FINANCE OFFICER’S RECOMMENDATION: COUNTY MANAGER’S RECOMMENDATION: Item 8H HCBOC 080326 Pg. 78 1 BYLAWS OF HARNETT COUNTY ANIMAL SERVICES ADVISORY COMMITTEE ARTICLE I NAME The Harnett County Board of Commissioners desire to establish a body to be called the Harnett County Animal Services Advisory Committee. It is hereinafter referred to as the “Committee”. ARTICLE II PURPOSE The duties and responsibilities of the Committee shall be to advise the Harnett County Board of Commissioners (hereinafter referred to as the “Commissioners”) on matters affecting the care, treatment, and impounding of animals in Harnett County. Such responsibilities include, but are not limited to: 1.To review and evaluate, on an on-going basis, animal-related issues, needs, and services in Harnett County. 2.To coordinate with Animal Services to support Harnett County initiatives and provide support for responsible animal ownership including assisting and coordinating with any county-wide public information programs. 3.To support education for the public regarding animal care, responsible animal ownership, and policies that support these objectives. 4.To coordinate activities with other agencies and boards, including a strong emphasis on adoption of animals and spay and neuter services. 5.To report to the Harnett County Board of Commissioners upon request, on animal issues within Harnett County. The Committee shall neither be responsible for nor authority over the day-to-day operations of Animal Services or personnel matters. ARTICLE III MEMBERSHIP Section 1. Members Membership on the Committee shall be limited to seven voting (7) members appointed as follows: 1.A member representing each of the County’s five voting districts selected by the Commissioners. HCBOC 080326 Pg. 79 2 2. One Veterinarian who lives or works in Harnett County selected by the Commissioners. 3. One member selected by the Animal Services Manager. The Committee shall also contain one ex-officio Harnett County employee member. The voting members, other than the veterinarian, shall be Harnett County residents with knowledge and experience in animal welfare, rescue, advocacy, hunting, or other animal-related experience. Section 2. Terms Committee members shall serve two-year terms, or for the remainder of the unexpired term of a member who has resigned or otherwise vacated their membership position. Committee members shall not be permitted to serve more than three consecutive full terms without an intervening period of one year between appointments. If a Committee member serves three consecutive terms and the Commissioners do not receive any applications from a qualified candidate, the Committee member may be appointed to another term. Section 3. Removal of Members Committee members serve at the pleasure of the Commissioners and may be removed, with or without cause, at any time, by a majority vote of the Commissioners. Section 4. Vacancies in Membership Any vacancy occurring in the membership of the Committee shall be filled by the Commissioners. Members may be reappointed to an additional term in accordance with Section 2 above. Section 5. Voting Members All of the members designated in Section 1, above, shall be voting members of the Committee with the exception of ex-officio members. Section 6. Quorum A majority of all active members present at a meeting shall constitute a quorum of the Committee and an affirmative vote of the majority of the members present at a meeting of the Committee shall be required to constitute official action of the Committee. ARTICLE IV ORGANIZATION Section 1. Officers The regular members of the Committee shall elect among themselves three officers of the Committee, a Chairman, a Vice-Chairman, and a Secretary. The Chairman and Vice-Chairman of the Board shall be elected in the following manner: HCBOC 080326 Pg. 80 3 A. The Chairman, Vice-Chairman, and Secretary shall be elected by the Committee during its first meeting of each year called into session. B. A prospective Chairman, Vice-Chairman, and Secretary must have a minimum of one year experience on the Committee. C. The Chairman, Vice-Chairman, and Secretary shall serve terms of one year in their respective offices and shall be limited to two successive full terms. Section 2. Duties of Officers The responsibilities of the Chairman, Vice-Chairman, and Secretary shall be as follows: A. The Chairman shall preside at meetings, maintain order and proper decorum, and conduct Committee activities as necessary. B. The Vice-Chairman shall assume the responsibilities o the Chairman in his or her absence, when the Chairman is temporarily unable to serve, or as directed by the Chairman. C. The Secretary shall prepare minutes of the meetings and draft reports in accordance with Section 8 below. Section 3. Minutes The Secretary of the Committee shall be the recording secretary to keep minutes of the Committee meetings. Section 4. Appointment Any officer appointed by the Committee serves at the pleasure of the Commissioners and may be removed with or without cause by a majority vote of the Commissioners. Should a vacancy occur in any office as a result of death, resignation, removal, disqualification, or any other cause, the Committee membership