AGENDA ITEMS #1-4 Lillington Board of Commissioners October 1st & 2nd, 2025 Special Board Meeting/Retreat Minutes 1 Special Board Meeting of the Town Board of the Town of Lillington, Wednesday, October 1, 2025 at 1:00 p.m. – 4:00 p.m. and Thursday, October 2, 2025 at 8:30 a.m. – 11:00 a.m. at The Davis Community Center at 1101 Manly Avenue, Wilmington, North Carolina for the purpose of conducting a Town Board Planning Retreat. Lucas, Town Clerk Alicia Adams, Administrative Services Director (Day 1) Shane Cummings, Town Engineer October 1, 2025-Day One CALL TO ORDER: Mayor McFadden opened the Special Meeting/Planning Retreat and called the meeting to order and welcomed those in attendance. Mayor McFadden recognized Joseph Jeffries, Town Manager. Mr. Jeffries explained that the town has been working on the Downtown Project for a little over 4 years. Mr. Jeffries stated he was going to give the Board more information about the Downtown Project and that Shane Cummings, Town Engineer and Alicia Adams, Administrative Services Director would be chiming in with information as well. Mr. Jeffries explained they would give the information on the strategy they would like to take for Downtown and on Day 2, Mr. Cole will talk about how this will all be financed. They discussed in detail Phases 1, 2 and 3 of the Downtown plans including the 10th Street bypass, Regional Stormwater Pond, the River Trail and Cost estimates and funding. Discussions continued with the Board. Mr. Cummings highlighted the following; • GLF McAdams: o Stage A  Final adjustments are being made to the 100% plans to account for latest Stewart design.  Looking to go out for bid and award by the end of the year.  Upsizing stormwater pipes and adding additional inlets throughout 8th street.  Inlets would be to existing grade and would be adjusted during the street scape installation to bring to new elevations.  Three runs of gravity sewer and 4 manholes to be installed. Lillington Board of Commissioners October 1st & 2nd, 2025 Special Board Meeting/Retreat Minutes 2 Stage B  Interior installation of future parking area around red barn.  Trench drains and roof drains will be picked up under the Stewart design. Structures will be stubbed to catch these additional drainage devices.  Asphalt, sidewalk and curb repairs will be made as the project is completed.  Phasing and working up to Ivey or South. • Regional Pond: o Next steps are to make a resolution, appraisal, and survey or the property. o Area served by pond. o Wetland so low impact vs Wet pond. o Conveyance through existing piping under RR. • UTILITY COORDINATION o Duke/Pike:  All released in one phase most likely. Once given the green light to start(easements obtained) they will move in in 2-3 months. Conduit can be installed by Town on upper 8th and poles remain until Phase 2 is complete with final grade or at the point of rough grade where final elevations can be established for flush mounts.  Lower 8th street and interior block can happen as a stand alone prior to northern portion of 8th street. o Charter:  They are moving through steps to complete the design on their end with their consultant.  They will mobilize to complete relocations within 1-2 weeks of notice.  Entire project would take 30-90 days. 8th area only about 30 days.  They will coordinated individual property connections. o Bright speed:  Working on relocation plans and information. Should have something by the end of the week. o Conterra:  Awaiting confirmation of any conflicts. It was our understand the impacts would be minimum since most items are underground. o Harnett County:  No conflicts. Ms. Adams spoke about grant opportunities and highlighted the following; Downtown Phase 1 Lillington Board of Commissioners October 1st & 2nd, 2025 Special Board Meeting/Retreat Minutes 3 Grant Opportunities for Phase I • Rural Downtown Economic Development Grants – 5% Match • Golden Leaf • BRIC FEMA Duke Energy • All six blocks must be taken down at one time there is not a way to phase this portion of the project • $2.3 million • From easement acquisition 2-3 months to mobilize Stormwater along 8th street from Ivey to Harnett • Funded through Golden Leaf Primary • Staff is hopeful to award a construction contract at the end of the year • Staff will be submitting an extension request along with additional funding request to the Golden Leaf Board of Directors. • The project cost currently is being estimated at more than the originally funded grant Pedestrian Lighting ` Clock Plaza Flood Resiliency – Regional Stormwater Pond • Currently waiting actual construction cost • This does not include the additional railroad crossing that will be needed once other projects begin to utilize the pond • Currently have $1,500,000 for acquisition and construction Total Phase I $11,442,508.69 Flood Resiliency $1,500,000.00 LAPP $1,347,000.00 Golden Leaf $1,050,000.00 Contingency 20% Total $7,545,508.69 $1,509,101.74 $9,054,610.43 Total Phase II $4,628,744.12 $925,748.82 $5,554,492.95 Total Phase III $2,885,429.71 $577,085.94 $3,462,515.65 Lillington Board of Commissioners October 1st & 2nd, 2025 Special Board Meeting/Retreat Minutes 4 • 20-22 