HomeMy WebLinkAbout2026-29 RESOLUTION OF THE HARNETT COUNTY BOARD OF COMMISSIONERS DECLARING ITS INTENT TO RELOCATE BOUNDARY LINES BETWEEN ADJOINING FIRE DISTRICTSRESOLUTION NO. 2026-29 RESOLUTION OF THE HARNETT COUNTY BOARD OF COMMISSIONERS DECLARING ITS INTENT TO RELOCATE BOUNDARY LINES BETWEEN ADJOINING FIRE PROTECTION SERVICE DISTRICTS WHEREAS, pursuant to North Carolina General Statute § 153A-301, the Harnett County Board of Commissioners (hereinafter referred to as the "Board") adopted a resolution on May 16, 2011 to establish fire protection service districts in Harnett County; and WHEREAS, pursuant to North Carolina General Statute § 153A-304.3, the Board may by resolution relocate the boundary lines between adjoining fire protection service districts if the districts were established for substantially similar purposes; and WHEREAS, the Board declares its intent to adopt a resolution to relocate the boundaries of the Coats and Angier Fire Protection Service Districts; and WHEREAS, the Board shall make available to the public a report containing a map showing the current and proposed boundaries of the district, a statement that the proposed boundary relocation meets the requirements of subsection (a) of North Carolina General Statute § 153A-304, a plan for providing service to the area affected by the relocation of district boundaries, and the effect that the changes in the amount of taxable property will have on the ability of the district to provide services or to service any debt; and WHEREAS, the Board calls a public hearing on the matter to hear all interested persons prior to taking action on this request; and NOW, THEREFORE BE IT RESOLVED by the Harnett County Board of Commissioners as follows: 1. It is declared to be the intent of the Harnett County Board of Commissioners to approve the relocation of the boundary lines between the Coats and Angier Fire Protection Districts. 2. A report was made available for public inspection in the office of the clerk of the Harnett County Board of Commissioners and on the Harnett County webpage www.harnett.org. Said report shall contain a map showing the current and proposed boundaries of the district, a statement that the proposed boundary relocation meets the requirements of subsection (a) of North Carolina General Statute § 153A-304, a plan for providing service to the area affected by the relocation of district boundaries, and the effect that the changes in the amount of taxable property will have on the ability of the district to provide services or to service any debt for at least two weeks before the date of the public hearing. 3. A public hearing on the proposed relocation of the Coats and Angier Fire Protection Districts boundary lines shall be conducted by the Harnett County Board of Commissioners at 6:00 p.m. on the 151 day of June, 2026, at which time the Board shall hear all interested persons who appear with respect as to whether the Board should adopt the proposed boundary lines. In Harnett County, the North Carolina Office of State Fire Marshal is responsible for conducting regular inspections of our contracted fire departments as part of the North Carolina Response Rating System (NCRRS). The NCRRS rating system ranges from one (highest) to 10 (lowest, not recognized as a certified fire department by the state). Higher ratings can significantly lower homeowners' insurance rates in that fire district. Properties that are more than six road miles from a responding station shall be given a public protection classification rating of "PPC 10". Due to construction since the establishment of our fire districts, these parcel(s) along the Angier Black River Fire Service District and Coats Grove Fire Service District lines, currently three properties are beyond six road miles from the responsible fire department. Therefore, classifying these properties a "PPC 10". To better serve our citizens', I am respectfully requesting we change Angier Black River Fire Department, Service District (see Exhibit -A) and Coats Grove Fire Department, Service District (see Exhibit-B) to afford the affected property owners lower insurance rates. County of Harnett currently contracts with both departments to provide fire protection services in these districts. These service districts were established for and continue to provide substantially similar services. Angier Black River Fire Service District and Coats Grove Fire Department Service Districts, were established upon a finding that there was a demonstrable need for providing fire protection services within the areas of the districts, that it was impossible or impracticable to provide fire protection services on a county -wide basis, that it was economically feasible to provide fire protection service for the districts without unreasonable or burdensome annual tax levies, and that there was a demonstrable demand