Following the public hearing, the Board of Commissioners may consider adopting a Resolution of Intent to Relocate Boundary Lines between Adjoining Fire Protection Service Districts. 8.Public Hearing – Harnett County FY 2026-2027 Budget A proposed budget for the fiscal year beginning July 1, 2026, for Harnett County, North Carolina, was presented to the Harnett County Board of Commissioners on May 4, 2026. The proposed budget, including expenditures for the Harnett County Economic Development Department, is available in the office of Clerk to the Board, 455 McKinney Parkway, Lillington, North Carolina, for public inspection. The proposed budget is also available for public inspection online at www.harnett.org under “What’s New.” The total expenditures budgeted for economic development matters is $1,088,774. Members present: Duncan E. Jaggers, Chairman Matthew B. Nicol, Vice Chairman Barbara McKoy, Commissioner William Morris, Commissioner W. Brooks Matthews, Commissioner Staff present: Brent Trout, County Manager Dwight Snow, County Attorney Kimberly Honeycutt, Finance Officer Melissa Capps, Clerk Chairman Jaggers called the meeting to order at 9:00 am. Commissioner Matthews led the Pledge of Allegiance and provided the invocation. Eric Truesdale, Veterans Services Director, presented information regarding the Harnett County Heroes Remembrance recognition. We are recognizing and honoring veterans that appear on our Wall of Heroes. These individuals have received awards for acts of individual heroism, not as a unit. Mr. Truesdale read Staff Sergeant Jon R. Walker’s citation. Commissioner Matthews made a motion to approve the agenda as published . The motion was seconded by Commissioner Morris and carried unanimously. Chairman Jaggers opened the public comment period and the following people spoke: 1.Alan Longman of 234 Hamilton Road, Bunnlevel, NC. 2.Larry Mitchell of 478 Century Drive, Cameron, NC. 3.Elizabeth Longman of 234 Hamilton Road, Bunnlevel, NC . 4.Jerry Rivas of 364 Twin Ponds Road, Sanford, NC. Chairman Jaggers requested a copy of the video recording. Chairman Jaggers states that is the fourth time Mr. Rivas said that Commissioner Nicol and I have taken money from a company and we are going to take care of that. No one else spoke and the public comment period was closed. Item 6A HCBOC 061526 Pg. 4 Harnett County Board of Commissioners Regular Meeting Minutes June 1, 2026 Page 2 of 8 Commissioner Matthews made a motion to approve the consent agenda. The motion was seconded by Commissioner McKoy and carried unanimously. The following item was on the consent agenda: A. Meeting Minutes of May18, 2026 Kimberly Whitted, Juvenile Crime Prevention Council (JCPC) Chairperson, reviewed a request from the Juvenile Crime Prevention Council (JCPC) for permission to submit county plan program agreements for the North Carolina Department of Public Safety, Juvenile Crime Prevention Council programs for FY 2026-2027. The Harnett County Juvenile Crime Prevention Council (JCPC), in fulfillment of the duties and responsibilities as set forth in the General Statutes of the State of North Carolina, has reviewed and updated this County Plan for FY 2026-2027. In 2019, House Bill 593 passed which approved an optional 1 or 2-year funding cycle for DPS JCPC funds, which is determined locally by each JCPC statewide. Also included in the HB was Raise the Age in N.C. which directs 16- & 17-year- olds from District Court to Juvenile Court. In order to see any new possible trends in juvenile justice data (now serving 16- & 17-year-olds) and to plan programming in the community accordingly, the Harnett County JCPC approved a 2-year funding cycle. Data continues to be monitored by the JCPC annually, which provides direction to which funding cycle is most beneficial to the community and Council. The JCPC has identified the issues and factors which have an influence and impact upon vulnerable youth, at-risk youth, delinquent youth, and their families in Harnett County. Further, the JCPC has identified the strategies and services most likely to reduce/prevent delinquent behavior. Monitoring and Evaluation: Each program funded in the past fiscal year by the JCPC has been monitored by the JCPC Monitoring Committee and programs were found in full compliance with DPS JCPC Policy and within the operating parameters of their budget and providing the services as described in their program agreement. The monitoring results and program outcome evaluations were considered in making funding allocation decisions. The JCPC will continue to conduct annual implementation monitoring of its funded programs. Priorities for Funding for FY 25-26 through 26-27 Biennium: Through a review of risk & needs assessment data, the Youth Assessment Screening Inventory (YASI) data and a community resource assessment, the JCPC has determined that the following services are needed to reduce/prevent delinquency in Harnett County. 1. Parent/Family Skill Building 2. Interpersonal Skill Building 3. Vocational Skills 4. Tutoring/Academic Enhancement 5. Mediation/Conflict Resolution 6. Restitution/Community Service 7. Teen Court 8. Services Addressing Problem Sexual Behavior 9. Juvenile Structured Day programs HCBOC 061526 Pg. 5 Harnett County Board of Commissioners Regular Meeting Minutes June 1, 2026 Page 3 of 8 Funding Recommendations: Having advertised a Request for Proposals (RFP) for these needed services for a minimum of thirty (30) days on 12/9/2024 for biennium service delivery, the JCPC has reviewed submitted proposals and has determined that the existing funding partners continue to provide services to address the need with the funding available. As required by statute, the JCPC recommends allocation of the NC Department of Public, Division of Juvenile Justice and Delinquency Prevention funds to the following programs in the amounts specified below for the 26-27 fiscal year (see the Harnett County Funding Plan with this report): 1. Harnett County Juvenile Restitution/Community Service and Teen Court Programs: $138,485 2. Harnett County Sheriff's Department PAL Program: $68,250 3. Dunn PAL School Kids in Power (SKIP) and Career Readiness: $108,310 The JCPC further recommends that the following amount be allocated for the administrative costs of the Council for fiscal year 26-27: $5,000. Ms. Whitted stated we have