acres Phase II • Interior Block Phase III • North side of Front street and mast arms 10th Street bypass – LAPP Funding Process (Locally Administered Projects Program) • Staff has partnered with NCDOT in order to pursue LAPP Funding for the 10th Street bypass • The Town’s pre-submittal meeting is October 2nd • Application is due October 31st • Minimum of a 20% local match $340,500 included in the total cost of Phase I OCTOBER 2, 2025-DAY TWO: Mayor Glenn McFadden recognized Ted Cole with Davenport Public Finance. Mr. Cole passed out a packet to everyone in attendance. Included in the packet were the following: - Credit Rating and Peer Comparative Overview - General Fund Operations and Fund Balance - Existing Tax Supported Debt Profile - FY 2027 Major Capital Projects - Existing Tax Supported Debt Under General Fund Financial Performance Mr. Cole highlighted the following: - Since 2021, the Town’s operating revenues have exceeded operating and debt service expenditures, resulting in a structurally balanced budget and annual operating surpluses. - In FY 2021, the Town experienced significant stormwater capital expenses due to storm damage. The Town received a disaster declaration from the State for 75% of the costs. Reimbursement payments have been received in FY 2022-2024. - The Town has increased their total fund balance from FY 2021 to FY 2024 by approximately $2,538,772 and unassigned fund by $2,158,458. - The Town anticipates increasing their unassigned fund balance by an additional approximately $150,000 in FY 2025. - In FY 2023, the Town re-established compliance with its Available General Fund Balance to Expenditures Policy of 40%. Ms. Lucas stated the Town of Lillington’s Parks and Recreation Department is requesting the following temporary road closures: • Front Street • Main Street • 8th, 9th, and 10th Streets • W. James and W. Ivey Streets The Town of Lillington’s Christmas Parade and Gathering is Saturday, December 13, 2025 at 11:00 a.m., the street closure request is from 8:00 a.m. to 12:00 p.m. As there were no other speakers, the Public Hearing was closed at 6:03 p.m. Item #6A Consideration of Approval of an Ordinance for Temporary Street Closure of Town and NCDOT Streets for the Town of Lillington Christmas Parade on December 13, 2025 A motion was made by Commissioner Page to approve the Temporary Street Closure of Town and NCDOT Streets for the Town of Lillington Christmas Parade on December 13, 2025. This motion was seconded by Commissioner Moss and was approved unanimously. NEW BUSINESS Item #7 Consideration of Resolution Directing the Town Clerk to Investigate a Non-Contiguous Satellite Annexation Petition Received Under General Statue §160A-58.1 from David Huang and Yaqi Wang Mayor McFadden recognized Lindsey Lucas, Town Clerk. Mrs. Lucas stated for your Consideration is a Resolution Directing the Town Clerk to Investigate a Non-Contiguous Satellite Annexation Petition Received Under General Statute §160A-58.1 from David Huang and Yaqi Wang. The Annexation Petition was received on September 17, 2025. The non-contiguous annexation of 3.79 acres of the property identified as PIN #: 0661-01-6500.000 located on NC 210 N situated in the County of Harnett. Lillington Board of Commissioners October 14, 2025 A motion was made by Commissioner McPhail to approve the Resolution Directing the Town Clerk to Investigate a Non-Contiguous Satellite Annexation Petition Received Under General Statute §160A-58.1 from David Huang & Yaqi Wang. The motion was seconded by Commissioner Langdon and approved unanimously. For the Record: The Town Clerk does hereby certify an investigation has been completed of the petition for the non-contiguous annexation of 3.79 acres of the property identified as PIN #: 0661-01-6500.000 located on NC 210 N situated in the County of Harnett. The motion was seconded by Commissioner Langdon and approved unanimously. Non-Agenda Items: Mayor Glenn McFadden inquired as to whether there were any non-agenda items that should be addressed by Town Board members or staff. Commissioners thanked staff for the work that went into the Planning Retreat. Adjournment: The meeting adjourned following the unanimous approval of a motion by Commissioner Babb and a second by Commissioner McPhail. Lucas, Town Clerk Glenn McFadden, Mayor AGREEMENT BETWEEN MID-CAROLINA REGIONAL COUNCIL and TOWN of LILLINGTON for the provision of Technical Service Assistance This AGREEMENT, entered into on October ___, 2025, by and between Mid-Carolina Regional Council (hereinafter referred to as the "Council") and the Town of Lillington, North Carolina (hereinafter referred to as the "Local Government"); WITNESSETH THAT: WHEREAS, the Council is empowered to provide technical assistance by the North Carolina General Statutes and by resolution passed by the Council on April 17, 1972. Technical assistance shall consist of the provisions of services as described in Attachment A, which is herein made part of this AGREEMENT; WHEREAS, the Local Government has requested the Council to provide such technical assistance to the Local Government; and WHEREAS, the Council desires to cooperate with the Local Government in every way possible to the end that the proposed activities are carried out in an efficient and professional manner; NOW, THEREFORE, the parties hereto do mutually agree as follows: 1. Personnel That during the period of this Contract, the Council will furnish the necessary trained personnel to the Local Government to perform the tasks outlined in Attachment A Work Program. 