ITEM SUMMARY
Consideration of adoption of the annual budget for the upcoming fiscal year as defined by § 159-8:
§ 159-8. Annual balanced budget ordinance.
(a) Each local government and public authority shall operate under an annual balanced
budget ordinance adopted and administered in accordance with this Article. A budget ordinance
is balanced when the sum of estimated net revenues and appropriated fund balances is equal to
appropriations. Appropriated fund balance in any fund shall not exceed the sum of cash and
investments minus the sum of liabilities, encumbrances, and deferred revenues arising from cash
receipts, as those figures stand at the close of the fiscal year next proceeding the budget year. It is
the intent of this Article that, except for moneys expended pursuant to a project ordinance or
accounted for in an intragovernmental service fund or a trust and agency fund excluded from the
budget ordinance under G.S. 159-13(a), all moneys received and expended by a local
government or public authority should be included in the budget ordinance. Therefore,
notwithstanding any other provision of law, no local government or public authority may expend
any moneys, regardless of their source (including moneys derived from bond proceeds, federal,
state, or private grants or loans, or special assessments), except in accordance with a budget
ordinance or project ordinance adopted under this Article or through an intragovernmental
service fund or trust and agency fund properly excluded from the budget ordinance.
(b) The budget ordinance of a unit of local government shall cover a fiscal year
beginning July 1 and ending June 30. The budget ordinance of a public authority shall cover a
fiscal year beginning July 1 and ending June 30, except that the Local Government Commission,

if it determines that a different fiscal year would facilitate the authority's financial operations,
may enter an order permitting an authority to operate under a fiscal year other than from July 1 to
June 30. If the Commission does permit an authority to operate under an altered fiscal year, the
Commission's order shall also modify the budget calendar set forth in G.S. 159-10 through
159-13 so as to provide a new budget calendar for the altered fiscal year that will clearly enable
the authority to comply with the intent of this Part. (1971, c. 780, s. 1; 1973, c. 474, s. 5; 1975, c.

BUDGET ORDINANCE FOR FISCAL YEAR (FY) 2026-2027
BE IT ORDAINED by the Board of Commissioners of the Town of Lillington, North Carolina,
in accordance with G.S. 159-13 of the North Carolina General Statutes, that:
Section 1. General Fund
The following amounts are hereby appropriated in the General Fund for the operation of the
town government and its activities for the fiscal year beginning July 1, 2026, and ending June 30,
2027, in accordance with the chart of accounts heretofore established for the Town:

Section 2. Powell Bill Fund
The following amounts are hereby appropriated in the Powell Bill Fund for the fiscal year
beginning July 1, 2026, and ending June 30, 2027, in accordance with the chart of accounts
heretofore established for the Town:

It is estimated that the following revenues will be available in the Powell Bill Fund for the fiscal
year beginning July 1, 2026, and ending June 30, 2027:

Section 3. Water/Sewer Fund
The following amounts are hereby appropriated in the Water/Sewer Fund for the fiscal year
beginning July 1, 2026, and ending June 30, 2027, in accordance with the chart of accounts
heretofore established for the Town

It is estimated that the following revenues will be available in the Water/Sewer Fund for the
fiscal year beginning July 1, 2026, and ending June 30, 2027:

Section 4. Stormwater Fund
The following amounts are hereby appropriated in the Stormwater Fund for the fiscal year
beginning July 1, 2026, and ending June 30, 2027, in accordance with the chart of accounts
heretofore established for the Town

It is estimated that the following revenues will be available in the Stormwater Fund for the fiscal
year beginning July 1, 2026, and ending June 30, 2027:

Section 5. Board of Commissioners
The following is the salary schedule for the Town of Lillington Board of Commissioners for the
fiscal year beginning July 1, 2026 and ending June 30, 2027:
Mayor $ 2,633
Commissioners $ 1,757
In addition, the Board will receive an insurance stipend at the rate of $1,020.00 per month for FY
2026-2027.
Section 6. Tax Levy
There is hereby levied a tax at a rate of $0.58 (fifty-eight cents) per $100 valuation of property
listed as of January 1, 2026, for the purpose of raising revenues listed as Ad Valorem Tax which
includes Current Year for Property and Motor Vehicle in the General Fund in Section 1 of this
ordinance. The rate of tax, for the purpose of taxation is based upon an estimated valuation of
property $1,044,034,395 a projected levy of $6,055,399 and an estimated collection rate of
99.43%. Motor vehicles estimated valuation of $78,561,176, a projected levy of $455,654 and
an estimated collection rate of 100%. The revenue-neutral tax rate, as defined by G.S. 159-11(e),
is the rate estimated to produce revenue for the next fiscal year equal to the revenue that would
have been produced for the next fiscal year by the current tax rate if no reappraisal had occurred.
The tax rate that would produce the same levy as the current tax rate on the new valuation is
40.13 cents.
Section 7. Insurance
The Board of Commissioners has authorized the Fiscal Year 2026-2027 Budget to include the
following cost sharing for insurance based on the employee’s full-time equivalency (part time
employees will not be eligible).
Employee Only - Health: $ 1,020.03
Dental: $ 35.86
Vision: $ 5.49
Section 8. Fees
The Board of Commissioners hereby declares that all fees that the Town has authority to charge
on July 1, 2026 to be in effect during Fiscal Year 2026-2027 as set forth in Attachment A.

