Lucas, Town Clerk AGENDA ITEM Consideration of ABC Board Appointment ITEM SUMMARY Per the requirements of GS § 18B-700, the Lillington Board of Alcoholic Control has one (1) vacancy open for appointment. Mr. Norman Franklin Lewis has requested reappointment to the Board. If appointed, his term will expire October 2028. The Town Clerk received no other applications. § 18B-700. Appointment and organization of local ABC boards. (a) Membership. – A local ABC board shall consist of three or five members appointed for three-year terms unless the board is a board for a merged ABC system under G.S. 18B-703 and a different size membership has been provided for as part of the negotiated merger. If the board is a three-member board, one member of the initial board of a newly created ABC system shall be appointed for a three-year term, one member for a two-year term, and one member for a one-year term. If the board is a five-member board, one member of the initial board of a newly created ABC system shall be appointed for a three-year term, two members for two-year terms, and two members for one-year terms. As the terms of initial board members expire, their successors shall each be appointed for three-year terms. If a board is initially a three-member board and the appointing authority determines a five-member board is preferable, the terms of the two new members shall be for three years. If a local board has five members and the appointing authority determines a three-member board is preferable, the appointing authority shall not reduce the size of the board except upon the expiration of a member's term and only with the approval of the Commission. The appointing authority shall designate one member of the local board as chairman. RECOMMENDED ACTION Appoint ABC Board Member. AGENDA ITEM #4 AGREEMENT BETWEEN MID-CAROLINA REGIONAL COUNCIL and TOWN of LILLINGTON for the provision of Technical Service Assistance This AGREEMENT, entered into on October ___, 2025, by and between Mid-Carolina Regional Council (hereinafter referred to as the "Council") and the Town of Lillington, North Carolina (hereinafter referred to as the "Local Government"); WITNESSETH THAT: WHEREAS, the Council is empowered to provide technical assistance by the North Carolina General Statutes and by resolution passed by the Council on April 17, 1972. Technical assistance shall consist of the provisions of services as described in Attachment A, which is herein made part of this AGREEMENT; WHEREAS, the Local Government has requested the Council to provide such technical assistance to the Local Government; and WHEREAS, the Council desires to cooperate with the Local Government in every way possible to the end that the proposed activities are carried out in an efficient and professional manner; NOW, THEREFORE, the parties hereto do mutually agree as follows: 1. Personnel That during the period of this Contract, the Council will furnish the necessary trained personnel to the Local Government to perform the tasks outlined in Attachment A Work Program. 2. Compensation That for the purpose of providing funds for carrying out this Contract, the Local Government will pay the Council the following rates based on the services provided: • Code Enforcement Services: $60/hour • Zoning Administration: $60/hour • Planning Services: $75/hour • Clerical Services: $65/hour • Administrative Services: $82/hour The only compensation received will be travel costs and the hourly rate as listed above unless agreed upon in writing by both parties. The Council shall invoice the Local Government on a monthly basis for the services provided for the prior month. 3. Materials/Work Product All materials produced will be property of the Local Government (i.e. applications, forms, templates, policies, etc.). 4. Time of Performance The contract shall begin October _____, 2025 until terminated by either party according to the specification in item number 5. 5. Termination/Modifications The Local Government may from time-to-time request changes in the scope of work or services to be performed by the Council hereunder. Such changes, including any increases or decreases in the Council's compensation, which are mutually agreed upon by and between the Local Government and Council, shall be incorporated as written amendments to the Contract. The Local Government or the Council may terminate this AGREEMENT by giving a 15 days written notice (electronic or paper). 6. Interest of Members, Officers, or Employees of the Council, Members of the Local Government, or Other Public Officials No member, officer, or employee of the Council or its agents; no member of the governing body of the locality in which the program is situated; and no other public official of such locality or localities who exercises any functions or responsibilities with respect to the program during his or her tenure or for one year thereafter, shall have any financial interests, either direct or indirect, in any contract or subcontract, or the proceeds thereof, for work to be performed in connection with the program assisted under this Agreement. Immediate family members of said members, officers, employees, and officials are similarly barred from having any financial interests in the program. The Council shall incorporate, or cause to be incorporated, in all such contracts or subcontracts, a provision prohibiting such interest pursuant to the purpose of this section. 7. Nondiscrimination Clause No person in the United States shall on the grounds of race, color, national origin, or sex be excluded from participation in, be denied the benefits of, or be subjected to discrimination with any program or activity funded in whole or in part with funds available under the Housing and Development Act of 1974, Section 109. 8. Age Discrimination Act of 1975 as amended No qualified person shall on the basis of age be excluded from participation in, denied the benefits of, or otherwise be subjected to discrimination under any program or activity which receives benefits from federal financial assistance. 