been receiving the same amount of funding for a number of years, ever since I’ve been serving on the JCPC, probably about 10 years. We have with your help, requested additional funds form the state, because we have ani increasing population in the County that includes juveniles, which includes the number of services we need to provide. If that funding does not increase from the state, it makes it harder for us to fully fund the programs in their abilities to provide these services. That also could mean that we need to have more funding that comes from the County to counter these increasing costs. As we all know, costs have increased for salaries, for services, for materials and supplies, and these providers that provide key services for the county are feeling that pressure, as their costs increase and they are looking for additional funding. Commissioner McKoy stated I serve on this committee and they do outstanding work for the juveniles in this County. The money that is spent on keeping these kids out of incarnation is well spent. Thank you for the job you do. Vice Chairman Nicol made a motion to approve the request from the Juvenile Crime Prevention Council (JCPC) for permission to submit county plan program agreements for the North Carolina Department of Public Safety, Juvenile Crime Prevention Council programs for FY 2026-2027. The motion was seconded by Commissioner Matthews and carried unanimously. Larry Smith, Emergency Services Director, reviewed a request for the approval of the Fireworks application from Pyro Shows East Coast, for Anderson Creek Club fireworks display. Pyro Shows East Coast meets all safety requirements related to fire code compliance. The events will take place on June 27th at 9:15 p.m. Vice Chairman Nicol made a motion to approve the Fireworks application from Pyro Shows East Coast, for Anderson Creek Club fireworks display. The motion was seconded by Commissioner Morris and carried unanimously. Mr. Smith also reviewed a request for the approval of the Fireworks application from Pyro Shows East Coast, for the Town of Erwin fireworks display. Pyro Shows East Coast meets all safety requirements related to fire code compliance. The events will take place on July 3rd at 9:15 p.m. at Woodall Park. The motion was seconded by Commissioner Morris and carried unanimously. Mr. Smith also reviewed a request for approval of the Fireworks application from Pyro Shows East Coast, for the Town of Lillington fireworks display. Pyro Shows East Coast meets all safety requirements related to fire code compliance. The events will take place on July 3rd at 9:15 p.m. Vice Chairman Nicol made a motion to approve the Fireworks application from Pyro Shows East Coast, for the Town of Lillington fireworks display. The motion was seconded by Commissioner McKoy and carried unanimously. Seann Byrd, Harnett Regional Water Assistant Director reviewed a request for the Board of Commissioners to review and consider the recommendation to award a contract for the St Matthews Rd. Utility Extension Sewer Project to TA Loving in the amount of $1,153,115.00, being the lowest responsive, responsible bidder. When the bid was advertised, six vendors attended a pre-bid meeting and five bids were received. The sewer portion of the project will connect two parallel sewer interceptors to provide additional capacity to the southern side of Erwin. Funding will be a mix of reserves and an ARPA grant. Upon approval, the Board of Commissioners will issue a Resolution of Notice of Intent to Award. Commissioner McKoy asked if there was any match. Mr. Bryd stated the ARPA grant was for $1,000,000 and we are about $400,000 into that grant right now. So the $600,000 that is left over will be used for this project. Commissioner McKoy made a motion to approve. The motion was seconded by Commissioner Matthews and carried unanimously. (Attachment 1) Mr. Bryd also reviewed a request to review and consider the recommendation to award a contract for the US421 Utility Extension 2026 to Lorman, Inc in the amount of $139,444.60, being the lowest responsive, responsible bidder. When the bid was advertised, two bids were received for the informal construction project. The project consists of installation of approximately 615-linear feet of 8-inch water line with appurtenances, a sewage package pump station, 2- inch parallel force mains with appurtenances, and site restoration including full depth patch of St. Matthews Road. Commissioner Matthews made a motion to approve the recommendation to award a contract for the US421 Utility Extension 2026 to Lorman, Inc in the amount of $139,444.60, being the lowest responsive, responsible bidder. The motion was seconded by Commissioner Morris and carried unanimously. Christine Wallace, Tax Administrator presented information regarding a request to purchase Comper software for appraisal purposes in the amount of $73,420. Comper Pro is a GIS based software that: • Provides real time data for current and accurate property information • Citizen transparency in a user-friendly format • Comper Pro integrates with appraisal software and GIS to provide information – o Sales Comparable o Sales Searches o Assessment Analysis o Data Access o Appeals HCBOC 061526 Pg. 7 Harnett County Board of Commissioners Regular Meeting Minutes June 1, 2026 Page 5 of 8 Additional discussion included concerns regarding reappraisal and appeals process, cost of software and yearly subscription cost and streamlining process. Ms. Wallace stated she would come back and do a public presentation once the software is installed. Vice Chairman Nicol made a motion to approve the request to purchase Comper software for appraisal purposes in the amount of $73,420. The motion was seconded by Commissioner Morris and carried unanimously. A list of the expansion requests were also provided to the Board. A copy of the presentation and expansion list is attached to the minutes as Attachment 2 and Attachment 3. Additional discussion included proposed schools included in the budget (Highland High School and CTW High School), Social Services additional positions requested, and the potential impacts of Senate Bill 889. Ainsley Johnson, Health Director, presented information regarding a request to amend the appointment of Dr. Terrill Brown on the Board of Health. Pursuant to the authority set forth in G.S. 130A 