Section 9. Special Authorization – Budget Officer
A.The Town Manager shall serve as Budget Officer
B.The Budget Officer is authorized to effect interdepartmental and intradepartmental
transfers of $1,500 or less. Notification of all transfers shall be made to the Board of
Commissioners at the next regular meeting following the transfer.
Section 10. Document Availability
Copies of this Budget Ordinance shall be furnished to the Budget Officer, Clerk to the Board of
Commissioners and the Finance Officer to be kept on file by them for their direction in the
disbursement of funds.

ORDINANCE FY2026-22
AN ORDINANCE TO AMEND THE LILLINGTON CODE OF
ORDINANCES TO ESTABLISH A STORMWATER UTILITY AND IMPLEMENTING A STORMWATER UTILITY FEE, TO BE BILLED ANNUALLY ON THE PROPERTY TAX BILL
WHEREAS, the management, protection, and regulation of stormwater runoff is necessary to
reduce flooding, erosion, sedimentation, and the discharge of pollutants into surface waters,
thereby protecting the public health, safety, and welfare of the residents of the Town of Lillington;
and
WHEREAS, the development and alteration of land surfaces increases both the quantity and rate
of stormwater runoff and degrades stormwater quality; and
WHEREAS, all developed parcels of real property within the Town contribute to and benefit from
the Town’s stormwater infrastructure, programs, and services; and
WHEREAS, continued compliance with federal and state stormwater regulations requires a
reliable, equitable, and dedicated source of funding; and
WHEREAS, North Carolina General Statute §160A-314 authorizes municipalities to establish
stormwater utilities and to charge fees for stormwater management services;
NOW, THEREFORE, BE IT ORDAINED BY THE TOWN BOARD OF THE TOWN OF
LILLINGTON, NORTH CAROLINA, THAT:
SECTION 1.
The Code of Ordinances of the Town of Lillington is hereby amended to add Chapter 54, entitled
“Stormwater Utility,” to read as follows:
CHAPTER 54 – STORMWATER UTILITY
Sec. 54-1. Purpose.
(a)Stormwater management services and facilities provide a direct benefit to all developed
properties within the Town;

(b)Quality and quantity of stormwater runoff standards mandated by the state and federal
government require local governments develop more detailed and advanced stormwater
programs;
(c)Providing a stable source of funding for the activities heretofore described can best be
accomplished through the creation of a stormwater utility;
(d)G.S. 160A-314 authorizes the town to establish and revise, from time to time, a schedule of
rates and charges to fund the stormwater management program activities including both
structural and natural stormwater conveyance and drainage system services provided by the
stormwater management utility; and
(e)The cost of providing stormwater services is more equitably allocated based on impervious
surface area, which is directly related to stormwater runoff;
(f)The establishment of a stormwater management utility that would be accounted for as a
separate enterprise fund and would facilitate the provision of a stormwater management
program is reasonable and in the public interest.
Sec. 54-2. Establishment of Stormwater Utility and Enterprise Fund.
(a)There is hereby created a Stormwater Utility for the Town of Lillington, which shall be
responsible for planning, regulating, operating, maintaining, repairing, and improving
stormwater systems, facilities, and programs throughout the Town.
(b)There is hereby established a Stormwater Utility Enterprise Fund, into which all stormwater
utility revenues shall be deposited and from which all stormwater utility expenditures shall be
paid.
Sec. 54-3. Jurisdiction and Applicability.
(a)The jurisdiction of the stormwater utility shall extend to all property within the corporate limits
of the Town of Lillington, including property hereafter annexed.
(b)All developed real property, whether public or private, shall be subject to the stormwater utility
fee except as otherwise provided herein.
Sec. 54-4. Definitions.
For purposes of this Chapter:
Built-upon area (BUA) means the portion of a development project that is covered by impervious
or partially impervious surface including, but not limited to, buildings; pavement and gravel areas
such as roads, parking lots, and paths; and recreation facilities such as tennis courts; "built-upon
area" does not include a wooden slatted deck, the water area of a swimming pool, or pervious or