may delegate the powers and duties of such office to any officer or to any m ember until such time as a successor for said office is elected and appointed. ARTICLE V MEETINGS Section 1. Regular Meetings The Committee shall meet at least quarterly at a place as shall be designated in the notice of meeting. Designated Harnett County staff shall be present to assist the Committee. Section 2. Special Meetings The Chairman or Commissioners may call such special meetings as may be deemed necessary to carry out the duties of the Committee. HCBOC 080326 Pg. 81 4 Section 3. Hearings The Committee shall hold such hearings as it may deem necessary and desirable at such times and places as may be determined by a majority vote of the Committee at a regular meeting. Section 4. Agenda Any member may request the Chairman to place an item on the agenda. If the Chairman should decline to place a requested item on the agenda, a member may have such item placed on the agenda by submitting it in writing to the Chairman with supporting signatures of three members. Section 5. Rules of Order The deliberations of all meetings of the Committee and its various sub-committees shall be governed by Robert’s Rules of Order, Newly Revised. Section 6. Notice of Meetings All meetings and hearings conducted by the Committee shall be properly noticed pursuant to the Open Meetings laws of the State of North Carolina. Notice of the time, place, and agenda items to be considered at each meeting shall be given in writing to all members at least one week prior to each meeting. Any matters not appearing on the agenda may be considered upon a favorable vote of a majority of the members present to do so. Notice of special meetings and intended agenda items shall be given to all Committee members in writing or by phone at least three days in advance of any special meeting. Section 7. Cancellation of Meetings All meetings, both regular and special, may be cancelled by giving reasonable notice to each member of the Committee and by posting a Notice of Cancellation at the place of meeting. Section 8. Reporting The Committee shall make a report of attendance, key issues discussed, and recommendations to the Commissioners after each quarterly meeting. The report shall be drafted by the Secretary, approved and signed by the Chairman, and submitted to the Clerk to the Commissioners. The Committee shall also report any matters or issues of immediate concern to the County Manager and present such matters to the Commissioners as needed or requested. ARTICLE VI VOTING Section 1. One Vote Ea ch Each voting Committee member, including the Chairman, shall be entitled to one vote. HCBOC 080326 Pg. 82 5 Section 2. Proxy Votes No member shall vote by proxy. Section 3. Abstentions Members may register their abstention on any vote which shall be reflected in the minutes, and members are encouraged to abstain on matters which would pose for them any conflict of interest. Section 4. Determination of Actions All final actions, positions, or policy recommendations shall require the favorable vote of a majority of those members present at a duly called meeting. If the result of a vote results in a tie, the Chairman shall break the tie with their vote. ARTICLE VII AMENDMENTS These bylaws may be altered, amended, or rescinded at any meeting by the vote of two- thirds of all the voting members of the Committee, provided that at least two weeks written notice, including the proposed changes, is given of the intention to alter, amend, or rescind the bylaws at any such meeting. All altered, amended, or rescinded bylaws by the Committee are subject to final approval by the Commissioners. The bylaws may also be altered, amended, or rescinded by a majority vote of the Commissioners. Elderly or disabled property tax homestead exclusion. 9 … 10 (a2) Individual Income Eligibility Limit. – For the taxable year beginning on July 1, 2008, 11 the individual income eligibility limit is twenty‑five thousand dollars ($25,000). For taxable 12 years beginning on or after July 1, 2009, the individual income eligibility limit is the amount for 13 the preceding year, adjusted by the same percentage of this amount as the percentage of any 14 cost‑of‑living adjustment made to the benefits under Titles II and XVI of the Social Security Act 15 for the preceding calendar year, rounded to the nearest one hundred dollars ($100.00). On or 16 before July 1 of each year, the Department of Revenue must determine the individual income 17 eligibility amount to be in effect for the taxable year beginning the following July 1 and must 18 notify the assessor of each county of the amount to be in effect for that taxable year. 19 (a3) Joint Income Eligibility Limit. – The joint income eligibility limit is equal to one 20 hundred fifteen percent (115%) of the income eligibility limit under subsection (a2) of this section 21 for the taxable year. 22 (b)Definitions. – The following definitions apply in this section:23 (1)Code. – The Internal Revenue Code, as defined in G.S. 105-228.90.24 (1a) Income. – All moneys received from every source other than gifts or25 inheritances received from a spouse, lineal ancestor, or lineal descendant. For26 married applicants