Mayor Elmore introduced Bo's family and staff members who were in attendance, noting the family's deep ties to the Dunn community, Bo's history as an athlete, his faithful church membership, and his years of service on the City Council and as Mayor Pro Tem. Mayor Elmore read the proclamation on behalf of the City, which recognized Dafford Funeral Home, Incorporated for celebrating 80 years of service to the Dunn community. The proclamation noted that the business was founded in 1946 by the late Walter Dafford, a World War II veteran, and his wife Fannie Dafford, a school teacher. It further recognized their son, Dallas L. "Bo" Dafford, Sr., a United States Army Vietnam Veteran, who served ten (10) years as Mayor Pro Tempore on the Dunn City Council, and acknowledged the family's extensive service on National Mortuary Association board, Local Banking and Nonprofit Board, and countless hours of volunteer community service. The proclamation concluded with congratulations and appreciation extended on behalf of the Mayor, the City Council, and the residents of the City of Dunn. Bo Dafford offered brief remarks, expressing gratitude to the community for its longstanding embrace of his family. The Council recessed briefly following the presentation to allow attendees to depart before reconvening. Mr. Davis stated that he had been issued a Trespass Noticdrom the MunicipahBuilding after visiting the City Manager's office to file a Public Records Request_underr G.S.13"2,concerningthe Dunn Police Department. He indicated that he had notet received the requested records and expressed concern that City staff had directed Police Officers to arrest him should he return to the building, which he argued placed officers na legally compromising g p g p g position. Mr. Davis contended that requ sting public! records and r` cording public officers in the course of their duties constitutes legitifnate, business and is a constitutionally protected activity. He urged the Council to review G.S.1 2 wiiththe Citq Ma"r tiger and cautioned that withholding public records constitutes a Class A misdemeanor. He commented that City Manager Justin Hembree a d CityA Y rnegTilghman,Pope were not in attendance [theywere both sittingin their ussua!'places on either side of'the'Mayor with their name plaques in front of them]. He also notedhis °intention to pursue litigation in District Court if the matter was not resolved. Mayor Elmore thanked Mr. Davis the way he conducted himself and acknowledged his comments. CONSENT AGENDA Mayor Elmore presented the Consent Agenda Item, which consisted of: • Approval of August 11, 2026 Work Session Minutes Motion by Council Member J. Wesley Sills, second by Mayor Pro Tem April Gaulden to approve the standalone Consent Agenda Item. All in favor. Motion carried unanimously. ITEMS FOR DISCUSSION & POSSIBLE ACTION Ordinance Text Amendment OA-26-01 Public Hearine Mayor Elmore opened the Public Hearing at 6:53 p.m. and invited City Manager Justin Hembree to provide an overview. City Manager Hembree noted that the amendments were primarily technical or administrative in nature and had been discussed at the previous work session. The outstanding issue carried over from that session concerned the approval authority for Final Plats. Senior Planner Stephanie Goodrich presented the proposed Text Amendments to the Unified Development Ordinance (UDO). The proposed changes included the following: Technical and Administrative Changes: A note to be added to the top of the Public Notice Table, removed and its language relocated to the neighborhooc correction to the use table removing a duplicate listing off eliminate conflicting zoning classifications; a language up`d newly added definition in Article 11; the deletion ofla sectic for residential duplexes in order to conform with'S'tate regul a correction of a typographical error in the home oceupatic from "accessory structure" to "primary structure" fo-Cregl. percentage (maximum 25 percent of gross floor area). `\ Definition Addition: 4 A definition for "correctional, probation,<or l Article 11, to define that proposed use placpc Process Change: Major Subdivision and :Final PlatAp would shift approvalauthority forn; and City Council,,respectively;>to` Technical R vew-Committee;,cor reviewed`by the Technical Review C Final Plats proceed to City Counc through the'Technical Review Con - or Director. The proposed change would route both e with final approval resting with the Administrator Reasonableness and Consistency Statement., Staff recommended adoption of a Reasonableness and Consistency Statement.as set forth on the final page of the'amendment document. A substantive discussion followed among Council members. Council Member Alan Hargis expressed concern and opposition to the proposed change in approval authority, arguing that the Council has historically and meaningfully weighed in on land use decisions and should retain oversight. City Manager Hembree and Ms. Goodrich clarified the distinction between the Final Plat process and the broader subdivision approval process, explaining that by the time a Final Plat reaches the Council under the current framework, all substantive decisions have already been made by the Planning Board and the Technical Review Committee, and the Council has no discretionary basis for denial if all requirements have been met. Council Member Hembree acknowledged that if the Council wished to revisit the broader question of subdivision approval authority at an earlier stage of the process, that would require a more in-depth, separate text amendment. Mr. Hembree noted that the types of