35 and G.S. 90, Article 1, and following consultation with Harnett County legal counsel and UNC’s School of HCBOC 061526 Pg. 9 Harnett County Board of Commissioners Regular Meeting Minutes June 1, 2026 Page 7 of 8 Government, I request that Dr. Terrill Brown’s appointment to the Board of Health be amended to the public member seat. We recently had a vacancy of this seat on May 28th. Dr. Brown is in agreement with this request and we look forward to his experience and knowledge that he will bring to our board. So at this time, I request to amend the appointment of Dr. Terrill Brown to the public member seat instead of the physician seat. He will serve out the term of the existing public member seat which is December of 2027 and then at that time be eligible for reappointment. Commissioner Morris made a motion to approve amendment of Dr. Terrill Brown’s appointment to the public member seat. The motion was seconded by Vice Chairman Nicol and carried unanimously. Ms. Johnson requested the Board accept the resignation of Amy Brown from the public member position with a resignation date of May 28th. Commissioner Morris made a motion to accept the resignation of Amy Brown from the Board of Health from the public member position as of May 28, 2026. The motion was seconded by Vice Chairman Nicol and carried unanimously. The Board of Commissioners reviewed applications to serve on boards and committees. Vice Chairman Nicol made a motion to reappoint Kathy Weeks to the Harnett County Public Library Board of Trustees as the Town of Coats liaison. The motion was seconded by Commissioner Matthews and carried unanimously. Vice Chairman Nicol made a motion to appoint Paul Polinski to the Social Services Board as the Commissioner appointee position. The motion was seconded by Commissioner Morris and carried unanimously. Brent Trout, County Manager shared department accomplishments. Solid Waste hosted a hazardous household waste and paper shredding event on Saturday May 15th. HARTS competed in the 2026 NC Public Transportation Association Rodeo April 25th and Cresent Braswell, a returning operator placed 5th as an individual competitor. Richard Nicely also attended and placed 14th out of 63 operators from all over the state. May was Mental Health Awareness Month; Human Resources offered a lot of activities. Commissioner Morris made a motion to approve the budget amendments as requested by the Finance Officer. The motion was seconded by Vice Chairman Nicol and carried unanimously. (Attachment 4) Commissioner Morris made a motion to approve contract amendments that exceed the manager’s signature threshold for Tyco Technology dba Johnson Controls and Holand Industrial. The motion was seconded by Commissioner McKoy and carried unanimously. Vice Chairman Nicol made a motion in order to confirm with open meeting laws, the Board of Commissioners following this meeting take a tour of the Detention Center. Commissioner Morris seconded the motion. Chairman Jaggers asked if we would recess the meeting and convene at the Detention Center, Mr. Trout stated yes sir. Motion carried unanimously. Commissioner Morris made a motion to convene into Closed Session to discuss a certain personnel matter. This motion is made pursuant to NC General Statute 143-318.11 (a) (6). The motion was seconded by Vice Chairman Nicol and carried unanimously. Following a motion to come out of Closed Session, Chairman Jaggers called the meeting back to order in open session and recessed the meeting to reconvene at the Detention Center for a tour. Members present: Duncan E. Jaggers, Chairman Matthew B. Nicol, Vice Chairman Barbara McKoy, Commissioner William Morris, Commissioner W. Chairman Jaggers requested from this point forward, monthly reports about compliance of all the regulations we have so we know we are continually being in compliance and what the status of the shelter is. Commissioner McKoy requested a copy of the report for all commissioners. Vice Chairman Nicol stated we definitely do not want to bring anything going on like this into the new shelter. Vice Chairman Nicol stated we need some proactive measures taken. Commissioner Matthews stated I understand we are investigating, the main question I would like answered is how we could have been alerted to this earlier and then why nothing happens in regards to what we alerted to. Commissioner Morris stated I would say the manager needs to be notified within one business day and then at his earliest convenience notify the commissioners. Additional discussions included volunteers, policies, and procedures. Eric Truesdale, Veteran Services Director, requested the Heroes Remembrance be postponed. Ainsley Johnson, Health Director, Belinda Rayner, Public Health Administrator/PIO and Dr. David Tillman, Associate Professor and Chair of Department of Public Health at Campbell University presented information regarding the 2025 Community Health Assessment. (Attachment 2) Sarah Williford, Safety and Risk Manager, reviewed a request to approve the newly developed Harnett County Safety Committee Policy. Vice Chairman Nicol made a motion to approve the Harnett County Safety Committee Policy. The motion was seconded by Commissioner Morris and carried unanimously. (Attachment 3) Kenneth Snipes, Facility Maintenance Director, reviewed a request to award a bid to Johnson Brothers for resealing and repairing of various county parking lots. This was an informal bid, and only one bid was received from Johnson Brothers Utility and Paving out of Lillington. Commissioner McKoy made a motion to award a bid to Johnson Brothers for resealing and repairing of various county parking lots. The motion was seconded by Vice Chairman Nicol and carried unanimously. Stephen Barrington, Economic Development Director, introduced Andy Mills with Colliers Engineering. Mr. Mills reviewed a request to identify suitable routes to county property off of Hwy 87. The due diligence activities performed by Colliers Engineering has identified two suitable routes for future roads to serve the site. The first access point identified off Hwy 87 may allow for a combination of an existing easement and the acquisition of additional right-of-way for a new road to the County’s property. A second route is identified off Nursery Road requiring an easement across adjacent property. We are requesting the Board of Commissioners approval, in conjunction with the County Manager and or designees: 1. To further investigate recommended land acquisition and corresponding cost estimates; and 2. To initiate contact with Fort Bragg regarding approval of an easement for a future road to the County property. Vice Chairman Nicol shared he believes Fort Bragg has already been contacted regarding the approval of an easement for this property. Vice Chairman Nicol requested the Board consider adding him as a designee with the County Manager to work on this project. Brent Trout, County Manager, provided an update on a few items regarding the FY 26-27 Recommended Budget. Items included: 1. Legislative Update • Senate Bill 889 is scheduled for a hearing today at 2:00 p.m. before the House State and Local Government Committee. Staff will continue to monitor the bill's progress and evaluate any potential budgetary impacts for the County. 