residing with their spouses, the income of both spouses27 must be included, whether or not the property is in both names.28 (1b) Joint income. – The combined income of both spouses who are married and29 residing together, irrespective of whether the property is in both names.30 (1b)(1c) Owner. – A person who holds legal or equitable title, whether individually,31 as a tenant by the entirety, a joint tenant, or a tenant in common, or as the32 holder of a life estate or an estate for the life of another. When a permanent residence is owned and occupied by 25 two or more persons other than husband and wife, no property tax homestead circuit breaker is 26 allowed unless all of the owners qualify and elect to defer taxes under this section.each qualifying 27 owner is entitled to the property tax relief provided by this section, provided that each owner 28 must apply separately for the relief. 29 (f) Tax Limitation. – A qualifying owner may defer is exempt from paying the portion 30 of the principal amount of tax that is imposed for the current tax year on his or her permanent 31 residence and exceeds the percentage of the qualifying owner's income set out in the table in this 32 subsection. If a permanent residence is subject to tax by more than one taxing unit and the total 33 tax liability exceeds the tax limit imposed by this section, then both the taxes due under this 34 section and the taxes deferred under this section must be apportioned among the taxing units 35 based upon the ratio each taxing unit's tax rate bears to the total tax rate of all units. 36 Income Over Income Up To Percentage 37 -0- Income Eligibility Limit 4.0% 38 Income Eligibility Limit 150% of Income Eligibility Limit 5.0% 39 (g) Temporary Absence. – An otherwise qualifying owner does not lose the benefit of 40 this circuit breaker because of a temporary absence from his or her permanent residence for 41 reasons of health, or because of an extended absence while confined to a rest home or nursing 42 home, so long as the residence is unoccupied or occupied by the owner's spouse or other 43 dependent. 44 (h) Deferred Taxes. – The difference between the taxes due under this section and the 45 taxes that would have been payable in the absence of this section are a lien on the real property 46 of the taxpayer as provided in G.S. 105-355(a). The difference in taxes must be carried forward 47 in the records of each taxing unit as deferred taxes. The deferred taxes for the preceding three 48 fiscal years are due and payable in accordance with G.S. 105-277.1F when the property loses its 49 eligibility for deferral as a result of a disqualifying event described in subsection (i) of this 50 section. Transfer of the residence is not a 4 disqualifying event if (i) the owner transfers the residence to a co-owner of 5 the residence or, as part of a divorce proceeding, to his or her spouse and (ii) 6 that individual occupies or continues to occupy the property as his or her 7 permanent residence. 8 (2) The owner dies. Death of the owner is not a disqualifying event if (i) the 9 owner's share passes to a co-owner of the residence or to his or her spouse and 10 (ii) that individual occupies or continues to occupy the property as his or her 11 permanent residence. 12 (3) The owner ceases to use the property as a permanent residence. 13 (j) Gap in Deferral. – If an owner of a residence on which taxes have been deferred under 14 this section is not eligible for continued deferral for a tax year, the deferred taxes are carried 15 forward and are not due and payable until a disqualifying event occurs. If the owner of the 16 residence qualifies for deferral after one or more years in which he or she did not qualify for 17 deferral and a disqualifying event occurs, the years in which the owner did not qualify are 18 disregarded in determining the preceding three years for which the deferred taxes are due and 19 payable. 20 … 21 (l) Creditor Limitations. – A mortgagee or trustee that elects to pay any tax deferred by 22 the owner of a residence subject to a mortgage or deed of trust does not acquire a right to foreclose 23 as a result of the election. This act is effective for taxes imposed for taxable years beginning on 8 or after July 1, 2026. 9 HCBOC 080326 Pg. 92 RESOLUTION BY THE HARNETT COUNTY BOARD OF COMMISSIONERS IN SUPPORT OF SENATE BILL 2025-349 WHEREAS, Article V, Section 2(2) of the North Carolina Constitution requires uniform property tax rates on all property throughout a particular taxing unit and uniform property tax classifications throughout the entire state; and WHEREAS, ever-increasing real property values and taxes in North Carolina make elderly and disabled citizens vulnerable, as fixed incomes struggle to keep pace with the additional costs of living; and WHEREAS, the Harnett County Board of Commissioners (the “Board”) is committed to the protection of its senior citizens and disabled members of the community to ensure that they can remain in their homes; and WHEREAS, the Board is prohibited from adopting local legislation that would increase income thresholds for elderly or disabled exemptions or from creating new exemptions and exclusions; and WHEREAS, the North Carolina Senate