Minutes of Regular Meeting
March 15, 2004
The Harnett County Board of Commissioners met in regular session on March 15,
2004, in Courtroom 6, Harnett County Courthouse, 301 West Cornelius Harnett
Boulevard, Lillington, North Carolina.

Vice Chairman Hill called the meeting to order at 7 :00 p.m. and Commissioner
Titchener led the pledge of allegiance and prayer.
Commissioner Andrews moved to approve the agenda as published with addition of
items listed below to the consent agenda. Commissioner Titchener seconded the
motion and it passed unanimously.

Upon motion by Commissioner McNeill and seconded by Commissioner Andrews,
the Board unanimously approved the following items on the consent agenda:

4. Contracts awarded for Western Harnett Industrial Park and Edgerton II Industrial
Park (Attachment 2)
5. Department name changes: In order to clarify responsibilities and better identify
departments, Personnel will become the Department of Human Resources and
the current Department of Human Resources will become the Department of
Workforce Development/Job Link Career Center. This change will become
effective July 1, 2004.
6. Work Authorization No.2 701-0301. This authorization provides final design,
development of bid documents, and assistance in receiving bids for the relocation
of Old Stage Road. Old Stage road project will be coordinated with and approved
by the NC Department of Transportation.
7. Project Ordinance for Raw Water Intake Upgrade Project (Attachment 3)
8. Engineering agreement with Marziano & Minier for Raw Water Intake Upgrade
Project in the amount of $85,000.
9. Authorize acceptance of $5,000 grant for RSVP (Retired Senior Volunteer
Program) from the National Council on Aging in conjunction with the Points of
Light Foundation to provide access to a web-based service designed to help older
adults, their families, caregivers and community organizations determine benefits
for which they may qualify.
10. Project Ordinance authorizing an Expansion Feasibility Study of the Law
Enforcement and Detention Center. This study will consider options which will

include expanding and renovating at the existing site, and building a new facility
at the County Complex. (Attachment 4)
11. Authorization for Cooperative Extension to submit an application to the
Department of 4-H Youth Development 2004 Summer School-Age Care
Availability Grant in the approximate amount of$25,000. Ifreceived, the funds
will be used to increase the number of slots available for quality and safe Summer
School-Age Care.
12. Authorization for Sheriff s Department to submit a grant proposal to the Criminal
Justice Partnership Program for funding in the amount of $85,246
13. Resolution authorizing purchase of school buses by Harnett County Schools
(Attachment 5)
Commissioner Andrews moved for the appointments listed below. Commissioner
McNeill seconded the motion and it passed unanimously.

