Regular Meeting Minutes
January 13, 2026
The Harnett County Board of Commissioners met in regular session on Tuesday, January 13, 2026 at 9:00
am, in the Commissioners Meeting Room, Harnett County Resource Center and Library, 455 McKinney
Parkway, Lillington, North Carolina.
Members present: Duncan E. Jaggers, Chairman
Matthew B. Nicol, Vice Chairman

Chairman Jaggers called the meeting to order at 9:00 am.
Commissioner Morris led the Pledge of Allegiance and provided the invocation.
Amy Noel, Assistant Veterans Services Director, presented information regarding Harnett County
Heroes Remembrance recognition. We are recognizing and honoring veterans that appear on our Wall of
Heroes. These individuals have received awards for acts of individual heroism, not as a unit. Ms. Noel
read Sergeant First Class James Mountcastle's citation. Chairman Jaggers presented Sergeant First Class
Mountcastle with a certificate.
Chairman Jaggers called for any additions or deletions to the published agenda. Commissioner
Matthews made a motion to approve the agenda as published. The motion was seconded by
Commissioner Morris and carried unanimously.
Chairman Jaggers opened a hearing to consider a request for a refund of overpayment of excise tax paid
on Lot 10, Ila's Way due to the deed being filed twice.
Lorie Babb, Assistant Register of Deeds, stated Mr. Willis asked that I extend his apologies for not
being able to attend today, he is attending the Harnett County Community Foundation board initiation
meeting. Whitaker & Hamer inadvertently recorded the same deed and deed of trust twice in the Harnett
County Register of Deeds Office. An excise tax of $560 was paid with each recording. They are
requesting a refund of $560 overpayment.

Commissioner Morris made a motion to refund the overpayment approving a Resolution authorizing the
refund of the excise tax overpayment. The motion was seconded by Commissioner McKoy and carried
unanimously. (Attachment 1)
Mark Locklear reviewed information regarding a request to establish a conditional zoning process.
Information included:
• An explanation of conditional zoning
o A rezoning process that establishes zoning districts with mutually agreed -upon conditions
to ensure conformance with adopted plans and mitigate potential development impacts.
o UNC SOG: More than half of NC local governments utilize Conditional Zoning
o All 5 municipalities in Harnett County and each of the surrounding counties
• The purpose of establishing a Conditional Zoning process
o Establishing a conditional zoning process is a recommendation of the Harnett Horizons
2040 Comprehensive Land Use Plan
o After NC Senate Bill 382 was signed into law, the County's discretion to amend the
Unified Development Ordinance has been significantly restricted - Conditional Zoning is
one of few viable options remaining following Senate Bill 382

Commissioner McKoy made a motion to proceed with the process to establish a conditional zoning
process. Vice Chairman Nicol seconded the motion. Motion carried unanimously.
Kimberly VanBeck, Library Director reviewed a request for permission to apply for and accept if awarded
a National Endowment for the Arts (NEA) Big Read Grant in the amount of $5,000, with a minimum
$5,000 required match. This project will bring the community together to read "Demon Copperhead" by
Barbara Kingsolver and a related youth title, using books, discussions, art, and storytelling to spark
conversations about addiction, resilience, and the power of sharing personal stories. Through countywide
events, partnerships, and creative programs, the Harnett County Public Library will help people of all ages

connect with local history, culture, and one another. Commissioner McKoy made a motion to approve the
request to apply for and accept if awarded a National Endowment for the Arts (NEA) Big Read Grant in
the amount of $5,000, with a minimum $5,000 required match. The motion was seconded by
Commissioner Morris and carried unanimously.
Tommy Burns, Harnett Regional Water Director, reviewed a request for the approval to purchase and
close on three tracts identified by PIN Numbers 0597-08-2455.000, 0597-06-0841.000, and 0597-07-
1677.000. These tracts were identified as suitable for the new water treatment plant to be built near Erwin,
NC. These tracts are unique in that they adjoin an existing water intake that Harnett Regional Water has
owned and maintained since the acquisition of the utility system from the Town of Erwin. This unique
feature makes this property purchase essential to design, engineering and water withdrawal for the soon
to be constructed water plant. This location is also idea because it will enable Harnett Regional to further
expand its water capabilities in the central and eastern parts of Harnett County as well as to Cumberland
County in the southern portion of the service area. This purchase, coupled with the purchase in 2025 of
property for a new regional sewer treatment plant in Erwin, will serve the County and regional needs for
many years to come. HRW is requesting purchase approval in the amount of $2,800,000 for the property
and related expenses to reimburse HRW for due diligence items, including environmental evaluations,
surveys and wetlands reviews, and closing costs and related expenses (attorney fees, title insurance, etc.).
Commissioner Morris made a motion to approve the property purchase and related expenses and approval
of any corresponding budget amendments needed. The motion was seconded by Commissioner McKoy.
Dwight Snow, County Attorney, requested the Board to include in that motion authority for the County
Manager to sign closing documents. Commissioner Morris amended his motion to approve the property
purchase and related expenses, approval of any corresponding budget amendments needed and authority
for the County Manager to sign closing documents. Commissioner McKoy seconded the amended motion
and the amended motion carried unanimously.
Coley Price, Deputy County Manager, reviewed a request for the Board of Commissioners to consider
and approve the recommendation to contract with Edifice LLC for Construction Manager at Risk (CMAR)
services including pre -construction, cost estimates/Guaranteed Maximum Price (GMP) and construction
managers' services for the Animal Adoption Center project. Pre -construction fee is $88,000 and
construction fees are at 4% of the Cost of Work converted to a Lump Sum at Owner's acceptance of the
GMP. Animal Adoption Center project site is located at 3708 US 421 North, Lillington, NC.
Commissioner Morris made a motion to approve the contract with Edifice LLC for CMAR services for
the Animal Adoption Center. The motion was seconded by Vice Chairman Nicol and carried unanimously.
Mr. Price also reviewed a request to approve a Project Ordinance Amendment related to the Animal
Adoption Center. Vice Chairman Nicol made a motion to approve the Project Ordinance Amendment as
requested. The motion was seconded by Commissioner Matthews and carried unanimously. (Attachment

