Mr. Trout shared he and the other managers will be attending the ICMA Conference and asked how the
Board would like to handle the October 19, 2026 Meeting. Consensus of the Board was to hold the
October 19, 2026 meeting and let Christopher Appel, Senior Staff Attorney, sit in for the Manager.
Chairman Jaggers stated I would like to see us contact the legislators, if the Board agrees, that if you
have lived in your home in Harnett County for 10 or 15 years and you are 65 or older, that you do not
pay anymore property tax on your home. Commissioner Morris asked staff to prepare an estimate of
what that impact may be. Vice Chairman Nicol asked if we could also include veterans and some ideas
that we may could look at, such as income levels, qualifications, etc.

Commissioner Matthews asked for an update on Data Centers. Mark Locklear, Development Services
Director provided a quick update on what the Steering Committee has discussed and provided a timeline
on when a draft will be presented to the Board.
Commissioner Matthews made a motion to adjourn at 11:09 am. The motion was seconded by Vice
Chairman Nicol and carried unanimously.

RESOLUTION OF THE HARNETT COUNTY BOARD OF COMMISSIONERS
TO PARTIALLY ABANDON A PUBLIC ROAD FROM NORTH CAROLINA’S SECONDARY
ROAD SYSTEM
WHEREAS, pursuant to North Carolina General Statute §136-63, a board of county commissioners
may, on petition, request the North Carolina Department of Transportation to change or abandon any road in
the Secondary Road System when the best interest of the people of the county will be served thereby;
WHEREAS, the North Carolina Department of Transportation, upon petition, investigated and
recommended the partial abandonment of a 0.225 mile stretch of SR 2076 (Airport Road) from Mile Marker
(“MM”) 0.435 to MM 0.66 from the State’s Secondary Road System;
WHEREAS, the North Carolina Department of Transportation requested the Harnett County Board of
Commissioners to adopt a resolution approving the partial abandonment of SR 2076 (Airport Road) from the
State System if the Harnett County Board of Commissioners concurred with the Department of
Transportations’ recommendation; and
WHEREAS, said Board of Commissioners concurs with the Depart of Transportations’
recommendation to partially abandon the above-referenced portion of SR 2076 (Airport Road).
NOW, THEREFORE, be it resolved by the Harnett County Board of Commissioners as follows:
The Harnett County Board of Commissioners hereby approves and adopts the recommendation of
the North Carolina Department of Transportation to partially abandon from the State’s Secondary
Road System the public road or easement which heretofore served as a portion of SR 2076 (Airport
Road) as herein described. The public road or easement to be abandoned is 0.225 mile portion of
SR 2076 (Airport Road) from MM 0.435 to MM 0.66 in Harnett County, North Carolina shown
on the attached Exhibit A.

individuals to treatment and prevent future overdoses
5.Facilitate the engagement of local faith communities in Mental Health First Aid training as well as more advanced,
in-depth training for clergy
6.Make free, low-barrier naloxone available for every individual who is released from detention in Harnett County
Jail, along with overdose prevention and response training
7.Equip primary care providers to effectively manage medication assisted treatment for substance use disorders in
primary care settings
8.Increase safe disposal of needles and other drug paraphernalia through a supervised collection site and secure
sharps container in the county
9.Conduct a multi-level messaging campaign to prevent accidental drug exposures in young children – including
printed messaging to faith communities, social media campaigns, community workshops, and local broadcast
media
10.Explore distribution of naloxone through networks of community-based organizations and faith-based
organizations
11.Increase access to the full range of behavioral health services and MAT/MOUD, including expanded use of mobile