Ernestine McLean, Charles R. Meeks, Phyllis Taylor, Flora Weeks and Minnie
Mae McLean - all appointed for 3-year terms to expire 2/28/07
nominated by Commissioner McNeill
Harnett County Public Facilities Corporation Board of Directors
Jesse Alphin, Billy G. Pope and William A. (Tony) Wilder - all appointed for
I-year term to expire 3/31/05
nominated by Commissioner Titchener
Fred Myers, representing the Dr. Martin Luther King, Jr. Observance Committee,
presented a request for funding to support a civil rights museum to be located at 503
East Roy Street, Dunn. The Committee's request will be considered in the upcoming
budget process.
Tilghman Pope, Chairman, Economic Development Commission, noted that the
County is seeing positive results of using "blueprints" developed by the Leak -
Goforth Study. The Economic Development Commission evolved into an advisory
committee to the Harnett Forward Together Committee, and it has been determined
and is recommended by unanimous vote of the Economic Development Commission,
to merge with the Harnett Forward Together Committee and be a subcommittee of the
Harnett Forward Together Committee. Johnson Tilghman, Chairman, Harnett
Forward Together Committee, stated that the Harnett Forward Together Committee
agrees with and supports Mr. Pope's proposition. Lee Anne Nance, Director, Harnett
County Economic Development Commission stated that it is a team effort and that
both boards fully support the EDC office. This office fully supports the effort to
merge the two boards. After positive comments from each Commissioner,
Commissioner McNeill moved to dissolve the Economic Development Commission as
it is now and make it a subcommittee of the Harnett Forward Together Committee.
Members will no longer be appointed by the Board of Commissioners. Members of
the Economic Development Commission will be appointed by the Harnett Forward
Together Committee. Commissioner Andrews seconded the motion and it passed
unanimously.
Chris Prince, Fire Chief, Northwest Volunteer Fire Department, requested
authorization for the department to build a new fire station. Land has been purchased
across the road from the present fire station on Christian Light Road. The Department
is now debt free and has plans to sell the current facility and earmark the proceeds for
funding of the proposed new ?uilding. Commissioner Andrews moved to authorize
the Northwest Volunteer Fire Department to proceed with its new fire station building
project. Commissioner McNeill seconded the motion and it passed unanimously.
Vice Chairman Hill called to order a public hearing on the proposed Rural Operating
Assistance Program. Mr. Emory presented the proposed transportation program which
is funded by State and Federal grant funds allocated annually by the North Carolina
Department of Transportation. Harnett County's FY 2004-2005 allocations are:
EDT AP - $62,481 (Elderly and Disabled Transportation Assistance Program)
Work First - $11,781 (Funds are controlled and distributed by Social Services)
RGP - $45,901 (Rural General Public Program)
Vice Chairman Hill opened the meeting for comments to receive local input regarding
the grant. No comments were offered and the public hearing was closed.
Vice Chairman Hill called to order a public hearing on a zoning change request for
David Sawyer, from RA-30 to Commercial Zoning District, 4.77 acres located on
Hwy. 87/24 in Anderson Creek Township. Joseph Jefferies, Chief Planner, presented
the zoning change request. The Planning Board unanimously voted to recommend
approval. Vice Chairman Hill opened the meeting for comments from the public. No
comments were offered and the public hearing was closed. Commissioner McNeill
moved to approve the zoning change request for David Sawyer as presented.
Commissioner Titchener seconded the motion and it passed unanimously.
Vice Chairman Hill called to order a public hearing on a proposed Zoning Ordinance
text amendment regarding emergency services. Joseph Jeffries, Chief Planner,
presented the proposed amendment. Vice Chairman Hill opened the meeting for
comments from the public. No comments were offered and the public hearing was
closed. Commissioner Titchener moved to approve the Zoning Ordinance text
amendment as presented. Commissioner McNeill seconded the motion and it passed
unanimously. (Attachment 6)
Neil Emory, County Manager, reported on the following matters:
Chairman Teddy Byrd has finished his active tour of duty in Iraq and will
be home soon.
Veterans Service is selling T-shirts and ball caps as a fundraiser for the
Veterans Memorial project.
NC DOT's spring clean-up "Litter Sweep" project is April 17-30, 2004.
Mental Health Reform - After Mr. Emory's report regarding mental health
reform, Commissioner McNeill moved to table consideration of possible
partnering with Cumberland COl1nty to provide mental health services.
Commissioner Titchener seconded the motion and it passed unanimously.
Commissioner McNeill moved to go into closed session for the following purposes:
(1) to discuss certain personnel matters; and
(2) to discuss matters concerning the acquisition of real property.
This motion is made pursuant to N.C. General Statute Section 143-318.11 (a)(6) & (5).
Commissioner Titchener seconded the motion and it passed unanimously.
Commissioner McNeill moved for the Board to come out of closed session.
Commissioner Andrews seconded the motion and it passed unanimously.
There being no further business, Commissioner McNeill moved to adjourn.
Commissioner Andrews seconded the motion and it passed unanimously. The Harnett
County Board of Commissioners Regular Meeting, March 15, 2004, adjourned at 9:05
p.m.

Negotiations with Cape Fear Contracting have resulted in a construction cost
savings of $38,883.32. . This is the difference between the original bid amount
of$570,877.10 and a negotiated amount of $531,993.78. These amounts do
not include the lift station amount of $190,000.00, but does include the wet
well cost of $38,225.00.
Enoch Engineers, P.A. recommends awarding the contract to Cape Fear
Construction based on the recent negotiated prices as attached.

EXPANSION FEASffiILITY STUDY
BE IT ORDAINED by the Board of Commissioners of Harnett County, North Carolina sitting as
the governing board for Harnett County.
Section 1. This project consists of the feasibility study of long term options to address
detention and law enforcement space needs. This study will consider options which will include
expanding and renovating at the existing site and building new at the County Complex.