2. Compensation That for the purpose of providing funds for carrying out this Contract, the Local Government will pay the Council the following rates based on the services provided: • Code Enforcement Services: $60/hour • Zoning Administration: $60/hour • Planning Services: $75/hour • Clerical Services: $65/hour • Administrative Services: $82/hour The only compensation received will be travel costs and the hourly rate as listed above unless agreed upon in writing by both parties. The Council shall invoice the Local Government on a monthly basis for the services provided for the prior month. 3. Materials/Work Product All materials produced will be property of the Local Government (i.e. applications, forms, templates, policies, etc.). 4. Time of Performance The contract shall begin October _____, 2025 until terminated by either party according to the specification in item number 5. 5. Termination/Modifications The Local Government may from time-to-time request changes in the scope of work or services to be performed by the Council hereunder. Such changes, including any increases or decreases in the Council's compensation, which are mutually agreed upon by and between the Local Government and Council, shall be incorporated as written amendments to the Contract. The Local Government or the Council may terminate this AGREEMENT by giving a 15 days written notice (electronic or paper). 6. Interest of Members, Officers, or Employees of the Council, Members of the Local Government, or Other Public Officials No member, officer, or employee of the Council or its agents; no member of the governing body of the locality in which the program is situated; and no other public official of such locality or localities who exercises any functions or responsibilities with respect to the program during his or her tenure or for one year thereafter, shall have any financial interests, either direct or indirect, in any contract or subcontract, or the proceeds thereof, for work to be performed in connection with the program assisted under this Agreement. Immediate family members of said members, officers, employees, and officials are similarly barred from having any financial interests in the program. The Council shall incorporate, or cause to be incorporated, in all such contracts or subcontracts, a provision prohibiting such interest pursuant to the purpose of this section. 7. Nondiscrimination Clause No person in the United States shall on the grounds of race, color, national origin, or sex be excluded from participation in, be denied the benefits of, or be subjected to discrimination with any program or activity funded in whole or in part with funds available under the Housing and Development Act of 1974, Section 109. 8. Age Discrimination Act of 1975 as amended No qualified person shall on the basis of age be excluded from participation in, denied the benefits of, or otherwise be subjected to discrimination under any program or activity which receives benefits from federal financial assistance. 9. Section 504 Rehabilitation Act of 1973 as amended No qualified handicapped person shall, on the basis of handicap be excluded from participation in, be denied the benefits of, or otherwise be subjected to discrimination under any program or activity which receives or benefits from federal financial assistance. 10. E-Verify Provision Pursuant to G.S. 143-48.5 and G.S. 147-33.95(9), the undersigned hereby certifies that the Contractor named below, and the Contractor's subcontractors, complies with the requirements of Article 2 of Chapter 64 of the NC General Statutes, including the requirement for each employer with more than 25 employees in North Carolina to verify the work authorization of its employees through the federal E-Verify system. E-Verify System Link: www.uscis.gov ATTACHMENT A TOWN of LILLINGTON TECHNICAL SERVICE ASSISTANCE 1. WORK PROGRAM/BUDGET This is an agreement attached to and made part of the August 1, 2025 AGREEMENT between the Town of Lillington, North Carolina (hereinafter referred to as "Local Government") and Mid-Carolina Regional Council (hereinafter referred to as "Council") providing for technical assistance related to staffing needs, special projects on an hourly basis, and any other services the Local Government requests agreed to in writing. The basic services to be provided by Council are outlined below. 2. WORK PROGRAM/SCOPE OF SERVICES The intent of this AGREEMENT is for the Council to provide qualified professional personnel as technical assistance to the Local Government consistent with applicable federal laws, state laws, and town ordinances beginning October ____, 2025. Leveraging experience and resources possessed by Council staff, Council will consult and advise the Local Government consistent with applicable clerical, administrative, financial, accounting practices, planning and zoning, code enforcement, and governmental regulations. 