2. Education Funding (Harnett County Schools) • Harnett County Schools has requested an additional $500,000, bringing their total current expansion request to $6,000,000 for FY 2027. 3. Recommended Staffing Adjustments • Board of Commissioners requested information on the cost to provide an additional two (2) Animal Care Technician positions. The total cost is $120,422. • These positions are necessary to meet increased service demands and enhance overall animal care and shelter operations. 4. Capital Projects (Weapons Detection System) • Staff is still waiting for a formal quote for the weapons detection system. • To keep the project moving forward, staff recommends transferring $500,000 to Capital Reserves to begin implementation in FY 2027. 5. Board Guidance Requested • Staff requests direction from the Board on whether to add or remove any expansion items from the Recommended Budget. 6. Next Steps • Once the Board identifies any additional changes, staff will incorporate all updates and present funding options at the June 15th meeting. Mr. Trout presented information regarding a request that the Board consider selecting two ex-officio members from the Board of Commissioners and designate a chairperson per the bylaws for the Harnett County First Responders Advisory Committee. Commissioner McKoy stated I hope things continue to move forward and not backwards. A lot of factors are being considered, they have to be considered. I believe in moving swiftly, staff knows that. I felt like the county motto was let’s table it till next time and hopefully through action, we have changed that tone. This entire Board, if people have noticed, we are getting things done. This Board I believe is on the same page, we are able to talk and collaborate together to get things done. We do have staff that handles administrative things, you know, and we rely on them. They are hired to do their jobs. The past tells us definitely we need to take into consideration a lot of things before making a quick decision because as you see with lowering a levy rate but you do not see the implications of losing low wealth funding. We are working diligently, may not be as fast as everyone wants to see it. The wheels of government turn slowly, but they’re not fueled by excuses anymore. I appreciate everybody. Thank you. Commissioner McKoy thanked Vice Chairman Nicol for his comments and stated I think we need to take more time and more energy in making decisions before we go moving forward with stuff. The Board is doing a good job now and we do have a lot of projects going on. Harnett County is a growing County and we have to find a way to keep up. Chairman Jaggers stated last meeting, I watched Vice Chairman Nicol text Aaron about going over to the Detention Center. The whole pretense of that was planned, I laugh at that stuff sometimes. We will help if we can, and if we know what is going on we will be glad to address issues in the County. We are willing and more than glad to help with any issues going on in this County. In Harnett County, the North Carolina Office of State Fire Marshal is responsible for conducting regular inspections of our contracted fire departments as part of the North Carolina Response Rating System (NCRRS). The NCRRS rating system ranges from one (highest) to 10 (lowest, not recognized as a certified fire department by the state). Higher ratings can significantly lower homeowners’ insurance rates in that fire district. Properties that are more than six road miles from a responding station shall be given a public protection classification rating of “PPC 10”. Due to construction since the establishment of our fire districts, these parcel(s) along the Angier Black River Fire Service District and Coats Grove Fire Service District lines, currently three properties are beyond six road miles from the responsible fire department. Therefore, classifying these properties a “PPC 10”. To better serve our citizens’, I am respectfully requesting we change Angier Black River Fire Department, Service District (see Exhibit-A) and Coats Grove Fire Department, Service District (see Exhibit-B) to afford the affected property owners lower insurance rates. County of Harnett currently contracts with both departments to provide fire protection services in these districts. These service districts were established for and continue to provide substantially similar services. Angier Black River Fire Service District and Coats Grove Fire Department Service Districts, were established upon a finding that there was a demonstrable need for providing fire protection services within the areas of the districts, that it was impossible or impracticable to provide fire protection services on a county-wide basis, that it was economically feasible to provide fire protection service for the districts without unreasonable or burdensome annual tax levies, and that there was a demonstrable demand for fire protection services by persons residing in the districts. County of Harnett contracts with Angier Black River and Coats Grove Fire Departments to furnish fire protection services, facilities and functions pursuant to the standards set forth by the North Carolina Department of Insurance, County of Harnett and all other pertinent federal, state, and local laws and regulations within the boundaries of their fire protection service districts. Their Fire Protection Districts will be defined in the attached maps of