for fire protection services by persons residing in the districts. County of Harnett contracts with Angier Black River and Coats Grove Fire Departments to furnish fire protection services, facilities and functions pursuant to the standards set forth by the North Carolina Department of Insurance, County of Harnett and all other pertinent federal, state, and local laws and regulations within the boundaries of their fire protection service districts. Their Fire Protection Districts will be defined in the attached maps of the Fire Protection District and on record with the Clerk to the Harnett County Board of Commissioners and in the GIS/Land Records Management of Harnett County. The only change in response will be on single station responses, such as woods, brush, grass, and vehicle fires. These types of incidents only require response from the primary fire district in which the parcel lies. Angier Black River Fire Department operates on a $.085 tax levy per $100 valuation. Coats Grove Fire Department operates on a $.11 tax levy per $100 valuation. These changes will result in an approximate $1,250 increase in revenue for Angier Black River Fire Department based on current real property tax values and a decrease of approximately $1,650 for Coats Grove Fire Department. These changes should have minimal fiscal and operational impacts on the affected fire departments while providing an unswerving service to our homeowners at an equal or lower PPC. In addition, I have attached SS 153A-304.3, a combined map of the fire protection service districts as well as the current district line for your review and clarification. (a) Changes. — The board of county commissioners may by resolution relocate the boundary lines between adjoining county service districts if the districts were established for substantially similar purposes. The boundary lines may be changed in accordance with a petition from landowners or may be changed in any manner the board deems appropriate. Upon receipt of a request to change service district boundaries, the board of county commissioners shall set a date and time for a public hearing on the request prior to taking action on the request. (b) Report. — Before the public hearing required by subsection (a) of this section, the board of county commissioners shall cause to be prepared a report containing all of the following: (1) A map of the service district and the adjacent territory showing the current and proposed boundaries of the district. (2) A statement indicating that the proposed boundary relocation meets the requirements of subsection (a) of this section. (3) A plan for providing service to the area affected by the relocation of district boundaries. (4) The effect that the changes in the amount of taxable property will have on the ability of the district to provide services or to service any debt. The report shall be available for public inspection in the office of the clerk of the board for at least two weeks before the date of the public hearing. (c) Notice and Hearing. — The board shall hold a public hearing before adopting any resolution relocating the boundaries of a service district. Notice of the hearing shall state the date, hour, and place of the hearing and its subject, and shall include a statement that the report required by subsection (b) of this section is available for inspection in the office of the clerk to the board. The notice shall be published at least once not less than one week before the date of the hearing. (d) Effective Date. — The resolution changing the boundaries of the districts shall take effect at the beginning of a fiscal year commencing after its passage, as determined by the board. G.S. 153A-304.3 Page 1 NOTICE OF PUBLIC HEARING ON PROPOSED RESOLUTION OF THE HARNETT COUNTY BOARD OF COMMISSIONERS TO RELOCATE BOUNDARY LINES BETWEEN ADJOINING FIRE PROTECTION SERVICE DISTRICTS The Harnett County Board of Commissioners believes that it is in the best interest of the affected property owners of the Angier Black River Fire District and Coats Grove Fire Protection Districts to relo- cate a portion of the boundaries of these districts. A copy of the re- port as required by 153A-304.3(b) for the proposed relocation may be reviewed at the Office of the Clerk to the Board of Commission- ers, 455 McKinney Parkway, Lillington, North Carolina during regular business hours of 8:00a.m. to 5:00p.m. Monday through Friday. A public hearing will be held by the Harnett County Board of Com- missioners on Monday, June 15, 2026, at 6:00 p.m. in the Commissioners' Meeting Room, Harnett County Resource Center & Library, 455 McKinney Parkway, Lillington, North Carolina. Any person who wishes to be heard concerning the proposed Res- olution to relocate boundary lines between adjoining fire protection service districts will be able to address the Board at that time. 5/29/2026