has introduced Senate Bill 2025-349 which would create joint income eligibility tax relief for married couples and eliminate taxes in excess of the circuit breaker rather than defer them; and WHEREAS, the Board recognizes that Senate Bill 2025-349 is an important step in providing property tax relief to elderly and disabled individuals and desires that this bill be made into law. NOW THEREFORE, BE IT RESOLVED that the Harnett County Board of Commissioners adopts this Resolution in support of Senate Bill 2025-349 and respectfully urges the General Assembly to ratify this bill and transmit it to the Governor for his signature. Please place this item under the County Manager Reports section of the agenda at the next available meeting. $550,000 Superb Solutions 15% Sodium Hypochlorite FINANCE OFFICER’S RECOMMENDATION: COUNTY MANAGER’S RECOMMENDATION: Item 9E HCBOC 080326 Pg. 120 1 NORTH CAROLINA WATER TREATMENT CHEMICALS CONTRACT COUNTY OF HARNETT THIS WATER TREATMENT CHEMICALS CONTRACT (“Contract”), is made and entered into as of this 1 day of July, 2026, by and between COUNTY OF HARNETT, for and on behalf of Harnett Regional Water, (hereinafter referred to as “County”), and OLTRIN SOLUTIONS, INC., (hereinafter referred to as “Contractor”). 1.SERVICES TO BE PROVIDED Contractor shall provide and deliver to County 15% Trade Sodium Hypochlorite (“Chemicals”) that conforms to the standards and requirements set forth in this Contract. Purchases by County will be in full tanker truck loads (“TTL”) or any other method agreed upon between Contractor and County. Contractor shall provide a certified copy of chemical analysis upon each delivery and delivery shall be made F.O.B. to Harnett Regional Waters’ p lants as directed at the time the order is placed by County. Deliveries shall be made at such times as requested by County and in such quantities as ordered. Deliveries shall be made by Contractor and shall not subcontract such duties. 2.TERM The Contract Term shall begin on July 1, 2026 and end on June 30, 2027 (hereinafter referred to as the “Initial Term”). County reserves the right to renew this Contract after the expiration of the Initial Term subject to the same terms and conditions upon agreement of both parties, provided that funds have been appropriated by the Harnett County Board of Commissioners and performance under this Contract has been satisfactory. Price increase shall be considered at contract renewal time and may be cause for non-renewal. 3.CONTRACT PRICE Contractor shall provide and deliver Chemicals at the rate of $1.504 per pound Cl2 plus any applicable taxes (“Contract Price”). Contract Price includes loading, unloading, pumping, pallets, and all charges related to delivery. County will consider a reasonable fuel surcharge if spot diesel fuel prices for over the road vehicles rise above $6.00 per gallon for 60 consecutive days. 4.PAYMENT Contractor shall submit an invoice to County for services provided. County will make payments to Contractor upon receipt of and approval of the invoice by the Harnett Regional Water, which shall not exceed 30 days from the receipt of invoice by County. NON-APPROPRIATION Contractor recognizes that County is a governmental entity, and the contract validity is based upon the availability of public funding under the authority of its statutory mandate. In the event that public funds are not available and not appropriated by the Harnett County Board of Commissioners to purchase the Chemicals specified in this Contract, then this Contract shall automatically expire without penalty to County 30 days after written notice to Contractor of the non-appropriation of public funds. Contractor shall be entitled to payment for all conforming Chemicals delivered as of the date of expiration of the Contract for the non-appropriation of funds. 6. PHYSICAL REQUIREMENTS Chemicals shall be a clear, light yellow liquid and shall not contain more than 0.15 percent insoluble matter by weight. 7. CHEMICAL REQUIREMENTS Chemicals shall have a minimum of 125 grams per liter available chlorine equivalent to 12.5 percent sodium hypochlorite by weight for 15% Trade bleach. 8. IMPURITIES a. General. Sodium hypochlorite that meets the requirements of this Contract shall contain no soluble material or organic substances in quantities capable of producing deleterious or injurious effects on the health of those consuming water that has been treated properly with sodium hypochlorite. b. Specific Impurity Limits. The total free alkali (expressed as NaOH) in sodium hypochlorite shall not exceed 1.5 percent by weight. Sodium hypochlorite delivered under this Contract shall meet the following containment concentration limits: • Iron < 0.3 mg/L • Copper < 0.05 mg/L • Nickel < 0.05 mg/L • Bromate < 20 mg/L 9. SAMPLING AND ANALYSIS a. Sampling. Samples requested by a County employee shall be taken by the driver at the point of delivery and in the presence of a County employee. The sample shall be placed in a container that will be provided by County, which shall include a label to be completed by the driver collecting the sample. The sample shall be given to County employee for processing. HCBOC 080326 Pg. 122 3 b. Tank Samples. The sample taken by the driver should be a representative sample of the product delivered. Samples shall be held by County for 30 days before disposal. c. Analysis. No independent analysis of the provided samples will be performed by an outside laboratory unless it is deemed necessary for product verification. A County employee supervising delivery may perform simple tests such as specific gravity, pH or strength of product on the product before it is accepted for offloading into County’s storage vessels. 