the Fire Protection District and on record with the Clerk to the Harnett County Board of Commissioners and in the GIS/Land Records Management of Harnett County. Angier Black River and Coats Grove Fire Departments HCBOC 061526 Pg. 65 are currently and will continue being dispatched on the first alarm, to all structure fires on the affected properties. The only change in response will be on single station responses, such as woods, brush, grass, and vehicle fires. These types of incidents only require response from the primary fire district in which the parcel lies. Angier Black River Fire Department operates on a $.085 tax levy per $100 valuation. Coats Grove Fire Department operates on a $.11 tax levy per $100 valuation. These changes will result in an approximate $1,250 increase in revenue for Angier Black River Fire Department based on current real property tax values and a decrease of approximately $1,650 for Coats Grove Fire Department. These changes should have minimal fiscal and operational impacts on the affected fire departments while providing an unswerving service to our homeowners at an equal or lower PPC. Changes in adjoining service districts. (a) Changes. – The board of county commissioners may by resolution relocate the boundary lines between adjoining county service districts if the districts were established for substantially similar purposes. The boundary lines may be changed in accordance with a petition from landowners or may be changed in any manner the board deems appropriate. Upon receipt of a request to change service district boundaries, the board of county commissioners shall set a date and time for a public hearing on the request prior to taking action on the request. (b) Report. – Before the public hearing required by subsection (a) of this section, the board of county commissioners shall cause to be prepared a report containing all of the following: (1) A map of the service district and the adjacent territory showing the current and proposed boundaries of the district. (2) A statement indicating that the proposed boundary relocation meets the requirements of subsection (a) of this section. (3) A plan for providing service to the area affected by the relocation of district boundaries. (4) The effect that the changes in the amount of taxable property will have on the ability of the district to provide services or to service any debt. The report shall be available for public inspection in the office of the clerk of the board for at least two weeks before the date of the public hearing. (c) Notice and Hearing. – The board shall hold a public hearing before adopting any resolution relocating the boundaries of a service district. Notice of the hearing shall state the date, hour, and place of the hearing and its subject, and shall include a statement that the report required by subsection (b) of this section is available for inspection in the office of the clerk to the board. The notice shall be published at least once not less than one week before the date of the hearing. (d) Effective Date. – The resolution changing the boundaries of the districts shall take effect at the beginning of a fiscal year commencing after its passage, as determined by the board. It is declared to be the intent of the Harnett County Board of Commissioners to approve the relocation of the boundary lines between the Coats and Angier Fire Protection Districts. 2. Said report shall contain a map showing the current and proposed boundaries of the district, a statement that the proposed boundary relocation meets the requirements of subsection (a) of North Carolina General Statute § 153A-304, a plan for providing service to the area affected by the relocation of district boundaries, and the effect that the changes in the amount of taxable property will have on the ability of the district to provide services or to service any debt for at least two weeks before the date of the public hearing. 3. FINANCE OFFICER’S RECOMMENDATION: COUNTY MANAGER’S RECOMMENDATION: Item 9C HCBOC 061526 Pg. 91 1 INTERLOCAL COOPERATION AGREEMENT FOR THE COLLECTION OF TAXES BETWEEN HARNETT COUNTY AND THE TOWN OF LILLINGTON This Agreement, made and entered into on this the ____ day of ____________, 2026 between County of Harnett, a body politic and corporate, organized and existing under the laws of the state of North Carolina, hereinafter referred to as “County” and the Town of Lillington, a North Carolina municipal corporation organized and existing under the laws of the State of North Carolina, hereinafter referred to as “Town”; WITNESSETH: WHEREAS, the governing bodies of the County and Town have found and determined that it is in the public benefit and interest to provide for the collection by the County of real and personal property taxes levied by Town as well as certain special assessments assessed by Town, gross receipts taxes on vehicle rentals and leases, gross receipts taxes on heavy equipment rentals and leases, and certain motor vehicle taxes and fees; and WHEREAS, the North Carolina General Statutes in Chapter 160A, Article 20, Part I, provide that units of local government may enter into an agreement in order to execute an undertaking providing for the contractual exercise by one unit of any power, function and right, including the collection of taxes, of another unit; and WHEREAS, the Town of Lillington is within County of Harnett; and NOW THEREFORE, for and in consideration of mutual covenants contained herein and the mutual benefits to result therefrom, the parties hereby agree as follows: 1. DEFINITIONS: A. Consolidated Tax Bill: A tax bill for both the County and the Town taxes prepared by the County in those situations where both County taxes and Town revenues, to include Stormwater utility fees, are due, i.e. where property lies both within the County and the Town. B. Non-Consolidated Tax Bill: A tax bill for either County taxes only or Town revenues only prepared by the County in those situations where only County or only Town taxes are due, i.e. where property lies within the County and outside of the Town. C. Direct Costs. Those costs incurred for salaries and benefits, operational expenses, rents and capital outlay, plus those costs charged by County for direct services necessary to the operation of the office or department which shall be equal to one percent (1%) of the amount of taxes collected. Any property taxes, gross receipt taxes on vehicle rentals and leases, gross receipt taxes on heavy equipment rentals and leases, stormwater utility fees, and motor vehicle taxes and motor vehicle fees levied by the County or the Town for those Town residents residing in County including interest, penalties or costs and any special assessments due to the Town or County on property being foreclosed on as part of a tax foreclosure action, which are collectable by the Tax Collector within the scope of this Agreement and Article 22A. E. Tax Collector. The person appointed by the Board of Commissioners of the County of Harnett pursuant to N.C.G.S. §105-349, or its successor statute, by whatever title given, and currently known as the Harnett County Tax Administrator. 