3. SERVICES TO BE PROVIDED The following activities are illustrative of the services to be provided by Council to the Local Government: • Code Enforcement Services: o Mid-Carolina will provide a Code Enforcement Officer (CEO) to the Town of Lillington on an hourly basis, as requested by the Town. o The CEO will be responsible for the following: o Nuisance abatement according to the Town’s code of ordinance to include but not be limited to tall grass, junk vehicles and junk debris. o Housing code enforcement. The CEO will work with the appropriate building code officials to enforce the building regulations to include but not be limited to minimum housing, condemnation, and commercial maintenance code. o Solid waste ordinance enforcement. o The CEO will investigate all complaints, send the appropriate violation letters, conduct follow-up, abate violations, and close all cases (if applicable). • Zoning Administration: o Mid-Carolina will provide a Zoning Administrator to administer the Town zoning ordinance on an hourly basis, as requested by the Town. The Zoning Administrator will be responsible for zoning verification letters, zoning permits, zoning violations and any other zoning related task requested by the Town. o The Zoning Administrator will process all zoning permits and verification letters based on the Town’s current process. The Zoning Administrator will be responsible for all communications with the applicants and the full review and processing. o The Zoning Administrator will investigate all zoning complaints, send the appropriate violation letters, conduct follow-up, establish an amicable solution and close all cases. •Planning Services: o Mid-Carolina can provide professional planning services to the Town on an hourly basis, as requested. o Planning services can be project specific (i.e. - assistance with comprehensiveplans, ordinance amendments, etc.), plan review, planning consultation, processing of applications for planning board, Town board meetings and all otherplanning related needs. •Clerical Services: o Organizing and Filing of Documents and Files o Preparation of Town board meeting packets o Preparation of minutes •Administrative Services: o Review of Policies and Procedures to Ensure Compliance with Applicable Laws,Regulations, and Practices o Assists with the development and implementation of human resources policiesand procedures o Grant administration, project administration 4.FEES The Council proposes to provide the services described in this AGREEMENT as listed below: •Code Enforcement Services: $60/hour •Zoning Administration: $60/hour •Planning Services: $75/hour •Clerical Services: $65/hour •Administrative Services: $82/hour Town of Lillington By: ________________ Title: ________________ Date: ________________ Mid-Carolina Regional Council By: ________________ Title: ________________ Date: ________________ This instrument has been pre-audited in the manner required by the Local Government Budget and Fiscal Control Act. ITEM SUMMARY The Town of Lillington received a petition under §160A-58.1 for annexation. The Town Board by Resolution directed the Town Clerk to investigate the sufficiency of the petition. (a) The governing board of any municipality may annex by ordinance any area contiguous to its boundaries upon presentation to the governing board of a petition signed by the owners of all the real property located within such area. A municipality shall not be required to adopt more than one ordinance under this subsection within a 36-month period. For petitions received under subsection (b1) or (j) of this section, the clerk shall receive the evidence provided under subsection (l) of this section before certifying the sufficiency of the petition. Upon receipt of the certification, the municipal governing board shall fix a date for a public hearing on the question of annexation, and shall cause notice of the public hearing to be published once in a newspaper having general circulation in the municipality at least 10 days prior to the date of the public hearing; provided, if there be no such paper, the governing board shall have notices posted in three or more public places within the area to be annexed and three or more public places within the municipality. (d) At the public hearing persons resident or owning property in the area described in the petition and persons resident or owning property in the municipality shall be given an opportunity to be heard. The governing board shall then determine whether the petition meets the requirements of this section. Upon a finding that the petition that was not submitted under subsection (b1) or (j) of this section meets the requirements of this section, the governing board shall have authority to pass an ordinance annexing the territory described in the petition. The governing board shall have authority to make the annexing ordinance effective immediately or on the June 30 after the date of the passage of the ordinance or the June 30 of the following year after the date of passage of the