decisions where the Council has meaningfully disagreed with staff recommendations—Rezonings and Special Use Permits —would not be affected by this amendment, as those items would continue to come before the Council. No members of the public spoke for or against the amendment, and the Public Hearing was closed at 7:05 p.m. t , Decision ' I\ Motion by Mayor Pro Tem April Gaulden, second by Council,Member J. West Broad Street Stormwater and Repaving Project. City Manager Hembree reported that the City has entered into an agreement with the engineering firm Freeze & Nichols Inc. to conduct a Stormwater Study and Prepare Streetscape Design Work for West Broad Street, particularly the segment between Ashe Avenue and General Lee Avenue. A Community and Stakeholders Meeting has been scheduled for September 151 at 9:00 a. m. at Kim's Barbecue, located adjacent to the project site. Property owners and business owners along the corridor were invited by City staff. Representatives from Freese & Nichols Inc. will be in attendance to address technical questions. The City's stated goals for the design include resolving long-standing stormwater and drainage deficiencies beneath the roadway and addressing'the, ongoing problem of commercial delivery trucks blocking the road, particularly at loading areas behind the Wayne Avenue Shopping Center. City Manager HemMee noted that a loading lane configuration parallel to the rear of the buildings is und`' consideration, though Sherwin Williams presents a particular design challenge that requires furthe'r\'study. Financial Report In the absence of Finance Director McNallan, Deputy Finance Director Alexa AbUng presented the Financial Report for June and July, which had been prepared by Finance Director McNallan prior to his departure. Cash balances across all funds as of July 31, 2026, totaled $10,800,000, compared to $8,700,000 at the same point the prior year. The increase was attributed primarily to State grant reimbursements for Water and Sewer Projects. The City also holds a balance of $1,900,000 in the East Side Pump Station Construction Account. The Budget Benchmark for the period ending June 30 was 99.99 percent. General Fund property taxes collected by the county for the month of June totaled $66,000, compared to $126,000 for June 2025. A Council member inquired about the significant decrease, and staff noted that delays in Harnett County's propertytax billing process may be a contributing factor. Fiscal year 2026 year-to-date property tax revenues received total approximately $6,000,000, against a total estimated tax levy of $5,900,000, inclusive of property taxes, motor vehicle taxes, and downtown district assessments. Sales tax receipts for Maytotaled $331,000, approxir the prior year. Year-to-date Sales Tax Revenue of $3 $3,450,000 annual budget. Ms. Rodriguez reported that since July 1, 2026, two hundred (200) cases have been opened and addressed, compared to forty-five (45) cases during the same period in the prior year — a significant increase in activity reflecting a more proactive enforcement posture. City Manager Hembree recognized Code Enforcement Officer Rodriguez for her willingness to temporarily assist in the Finance Department's Utility Billing Operations during a period of unexpected staffing challenges, in addition to her regular Code Enforcement duties. Regarding the persistent issue of residential trash receptacles left on roadways beyond collection day, staff reported that door hangers, tape, and informational flyers are being distributed to residents as a compliance and education tool, and that general resident cooperation has been cooperative when staff engages directly. In 2017 the city initiated a city-wide large-scale rezoning and this property was rezoned from residential/agricultural to Industrial. Either zoning districtwould be appropriate in the long range land use plan, but if considering the fact that the parcel would be difficult to develop as industrial given the site constraints and the fact that it has not been a consideration of the ownerto change the land use, restoring the residential low density district that it was prior to the city initiated rezoning is appropriate. A stream runs on the opposite side of the property from the pipeline, making this area unusable for structures. There is also one house built in 1920, which I rent out, that is on the far edge of the property near the stream. The areas adjoining this property are used for faming, so rezoning to R20 should not be a detriment to these properties. This property is a part of Hamett County's Land Use Plan and is a part of the deferrment program. Thank you for your consideration of my request. 14 INSTRUCTIONS FOR FILING A REZONING APPLICATION 1) A petitioner for a zoning change must complete this application in full. They worked through each .map parcel by parcel determining the zoning, that needed to be assigned to update the zoning map. 'Mrs. Wullenwaber advised the board that she plans to ;have this. as a public hearing in November; and on the Council.Agenda"in December so we can wrap it up by the end of the year. REGULAR BUSINESS: Commercial Maintenance Lode: Planning & Inspections Director Wullenwaber addressed the board and reminded th ..at this:hao been discussed previously, She presented a document that was the final draft, which was been sent to the city attorney for final revisions and proofing. 