2. PURPOSE. The purpose of this Agreement is to establish the undertakings as provided in N.C.G.S., Chapter 160A, Part I, whereby the Tax Collector collects for the Town all current and delinquent Revenues as defined in Section 1(C) of this Agreement, effective on the first day of July, 2012. 3. METHODS AND PROCEDURES. The methods and procedures which shall be followed by the County, Tax Collector and the Town to implement this undertaking shall be as follows: A. The Tax Collector shall perform, on behalf of the Town, those duties specified in N.C.G.S., Section 105-330.5 and other duties specified herein. B. The County shall provide the Tax Collector with such assistants and employees as are deemed necessary in the sole discretion of the County for said Tax Collector to accomplish his duties to collect the Town Revenues as set forth herein. C. The governing body of the County shall cause to be performed all actions pertaining to or ancillary to collection of Revenues for Town, required by N.C.G.S. Chapter 105, including but not limited to the following: 1. Preparation of tax scrolls and tax books or a combined record as required by N.C.G.S. §105-319; 2. Adoption of the Order to Collect Taxes as required by N.C.G.S. §105-321; 3. Review of listings and evaluations as required by N.C.G.S. Chapter 105, Subchapter II, Article 21; 4. Listing, appraising and assessing property as required by N.C.G.S. Chapter 104, Subchapter II, Article 22; 5. Delivery of tax receipts to the Tax Collector as required by N.C.G.S. §105-352; HCBOC 061526 Pg. 93 3 6.Execution of settlements as required by N.C.G.S. §105-373. D.The Tax Collector shall follow the tax collection and settlement procedures set forth in N.C.G.S., Chapter 105, Subchapter II, and the administrative and accounting practices of Harnett County, except that the following special procedures shall apply to the extent that they are not inconsistent with said General Statutes: 1.The Tax Collector shall remit to the Town all Revenues collected for the Town under this Agreement on a monthly basis. 2.Where the Town’s share of collected Revenues cannot be readily ascertained, the Tax Collector shall initially apportion such Revenues between the County and the Town pro-rata in proportion to each unit’s share of the estimated total Revenues owed as of July 1 of the then-current fiscal year and cause such funds to be remitted to the Town as set forth in subsection 1 above. 3.Any adjustments that need to be made as a result of the apportionment as set forth in subsection 2 above, or as a result of uncollectable payment by check or other reason shall be made by the Tax Collector each month. 4.Records maintained by the Tax Collector shall show separately the amount collected on behalf of the Town and such records shall be available for inspection at the request of Town. 5.The Tax collector shall prepare and mail one Consolidated Tax Bill per parcel for each parcel on which both County and Town taxes are owed, detailing all County and Town taxes due as well as any stormwater utility fees. In the event of a partial payment on such a consolidated Tax Bill, where the taxpayer has not specifically designated how payment is to be applied, the amount of such payment shall first be applied in satisfaction of the taxes owed with the amount to be applied pro rata to each taxing unit’s share of the principal amount of the taxes which were the basis of said collection. Any remaining monies shall then be applied to the motor vehicle license fees levied by the Town. The Tax Collector shall prepare and mail one Non-Consolidated Tax Bill per parcel for each parcel on which either the County only or the Town only taxes are owed. 6.The Tax Collector shall collect Revenues due the Town in the same manner as the Tax Collector collects revenues due the County. The Tax Collector shall report delinquent Revenues due the Town in the same manner as the Tax Collector reports delinquent revenues due the County. a.Where both County and Town Revenues are delinquent, any action to collect such Revenues shall be brought in the names of both taxing units. HCBOC 061526 Pg. 94 4 b. The costs of such actions will be borne by each taxing unit pro rata in proportion to its share of the total Revenues due, until such costs are recovered from the person owing such Revenues or some other source. 7. Penalties and interested collected, proceeds recovered from tax foreclosures and sales pursuant thereto, and discounts, settlements, or compromises allowed shall be apportioned between the County and the Town pro rata in proportion to each taxing unit’s share of the principal amount which was the basis of said collections, recoveries or allowances. 8. The Tax Collector shall make an annual report to the Town which shall include: a. Current real estate, personal property and motor vehicle tax collections on behalf of the Town, stated in dollars and as a percentage of the levy; b. Delinquent real estate, personal property and motor vehicle tax collections on behalf of the Town, stated in dollars and as a percentage of outstanding levies; c. Collections of Town Revenues other than property taxes by type, stated in dollars and as a percentage of the budget projections; d. Significant policy changes and recommendations pertaining to the Office of the Tax Collector; and e. Significant operational changes and recommendations pertaining to the Office of the Tax Collector. 