ordinance. (d1) Upon a finding that a petition submitted under subsection (j) of this section meets the requirements of this section, the governing body shall have the authority to adopt an annexation ordinance for the area with an effective date no later than 24 months after the adoption of the ordinance. (d2) Upon a finding that a petition submitted under subsection (b1) of this section meets the requirements of this section, the governing body shall, within 60 days of the finding, estimate the capital cost to the municipality of extending water and sewer lines to all parcels within the area covered by the petition and estimate the annual debt service payment that would be required if those costs were financed by a 20-year revenue bond. If the estimated annual debt service payment is less than five percent (5%) of the municipality's annual water and sewer systems revenue for the most recent fiscal year, then the governing body shall within 30 days adopt an annexation ordinance for the area with an effective date no later than 24 months after the adoption of the ordinance. If the estimated annual debt service payment is greater than or equal to five percent (5%) of the municipality's annual water and sewer systems revenue for the most recent fiscal year, then the governing body may adopt a resolution declining to annex the area. If such a resolution is adopted, the governing body shall immediately submit a request to the Local Government Commission to certify that its estimate of the annual debt service payment is reasonable based on established governmental accounting principles. (1) If the Local Government Commission certifies the estimate, the municipality is not required to annex the area and no petition to annex the area may be submitted under subsection (b1) of this section for 36 months following the certification. During the 36-month period, the municipality shall make ongoing, annual good faith efforts to secure Community Development Block Grants or other grant funding for extending water and sewer service to all parcels in the areas covered by the petition. If sufficient funding is secured so that the estimated capital cost to the municipality for extending water and sewer service, less the funds secured, would result in an annual debt service payment cost to the municipality of less than five percent (5%) of the municipality's annual water and sewer systems revenue for the most recent fiscal year, then the governing body shall within 30 days adopt an annexation ordinance for the area with an effective date no later than 24 months after the adoption of the ordinance. (2) If the Local Government Commission notifies the governing board that the estimates are not reasonable based on established governmental accounting principles and that a reasonable estimate of the annual debt service payment is less than five percent (5%) of the municipality's annual water and sewer systems revenue for the most recent fiscal year, then the governing body shall within 30 days of the notification adopt an annexation ordinance for the area with an effective date no later than 24 months after the adoption of the ordinance. (d3) Municipal services shall be provided to an area annexed under subsections (b1) and (j) of this section in accordance with the requirements of Part 7 of this Article. (e) From and after the effective date of the annexation ordinance, the territory and its citizens and property shall be subject to all debts, laws, ordinances and regulations in force in such municipality and shall be entitled to the same privileges and benefits as other parts of such municipality. Real and personal property in the newly annexed territory on the January 1 immediately preceding the beginning of the fiscal year in which the annexation becomes effective is subject to municipal taxes as provided in G.S. 160A-58.10. If the effective date of annexation falls between June 1 and June 30, and the effective date of the privilege license tax ordinance of the annexing municipality is June 1, then businesses in the area to be annexed shall be liable for taxes imposed in such ordinance from and after the effective date of annexation. (f) For purposes of this section, an area shall be deemed "contiguous" if, at the time the petition is submitted, such area either abuts directly on the municipal boundary or is separated from the municipal boundary by the width of a street or street right-of-way, a creek or river, or the right-of-way of a railroad or other public service corporation, lands owned by the municipality or some other political subdivision, or lands owned by the State of North Carolina. A connecting corridor consisting solely of a street or street right-of-way may not be used to establish contiguity. In describing the area to be annexed in the annexation ordinance, the municipal governing board may include within the description any territory described in this subsection which separates the municipal boundary from the area petitioning for annexation. (g) The governing board may initiate annexation of contiguous property owned by the municipality by adopting a resolution stating its intent to annex the property, in