Section II: No Private Use – Clarifies that personal use of County issued vehicle is
prohibited except for commuting and de minimus use which is defined as infrequent, brief
stop that adds no more than 5 miles and last no longer than 30 minutes and occurs no
more than once per week
Section III: Occasional Overnight Use – New Section – allows overnight use of a County
vehicle (not permanently assigned vehicle) when the employee’s next scheduled work
assignment requires direct travel from their home to the location of the assignment. Must
receive prior approval and does not grant approved commuter status
Section IV: Permanently Assigned Vehicle – New Section – provides updated criteria for
assigning a permanently assigned vehicle:
•The position requires work in the field, away from a physical office, more than 50% of
the position’s total work time AND the position starts the day from home directly to
the field 3 (three) or more days per week AND special equipment is needed that
cannot reasonably be kept in a personal vehicle, OR
•The position responds to after-hours business calls AND special equipment is
needed that cannot reasonably be kept in a personal vehicle.
Section V: Withholding Requirements – Updated to included IRS Community Rules
Section VI: Car Allowance – New Section – for certain administration employees or
department heads whose job duties require use of a vehicle for daily County business may
be provided a car allowance in lieu of providing County vehicles or reimbursing for mileage
and fuel. Allowances shall not exceed $600/month. For long-distance in-state travel or out
of state travel, the employee can use a County vehicle or request mileage reimbursement.
Section VII: Driver Qualifications – Paragraph 3 amended as follows:
3. Must meet driver’s license requirements (this includes proof of continuous liability
insurance from an insurer licensed to do business in North Carolina and a current
vehicle registration if driving a personal vehicle)
Also updates paragraph on arrests for DWI and other drug and alcohol-related offenses:
All County employees are required to report any Driving While Intoxicated (DWI) arrest, or
any other drug or alcohol related arrest while driving, whether on or off duty, to their
Department Head and the Human Resources Department. If the arrest occurs while on duty,
the employee shall report it immediately or as soon as physically possible. If the arrest
occurs while off duty, the employee shall report it within one (1) business day or as soon as
physically possible. The employee’s driving privileges may be suspended until final
disposition by the courts in addition to any disciplinary action pursuant to the Personnel

Ordinance. Failure to report the arrest will be considered a failure in job performance and/or
personal conduct and shall be grounds for disciplinary action.
Section X: Accessories and Modifications – New Section – no modifications, additions, or
removal of equipment without written permission from Fleet Maintenance
Section XIV: Alcohol, Drugs, Tobacco, and Firearms Prohibited – amended to clarify that
County and Sheriff-issued firearms and weapons, and County-issued pepper spray are
exempt from this section.
Section XVI: Motor Pool Vehicles – New Section – Permits employees to request use of
County vehicle through the new Fleet Services Motor Pool Program. To obtain a vehicle,
employee must complete a Motor Pool Vehicle Request Form at least 2 business days prior
to the requested use date. E mployees must also complete the Motor Pool Vehicle Condition
Checklist.
Section XVIII: Traffic Violations, Incidents, and Accidents – Paragraph 4 amended as
follows:
4. Contact the appropriate law enforcement agency if the accident involves
another motor vehicle or person. Law enforcement shall be contacted regardless of
the existence of any damage to the vehicle(s) or injury to person(s) even if the other
party states that they were not injured or that their vehicle was not damaged in the
accident.
Section XXI: Passengers – amended as follows:
Only passengers on County business are allowed in County vehicles, for example, local
Government officials and contractual relationships. County vehicles shall not be used to
transport family members to/from work or school.
Section XXIII: Defensive Driving Training – amended to add the following to the end of this
section:
“Additionally, any employee that is involved in a vehicle incident or accident while driving in
the performance of their job duties may be required to attend a Defensive Driving course”
Other changes to the Policy include:
1. Updated titles and references to Safety & Risk Manager and Fleet Management
2. Updated forms in the appendices to reflect policy changes and new forms for Motor
Pool Program

The applicant is requesting approval for the request to rezone to the CZ-RA-40, a
conditional zoning district. The proposed conditional zoning district would allow for a
single-family residential development with a minimum lot size of 12,500 square feet.
The applicant has agreed to all conditions recommended by staff and the Planning
Board.
Planning Board:
At the September 8, 2026 Planning Board meeting, a neighboring property owner spoke
to request two conditions to minimize potential conflict between their existing shooting
range and the proposed single family residential development. The following conditions
were requested:
1. A minimum 50-foot wide, undisturbed wooded buffer shall be provided and
maintained along the southern property line and securely fenced. Signage shall be
displayed on the exterior of the fence instructing residents to keep out of the adjacent
shooting range.
2.A restrictive covenant and disclosure statement shall be executed by the purchaser
and recorded concurrently with the deed for any property transfer within the
development, attesting that the purchaser has been notified of, and acknowledges, the
proximity of the adjacent shooting range and the operational impacts associated with its
use.

