If you need to record 10 more lots in a small phase instead, then I am fine with that also. Hi Ritchie, Just wanted to keep you informed/in the loop…the UMA (soil stabilization guys) are back at work on the Birchwood Grove/401 widening work today. The schedule would have them completing the areas that needed a second go late this week/early next and then, with favorable test results, Terrahawk will get going on the actual widening (they estimate 2-3 weeks depending on weather). I know that this phase of road widening is late and the leniency that you/NCDOT have shown is MUCH appreciated – again, our development leader that put us in this position is out of the organization, and we are trying to catch up. I hope that you recognize the efforts since we picked up the ball again in March – making sure that between NCDOT and engineering plans and contractor plans we were embarking on the right project scope of work; staking, flagging, testing; scheduling the soil stabilization specialty company (a real challenge); doing the stabilization work; and then the cure and test period – which has gotten us this far. As Scott communicated, 150 feet of the 800 feet of stabilization work needs additional treatment, cure time, and re-testing, and we are working to get the soil stabilization specialty company back out to do the work (we have a soft commitment from them for next Tuesday). Once that passes, Terrahawk – the site contractor – says we should have about 2-3 weeks of road widening, turn lane, overlay work. If the soil stabilization had ‘passed’ fully the first time around, we would be wrapping up the paving work now. As is, this will clearly push into December. OUR objective is to get this done as soon as possible – no intention of letting weather or asphalt plant maintenance or anything else get in the way. Thank you again for your help/cooperation. A modest release for 10-15 permits would be greatly appreciated. (Remember, in addition to our ‘word’ commitment, the project is fully bonded, and there are more permits needed in the current phase, and there is a following phase. Doug, I appreciate your team trying to move ahead with the roadway improvements, but please note that I have been advised by your team since March of 2022 that the deficiencies on this US route would be corrected. In an effort to compromise and work with your team, my staff has signed final plats for entire phases, provided built to standards letter, signed a plat with just a few lots to help you keep pre-sales, etc. - things we typically do NOT do in situations where a Developer has not fulfilled the requirements of the approvals issued by my office. Most recently, I was told that all the work would be completed by the end of October. I understand that there were issues with soils stabilization over the waterline that prevented this from occurring, but to the best of my knowledge, this stabilization work was “cured” two or three weeks ago and I still have not seen any roadway work on US 401. We are effectively into December when you factor in Thanksgiving, when we typically have to plan paving around asphalt plant maintenance and weather. We often reach December and just delay our paving until April when temperatures are less risky and we will likely get a better project. It seems that this is where your project is headed as well? I would be more inclined to offer some relief and consider another small plat as a compromise if I saw work on your end as well. When do you estimate I will see a Contractor working? I am the KB Home division president for the area. I know that you and your NCDOT team have been working with/communicating with Scott Johnson, our development leader, on the completion of the road widening obligations associated with the Birchwood Grove community in Harnett County. THE PURPOSE OF THIS EMAIL IS TO MAKE ANOTHER PLEA FOR YOU TO RELEASE THE PERMIT HOLD ON THE COMMUNITY. We acknowledge that we are late on completing the widening – not intentionally, we don’t know why our previous development leader did not get this done, but that is one of the reasons that he is gone. Since Scott Johnson’s involvement, I hope you would agree that we have moved full speed ahead – getting the plans confirmed, waterline and ROWs staked for construction, proceeding with the soil stabilization work associated with the waterline and ready to proceed with completing that work and then getting the actual widening/overlay done ASAP. The project is fully bonded, and we have been working diligently through the work. We are stopped for a bit as we can’t do lane closures over Thanksgiving week, but we are prepared to crank back up right after. At this point, not being able to submit permits is crippling for the Birchwood Grove community – we are at a point where we will have to return deposits from future homeowners and force them back into the home search process because we can’t meet our committed timeframes and at a point where we will have to lay off or move the sales and builder team in the community. I recognize that the situation is KB Home’s responsibility – not NCDOT’s – but you are certainly in a position to provide some relief. Again, I am making a plea for the release of permits for Birchwood Grove. If you can’t see fit to release the full platted phase 3, just the ability to move forward with 10-15 permits would provide some relief while we complete the widening. Again, we are actively working on the widening; the project is fully bonded; and there is a 4th phase in Birchwood Grove that you could stop if we don’t perform. Thank you for your consideration.