lieu of filing a petition. The resolution shall contain an adequate description of the property, state that the property is contiguous to the municipal boundaries and fix a date for a public hearing on the question of annexation. Notice of the public hearing shall be published as provided in subsection (c) of this section. The governing board may hold the public hearing and adopt the annexation ordinance as provided in subsection (d) of this section. (h) A city council which receives a petition for annexation under this section may by ordinance require that the petitioners file a signed statement declaring whether or not vested rights with respect to the properties subject to the petition have been established under G.S. 160A-385.1 or G.S. 153A-344.1. If the statement declares that such rights have been established, the city may require petitioners to provide proof of such rights. A statement which declares that no vested rights have been established under G.S. 160A-385.1 or G.S. 153A-344.1 shall be binding on the landowner and any such vested right shall be terminated. (i) A municipality has no authority to adopt a resolution or petition itself under this Part for annexation of property it does not own or have any legal interest in. For the purpose of this subsection, a municipality has no legal interest in a State-maintained street unless it owns the underlying fee and not just an easement. (j) Using the procedures under this section, the governing board of any municipality may annex by ordinance any distressed area contiguous to its boundaries upon presentation to the governing board of a petition signed by at least one adult resident of at least two-thirds of the resident households located within such area. For purposes of this subsection, a "distressed area" is defined as an area in which at least fifty-one percent (51%) of the households in the area petitioning to be annexed have incomes that are two hundred percent (200%) or less than the most recently published United States Census Bureau poverty thresholds. The municipality may require reasonable proof that the petitioner in fact resides at the address indicated. The evidence presented may include data from the most recent federal decennial census, other official census documents, signed affidavits by at least one adult resident of the household attesting to the household size and income level, or any other documentation verifying the incomes for a majority of the households within the petitioning area. Petitioners may select to submit name, address, and social security number to the clerk, who shall in turn submit the information to the Department of Revenue. (d) At the public hearing persons resident or owning property in the area described in the petition and persons resident or owning property in the municipality shall be given an opportunity to be heard. The governing board shall then determine whether the petition meets the requirements of this section. Upon a finding that the petition that was not submitted under subsection (b1) or (j) of this section meets the requirements of this section, the governing board shall have authority to pass an ordinance annexing the territory described in the petition. Annexation by petition. (a) The governing board of any municipality may annex by ordinance any area contiguous to its boundaries upon presentation to the governing board of a petition signed by the owners of all the real property located within such area. The petition shall be signed by each owner of real property in the area and shall contain the address of each such owner. (b) The petition shall be prepared in substantially the following form: DATE: To the _____________ (name of governing board) of the (City or Town) of ____________ 1. We the undersigned owners of real property respectfully request that the area described in paragraph 2 below be annexed to the (City or Town) of _________ 2. The area to be annexed is contiguous to the (City or Town) of _________ and the boundaries of such territory are as follows: (b1) Notwithstanding the provisions of subsections (a) and (b) of this section, if fifty-one percent (51%) of the households in an area petitioning for annexation pursuant to this section have incomes that are two hundred percent (200%) or less than the most recently published United States Census Bureau poverty thresholds, the governing board of any municipality shall annex by ordinance any area the population of which is no more than ten percent (10%) of that of the municipality and one-eighth of the aggregate external boundaries of which are contiguous to its boundaries, upon presentation to the governing board of a petition signed by the owners of at least seventy-five percent (75%) of the parcels of real property in that area. A municipality shall not be required to adopt more than one ordinance under this subsection within a 36-month period. For petitions received under subsection (b1) or (j) of this section, the clerk shall receive the evidence provided under subsection (l) of this section before certifying the sufficiency of the petition. Upon receipt of the certification, the municipal governing board shall fix a