The City of Dunn received a letter dated March 16, 2026, detailing a funding offer from NCDEQ for a loan amount from IIJA-DWSRF LSLR funds in the amount of $500,000. The letterfurther explains that this loan amount will be forgiven at 100%. These funds will be used to meet the requirements of the Lead and Copper Rule Revision (LCRR) and the Lead and Copper Rule Improvements (LCRI), including completion of the Lead and Copper Baseline Service Line Inventory, Lead Service Line Replacement Plan, and updated Lead and Copper Sampling Plan. Staff Recommendation(s) Staff are recommending that the City Council approve the acceptance of these loan/grant funds. Budgetlmpact The grant funds would increase the water project budget to $1,000,000 and would require a 2% loan fee ($10,000) to be paid from the City's water fund. Suggested Motion(s) Motion to adopt the resolution accepting the $500,000 of IIJA-DWSRF LSLR funds from NCDEQ for the Lead Service Line Replacement Project and the related Capital Project Ordinance Amendment. Page 1 of 1 CITY OF o DUNN NORTH CAROLINA RESOLUTION TO ACCEPT FUNDS FROM THE DRINKING WATER STATE REVOLVING FUND WHEREAS, on October 28, 2025, the City Council of the City of Dunn, North Carolina, authorized staff to submit a grant application to the North Carolina Division of Water Infrastructure (NCDWI) for the Lead Service Line Replacement Program; and, WHEREAS, the City of Dunn received a letter dated March 16, 2026, approving a Lead Service Line Replacement project as eligible to receive a total funding amount of a $500,000 loan from the IIJA Drinking Water State Revolving Fund (DWSRF) Lead Service Line Replacement (LSLR) funds; and, WHEREAS, the terms of the loan funding allow for one hundred percent, up to a maximum of $500,000, to be forgiven; and, WHEREAS, the completion of this project must occur before October 1, 2027, WHEREAS, these funds will be administered by the Division of Water Infrastructure (DWI), and WHEREAS, the City of Dunn intends to construct said project in accordance with the approved plans, specifications, and scope of work, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUNN: That the City of Dunn does hereby accept the afore mentioned SWIA grant #SRF-D-LSL-0175 funding offer of $500. 000 which is associated with DWI Agreement ID 2000088763. That the City of Dunn does hereby give assurance to the North Carolina Department of Environmental Quality that any Conditions or Assurances contained in the Award Offer will be adhered to, has substantially complied or will substantially comply with all Federal, State and local laws, rules, regulations, and ordinances applicable to the project and to Federal and State grants and loans pertaining thereto. Matti City Clerk gv6are' communif 6Tins! 1887 Capital Project Ordinance Amendment #1 Lead and Copper Service Assessment Project WHEREAS, the City Council for the City of Dunn, on June 24, 2025, adopted the annual budget ordinance number 02025-15 for the fiscal year beginning July 1, 2025; and, WHEREAS, the City Council, on June 24, 2025, adopted the Capital Improvements Plan for fiscal year 2025-26 that included the above -mentioned project; and, WHEREAS, on March 26, 2024, the City Council approved a Capital Project Ordinance in the amount of $500,000 for the first phase of the Lead and Copper Service Assessment Project; and, WHEREAS, it is necessary to amend this project for the second phase that includes an additional $500,000 to account for the funding and expenditures of the Lead and Copper Service Assessment Project, and, NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF DUNN, NC, PURSUANT TO SECTION 13.2 OF CHAPTER 159 OF THE GENERAL STATUTES OF NORTH CAROLINA, THAT: Section 1: Engineering services for the City of Dunn Lead and Copper Service Assessment Project is authorized to be undertaken until all project activity is completed, and is adopted as follows: Section 2. The Division will communicate to you when these documents are required. Once all documents have been received and approved, you may request disbursements using the Division's Disbursement Request form. If you request funds prior to paying contractors, you will have three business days to pay contractors upon receipt of funds. Davis -Bacon Requirements and American Iron and Steel Provisions Projects funded through the State Revolving Fund (SRF) programs must comply with DavisBacon wage requirements and American Iron and Steel provisions. Build America, Buy America Act (BABA) Projects funded through the IIJA-DWSRF