RESOLUTION AUTHORIZING THE EXECUTION AND DELIVERY OF AN
INSTALLMENT PURCHASE CONTRACT WITH RBC CENTURA BANK
TO FINANCE THE ACQUISTION OF CERTAIN EQUIPMENT FOR USE
BY THE Harnett C~unty Board or Education, NORTH CAROLINA,
AlTTHORIZING THE. EXECUTION AND DELIVERY OF RELATED
JNSTRUMENTs, AND DETERMINlNG oTHER MA'ITERS IN'
CONNECTION THEREWITH
BE IT RESOLVED by the governing body for the County of Harnett, North Carolina:
Section 1. The governing,body does hereby find and determine:
a) The Harnett County Board of Education proposes the acquisition of Certain equipment,
which may include fixtures as more fully described in the hereinafter mentioned Contract
(collectively, the "Equipment");
b) After consideration, the Harnett County Board of Education has determined that the most
advantageous manner offinancing thereof is by an instalhnent contract pursuant to Section
160A-20 of the General Statutes ofNorth Carolina, as amended;
c) Pursuant to Section 115C-528 of the General Statutes of North Carolina, the Harnett
County Board of Education is authorized to :finance the acquisition of personal property,
including fixtures, by installment contrncts that create a security interest in the property
:financed to secure repayment of the financing;
d) RBC Centum. Bank ("RBC Centum") has proposed that RBC Centum finance the
Equipment pursuant to an Insta1hnent Purchase Contract between the Harnett County
Board of Education and RBC Centum (the "Cootract") and a related Escrow Agreement
between the Purchaser and RBC Centum (the "Escrow Agreement"),
e) The Harnett County Board of Education has requested that the County pass a resolution
authorizing the Board of Education to enter into the Contract and Escrow Agreement,
binding the County to appropriate sufficient funds in ensuing fiscal years to meet the
amounts to be paid under the Contract and Escrow Agreement in those years, and
approving'the Contract and Escrow Agreement.
Section 2. The governing body of the Comrty of Harnett authorizes and directs the Authorized
Officer of the Harnett County Board Of Education to execute; acknowledge and deliver the Contract
and Escrow Agreement on behalf of the County in such form and substance as the person executing
and delivering such instnunents on beha1f of the County shall find acceptable. The Seaetary of the
Harnett County Board of Education is authorized to affix the official seal of the Harnett County Board
of Education to the Contratt and the Escrow Agreement and attest the same.
Section 3. The proper officers of the Harnett County Board of Education are authorized and
directed to eKecute and deliver any and aD ~ instruments, opinions, certificates, affidavits and
other documents and to do or cause to be done any and aD other acts and things necessmy or proper
for carrying out this Resolution and the Contratt and the Escrow Agreement
Section 4. NotwitbstaJxling any provision of the Contract or the Escrow .Agreement, no
deficiency judgment may' be rendered. against Ha,rnett cOOirty or the Harnett County Board of
Education in any action for breach of a contractual obligatiOn. under the Contratt or the' Escrow
Agreement and the taxing power ofHarnett County is not and may not be pledged directly or indirectly
to sea.rre any moneys due under the Contract. the security provided under the Contract being the sole
security for RBC Centma in such instance.
Section 5. The County covenants that, to the emnt permitted by the Constitution and laws of
the State of North Carolina, it will comply with the requirements of the Internal Revenue Code of
1986, as amended (the "Code") as required so that interest on the obligations under the Contract will
not be included in the gross income ofRBC Centum.

Section 6. The County covenants that it reasonably expects that it, an subordinate entities
thereof and all entities issuing obligations on behalf of the win issue in the aggregate less than
$10,000,000 of tmc:-exempt obligations (not counting J>rivate-activi bonds el<Cepl for qua1itied
50I.(cX3) bonds as defined ~ the~:) during calendar year 2004. In addition, the County hereby
deSIgnates the Contract and Its obligations under the Contract as a "qualified tax-exempt obligation"
fur the purposes of the Code.
Section 7: Pursuant to Section 115C-441(cl), the County approves the Contract and Escrow
Agreement and authorizes the Board of Education to approve the Contract and Escrow Agreement.
Tho County agrees to appropriate sufficient fimdt in en5Uing fiJoaI years to meet the amounts to be
paid under the Contract and Escrow Agreement in those years.
Section 8. This Resolution shall take effect immediately upon its passage.
Upon motion of Comm. McNeill. seconded by Comm. Andrews. members of the
governing body, the foregoing resolution entitled "RESOLUTION AUTHORIZING THE
EXECUTION AND DELIVERy OF AN INSTALLMENT PURCHASE CONTRACT WITH
RBe CENTURA BANK TO FINANCE THE ACQUISITION OF CERTAIN EQUIPMENT,

A RESOLUTION A1v1ENDING TIlE HARNETT COUNTY ZONING ORDINANCE TEXT
WHEREAS, the Board of Commissioners of Harnett County adopted a Zoning Ordinance on July
18, 1988 and June ~l 2000 for the purpOSI of promoting the health, IIfotyl and general welfare of
the county residents; and
WHEREAS, this ordinance was adopted under authority granted by the General Assembly of the
State of North Carolina, particularly G.S. I 53A-340; and
WHEREAS, the Zoning Ordinance contains provisions for amending said ordinance and those
provisions have been followed; and
WHEREAS, the Harnett County Planning Board has reviewed the amendment to Article VI
Sect.l.1J, 2.IQ, 4.IL, 5.IN, 6.IP, 7.IN and recommends the adoption of the following
amendment.
NOW, TIlEREFORE BE IT RESOLVED BY TIlE BOARD OF COMMISSIONERS OF