Melissa Capps, Clerk to the Board of Commissioners, reviewed a request to adopt a Resolution to change
the Legislative Luncheon from February 10, 2026 to February 2, 2026. Commissioner McKoy made a
motion to approve the Resolution to change the Legislative Luncheon from February 10, 2026 to February

2, 2026. The motion was seconded by Vice Chairman Nicol. Motion carried unanimously. (Attachment
3)
Bradley Abate, Harnett Regional Jetport Director, reviewed a request for the approval of Work
Authorization No. 8 for Parrish and Partners for the design and bidding phase of the runway extension at
Harnett Regional Jetport. The recent agreement to purchase the land for the runway extension allows the
County to move forward with the design of the project. The Work Authorization is presented for basic
services of design and bidding of the project plus special services needed for the project. The basic
services are to cost $526,465 for design and bidding and $464,909 for special services for a total of
$991,374. The special services expense also includes $217,361 in sub -consultants for survey, Geotech
and environmental work. The fees will be paid from the SCIF grant received from the General Assembly.
The design phase is scheduled to take approximately 45 weeks to complete. Vice Chairman Nicol made a
motion to approve the work authorization for Parrish and Partners for the design and bidding phase of the
runway extension project. The motion was seconded by Commissioner Matthews and carried
unanimously.
The Board of Commissioners reviewed applications to serve on Boards and Committees. Vice Chairman
Nicol made a motion to approve the reappointments to the Jetport Board for Townsend Quinn as an At -
Large member, James Johnson, III as the District 3 member, Danny Honeycutt as the District 4 member
and Jerry Milton as the Campbell University representative. The motion was seconded by Commissioner
Morris and carried unanimously.
Commissioner McKoy made a motion to appoint Jheri Hardaway to the Juvenile Crime Prevention
Council as the commissioner appointee position. The motion was seconded by Vice Chairman Nicol and
carried unanimously.
Vice Chairman Nicol made a motion to remove Chris Hawk from the Cemetery Board of Trustees. The
motion was seconded by Commissioner Matthews and carried unanimously.
Brent Trout, County Manager, stated there was some discussion last week regarding the Board of Elections
decision. I wanted to bring back mention that that decision was reviewed by the Board of Elections and
then they did dismiss the claim as it relates to the charge that she was not a resident of the property she
listed on her forms. She will be able to continue to be on the ballot.
Vice Chairman Nicol made a motion to approve the budget amendments as requested by the Finance
Officer. The motion was seconded by Commissioner Morris and carried unanimously. (Attachment 4)
Commissioner Morris made a motion to adopt a Resolution NC Department of Transportation add Gold
Finch Circle and Sweetbay Place in the Nature Crossroads Subdivision to the State's Secondary Road
System. The motion was seconded by Vice Chairman Nicol and carried unanimously. (Attachment 5)
Commissioner Morris made a motion to adopt a Resolution requesting NC Department of
Transportation add Tower Drive and Sandy Tingen Court in the Tingen Place Subdivision to the State's
Secondary Road System. The motion was seconded by Commissioner McKoy and carried unanimously.