Project Narrative
The proposed request is to conditionally rezone our current RA-40 Parcel to develop
an approximately 175-lot single-family residential subdivision that supports the
continued growth of Harnett County while promoting public health, safety, and
general welfare. The development includes an interconnected internal street
network with opportunities for future connectivity, providing efficient traffic
circulation and emergency vehicle access. Sidewalks, open space, and community
amenities are incorporated throughout the site to encourage pedestrian connectivity
and enhance neighborhood livability.
The subdivision will be served by public water and sanitary sewer, providing
reliable utility service and eliminating the need for individual wells and septic
systems. Stormwater management facilities will be designed in accordance with
applicable local and state regulations to manage post-development runoff and
protect downstream properties.
The proposed conditional zoning is compatible with the surrounding area, which
consists of a combination of existing residential development and agricultural land.
The development represents a logical extension of nearby residential growth while
limiting the property to single-family residential use through the conditional
rezoning process.
The proposal is consistent with the goals of the Harnett County Comprehensive

Land Use Plan by directing residential growth to an area where public
infrastructure and utilities are available or can be efficiently extended. The project
will provide additional housing opportunities to help meet the County's continued
residential demand while complying with the applicable standards of the Harnett

represents an orderly and planned pattern of growth that is consistent with the
County's long-term planning objectives.
Proposed Conditions
We aim to establish all finalized proposed conditions throughout the conditional
rezoning process with help of the Harnett County Planning staff. The proposed
conditions are intended to ensure that the development occurs in a manner
consistent with the submitted plan and the goals of Harnett County. The conditions
will provide certainty regarding the permitted use of the property and establish
development standards that promote compatibility with surrounding properties,
infrastructure efficiency, and high-quality community design.
Recorded Deeds & Supplemental Information
The recorded deeds available through the Harnett County Register of Deeds search
provided the majority of the property information required for this application.
However, no recorded deed specific to PIN 0664-46-5026 could be located through
the available records. The only documentation identified for this parcel was the
Voluntary Agricultural District documentation, which has been included with this
submittal for reference.
Additionally, proposed building elevations have been appended to the end of this
Project Narrative. While these elevations do not represent the exact home models
that will be constructed within the development, they are intended to provide a
representative example of the anticipated architectural style, building elements,
and overall character of the proposed community.

Site Description & Physical Characteristics
The site consists of four properties totaling 96.75 +/- acres and is located off Purfoy Road, approximately 1 mile
south of the Wake County line. The site is currently used for single-family residential and agricultural purposes.
There is a pond located in the northeast corner of the site approximately 2 acres size. The site slopes downward to
the west towards Kenneth Creek, which borders the rear property line. In the areas surrounding the creek, the site
is split zoned, with the environmentally sensitive portions of the site located within the Conservation Zoning
District. Approximately 8 acres of the site is designated as Conservation Zoning, and this area is not included in the
conditional rezoning request. The area located in the Conservation Zoning District is non-buildable, and no
permanent structures are permitted within this area.

Low Density Residential
Single family detached residential intended to remain predominately suburban in character and provide
low density single-family residential development. Gross densities of 1-2 dwelling units per acre depending
on zoning, utilities, soils, and character of adjacent development. Smaller lot sizes could be permitted as
part of Compatibility Development, which would also include a higher amount of open space to preserve
sensitive environmental areas.
Compatibility
The conditional rezoning request is compatible with the Low Density Residential Future Land Use
Classification. The request would allow low-density residential development with a minimum lot size of