10. REJECTION a. Notice of Nonconformance. If Chemicals delivered do not meet the requirements of current ANSI/AWWA B300 Standard, County shall provide Contractor with a notice of nonconformance within 10 days of County’s discovery of the nonconformance. County shall have the right to reject all nonconforming Chemicals and shall be immediately removed at no cost to County. b. Material Originating Outside of North America. No Chemicals shall be supplied under this Contract that was manufactured outside of North America without prior written approval of County. Contractor shall inform County, in writing, that the material was manufactured outside of North America, the origin of the material, and certification of conformance with current ANSI/AWWA B300 Standard. 11. AFFIDAVIT OF COMPLIANCE a. Compliance Requirements. County requires: (1) an affidavit from the manufacturer that the Chemicals furnished under the Contract specifications complies with current ANSI/AWWA B300 Standard and (2) a certified analysis of the Chemicals and a certified weight certificate with each shipment. The analysis shall include product content. b. Product Certifications: Sodium hypochlorite is a direct additive used in the treatment of potable water. This material should be certified as suitable for contact with or treatment of drinking water by an accredited certification organization in accordance with ANSI/NSF Standard 60, Drinking Water Treatment Chemicals- Health Effects. Evaluation shall be accomplished in accordance with requirements that are no less restrictive than those listed in ANSI/NSF Standard 60. Certification shall be accomplished by a certification organization accredited by the American National Standards Institute. Sodium hypochlorite is required to be registered with USEPA under FIFRA. HCBOC 080326 Pg. 123 4 12. TRAINING/SAFETY When requested or required, a factory trained representative shall be made available to train County personnel in the use of and/or safety aspects of the equipment or chemical. Contractor shall provide a Safety Data Sheet (“SDS”) for each product prior to the first delivery. Contractor shall be responsible for adhering to all federal, state, and local safety rules and regulations. All Contractor employees shall adhere to all safety practices and use of approved PPE during offloading of chemicals. Contractor shall be responsible for any and all chemical spills during offloading of chemicals (containment, cleanup, and abatement) in accordance with the facility’s written SPCC plan. 13. PACKAGING AND SHIPPING Packaging and shipping shall conform to all applicable local, state, and federal regulations (including USDOT regulations and applicable interstate regulations). 14. LEAKING CONTAINERS DURING SHIPMENT All containers delivered will be inspected for leakage upon arrival and prior to unloading. Leaking containers will not be unloaded and accepted by County. Response and remediation for any containers determined to be leaking shall remain the responsibility of Contractor. 15. CHEMICAL SPILL RESPONSE REQUIREMENTS a. Hazmat Response Teams. Contractor shall furnish the name, address, and telephone number of a qualified Hazmat Response Team. This team shall be supplied by Contractor to cleanup and mitigate a chemical spill caused by Contractor or its designee. The Hazmat Response Team must meet OSHA requirements and be available 24 hours per day, 7 days per week. b. Spill Response. Response to a hazardous material cleanup shall occur within 8 hours of notification by County. Spill mitigation actions taken by County shall not be construed as a replacement for Chemical Spill Response. County’s plant supervisor or authorized designee shall make the determination of need for Hazmat Response Team assistance. Contractor must supply information on response team prior to first shipment. 16. RISK OF LOSS Risk of loss and/or damage shall be upon Contractor until such time as the Chemicals have been physically delivered and accepted by County. HCBOC 080326 Pg. 124 5 17. WARRANTY Contractor warrants that all Chemicals furnished shall be free from all defects and shall conform in all respects to the technical specifications established herein. Contractor expressly warrants that all items are fit and sufficient for their intended purpose. 18. RELATIONSHIP OF THE PARTIES Contractor is an independent contractor of County. Contractor represents that it has or will secure, at its own expense, all personnel required in performing the services under this Contract. Such personnel shall not be employees of or have any contractual relationship with County. All personnel engaged in work under this Contract shall be fully qualified and shall be authorized or permitted under state and local law to perform such services. It is further agreed that Contractor will obey all State and Federal statutes, rules and regulations that are applicable to provisions of the services called herein. Neither Contractor nor any employee of the Contractor shall be deemed an officer, employee or agent of County. 