Chairman Jaggers requested under new business a discussion of the Probation Office location and issues
going on there. Mr. Trout stated we have made efforts to find a new location for the parole office. Staff
has made visits to that location and also looked at other potential buildings. Mr. Price shared rules and
regulations required for the Probation Office. Discussion included bathroom accommodations and
current lease terms. Commissioner Morris suggested the use of a mobile unit at the corner of McKinney
Parkway. Chairman Jaggers stated we are in support of solving these issues.
Commissioner Morris stated I want to thank Coley and Mike for looking into these issues with Probation
and Parole, I know this has been going on for almost a year. I know there are a lot of concerns, and we
need some quick resolution to it. I appreciate your efforts.
Commissioner McKoy stated I have been a part of this board for many years. When I thought about
running for this position it was about what I could do for the citizens of Harnett County and that is what
I strive for. My first thought was the employees and the low wages they were paid. It took a couple of
years to be successful but when Mr. Wood came in she asked him to look at and he did. My heart has
always been to bring more jobs to this County. Over 60% of our citizens go out of this county to work
and spend part of their tax revenue in other counties. Another thing, when I am talking about jobs, the
best thing that has happened to this county is Stephen Barrington. I have worked with other Economic
Development Directors, they brought nothing to this county but I see a future in him. This County
deserves mor jobs. and economic development for their citizens. The last thing, I want to say, this
building here we are sitting in, there was so much bad publicity, there was such a need for this building.
There are many more things I would like to see happen in this county and that's why stay for another
term, if I can. I want you to understand where I am coming from, my passion for Harnett County.
Commissioner McKoy thanked the other Board members and stated I appreciate your support. Let's
continue to move this County forward.
Chairman Jaggers stated as our County continues to grow, it is important that development is thoughtful
and sustainable. We really do appreciate all that y'all do over there. We want growth that respects our
communities, infrastructure and quality of life. When progress happens it's because when we work
together, we work together with staff, we work together with the public and we work together with
businesses. Our goal would be to attract more businesses to this county. When I came on this Board, I
thought the meetings were a little inefficient, where you came to one meeting and talked about the items
and then came to another to vote about it and now, we vote at every meeting. I appreciate the Board
allowing that to happen. I think the Board is in a great place.
Commissioner Matthews stated starting my second term on the Board and thinking back to when I first
joined Commissioner McKoy and the others on the Board, how with anybody first becomes a part of this
and you see all these things that know would be good four our county and our citizens and you want
them to happen right away. And the toughest thing for me to learn is that it is hard to make things
happen right away. When I hear about the Animal Adoption Center and Shelter, that is one of the first
things we where hit with when we first joined this board. It has been five years, but it is so encouraging
to see that finally begin to reach a point we can see it come to fruition. Mark talking about our Land Use
Plan that we worked so hard on developing, right before we could get it enacted, somewhat get our
hands tied on what we think would be some really great things for our county and our citizens. It's

encouraging to see things beginning to happen that will benefit our citizens and county. I have always
believed that leadership matters, and I have to commend Mr. Trout, senior leadership and all employees
on the great job they do to lead and serve our County. I also have to echo Commissioner McKoy's
comments about this Board, I appreciate the time and energy you folks put into serving our county and
our citizens. I know everyone's hearts are in the right place and you are here because you want to make
a difference in our citizens lives and communities.

Morris and carried unanimously.

RESOLUTION BY THE HARNETT COUNTY BOARD OF COMMISSIONERS
AUTHORIZING REFUND OF EXCISE TAX OVERPAYMENT
WHEREAS, pursuant to N.C. Gen. Stat. § 105-228.37, the Harnett County Board of
Commissioners (hereinafter referred to as the "Board") is required to review any timely request by a
taxpayer for a refund of overpayment of excise tax on the conveyance of property and to make a timely
decision regarding the County of Harnett's (hereinafter referred to as the "County") portion of any
overpayment; and
WHEREAS, on November 25, 2025, Whitaker & Hamer, PLLC, 121 E. Main Street, Clayton,
North Carolina 27520, recorded a duplicate Deed and Deed of Trust in Book 4315, Page 63-64 with excise
tax in the amount of $560.00, which was remitted to the Harnett County Register of Deeds; and
WHEREAS, the County received a timely written request for a refund of $560.00 in excise tax
overpayment from Joseph T. Hamer with Whitaker & Hamer, PLLC; and
WHEREAS, on January 13, 2026, the Board held a hearing in accordance with N.C. Gen. Stat. §
105-228.37(b) and upon motion made, seconded, and duly adopted, the Board has determined that the
refund request should be granted.
NOW THEREFORE, BE IT RESOLVED that the Harnett County Board of Commissioners, based
upon the evidence presented at the hearing, hereby determines that Whitaker & Hamer, PLLC is entitled
to a refund of the overpayment of excise tax in the amount of $560.00, plus any applicable interest; and
BE IT FURTHER RESOLVED that the Harnett County Board of Commissioners authorizes the
County Manager or Finance Officer to make payment to Whitaker & Hamer, PLLC in the total amount of
$560.00