4. DURATION: A. This Agreement will take effect on the 1st day of July 2026. The Town of Lillington shall be responsible for collecting all delinquent taxes which were due and payable prior to January 1, 2012. B. This Agreement shall continue from year to year, unless terminated sooner as set forth in Section 7 of this Agreement. 5. FINANCES: The County shall retain a sum equal to one percent (1%) of the actual collections of Revenue collected for the Town. These monies shall be deducted from the amounts remitted to the Town. HCBOC 061526 Pg. 95 5 6. APPOINTMENTS: The Tax Collector is appointed by the Harnett County Board of Commissioners. The appointment of the Tax Collector is made by the governing board of the County in accordance with the provisions of N.C.G.S. 05-349. Appointments of all assistants, consultants, attorneys or employees provided by the County to implement this undertaking shall be made by the appropriate County officials and shall not be subject to the approval of the Town. Such appointees shall be employees, agents, consultants or contractors, as the case may be, of the County and not of the Town. 7. GENERAL PROVISIONS: A. The participation of the Office of the Tax Collector in this undertaking, except as otherwise provided by law or this Agreement, shall be under the supervision of the Board of Commissioners of Harnett County and the County Manager, which officials shall have exclusive authority as provided by law to regulate and control the administration of said Office. Any problems experienced by the Town with regard to this undertaking shall be communicated to the County Manager to be resolved as the County Manager deems appropriate. B. A bond shall be given by the Tax Collector, in his official capacity pursuant to N.C.G.S. §105-349(c) in an amount set by the Board of County Commissioners. Bonds shall also be given to the Tax Collector’s and Clerks as may be designated by the Board of County Commissioners. Such bonds shall be subject to the approval of the Board of County Commissioners for the County’s protection and the County shall pay the premiums required therefore. The County shall provide defense to the Tax Collector to the same extent it does its employees under its applicable policies. C. The governing body of the Town may, at its own expense, provide for an audit of the records relating to taxes owed the Town and collected on its behalf by the Tax Collector in addition to any audit required by law. The Tax Collector shall cooperate in any audit provided by the Town pursuant to this subsection. D. Tax settlements shall be made annually by the Tax Collector to the Board of County Commissioners pursuant to N.C.G.S. §105-373 before tax records are delivered to the Tax Collector for the subsequent year. Copies of all tax settlement reports of the Tax Collector shall be provided to the governing body of the Town. E. This Agreement may be terminated by either of the parties with at least six (6) month’s prior written notice; however, termination shall be effective only at the end of a fiscal year. F. This Agreement shall be recorded in the Office of the Clerk of both the Town and County. HCBOC 061526 Pg. 96 6 G.Amendments to this Agreement shall be effective only when reduced to writing and duly executed by both parties. H.With respect to all Revenues collected by County under the terms of this Agreement, County shall have sole and absolute authority upon compliance with and subject to applicable law: 1.To set discount schedules after consultation with the Town Manager; 2.To determine the status and taxability of all property; 3.To prescribe the minimum amount or percentage of tax liability that may be accepted as partial payment; 4.To designate the method or methods of collection to be employed, whether by garnishment, levy, foreclosure, or such other remedy or remedies, against any taxpayer, his real or personal property, as may be provided by law; 5.To employ such professional services (legal, accounting, etc.) as may be required for the efficient collection of revenues; and 6.To make any and all elections, decisions and determinations available to Town and County under the Machinery Act of 1971, (as now in existence or hereafter amended) with respect to the listing, appraisal, assessment of property, refunds and releases, and collection of taxes, except for establishment of Town’s tax rate, which shall remain Town’s sole responsibility. Funding for this contract is included in the FY 26-27 Recommended Budget. FINANCE OFFICER’S RECOMMENDATION: COUNTY MANAGER’S RECOMMENDATION: Item 9D HCBOC 061526 Pg. 100 1 FY27 FUNDING AGREEMENT BETWEEN HARNETT COUNTY AND ALLIANCE HEALTH THIS AGREEMENT is made and entered into this 1st day of July 2026, by and between the COUNTY OF HARNETT (hereinafter referred to as the “County”) and ALLIANCE HEALTH, a political subdivision of the state of North Carolina and a Local Management Entity / Managed Care Organization (LME/MCO) as the terms defined in NCGS 122C-3 (hereinafter referred to as “Alliance”). WITNESSETH: WHEREAS, Alliance is the public local management entity operating the Medicaid Tailored Plan and Medicaid Direct health plans for eligible individuals in Harnett County; and WHEREAS, the County and Alliance desire to enter into this Agreement to set forth the parties’ rights and obligations to manage certain county-funded health services provided to residents of Harnett County and other matters related to the provision of those services. NOW THEREFORE, for and in consideration of mutual covenants herein and the mutual benefits to result therefrom, the parties hereby agree as follows: 1.TERM. This Agreement will take effect on the 1st day of July, 2026 and shall continue through and until June 30, 2027. 2.SERVICES. In consideration of the Annual Allocation and other good and valuable consideration agreed to herein, Alliance shall manage the provision of high quality, cost-effective mental health, developmental disabilities and substance use services (MH/DD/SUS) to residents of Harnett County to the extent that other first or third-party payor sources such as Medicaid, Medicare, private pay, insurance, or grant funding are not available, have been denied or exhausted, or State funding is not allocated by Alliance. Alliance shall adhere to the requirements of Chapter 122C of the North Carolina General Statutes and any other applicable local, state, or federal laws, rules and regulations. Alliance shall adhere to the terms and conditions of this Agreement and effect such policies, procedures, and actions as are reasonably required to carry out the terms and conditions of this Agreement. It is agreed and understood by the parties that this Agreement is for the funding of third-party service providers in the Alliance Network. Alliance is not a service provider. This Agreement does not create a business associate relationship between the parties. Alliance will enter into a Network Participation Agreement with selected providers for the provision of services described herein. 