partially pervious paving material to the extent that the paving material absorbs water or allows
water to infiltrate through the paving material, pursuant to N.G.C.S.143-214.7 (b2).
Developed property means real property containing impervious surface.
Equivalent Residential Unit (ERU) means a billing unit used to calculate the stormwater utility
fee.
Impervious surface means any surface that, in whole or in part, restricts or prevents the natural
absorption of water into the ground; such surfaces may include, but are not limited to, gravel,
concrete, asphalt or other paving material, and all areas covered by the footprint of buildings or
structures.
Sec. 54-5. Impervious Surface Area and Equivalent Residential Unit (ERU) Determination.
(a)Impervious surface area on a parcel directly relates to the volume, rate, and pollutant loading
of stormwater runoff discharged from that parcel to the town's structural and natural drainage
systems and facilities. Therefore, impervious surface area shall be the parameter for
establishing a rate structure to distribute the cost of services associated with the operation,
repair, improvement and maintenance of public drainage systems and facilities through a
schedule of rates, fees, charges, and penalties related to the operation of a stormwater
management utility and stormwater management enterprise fund as established in Section 54-
2.
(b)Residential Properties. Each developed residential parcel, including single-family, duplex,
townhouse, and individual residential condominium units, shall be assigned one (1) ERU,
regardless of the amount of impervious surface.
(c)Non-Residential Properties. All non-residential properties, including but not limited to
commercial, industrial, institutional, multifamily residential properties with two (2) or more
dwelling units, and mixed-use properties, shall be assigned one (1) ERU for each 2,850 square
feet of impervious surface area. All non-residential properties will be charged at a minimum
one (1) ERU.
Sec. 54-6. Stormwater Utility Fee.
(a)A stormwater utility fee is hereby imposed on all developed properties within the Town.
(b)The specific rates, charges, rounding standards, and implementation details shall be established
by the Town Board.
(c)The Town Board may revise the stormwater utility fee by ordinance or resolution, as permitted
by law, to ensure adequate funding of stormwater services.

(a)The stormwater utility fee shall be billed annually and collected on the Harnett County property
tax bill for each applicable parcel.
(b)The Town may enter into agreements with Harnett County for the billing and collection of the
stormwater utility fee as permitted by law.
(c)The stormwater utility fee shall constitute a lien on the property in the same manner as property
taxes, to the extent allowed by law.
Sec. 54-8. Exemptions.
(a)Except as provided in this section, no public or private property shall be exempt from
stormwater utility fee or receive a credit or offset against such fees. No exemption, credit,
offset or other reduction in stormwater rates shall be granted based on the age, tax or economic
status, race or religion of the customer, or other condition unrelated to the stormwater
management utility's cost of providing services, systems, and facilities.
(b)Exemptions. The following exemptions shall be allowed:
1.Unimproved parcels containing no impervious surface coverage.
2.Publicly dedicated roads and rights-of-way for vehicular or pedestrian traffic that have
been dedicated to and accepted by the Town of Lillington as public roads.
3.Railroad rights-of-way used for trackage and related appurtenances shall be exempt
from stormwater fees. However, railroad stations, maintenance buildings, or other
developed land used for railroad purposes shall not be exempt from stormwater service
charges.
4.Such other exemptions as may be required by state or federal law.
(c)No exemption shall be granted based solely on tax-exempt status or ownership.
Sec. 54-9. Appeals.
Any property owner who believes the impervious surface calculation or ERU assignment is
incorrect may submit a written appeal to the Town Manager or designee within thirty (30) days of
billing. The decision of the Town Manager shall be final.
Sec. 54-10. Use of Revenues.
All revenues derived from stormwater utility fees shall be used exclusively for stormwater
management purposes, including but not limited to:
(a)Compliance with state and federal stormwater regulations

(b)Operation and maintenance of stormwater infrastructure
(c)Capital improvements
(d)Watershed protection and flood mitigation
Sec. 54-11. Severability.
If a section, subsection, or part of this article shall be deemed or found to conflict with a provision
of North Carolina law, or other pre-emptive legal principle, then that section, subsection, or part
of this article shall be deemed ineffective, but the remaining parts of this article shall remain in
full force and effect.
SECTION 2.
If any provisions of this Ordinance are for any reason held invalid or unconstitutional by any court
of competent jurisdiction, such provision shall be deemed a separate, independent provision and
such holding shall not affect the validity of any other provision thereof, and to that end, the
provisions of this Ordinance are hereby declared to be severable.
SECTION 3.
This Ordinance shall become effective on June 24, 2026, and the Stormwater Utility Fee shall first
be billed beginning with the tax year 2027.
NOW THEREFORE BE IT FURTHER ORDAINED, to add Chapter 54, entitled
Stormwater Utility.
All provisions of any Town Ordinance or Resolution in conflict with this Ordinance are repealed.