Planning Board Meeting
At the September 8, 2026 Planning Board meeting, a neighboring property owner spoke to
request two conditions to minimize potential conflict between their existing shooting range and
the proposed single family residential development. The following conditions were requested:
1. A minimum 50-foot wide, undisturbed wooded buffer shall be provided and maintained along
the southern property line and securely fenced. Signage shall be displayed on the exterior of the
fence instructing residents to keep out of the adjacent shooting range.
2. A restrictive covenant and disclosure statement shall be executed by the purchaser and
recorded concurrently with the deed for any property transfer within the development, attesting
that the purchaser has been notified of, and acknowledges, the proximity of the adjacent
shooting range and the operational impacts associated with its use.
The Planning Board voted unanimously (5-0) to recommend approval of the rezoning request
with the additional conditions.
Suggested Statement-of-Consistency for Approval
The requested rezoning to CZ-RA-40 Conditional Zoning District is consistent with the Harnett
Horizons 2040 Comprehensive Plan and is reasonable for the following reasons:
The request advances policies in the land use plan that increase residential development standards
relating to enhanced open space and amenity requirements, pedestrian facilities, and improved
connectivity. Additionally, the proposed zoning change is compatible with the underlying land use,
Low Density Residential future land use designation.
The requested rezoning is reasonable because the users permitted under the proposed CZ-RA-40
classification remain identical to the uses permitted under the property’s current zoning
classification. Additionally, the request is supported by the availability of public water and sewer
utilities.
Suggested Statement-of-Consistency for Denial
The requested rezoning to CZ-RA-40 Conditional Zoning District is unreasonable for the following
reason:
The requested rezoning is unreasonable due to the proposed development density of 1.81 units per
acre, which is incompatible with surrounding agricultural and very low-density residential

COUNY OF HARNETT’S OFFICIAL ZONING MAP
WHEREAS, the applicant, Carson Calcutt, (hereinafter referred to as “Applicant”) is the authorized agent of the
owner Kent Jeffries et al., of approximately 87.57 acres of land identified by Property Identification Number(s)
PIN(s) 0664-36-1603.000; 0664-46-1451.000; 0664-46-5391.000; 0664-46-5026.000, more particularly
described in the legal description attached hereto as Exhibit A, and which by this reference is made a part hereof
(hereinafter referred to as the “Properties”; and
WHEREAS, the Applicant has submitted an application and a site plan to amend the Properties zoning designation
from the present zoning classification of RA-40 to CZ-RA-40, and to modify certain development standards for
the Properties; and
WHEREAS, the site plan and mutually agreed-upon conditions are attached hereto as Exhibit B, which by this
reference is made a part hereof; and
WHEREAS, a public hearing was properly noticed and held by the Harnett County Board of Commissioners on

Section 1. The Official Zoning Map of Harnett County shall be amended from the RA-40 zoning classification
to the CZ-RA-40 zoning classification for the Properties described in Exhibit A, project number PLAN2607-
0005.
Section 2. The amendment to the Official Zoning Map of Harnett County is subject to the mutually agreed-upon
conditions set forth in Exhibit B.
Section 3. This Ordinance does not constitute approval or authorization for development of the subject parcels.
Development shall occur in accordance with the applicable processes and requirements of the Harnett County
Unified Development Ordinance (“UDO”).
Section 4. All UDO development standards or land use provisions that apply to the RA-40 zoning classification
which are not modified by the conditions set forth in Exhibit B shall apply to the Properties.
Section 5. This Ordinance shall become effective immediately upon its adoption.

Park". The text Mr. Gregory has proposed would allow for a covered porch to have a
maximum area of 100 square feet; however, staff’s proposing a maximum area of 40
square feet. Staff’s proposal for a smaller porch size is to help avoid the illegal
conversion of covered porches into enclosed living areas, which has been problematic in
the past.
ADDITIONAL INFORMATION:
At the September 8, 2026 Planning Board meeting, the Planning Board voted
unanimously (5-0) to recommend approval of the applicant's proposed text amendment
as written. The Planning Board stated that the maximum allowable covered area of 40
as presented by staff was not large enough to accommodate seating or for those with
disabilities and required a wheelchair to utilize .
There was no one present to speak in opposition to the proposed text amendment.

jurisdiction of this Ordinance. This excludes front and rear uncovered porches and decks not exceeding
100 square feet.

“Standards for New & Altered Manufactured Home Parks” of this Section for additional requirements.

Reason for Requested Change:

Planning Board Meeting:
At the September 8, 2026 Planning Board meeting, the Planning Board voted unanimously (5-0) to approve
the text amendment as requested by the applicant. The Planning Board stated that a maximum allowable
covered area of 40 square feet as proposed in staff’s recommended text was too small. The Planning Board
stated concerns that staff’s recommended allowable size could make operating a wheelchair difficult and
limit enjoyment.
Suggested Statement-of-Consistency for Approval:
The requested Text Amendment is not in conflict with the policies, goals, and strategies outlined in the
Harnett Horizons 2040 Comprehensive Land Use Plan or the existing regulations in the Unified
Development Ordinance. Therefore, it is recommended that the Text Amendment request be APPROVED.
Suggested Statement-of-Consistency for Denial:
The requested Text Amendment does not advance the policies, goals, or recommendations outlined in the
Harnett Horizons 2040 Comprehensive Land Use Plan. Therefore, it is recommended that the Text
Amendment request be DENIED.

