Dear Steve:
Davis • Martin • Powell (DMP) is pleased to offer our contract amendment for Professional Services to
provide the City with Bidding, Construction Administration and -Resident Project Representation services
for the Proposed- Highway 301 South Elevated Tank and Long Branch Road Water Line Extension.
Understanding of the Project
The City is anticipating awarding a construction contract with a Notice -to -Proceed anticipated in April
2025 and a 450-day contract period. This amendment defines the scope and compensation for
Construction Administration and Field Services during construction.
Scope of Services
3) Construction Administration Services
— Assist the City with completing the Division of Water Infrastructure Funding Application
Conduct -the Pre -Construction Meeting and prepare meeting minutes.
Review shop drawings and submittals from the Contractor.
Review and respond to Requests for Information (BFI's) from the Contractor.
Conduct monthly progress meetings and prepare meeting minutes as needed.
Review change order requests and prepare -documents as needed.
Review Contractor's monthly pay requests and forward to the City for approval.
— Contract Closeout, to include attendance at the final field inspection,. review of final contract
documents, and Engineer's Certification of project completion to the appropriate agencies as
needed.
4) Construction Field Services
— The scope includes a Resident Project Representative (RPR) during the construction period to
review and observe work of the construction contractors. The RPR will be onsite to perform
periodic construction observation.
— The RPR shall be the Engineers' site representative and will serve as field Liaison between the
Contractor and the City, attend job site meetings, etc.

The RPR will review -and observe fieldwork, confirm payment quantities, determine acceptability
of work" items_ ,-etc., for compliance with -approved contract documents.
— The RPR will keep _a daily° field report describing the activities and construction progress of the
Contractor's); for each site visit.
The.;-RPR will- report directly, to the Engineer and the Engineer will- report to the City
Representative.
The RPR will assist the Contractor in. maintaining records of deviations from construction
drawings.
- — The-RPR shall have no ,authority regarding -the following:.
® Authorization of any deviation,from the contract documents
Approval of any substitute materials or equipment.
®" Performance of any of the responsibilities of Contractor(s), subcontractor(s), or Contractor's
superintendent. .
Expediting work for the Contractor's:).
Jobsite Safety
® Advice or directions relative to any aspect.of the means; methods; techniques, sequences, or
procedures of construction unless such is specifically called for in the Contract Documents.
5) Construction.Material_Testing and Coatink Application Testing
— These services will be performed by'DMP's specialty sub -consultant.

® Proof -rolling Observations /Subgrade Stabilization
'Engineered Fill Placement Testing
Shallow, Foundation Bearing.Material Evaluation
® Concrete Steel Reinforcement Evaluation
Structural Steel Testing
Concrete Sampling and Testing
Daily Reporting
Coating Application Testing Services (CAT):
Periodic monitoring- of blasting and painting operations by a Level 1 Coating Technician or
NACE Certified -Coating inspector, including the following testing:

> Observation of mixing, application & recoat process

Compensation.
DMP proposes -to provide the services described above at an hourly rate with the following anticipated
-fees, which is based on our experience with. similar projects:

The fees stated above are based on the anticipated requirements and steps we will need -to complete the
scope outlined in this contract amendment. The,RPR work is based on_a Project Representative being in
the field over the course of -the project for the equivalent of 10 months at 4 weeks per month at twenty
four (24) hours per week. Additional work due to site changes requested by the Owner or, requirements
imposed by permitting agencies may require adjustments to this intensity and fee. Any changes to this
fee will be reviewed and approved by the City before additional cost is incurred.
The Terms and Conditions of the March 21, 2023, Master On -call Agreement remain in effect for this scope
of work. Attached is an updated Rate Schedule.
Sub -Consultants
DMP intends to utilize the following sub -consultants for the listed specialties:

DMP has .the` capability to provide the following additional services, however, currently we have not
included these services as part of our scope. If any of these services are desired, or become'a requirement
of the project, additional fees will be negotiated.
- Construction layout and staking
— Geotechnical Analysis
If any -of these services are desired or- become a requirement of the project, additional fees, would be
provided, or work could. be completed using our attached standard. hourly rates. Any additional services
would not be -incurred without your. prior authorization.

RESOLUTION
Of the Dunn City Council
Declaring Certain Property of the City to be Surplus
and Authorizing the Disposition of Said Property
WHEREAS, The City Council of the City of Dunn, North Carolina, has determined that the
City owns certain property at 808 West E. Street, Erwin, NC, that contain
structures and personal property that are no longer needed or useable by the
City; and,
WHEREAS, The real property includes a house and outbuildings .that are in a significant
state of disrepair and are unsafe and, that there are various items of personal
property located in and around the house and outbuildings for which the City
has no use'but that may have some monetary value.
NOW, THEREFORE, _ BE IT RESOLVED by the Dunn City Council that the house,
outbuildings, and all contents and personal property therein at 808 West E. Street, Erwin,
NC, is declared surplus and the City Manager is hereby -authorized to demolish these
structures and to dispose of the personal property by any method authorized in Article 12
of Chapter 160A of the General Statutes.
The City Clerk shall publish such notice of this resolution and of the disposition of the
personal property as provided by Article 12 of Chapter 160A of the General Statutes.
Adopted by the City Council of Dunn, this 13th day of May, 2,025.

Of the Dunn _City Council

WHEREAS, The City.Council of the.City of Dunn, North Carolina, has determined that the
City owns certain real and personal property at 411 North Magnolia
Avenue, Dunn, NC [PIN 1516-77-8993] that is longer needed or useable by
the City,- and,
WHEREAS, The City Council has further determined that the real property would be more
marketable as a .vacant infill lot and that demolition of the house and
outbuilding would thus increase the marketability of the property; and,,
NOW, THEREFORE, BE IT RESOLVED by the Dunn City Council that the house, outbuilding,
and any personal property at 411 North Magnolia Avenue, Dunn, NC [PIN 1516-77-8993]
is declared surplus and that any personal property on the premises has no value and may
be disposed of by the City Manager and that the City Manager is authorized to demolish the
said house and outbuilding and to then sell the underlying real property by any method
authorized in Article 12 of Chapter 160A of the General Statutes.
The City Clerk shall publish such notice of this resolution and -of the disposition by sale of
the real property as provided, by Article 12 of Chapter 160A of the General Statutes.