9. WORK PROGRAM/BUDGET This is an agreement attached to and made part of the August 1, 2025 AGREEMENT between the Town of Lillington, North Carolina (hereinafter referred to as "Local Government") and Mid-Carolina Regional Council (hereinafter referred to as "Council") providing for technical assistance related to staffing needs, special projects on an hourly basis, and any other services the Local Government requests agreed to in writing. The basic services to be provided by Council are outlined below. 2. WORK PROGRAM/SCOPE OF SERVICES The intent of this AGREEMENT is for the Council to provide qualified professional personnel as technical assistance to the Local Government consistent with applicable federal laws, state laws, and town ordinances beginning October ____, 2025. Leveraging experience and resources possessed by Council staff, Council will consult and advise the Local Government consistent with applicable clerical, administrative, financial, accounting practices, planning and zoning, code enforcement, and governmental regulations. 3. SERVICES TO BE PROVIDED The following activities are illustrative of the services to be provided by Council to the Local Government: • Code Enforcement Services: o Mid-Carolina will provide a Code Enforcement Officer (CEO) to the Town of Lillington on an hourly basis, as requested by the Town. o The CEO will be responsible for the following: o Nuisance abatement according to the Town’s code of ordinance to include but not be limited to tall grass, junk vehicles and junk debris. o Housing code enforcement. The CEO will work with the appropriate building code officials to enforce the building regulations to include but not be limited to minimum housing, condemnation, and commercial maintenance code. o Solid waste ordinance enforcement. o The CEO will investigate all complaints, send the appropriate violation letters, conduct follow-up, abate violations, and close all cases (if applicable). • Zoning Administration: o Mid-Carolina will provide a Zoning Administrator to administer the Town zoning ordinance on an hourly basis, as requested by the Town. The Zoning Administrator will be responsible for zoning verification letters, zoning permits, zoning violations and any other zoning related task requested by the Town. o The Zoning Administrator will process all zoning permits and verification letters based on the Town’s current process. AGENDA ITEM #5 CAPITAL PROJECTS UPDATE SCIF Grants Downtown Facilities Stewart, Inc. is continuing to work on the construction drawings for Downtown. The Town has entered into a contract with Duke Energy including a non-refundable deposit of $90K. Duke has submitted their final design for underground utilities. A new easement for the underground utilities will have to be acquired to move forward with construction. There is approximately thirty different property owners. Staff is waiting for a list of required easements to begin the process of acquisition. Staff are continuing to work closely with Duke Energy and Pike. Staff has submitted review comments to Stewart and are currently working through those now. McAdams has submitted final construction drawings for underground stormwater infrastructure for the Downtown blocks. Pike Engineering submitted the pedestrian and roadway lighting and parking lot lighting and it’s under review by staff. Pike Engineering is doing both the roadway lighting and the parking lot lighting as a subconsultant for Duke Energy. Staff met with Pike Engineering streetscape lighting team August 15th to further discuss the streetscape design and some of the additions requested by staff. A revised site plan has been submitted for review. Stormwater Resiliency Funds Staff were notified that the State allocated $3.5 million for Stormwater infrastructure improvements and stream restoration, to provide more efficient stormwater management and flood resiliency. Project components will include stormwater management, replacing undersized culverts, and stabilizing streambanks to improve flood resiliency. Projects: 1. Downtown Stormwater Improvements • Final construction design is pending site negotiations. • Survey work for the site should begin in the next two weeks • Consultants are coordinating with the railroad RJ Corman to put in an additional crossing. • Construction drawings are underway and once completed soliciting for bid will begin. 2. Railroad Crossing • Staff were not successful in partnering with the railroad to complete this project, but the town has infrastructure outside of the railroad piping and we are working to get this repaired. This will improve the flooding that currently happens at this location. There is a large pipe network that belongs to the Town that staff has slated to repair with the flood resiliency funds. • The stormwater infrastructure has been CCTV and has been reviewed. There are no major concerns with the condition of the pipe. • Staff is hopeful to keep this project in the informal bidding range 3. 