date for a public hearing on the question of annexation, and shall cause notice of the public hearing to be published once in a newspaper having general circulation in the municipality at least 10 days prior to the date of the public hearing; provided, if there be no such paper, the governing board shall have notices posted in three or more public places within the area to be annexed and three or more public places within the municipality. (d) At the public hearing persons resident or owning property in the area described in the petition and persons resident or owning property in the municipality shall be given an opportunity to be heard. The governing board shall then determine whether the petition meets the requirements of this section. Upon a finding that the petition that was not submitted under subsection (b1) or (j) of this section meets the requirements of this section, the governing board shall have authority to pass an ordinance annexing the territory described in the petition. The governing board shall have authority to make the annexing ordinance effective immediately or on the June 30 after the date of the passage of the ordinance or the June 30 of the following year after the date of passage of the ordinance. (d1) Upon a finding that a petition submitted under subsection (j) of this section meets the requirements of this section, the governing body shall have the authority to adopt an annexation ordinance for the area with an effective date no later than 24 months after the adoption of the ordinance. (d2) Upon a finding that a petition submitted under subsection (b1) of this section meets the requirements of this section, the governing body shall, within 60 days of the finding, estimate the capital cost to the municipality of extending water and sewer lines to all parcels within the area covered by the petition and estimate the annual debt service payment that would be required if those costs were financed by a 20-year revenue bond. If the estimated annual debt service payment is less than five percent (5%) of the municipality's annual water and sewer systems revenue for the most recent fiscal year, then the governing body shall within 30 days adopt an annexation ordinance for the area with an effective date no later than 24 months after the adoption of the ordinance. If the estimated annual debt service payment is greater than or equal to five percent (5%) of the municipality's annual water and sewer systems revenue for the most recent fiscal year, then the governing body may adopt a resolution declining to annex the area. If such a resolution is adopted, the governing body shall immediately submit a request to the Local Government Commission to certify that its estimate of the annual debt service payment is reasonable based on established governmental accounting principles. (1) If the Local Government Commission certifies the estimate, the municipality is not required to annex the area and no petition to annex the area may be submitted under subsection (b1) of this section for 36 months following the certification. During the 36-month period, the municipality shall make ongoing, annual good faith efforts to secure Community Development Block Grants or other grant funding for extending water and sewer service to all parcels in the areas covered by the petition. If sufficient funding is secured so that the estimated capital cost to the municipality for extending water and sewer service, less the funds secured, would result in an annual debt service payment cost to the municipality of less than five percent (5%) of the municipality's annual water and sewer systems revenue for the most recent fiscal year, then the governing body shall within 30 days adopt an annexation ordinance for the area with an effective date no later than 24 months after the adoption of the ordinance. (2) If the Local Government Commission notifies the governing board that the estimates are not reasonable based on established governmental accounting principles and that a reasonable estimate of the annual debt service payment is less than five percent (5%) of the municipality's annual water and sewer systems revenue for the most recent fiscal year, then the governing body shall within 30 days of the notification adopt an annexation ordinance for the area with an effective date no later than 24 months after the adoption of the ordinance. (d3) Municipal services shall be provided to an area annexed under subsections (b1) and (j) of this section in accordance with the requirements of Part 7 of this Article. (e) From and after the effective date of the annexation ordinance, the territory and its citizens and property shall be subject to all debts, laws, ordinances and regulations in force in such municipality and shall be entitled to the same privileges and benefits as other parts of such municipality. Real and personal property in the newly annexed territory on the January 1 immediately preceding the beginning of the fiscal year in which the annexation becomes effective is subject to municipal taxes as provided in G.S. 160A-58.10. If the effective date of annexation falls between June 1 and June 30, and the effective