Regular Meeting Minutes
September 2, 2025
The Harnett County Board of Commissioners met in regular session on Tuesday, September 2, 2025 at
9:00 am, in the Commissioners Meeting Room, Harnett County Resource Center and Library, 455
McKinney Parkway, Lillington, North Carolina.
Members present: Matthew B. Nicol, Chairman

Chairman Nicol called the meeting to order at 9:00 am.
Vice Chairman Morris led the Pledge of Allegiance and provided the invocation.
Chairman Nicol called for any additions or deletions to the published agenda. Commissioner Jaggers made
a motion to approve the agenda as published. The motion was seconded by Vice Chairman Morris and
carried unanimously.
Vice Chairman Morris made a motion to approve the consent agenda. Commissioner Jaggers seconded
the motion. The motion passed unanimously. The items on the consent agenda were as follows:
A. Minutes
i. Regular Meeting Minutes of August 18, 2025
B. Harnett Regional Water requests the Board to approve the Northeast Harnett Water
Treatment Facility Project Ordinance. This project involves the permitting, design, and
construction of a new 10-20 MGD water treatment facility in Erwin, NC. This water
treatment facility will primarily serve the Northeast Harnett Service Area as well as the
Towns of Erwin and Coats. (Attachment 1)
C. Harnett Regional Water requests the Board to award an engineer contract in the amount
of $400,000.00 to Hazen and Sawyer for the Water System Master Plan Update.
D. General Services requests the Board of Commissioners approve contract negotiations
with Moseley Architects, Raleigh NC. After considerable deliberation from the RFQ
Review Committee, Moseley is rated the most qualified firm to design the Animal
Adoption Center. Moseley Architects' design team includes Moseley Architects, Shelter
Planners of America, and WithersRavenel.

E. General Services requests the Board of Commissioners to approve the US Department of
Agriculture (USDA) Housing Preservation Grant application in the amount of $95,000.
F. The Jetport Director requests the Board of Commissioners to approve an agreement with
Southeastern Aero, LLC to operate a Special Aviation Service Organization (SASO) to
provide maintenance activities at Harnett Regional Jetport. The term of the agreement
will be from July 1, 2025 to June 30, 2028 with Southeastern Aero providing an annual
payment of $900.00.
G. Legal requests the Board of Commissioners approve Purdue Pharmaceutical Settlement
and Second Opioid Manufacturer Settlements and adopt a Resolution authorizing the
execution of the opioid settlements with secondary opioid manufacturers. (Attachment
2)
H. Legal requests approval of the Johnston -Lee -Harnett Community Action lease agreement.
The new rent amount is $431 and the terms of the new lease are an initial term of two
years with three one-year options to renew.
I. Harnett County Senior Staff Attorney requests public disclosure of Settlement Agreement
and Mutual Release in The Spruill Construction Corporation v. County of Harnett. Case
settled in the amount of $92,500.00 on August 11, 2025.
J. Harnett County Senior Staff Attorney requests public disclosure of Mediated Settlement
Agreement in Marcus Washington and Rachel Washington v. Harnett County, North
Carolina (24CV2131-420). Case settled in the amount of $52,500.00 on August 22, 2025.
K. The North Carolina Home Builders Charitable and Educational Foundation is requesting
the Board of Commissioners approve the reimbursement of all appliable fees for the
construction of a house located at 460 Beacon Hill Road, Lillington, NC. The purpose of
the build is to provide funds to Deputy Chris Johnson's family. The estimated building
fees are $1,275 and water tap fees are $3,440 for a total fee reimbursement of $4,715.
L. As discussed at the August 26, 2025 Work Session, the Board of Commissioners would
like to appoint Nancy Jackson (District 2) and Lyndra Johnson (District 5) to the Harnett
County Commission for Women and Youth, appoint Abigale Farina as an alternate
member to the Dangerous Dog Committee and reappoint William Dan Andrews to the
Board of Adjustment (District 4).
Commissioner Matthews read and presented a copy of the Library Card Sign-up Month Proclamation.
The Harnett County Board of Commissioners proclaimed September 2025 as Library Card Sign-up
Month in Harnett County and encouraged all residents to sign up for a library card and explore the
endless possibilities it offers.
Commissioner Matthews read and presented a copy of the School Attendance Awareness Month
Proclamation. The Harnett County Board of Commissioners proclaimed the month of September 2025
as: Attendance Awareness Month in Harnett County and called upon all Harnett County schools,
students, families, community agencies, and civic organizations to work collaboratively to eliminate
barriers to attendance and ensure every student is present, engaged, and learning every day.
Chairman Nicol opened the meeting for informal comments by the public, allowing up to 3 minutes for
each presentation up to 30 minutes. The following people provided comments:

No one else spoke and the public comment period was closed.
Brent Trout, County Manger, reminded everyone of the Town Hall Meeting on Thursday at 6:00 -7:30
pm. Commissioner McKoy is hosting the Town Hall and it will be held here in the RCL Building.
Commissioner McKoy made a motion to approve the budget amendments as requested by the Finance
Officer. The motion was seconded by Vice Chairman Morris and carried unanimously. (Attachment 3)
Vice Chairman Morris stated after looking at the Board of Election pay; I had Mr. Morrow and
management folks pull a list of what other Board of Elections are paid. They have not had a raise in a
number of years. Commissioner McKoy stated she would like to hear from the Board of Elections and
director on what they would like to see. Mr. Trout stated we could add it to the next work session and
have them bring forward some information and a recommendation as to what they would like you to
consider. Consensus of the Board was to add this to the next work session.
Commissioner Jaggers made a motion to go into Closed Session for the following purposes: consultation
with and instructions to the county staff concerning the position to be taken by the County in negotiating
a proposed contract for the acquisition of real property and to consult with the county legal staff in order
to preserve the attorney -client privilege concerning the handling of certain litigation, namely the
worker's compensation claim of "Amanda Dunn v. County of Harnett" IC File NO.23-011193. This
motion is made pursuant to NC General Statute Section 143-318.11 (a)(5) and (3). The motion was
seconded by Vice Chairman Morris and carried unanimously.
Following a motion to come out of Closed Session, Chairman Nicol called the meeting back into open
session.
Commissioner Jaggers made a motion to adjourn at 10:07 am. The motion was seconded by Chairman
Nicol and carried unanimously.

Northeast Harnett Water Treatment Facility
CAPITAL PROJECT ORDINANCE
BE IT ORDAINED by the Board of Commissioners of Harnett County, North Carolina, sitting as the governing board for Harnett
County.
Section 1. The Northeast Harnett Water Treatment Facility project involves the permitting, design, and construction of a new
8-15 MGD water treatment facility in Erin NC. This water treatment facility will primarily serve the Northeast
Harnett Service Area as well as the Towns of Erin and Coats. This new water supply to these growth corridors will
allow for more capacity in the existing Harnett Regional Water Treatment Facility to service increasing water
demand in the north, central and west sides of Harnett County. Regional partnerships with surrounding
communities on the south and east of Harnett County are being explored in order to expand access to water
services.

