Section: 11.6.1, F., G. Current Text: F. Prohibited Uses & Structures No part of the park shall be used for non-residential purposes, excluding facilities related to the maintenance of the park. The following uses and structures shall be prohibited within manufactured home parks: 1. The transfer of a manufactured home space or spaces either by sale or by any other means within a manufactured home park 2. The storage of abandoned or junk vehicles 3. The storage of uninhabitable manufactured homes 4. Recreational Vehicles (RVs) as a permanent residence 5. Storage of possessions and equipment under the manufactured home Proposed Text: See Attachment 1: Proposed Text Reason for Requested Change: To amend Harnett County’s U.D.O. pertaining to Manufactured Home Park use regulations. Currently, manufactured home park sales offices are not permitted as an accessory use within a manufactured home park because the Manufactured Home Park use regulations expressly prohibit nonresidential land uses. The proposed amendment would establish a new Subsection F to permit the sale of Page 2 of 3 manufactured homes as an accessory use within a manufactured home park and to establish specific use regulations governing that activity. In addition, a new Subsection G would clarify that the sale of manufactured homes within a manufactured home park is exempt from the Unified Development Ordinance's prohibition on nonresidential land uses in manufactured home parks. The requested text amendment was initiated in response to a proposal from by the applicant, HH Spring Lake MHP Spring Lake NC, LLC., an owner and operator of manufacture home parks within the County. The applicant utilizes a business model that includes the sale of manufactured homes within the parks it owns and manages. Under current regulations, the applicant is unable to obtain a dealer license from the north Caolina Division of Motor Vehicles (NCDMV) because NCGS § 20-286 requires a licensed dealer to maintain an on-site sales office. The County’s Unified Development Ordinance currently classifies a sales office as a nonresidential land use, an nonresidential land uses are prohibited within manufactured home parks. By amending the text to allow for the sale of manufactured homes as an accessory use, the applicant will be able to obtain a dealer’s license from the State and sell manufactured homes within a manufactured home park. The proposed text amendment will allow for the sales of manufactured homes within a park to operate in the same manner as rentals within a manufactured home park currently take place with no additional impact to the community or surrounding land uses. Suggested Statement-of-Consistency: (Staff concludes that…) The requested Text Amendment is reasonable due to compatibility with similar existing regulations and the Harnett Horizons 2040 Future Land Use Plan. The proposed text amendment will allow for the sales of manufactured homes within a park to operate in the same manner as rentals within a manufactured home park with no additional impact on the community or surrounding land uses. Additionally, the text amendment advances Goal 1, Strategy 1C, in the Housing chapter of the Harnett Horizons 2040 Future Land Use Plan. Harnett Horizons 2040 Future Land Use Plan Housing Goal 1: Accommodate a mixture of housing types in appropriate areas. Strategy 1C: Remove regulatory barriers to meet market demand for different housing types. Therefore, it is recommended that this Text Amendment request be APPROVED. Sales are limited to existing, permitted lots 2. All associated manufactured homes shall be properly permitted in accordance with the requirements of Harnett County and the State of North Carolina 3. Display of model homes and surplus inventory is prohibited G. Prohibited Uses & Structures No part of the park shall be used for nonresidential purposes, excluding facilities related to the maintenance of the park and facilities used as a dedicated office for the purpose of renting, leasing, or selling of a manufactured home for which the park owner holds the title and for which all permits and approvals required by law to install the manufactured home have been obtained. The following uses and structures shall be prohibited within manufactured home parks: 1. The transfer of a manufactured home space or spaces either by sale or by any other means within a manufactured home park 2. The storage of abandoned or junk vehicles 3.