date of the privilege license tax ordinance of the annexing municipality is June 1, then businesses in the area to be annexed shall be liable for taxes imposed in such ordinance from and after the effective date of annexation. (f) For purposes of this section, an area shall be deemed "contiguous" if, at the time the petition is submitted, such area either abuts directly on the municipal boundary or is separated from the municipal boundary by the width of a street or street right-of-way, a creek or river, or the right-of-way of a railroad or other public service corporation, lands owned by the municipality or some other political subdivision, or lands owned by the State of North Carolina. A connecting corridor consisting solely of a street or street right-of-way may not be used to establish contiguity. In describing the area to be annexed in the annexation ordinance, the municipal governing board may include within the description any territory described in this subsection which separates the municipal boundary from the area petitioning for annexation. (g) The governing board may initiate annexation of contiguous property owned by the municipality by adopting a resolution stating its intent to annex the property, in lieu of filing a petition. The resolution shall contain an adequate description of the property, state that the property is contiguous to the municipal boundaries and fix a date for a public hearing on the question of annexation. Notice of the public hearing shall be published as provided in subsection (c) of this section. The governing board may hold the public hearing and adopt the annexation ordinance as provided in subsection (d) of this section. (h) A city council which receives a petition for annexation under this section may by ordinance require that the petitioners file a signed statement declaring whether or not vested rights with respect to the properties subject to the petition have been established under G.S. 160A-385.1 or G.S. 153A-344.1. If the statement declares that such rights have been established, the city may require petitioners to provide proof of such rights. A statement which declares that no vested rights have been established under G.S. 160A-385.1 or G.S. 153A-344.1 shall be binding on the landowner and any such vested right shall be terminated. (i)A municipality has no authority to adopt a resolution or petition itself under this Partfor annexation of property it does not own or have any legal interest in. For the purpose of this subsection, a municipality has no legal interest in a State-maintained street unless it owns the underlying fee and not just an easement. (j)Using the procedures under this section, the governing board of any municipality mayannex by ordinance any distressed area contiguous to its boundaries upon presentation to the governing board of a petition signed by at least one adult resident of at least two-thirds of the resident households located within such area. For purposes of this subsection, a "distressed area" is defined as an area in which at least fifty-one percent (51%) of the households in the area petitioning to be annexed have incomes that are two hundred percent (200%) or less than the most recently published United States Census Bureau poverty thresholds. The municipality may require reasonable proof that the petitioner in fact resides at the address indicated. (k)The petition under subsection (j) of this section shall be prepared in substantially the following form: DATE: To the ___________ (name of governing board) of the (City or Town) of ______________ 1.We the undersigned residents of real property believe that the area described inparagraph 2 below meets the requirements of G.S. 160A-31(j) and respectfully request that the area described in paragraph 2 below be annexed to the (City or Town) of _________.2.The area to be annexed is contiguous to the (City or Town) of ________, and theboundaries of such territory are as follows:(l)For purposes of determining whether the percentage of households in the area petitioning for annexation meets the poverty thresholds under subsections (b1) and (j) of this section, the petitioners shall submit to the municipal governing board any reasonable evidence that demonstrates the area in fact meets the income requirements of that subsection. The evidence presented may include data from the most recent federal decennial census, other official census documents, signed affidavits by at least one adult resident of the household attesting to the household size and income level, or any other documentation verifying the incomes for a majority of the households within the petitioning area. Petitioners may select to submit name, address, and social security number to the clerk, who shall in turn submit the information to the Department of Revenue. Such information shall be kept confidential and is not a public record. The Department shall provide the municipality with a summary report of income for households in the petitioning area. Information for the report shall be gleaned from income tax returns, but the report submitted to the municipality shall not identify individuals or households.