LSLR funding program must comply with the Build America, Buy America Act (BABA). Definitions and Nomenclature > Designated Truck Route: This refers to a specific roadway or series of roads that are designated for truck traffic, often in areas with weight or other restrictions on other through routes. Commercial Motor Vehicle: In legal terms, a truck can be "designated" as a commercial motor vehicle based on its weight (e.g., a gross vehicle weight rating or GVWR of 10,001 pounds or more), its use for transporting 16 or more passengers, or its role in carrying hazardous materials. Weight or Axle Classification: States may designate trucks as commercial vehicles based on their weight or number of axles, regardless of whether they are used commercially., >A commercial motor vehicle (CMV) is defined as any vehicle"I th a commercial license plate and are designed or used to transport passengers or property (§20-4.01, 3d). Codrington Park. The scope of this project includes paving an existing parking lot, constructing an additional parking lot, building new restroom facilities, installing sidewalks to connect all park amenities, and creating an accessible ramp connection from the adjacent Harnett Training School campus. With the goal of expanding the park renovation beyond the scope of the AP Grant, the City engaged McAdams, a civil engineering firm, to develop a comprehensive master plan for C.B. Codrington Park. This master plan is intended to strategically position the City to pursue funding through the Parks and Recreation Trust Fund (PARTF) for additional improvements not covered by the AP Grant. Magnolia Avenue (PIN 1516-77-8993.000) for $40,000.00. The property is zoned R-7 with a tax value of $31,970.00. On May 13, 2025, this Council declared the property surplus, ordered the house demolished, and the real property sold. Subsequently, one or more developers expressed an interest in renovating the house therefore demolition was delayed and now this offer is presented for consideration. G.S. 160A-269 provides the following procedure when a city proposes to accept an offer to purchase real property: • Council must require a bid deposit of 5% and publish a Notice of the Offer containing a general description of the property, the amount and terms of the offer, and a notice that within 10 days any person may raise the bid by not less than ten percent (10%) of the first one thousand dollars ($1,000) and five percent (5%) of the remainder. Page 1 of 2 If the original offer is raised (ie. upset), the new bidder must deposit with the Clerk five percent (5%) of the increased bid, and the Clerk must readvertise the offer at the increased bid. This procedure is repeated until no further qualifying upset bids are received, at which time the Council may accept the offer and sell the property to the highest bidder. The Council may at any time reject any and all offers. If the Council accepts this initial $40,000.00 offer, the next step would be to adopt a Resolution Authorizing Upset Bid and direct that the Clerk publish the Notice of Sale by Upset Bid. After the upset bid period expires and the Council elects to accept the offer of the highest bidder, the City and buyer would execute a formal purchase agreement binding the parties and proceed to close. Godwin, Assistant City Manager Action Item: No Attachment(s): None Background At the March 24, 2026, Council Meeting, City staff addressed ongoing issues with yard waste cans being contaminated with regular trash. Contaminated yard waste cans create significant problems forthe County landfill, Republic Services, and the City of Dunn. Addressing this issue requires Republic Services and City personnel to be onsite two days a week to manually separate trash from yard waste. This process often takes multiple hours tying up several Public Works employees including the Public Works Director. The scope of contamination in the yard waste cans is not limited to regular household trash but has included dead animals, needles, and household appliances all of which create safety hazards for Public Works employees and regulatory compliance problems for the landfill and Republic Services. Joe Dehner from Republic Services will provide an overview of the issue and discuss options available to the City to address this issue. At this budget workshop, a PowerPoint presentation will be provided that will focus on the revenues and expenditures for operations of the General Fund, Water & Sewer Fund, Stormwater Fund, and Capital Project Requests for FY27-FY31.