30 Even though it is not zoning, it does deal with planning .and now that we are Planning & Inspections, under one department officially we are really trying to grow and do things. This will help repair some of the commercial buildings that are not up to code. It is called the Commercial Maintenance Code.but the official name'is Non -Residential Building_ Maintenance Code. It is similar to the. Minimum Housing. Code but for -commercial buildings. It covers trash not being properly contained, storm drainage, and parking lots with big potholes. A building can be condemned or deemed unfit. One waiting period was 2 years and another"was 5 years. If it is condemnable, we will condemn it and demolish it. However, if it is just unfit once we enter an ordinance on the property, we have to wait -for two (2) years for just a normal retail property. If it is a warehouse, we have to wait five (5) years. That two and five years has been the standard for all the codes Mrs. Wullenwaber has seen while researching this matter. A motion was made by Joe Miriello and seconded by Doug Heath to recommend approval of the commercial maintenance code to city Council. It will be placed on the September 22, 2026, City Council agenda for consideration. The applicant is requesting a zoning map amendment to the parcels at PIN#s 1526-25- 9378.000 and 1526-26-4072.000, located at 11285 NC 55 E and CP&L Road, currently zoned 1-100, Industrial to include the use of a Recreational Vehicle Campground. This site has been in research and review for several years and was successfully granted a Conditional Use Permit (CUP) in 2021. Since 2021, the CUP expired and the new procedural method to grant a conditional use is through a rezoning with conditions. City Management and staff have met with the applicant and it is our belief that adding a campground for Recreational Vehicles to the existing zoning most closely aligns with the intent of the original approval of the Conditional Use Permit. The subject properties are being annexed concurrently. The applicant received approval on a preliminary site plan and is in the process of getting a full site plan review upon annexation approval. Atthe September 1, 2026 Planning Board Meeting, the Planning Board voted unanimouslyto recommend approval of Conditional Zoning/Map Amendment CZ-26-03. Page 1 of 2 A Public Hearing Notice will be posted in the Daily Record to run on September 11 and 18, a sign will be placed on the subject property, and Letters will be mailed to adjacent property owners. During the UnifiedDevelopment Ordinance update in 2023, these uses were removed. Elmore Jr. Mayor Pro Tem Dr. David L. Bradham Council Members J. Wesley Sills April L. Gaulden Frank McLean Billy Tau Chuck Tumage City Manager Steven Neuschafer Ropestar Events, LLC (mailing address 111 West Main Street, Suite 202, Garner, NC 27529-3250) has applied for a Conditional Use Permit to develop a Recreational Vehicles (RV) Park / Campground at property identified as PIN 1526-25-9378.000 and PIN 1526-26-4072.000, parcels of land between NC 55 East and 1-95. Access to the property is via NC 55 East. The property is 55.22 acres+/- and consists of a field, woods, some wetlands, and 22 acres+/- of a pond. These parcels are zoned I-100, Industrial District. This matter was duly noticed for the May 11, 2021 public hearing in advertisements in a newspaper of general circulation April 20 and 27, 2021. Signs were posted on the property April 20, 2021 and kept there until afterthe public hearing. At the Public Hearing May 11, 2021, the following were sworn in to give testimony: From City staff: • George Adler, Planning Director • Steven Neuschafer, City Manager The following testified for the applicant: • Donnie Adams, of Adams & Hodge Engineering PC Brian Barefoot, Ropestar Events LLC The following members of the public offered testimony on the subject or asked questions about the project, which were responded to by one or more of the above witnesses: • None The following parties opposed the project and provided testimony as such: • None After receiving the staff report, staff testimony, and the submission of documents from any party; and hearing the testimony of all witnesses; the Dunn City Council makes the following FINDINGS OF FACT: 1 1) The application submitted was complete. 2) The use requested —RV Park/Campground—is listed among the conditional uses in the Dunn City Code at Section 22-461(11)(a). 3) The requested use is essential or desirable to the public convenience or welfare. The properties are located between 1-95 and NC 55, providing easy access to 1-95 Exit 73 less than a mile away via NC 55. Approximately half the property is a 22-acre pond. This location on 1-95, between population centers to the north and Florida to the south is well situated as a resting place for the RV traveling public. The closest RV parks currently are approximately 10 miles to the north near Benson and 14 miles to the south near Wade. An RV park at this location in Dunn will enhance public convenience and should increase tourism that will benefit local businesses in Dunn. 4) The requested use will not impair the integrity or character of the surrounding or adjoining districts, nor be detrimental to health, morals, or welfare. An RV campground will not detract from the character of the adjoining districts and should preserve the rural feel of the area. The pond will remain and, combined with proposed improvements, create "viewscapes" to enhance the view from roadways and adjacent properties. The parcels' wooded areas will be altered only enough to establish the campsites and road system, leaving a large portion for walking trails and buffering. Extra buffering will be required between the RV park and adjacent residential parcels. 