13th Street Reservoir • McAdams is recommending upsizing the northernmost culvert crossing on S 13th Street to dual RCBC box culverts to eliminate roadway overtopping for the 10 and 25-Year design storms. Although this recommendation is a slight deviation from the 15’W x 6’H RCBC, which is listed as the preferred design alternative (#2) in the previous Town of Lillington Stormwater Assessment, it will better maintain existing stream geometry and lend to more feasible construction and procurement of materials. • All easements have been acquired. • Staff has reviewed the bidding and contract documents and sent comments back to McAdams • Staff will begin soliciting bids for this project before the end of the year Golden Leaf Application Stormwater Harnett Street Project Description: The proposed storm drainage improvements would include removal and replacement of existing storm drainage pipe, ranging from 15” RCP to 30” RCP, and removal and replacement of storm drainage structures, including catch basins, drop-inlets, storm drainage manholes, and storm drainage headwalls. The proposed storm drainage infrastructure will effectively capture storm runoff, convey stormwater efficiently inside public right-of-way, and increase the level of service of the storm drainage system. In addition, private storm drainage infrastructure would be relocated to the Town Right-of-Way to allow for easier access for future maintenance and inspections. The probable cost of this project is $1.3 million, the Town has agreed to contribute $250,000 to the project. The Golden Leaf Grant Agreement was approved in June 2024. A project ordinance confirming the Town’s financial contribution was approved at the August 2024 Regular Meeting. Final construction drawings have been submitted and reviewed by staff. Once the project has been solicited for bid and a contractor is selected, staff will request an extension from Golden Leaf. When submitting the quarterly report to Golden Leaf staff will request that extension request at that time. The extension request will be for twelve months to ensure we have adequate time to complete the construction project and all grant requirements. Fire Station #3 Construction has begun on Fire Station #3 located on Hwy 210. Exterior framing is scheduled to be completed in the week of November 17th. Interior framing will be completed the week of November 24th. Mechanical, electrical, and plumbing rough-in has started and will continue to over the next two weeks. The schedule is currently moving along with no major changes. ARPA S.L. 2022-74 Appropriated Projects All documentation was submitted to the State to fund the Hwy 210 sewer line expansion and Southern Regional Sanitary Sewer/Poorhouse Creek installation of new sanitary sewer interceptor and regional pump station. The total allocation was $9,250,000. Staff has received the offer and acceptance letter from the Department of Water Infrastructure. a. South Regional/Poorhouse Creek Staff attended a progress meeting October 28, 2025. All four bores are completed. The contractor has installed force main down Edwards Brothers Drive and it is currently being tested. Pump Station construction will begin this month and the projected startup date is June 2026. LASII Grant Staff submitted the LASII grant application October 2, 2023 requesting $500,000 to develop and implement a new stormwater utility to provide a predictable, equitable and ongoing funding source for its stormwater program. The activities that the Town seeks to accomplish with the funding that the utility will provide include: • Increasing the flood resiliency of the transportation system in and through the Town; • Funding stormwater Capital Improvement Projects (CIPs) to address stormwater quantity and quality issues; • Handling critical maintenance needs and operations; and • Meeting planning and implementation needs. The scoping document was approved by DWI, the grant agreement and the acceptance of funding resolution was approved at the August meeting. The McAdams engineering services contract was approved at the August meeting. The project schedule is two years, with a completion date of August 2026. Staff are continuing to have monthly progress meetings with McAdams. Assets have been mapped and inventoried. Once the H & H study is completed, we can begin the Capital Improvement Plan that will be instrumental in the creation of the stormwater utility fee. Staff met with the Stormwater Advisory committee twice and they have a rate to recommend to the Town Board. Staff will brief the Board on the recommended rate and what that looks like in the future. A minimum of two public information sessions will be held at the beginning of the year. S.L. 2023 Appropriated Funds The Town was appropriated $11,062,500 through Session Law in 2023. Administrative cost for the funds is $331,875.00. Available funds remaining are $10,730,625. Additional Proposed projects with remaining funds: 1. Water Tank $4.5 million • Request for Qualifications were accepted at Town Hall July 16th at 2:00pm • Four firms submitted and are currently under review • Request for funding have been approved by DWI and all required documents are on the consent agenda for approval. • Project Ordinance has been approved • Contract with firm was approved and staff will begin working with them in the coming weeks and should have a project schedule timeline. • Weston & Sampson is the selected firm and we are working to locate and acquire a site • The land is currently under the acquisition process 2. WWTP project $3.1 million • Request for funding have been approved by DWI • Project Ordinance has been approved • Staff is currently working with HRW to complete disbursement request for the project. North Harnett WWTP Capacity Upgrade Harnett County has begun the process of submitting reimbursement requests to the Town for the Town’s portion of the WWTP. Currently, there are three outstanding invoices that Town staff is waiting for DWI to approve. Substantial completion October 2027. Locally Administered Projects Program (LAPP) Staff applied for the 10th Street bypass project and submitted the application October 31, 2025. The estimated cost is $1.8 million with a local match of $360,000. The Locally Administered Projects Program (LAPP) was first adopted by the NC Capital Area MPO on October 20, 2010. The program is used by the MPO to prioritize and program local transportation projects in the region that utilize federal funding. LAPP is a competitive funding program managed by CAMPO that prioritizes locally administered projects in the Region. These projects are funded using federal funding sources directly attributed to the region with a minimum 20% local match.