3.ANNUAL ALLOCATION. Pursuant to N.C.G.S. 122C-115, the County agrees to pay to Alliance an Annual Allocation of Four Hundred Eight Thousand Dollars and No Cents (408,000.00) to be broken out as follows: Four Hundred Thousand Dollars and No Cents ($400,000.00) shall be used for the provision of services at Daymark Recovery Services in Erwin and Eight Thousand Dollars and No Cents ($8,000.00) for administrative costs associated with administering the obligations set forth herein. The County shall pay to Alliance through a wire transfer an amount equal to one-quarter of the Annual Allocation beginning on July 15, 2026, and quarterly thereafter. Alliance will recognize funding as income in the year received and any unspent funding from the current year and prior years will be recognized as income in the current year. WAIVER: The failure of a party to insist upon strict adherence to any term of this Agreement on any occasion shall not be considered a future waiver of the term or deprive that party of its right thereafter to insist upon strict adherence to that term or any other term of this Agreement. Any waiver must be in writing, and no waiver of any breach of any provision of this Agreement shall constitute a waiver of any other breach of such provision or of any other provision thereof. 5. ENTIRE AGREEMENT: This Agreement constitutes the entire agreement among the Parties as of the date hereof with respect to the subject matter hereof and cannot be amended or terminated orally. 6. NO THIRD-PARTY BENEFICIARIES: This Agreement is not intended for the benefit of any third party. The rights and obligations contained herein belong exclusively to the parties hereto and shall not confer any rights or remedies upon any person or entity other than the parties hereto. 7. SEVERABILITY: The Parties agree that if any provision of this Agreement, or portion thereof, shall be adjudged by any court of competent jurisdiction to be invalid or unenforceable for any reason, such determination shall be confined to the operation of the provision at issue and shall not affect or invalidate any other provision of this Agreement, and such court shall be empowered to substitute, to the extent enforceable, a provision similar thereto or other provisions so as to provide to the fullest extent permitted by applicable law the benefits intended by such provisions. 8. PARAGRAPH HEADINGS: Paragraph headings contained in this Agreement are included for convenience only and do not define, limit, or describe the scope of intent of this Agreement or in any way affect this Agreement. 9. APPLICABLE LAW: This Contract shall be governed by and in accordance with the laws of the State of North Carolina. All actions relating in any way to this Contract shall be brought in the General Court of Justice in the County of Harnett and the State of North Carolina. 10. EXECUTION: The Parties agree to execute all documents, instruments, or further assurances as may be necessary or required to effectuate and complete all transactions contemplated by this Agreement. 11. ASSIGNMENT: This Agreement shall not be assigned, in whole or in part, without the prior written consent of the Parties. 12. The implementation of this Contract shall be carried out in strict compliance with all Federal, State, and local laws. 16. AUDIT RIGHTS: For all Services being provided hereunder, County shall have the right to inspect, examine, and make copies of any and all books, accounts, invoices, records and other writings relating to the performance of the Services identified in this contract. Audits shall take place at times and locations mutually agreed upon by both parties. Notwithstanding the foregoing, Alliance must make the materials to be audited available within two (2) weeks of the request for them. To the extent that any records constitute “protected health information” as that term is defined by the Health Insurance Portability and Accountability Act of 1996 (“HIPAA”), it is the intent of this Section to allow the County to only receive the minimum necessary information in de-identified and/or aggregated form only for the purpose of evaluating financial and reporting requirements under this Agreement. Costs of any audit or review conducted under the authority of this section are the responsibility of the County unless a material breach by Alliance is detected, in which case the breaching party shall be responsible for the reasonable costs of the audit or review. 17. COUNTY NOT RESPONSIBLE FOR EXPENSES: County shall not be liable to Alliance for any expenses paid or incurred by Alliance, unless otherwise agreed in writing. 18. WHEREAS, County and Contractor entered into an Agreement with Omnico on October 1, 2022, (hereinafter referred to as the “Agreement”) to provide cleaning services for Harnett County governmental buildings; and WHEREAS, Contractor agreed to the terms of this contract for services is from October 1, 2022 and shall end on June 30, 2025; and WHEREAS, the County desires to extend the terms of the agreement to include an additional two (2) years of service; and WHEREAS, the County desires to amend the contract price to include an additional two (2) years of service, and NOW, THEREFORE, in consideration of the mutual benefits, representations, and agreements contained herein and for good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged, the parties agree as follows: 1. The contract terms shall be extended for an additional two (2) year period, beginning July 1, 2025 and through June 30, 2027. 2. Section 3., Contract Price. shall be deleted in its entirety and replaced with the following: Contract Price. County shall pay the rates established in Attachment D attached hereto and hereby incorporated herein for the cleaning services actually performed.