WHEREAS, the Harnett County Planning Board has reviewed the amendment to the article of the UDO as
listed below and recommends the adoption of the following amendment.

RESOLUTION BY HARNETT COUNTY BOARD OF COMMISSIONERS
WHEREAS, the Infrastructure Investment and Jobs Act (IIJA) of 2021 and North Carolina General Statute
(NCGS) 159G have authorized the making of principal forgiveness loans to aid eligible, drinkingwater
system owners in financing preconstruction activities and planning efforts associated with the removal of per
and polyfluoroalkyl substances (PFAS); and
WHEREAS, the North Carolina Department of Environmental Quality has offered a Drinking Water State
Revolving Fund Emerging Contaminants (DWSRFEC) loan with principal forgiveness in the amount of
$500,000 to conduct Harnett Regional WTP PFAS Study, hereafter referred to as the “Project”; and
WHEREAS, Harnett County intends to conduct said Project in accordance with a scope of work that was
approved by the North Carolina Division of Water Infrastructure.
NOW, THEREFORE, BE IT RESOLVED BY THE HARNETT COUNTY BOARD OF
COMMISSIONERS:
That Harnett County does hereby accept the DWSRFEC principal forgiveness loan offer in the amount of
$500,000; and
That Harnett County does hereby give assurance to the North Carolina Department of Environmental Quality
that they will adhere to all applicable items specified in the standard "Conditions" and "Assurances" of the
Department's funding offer, awarded in the form of a DWSRFEC principal forgiveness loan; and
That Brent Trout, County Manager and successors so titled, is hereby authorized and directed to furnish such
information, as the appropriate State agency may request, in connection with such application or the Project;
to make the Assurances as contained above; and to execute such other documents as may be required in
connection with the application; and
That the Harnett County has complied substantially or will comply substantially with all Federal, State and
local laws, rules, regulations, and ordinances applicable to the Project, and to Federal and State grants and
loans pertaining thereto.

REQUEST:
This is a formal request for the Board to approve the Buies Creek and Coats Collection
Systems grant resolution in the amount of $10,631,302.00. The funds will be used for
design, engineering, and the installation of a new gravity and force main sewer line as
well as upgrades to existing sewer pump stations in the collections system aimed at
improving sewer capacity and success in the specified areas. This project will expand
the existing sewer infrastructure to accommodate growing demand while ensuring
complance with local and regional wastewater regulatioins. The proposed sewer line
and pump station upgrades are located in the NC Highway 27 East and US 421 South
Corridors.

RESOLUTION BY HARNETT COUNTY BOARD OF COMMISSIONERS
WHEREAS, Harnett County has received a Directed Projects grant from the 2023 Appropriations Act,
Session Law 2023-134, administered through the Drinking Water Reserve and Wastewater Reserve to assist
eligible units of government with meeting their water/wastewater infrastructure needs, and
WHEREAS, the North Carolina Department of Environmental Quality has offered 2023 Appropriations Act
funding in the amount of $10,631,302.00 to perform work detailed in the submitted application, and
WHEREAS, Harnett County intends to perform said project in accordance with the agreed scope of work,
NOW, THEREFORE, BE IT RESOLVED BY THE HARNETT COUNTY BOARD OF
COMMISSIONERS:
That Harnett County does hereby accept the 2023 Appropriations Act Directed Projects Grant offer of
$10,631,302.00.
That Harnett Cunty does hereby give assurance to the North Carolina Department of Environmental Quality
that any Conditions or Assurances contained in the Award Offer will be adhered to.
That Brent Trout, County Manager, and successors so titled, is hereby authorized and directed to furnish such
information as the appropriate State agency may request in connection with this project; to make assurances as
contained above; and to execute such other documents as may be required by the Division of Water
Infrastructure.