RESOLUTION BY THE HARNETT COUNTY BOARD OF COMMISSIONERS
AUTHORIZING EXECUTION OF OPIOID SETTLEMENTS WITH SECONDARY
OPIOID MANUFACTURERS, PURDUE PHARMA LP, AND THE SACKLER FAMILY,
AND APPROVING THE THIRD SUPPLEMENTAL AGREEMENT FOR ADDITIONAL
FUNDS BETWEEN THE STATE OF NORTH CAROLINA AND LOCAL
GOVERNMENTS ON PROCEEDS RELATING TO THE SETTLEMENT OF OPIOID
LITIGATION
WHEREAS more than 41,500 North Carolinians lost their lives to a drug overdose from
2000-2023.
WHEREAS the Centers for Disease Control and Prevention has estimated the total
economic burden of prescription opioid misuse alone in the United States to be $78.5 billion a
year, including the costs of healthcare, lost productivity, addiction treatment, and criminal justice
involvement;
WHEREAS, Harnett County's drug overdose death rate in 2024 was 31.8 per 100,000
residents, which represents 45 total deaths for that year, and the drug overdose emergency
department visit rate in 2024 was 10 1. 8 trips per 100,000 residents, which represents 144 total ED
visits for that year; and
WHEREAS certain counties and municipalities in North Carolina joined with thousands
of local governments across the country to file lawsuits against opioid companies, manufacturers,
pharmaceutical distributors, and chain drug stores to hold those companies accountable for their
misconduct;
WHEREAS settlements (collectively "the Secondary Opioid Manufacturer Settlements")
have been reached in litigation against Alvogen, Inc., Amneal Pharmaceuticals LLC, Apotex
Corp., Hikma Pharmaceuticals USA Inc. f/k/a West -Ward Pharmaceuticals Corp., Indivior Inc.,
Sun Pharmaceutical Industries, Inc., Viatris Inc., and Zydus Pharmaceuticals (USA) Inc., as well
as their subsidiaries, affiliates, officers, and directors (collectively "the Secondary Opioid
Manufacturer Defendants") named in the Secondary Opioid Manufacturer Settlements;
WHEREAS representatives of local North Carolina governments, the North Carolina
Association of County Commissioners, and the North Carolina Department of Justice have
negotiated and prepared a Third Supplemental Agreement for Additional Funds ("SAAF-3 ") to
provide for the equitable distribution of the proceeds of the Secondary Opioid Manufacturer
Settlements;
WHEREAS settlements have been reached, under Purdue Pharma L.P.'s bankruptcy
plan, whereby Purdue Pharma L.P. ("Purdue") and members of the Sackler family will pay
approximately $7.4 billion to settle opioid claims across the nation, which settlements would be
subject in North Carolina to the equitable distribution of the proceeds as set forth in the
Memorandum of Agreement ("MOA") which has already been approved by this Board;
WHEREAS by joining the Secondary Opioid Manufacturer Settlements, approving the
SAAF-3, and approving the bankruptcy plan and settlements relating to Purdue and the Sackler
family, the state and local governments maximize North Carolina's share of opioid settlement
funds to ensure the needed resources reach communities, as quickly, effectively, and directly as
possible;
WHEREAS it is advantageous to all North Carolinians for local governments, including
Harnett County and its residents, to sign onto the Secondary Opioid Manufacturer Settlements,
SAAF-3, and approving the bankruptcy plan and settlements relating to Purdue and the Sackler
family, in order to demonstrate solidarity in response to the opioid overdose crisis, and to
maximize the share of opioid settlement funds received both in the State and this County to help
abate the harm; and
WHEREAS both the MOA and SAAF-3 directs substantial resources over multiple years
to local governments on the front lines of the opioid overdose epidemic while ensuring that these
resources are used in an effective way to address the crisis.
NOW, THEREFORE, BE IT RESOLVED that the Harnett County Board of
Commissioners hereby authorizes the County Manager to execute the necessary documents to
enter into opioid settlement agreements, as set forth herein, with the Secondary Opioid
Manufacturer Defendants, to execute the SAAF-3, and to approve the bankruptcy plan and
settlement agreements relating to Purdue and the Sackler family, and to provide such documents
to Rubris, the Implementation Administrator.

HARNETT COUNTY RIVERSIDE DRAINAGE ASSESSMENT
CAPITAL PROJECT ORDINANCE AMENDMENT
BE IT ORDAINED by the Board of Commissioners of Harnett County, North Carolina, sitting as the governing board for
Harnett County.
Section 1. The Riverside Community of Harnett County, located in the southeastern potion of the County, has
experienced long-term drainage issues. The citizens of the community have requested assistance in
identifying and remediating flooding and drainage in the low lying areas. The Soil & Water Conservation
District staff have conducted site visits to assess the drainage needs and organized community meetings
to hear the concerns of the citizens. The Staff of the district, along with a third party, conducted a
watershed analysis to further assist in identifying drainage improvements in the Riverside community.
This project ordinance will allow the county to continue the implementaion of the assessment and
remediation of the drainage issue.

This project consists of the renovation and construction of several projects identified in the Capital
Improvements Program. The activities will include the renovation and monumentalizing of the Old
Boone Trail School Entryway, the creation of mountain biking trails and associated amenities at
Anderson Creek Park, the construction of new restroom facilities at the Patriots Park and the
replacement and construction of ballfield fencing at the newly developed Benhaven Community
Park. A State Capital Infrastructure Grant (S.L. 2021.180) administered through OSBM will provide
the funding for this project as well as a transfer from the Parks Capital Reserve Fund.