5) If completed as proposed, the requested use will conform with the land development plan and the Dunn City Code. The Future Land Use Map anticipated the area east of 1-95 in the vicinity of the property to remain agricultural/open space in 2030. But the Future Land Use Map, completed in 2005, couldn't foresee the changes the economy would go through. The zoning was changed to 1-100 in 2013 to amend the zoning map to reflect the current use of properties and the 2030 land use plan. An RV park is a permitted conditional use in the 1-100 Industrial District. The preliminary site plan developed for the RV park, as of April 23, 2021, conforms to the requirements in Chapter 22, Article Vill: Travel Trailers and Trailer Campgrounds and meets all requirements to allow for a conditional use permit. 6) Adequate utilities, access roads, drainage, sanitation, and other necessary facilities have been or can be provided. City water is accessible to the site from a water line near 1-95; sewer as well. Access to the property will be from NC 55, where a NCDOT approved drive way access currently is. Storm water conveyance, storage, and treatment will be designed to meet the City of Dunn's storm water requirements. Solid waste will be collected by a private company. Access to all utilities currently exist or can be provided. Based on the preceding FINDINGS OF FACT, the Dunn City Council concludes that the Conditional Use Permit should be granted as set forth herein and has voted to approve the same following the public hearing. The Conditional Use Permit is effective upon the signing of the same, the giving of notice as required, and the filing of the same with the Planning Department. This is the 8`dayofJune, 2021. This property is located within the City of Dunn's zoning C-3. Per the City's LIDO, Article 5 - Table 5.06 states that the Banquet Hall / Event space is allowed within this zoning; however, the Owner must apply for a Special Use Permit. The requested use will be in conformance with the City's Land Development Plan. The Owner has mentioned that the existing 1,827 square -foot building was originally leased for commercial purposes and would now like to use it as a rentable space for events. This space can be utilized by local businesses and citizens looking for space to have an event. The proposed use will not negatively impact the surrounding area, and the Owner will abide by any noise ordinances that the City has in place. The Owner also owns the 0.16-acre property to the east of the property where he intends to improve and use it for parking for the event space. Per the City's UDC, Article 6 - Section C, there is not a specific parking requirement for Banquet Hall / Event space, therefore the "All Other Commercial Uses" (1 stall per 500 square - feet) parking requirement was used to determine the required parking. For the 1,827 square -foot building, the total parking required would be 4 parking spaces. The Owner is proposing to have 29 parking spaces, 2 of which will be handicap stalls. It is not anticipated that utility service (water, sewer, etc.) upgrades will be required for the proposed use. The existing driveway entering the property will remain as the primary ingress and egress to the site. Drainage patterns will follow the historic pattern of the property. The parking lot asphalt improvements are proposed at the front half of the property while the back half of the parking lot is proposed to be gravel to help reduce the overall imperviousness. Page 1 of 2 Here Civil Consultants. LLC. ____ _Special Use Permit_ 804 S Clinton Ave - Dunn, NC The Owner welcomes any input from the City as well as neighboring property owners and is willing to compromise with any reasonable requests for the change of use. The change of use would give the Owner more flexibility for the building space and could potentially help grow his business. Sincerely, Ravin Nanpatee, P.E. The 840 sq/ft structure current tax value of the structure itself is $88,226. G.S. 160A-269 provides for the following upset bid procedure when a city proposes to accept an offer to purchase certain personal property or any real property: • Council must require a bid deposit of 5% and direct the Clerk to publish a Notice of the Offer containing a general description of the property, the amount and terms of the offer, and a notice that within 10 days any person may raise the bid by not less than ten percent (10%) of the first one thousand dollars ($1,000) and five percent (5%) of the remainder. Page 1 of 2 If the original offer is raised (ie. upset), the new bidder must deposit with the Clerk five percent (5%) of the increased bid, and the Clerk must readvertise the offer at the increased bid. This procedure is repeated until no further qualifying upset bids are received, at which time the Council may accept the offer and sell the property to the highest bidder. The Council may at any time reject any and all offers. To initiate the upset bid process on this initial $10,000 offer, Council's next step would be to adopt the attached Resolution Declaring Residential Structure Surplus &Authorizing Upset Bid Process on that Residential Structure and, to direct that the Clerk publish the attached Notice of Sale by Upset Bid. The Resolution and Notice require that any upset bidder must also remove the structure at the bidder's expense within 60 days of closing. After the final upset bid period expires and should the Council elect to accept the offer of the highest bidder, the City and buyer would execute a formal purchase agreement binding the parties and proceed to close. BudgetJmpact Proceeds from any sale of this structure on the property would go to the General Fund.