19. COMPLIANCE WITH LAWS Contractor shall obtain and maintain all licenses, permits, liability insurance, and worker’s compensation insurance and comply with any and all other standards or regulations required by federal, state, or county statute, ordinances and rules during the performance of this Contract. 20. INSURANCE Contractor shall obtain, at its sole expense, all insurance required in the following paragraphs, listed below as A, B, & C and shall not commence work until such insurance is in effect and certification thereof has been received by County. a. Workers’ Compensation Insurance - Coverage for all paid and volunteer workers meeting the statutory requirements of The North Carolina Workers’ Compensation Act, North Carolina General Statutes § 97. b. c. Commercial Automobile Liability – Bodily injury and property damage liability insurance in an aggregate amount of at least $1,000,000.00. c. Commercial General Liability – Bodily injury and property damage liability as will protect Contractor from claims of bodily injury or property damages which arise from operations of this Contract. The amounts of such insurance coverage shall not be less than $1,000,000.00 per occurrence and $3,000,000.00 aggregate coverage. The insurance shall include coverage for products/completed operations, personal injury liability and contractual liability. HCBOC 080326 Pg. 125 6 21. INDEMNIFICATION Contractor shall indemnify and hold harmless County, its officers, agents, and employees from and against all loss, cost, damages, expenses (including attorney’s fees), and liability caused by accident or other occurrence resulting in bodily injury, including death and disease to any person, or damage or destruction to property, real or personal, arising directly or indirectly from operations, products, or services rendered or purchased under this Contract. This indemnification requirement set forth in this Article shall survive termination of this Contract. 22. DEFAULT Failure to satisfactorily perform the services required by this Contract will be grounds for County to declare Contractor in default. Unless otherwise provided herein, this Contract may be cancelled or annulled in whole or in part with a 30 day written notice of default by County to Contractor upon nonperformance or violation of the terms of this Contract. An award may be made to another bidder for services specified, or they may be purchased on the open market and Contractor shall be liable to County for costs to County in excess of the defaulted contract prices. Contractor shall continue the performance of this Contract to the extent that any part is not terminated under the provisions of this clause. 23. TERMINATION Notwithstanding any other provision of this Contract, this Contract may be terminated at any time by County, for any reason or no reason, upon 30 days written notice to Contractor. 24. NO WAIVER In the event that either party fails to enforce any obligation of the other party under this Contract when performance is due, such delay or failure to enforce shall not constitute a waiver of its right to seek full performance at any future time. 25. In the event that County consents to Contractor ’s assignment, Contractor shall continue to remain liable notwithstanding such assignment for the future performance of all of the terms, covenants and conditions of this Contract. 27. NOT THIRD PARTY BENEFICIARIES Nothing contained in this Contract shall create a contractual relationship with, or cause of action in favor of, a third party against County or Contractor. 28. ENTIRE AGREEMENT The parties have read this Contract and agree to be bound by all of its terms, and further agree that it constitutes the complete and exclusive statement of the Contract between the parties and supersedes all prior negotiations, representations, or agreements, either written or oral. This Contract may only be amended in writing and signed by County and Contractor. 29. GOVERNING LAW AND VENUE This Contract shall be governed and construed in accordance with the laws of the State of North Carolina. Any action or proceeding arising under this Contract shall be filed and heard in the Superior Court of Harnett County. 30. E-VERIFY Contractor understands that E-Verify is the federal program operated by the United States Department of Homeland Security and other federal agencies, or any successor or equivalent program used to verify the work authorization of newly hired employees pursuant to federal law in accordance with §64-25(5) of the North Carolina General Statutes. Provided that Contractor is a person, business entity, or other organization that transacts business in this State and that employs 25 or more employees in this State, then Contractor understands and certifies that they shall verify the work authorization of the employee through E-Verify in accordance with §64-26(a) of the North Carolina General Statutes.
