AN ORDINANCE TO EXTEND THE CORPORATE LIMITS OF
THE CITY OF DUNN, NORTH CAROLINA
WHEREAS, the City Council of the City of Dunn has been petitioned under Part 1 of Article
4A of Chapter 160A of the General Statutes to annex the area described below; and
WHEREAS, the City Council has by resolution directed the City Clerk to investigate, the
efficiency of the, petition; and
WHEREAS, the City Clerk has certified the sufficiency of the petition and a public hearing on
the question of this annexation was held at the Dunn Municipal Building at 6:30 p.m. on
February 25, 2025, after due notice by publication on March 14, 2025; and
WHEREAS the City Council finds that the area described therein meets the requirements of
Part 1 of Article 4A of Chapter 160A of the General Statutes.
NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Dunn, North Carolina
that:
Section 1. By virtue of the authority granted by Part 1 of Article 4A of Chapter 160A
of the General Statutes, the following described territory is hereby annexed and made part
of the City of Dunn as of March 25, 2025:

Being that certain tract of Land located in Averasboro Township, Harnett County, North
Carolina, and being more particularly described as follows:
BEGINNING' at an existing iron rebar on the western right-of-way margin. of North Powell
Avenue, said rebar having North Carolina State Plane Coordinates of North 573,137.63,
East 2,110,073.66 (NAD 83/201 1datum); thence from said rebar and along the western
right-of-way margin of. North Powell Avenue, South 07'10'55" West a distance of 162.29
feet; thence continuing with said right-of-way margin, a curve to the left with an arc length
of 47.38 feet, a radius of 1914.60 feet, a chord bearing of -South 06°35'13" West and a
chord length of 47.38 feet; thence North 76059'47" West a distance of 2107.82 feet to an
existing concrete monument; thence North 38'40'11 East a distance of 641.20 feet to an
existing rusted 2" iron pipe; thence South 65'25'15" East a distance of 1209.57 feet to an
existing 1" iron pipe; thence South '65°30'33" East a distance of-636'.12' to the original
Point of Beginning.
Said tract containing 18.21 acres and being further illustrated on plat prepared by Taylor
Land Consultants, PLLC titled "Annexation Plat — 18.21 Acres", dated January 4th, .2025
and being recorded in Plat Book 25, Page 14 of the Harnett County Registry.
Section 2. Upon and after March '25, 2025, the above -described territory and its
citizens and property shall be, subject to all debts, laws, ordinances, and regulations in force
in the City of Dunn and shall be entitled to the same privileges and benefits as other parts of
the City of Dunn. Said territory shall be subject to municipal taxes according to G. S. 160A-
58.10.
Section 3. The Mayor of the City of Dunn shall cause to be recorded in the office of
the Register of Deeds of Harnett County, and in the office of the Secretary of State at Raleigh,
North Carolina, an accurate map of the annexed territory, described in Section 1 above,
together with a duly certified copy of this ordinance. Such a map shall also be delivered to.
the County Board of Elections, as required by G. S. 163-288.1.

RESOLUTION OF TENTATIVE AWARD
City of Dunn
Eastside Pump Station Project
WHEREAS, the City of Dunn, North Carolina has received bids, pursuant to duly.
advertisement notice therefore, for construction of the Eastside Pump Station Project; and,
WHEREAS, the consulting engineers of WithersRavenel have reviewed the bids; and,
WHEREAS, T.A. Loving Company was, the lowest responsive responsible bidder, for an amount
of $10,3.16,335.00; and,
WHEREAS; "the consulting 'engineers recommend a TENTATIVE AWARD .to the lowest
responsive responsible bidder; and
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUNN:
The Tentative award is made to T.A. Loving Company, the lowest responsive responsible
bidder with a total bid amount of $10,316,3A00.
That the City- of Dunn gives assurance to USDA Rural Development and the N.C. Local
Government Commission that any Conditions or Assurances contained in the Award Offer
will be adhered to and that the City has substantially complied or will substantially comply.
.with all.Federal, State.and local laws, rules, regulations, and ordinances applicable to the
project and to Federal and State grants and loans pertaining thereto.
That City Manager Steve Neuschafer, the Authorized Official, and successors so titled,
are hereby authorized and directed to furnish such information as the appropriate State
agency may request in connection with this project; to make the assurances as contained
above; -and to ekecute such other documents as maybe required by the Division of Water,
Infrastructure.
BE IT FURTHER RESOLVED.that such TENTATIVE AWARD is ntingent upon. the approval,

RE: Bid Evaluation and Recommendation of Award
Eastside Pump Station Improvements
WR Project No. 23-0173-003
Dear Mr. Neuschafer:
On Tuesday February 25', 2025, at 2:00 PM, bids were received for the referenced project at a
second bid opening conference. The first bid opening conference on February 13t", 2025
yielded no bidders. The intent of this letter is to present our evaluation of the bids and make a
recommendation for award.
EVALUATION OF BIDS
One (1) bid package was received at this second bid opening conference. The bid was hand
delivered to the City.of Dunn City Hall before the scheduled bid opening. The base bid was read
publicly as follows:.
Bidder Base Bid
TA Loving Company $10,316,335.00
Following the bid opening, WithersRavenel further reviewed the bid package in detail for
compliance with NC General Statutes (NCGS) and requirements set`by the funding agency
(USDA -Rural Development). The results from our review are summarized in a table attached to
this letter. Our review shows that the bidder provided all the required documentation in their
bid package and that everything was properly completed. We also reviewed the qualifications of
the bidder. The bidder has completed many similar types of projects in recent years and has
recently completed a -similar project for the City. As such, it is our professional opinion that the
bidder is the lowest, responsive and responsible bidder.
RECOMMENDATION
Based on discussions with City Staff following the bid opening conference, it appears that the
City. is willing to appropriate funds as needed to provide an adequate construction contingency
and cover budget shortfalls as shown in the attached USDA Post -Bid Project Budget sheet.
Based on this, WithersRavenel recommends awarding the project to the lowest, responsive, and
responsible bidder,JA Loving Company, pending review and approval by USDA -Rural
Development. -

RURAL DOWNTOWN ECONOMIC DEVELOPMENT GRANT APPLICATION
WHEREAS, the City Council of the City of Dunn, North Carolina continues to be committed to
and supportive of the ongoing revitalization of its historic downtown district; and,
WHEREAS, in furtherance of this commitment and support, the City Council does authorize the
City Manager of the City of Dunn to apply for a North Carolina Department of Commerce Rural..
Downtown Economic Development Grant on or before the April 28, 2025, deadline; and
WHEREAS, the grant funds, if awarded would be used to redevelop a historical City -owned
building at 107 S. Railroad Avenue and to redevelop an adjacent tract of City -owned land into a
pocket park for the use and enjoyment of the citizens of Dunn; and
WHEREAS, the City would match the grant funds by five percent (5%) if awarded the grant; and
NOW,THEREFORE BE IT RESOLVED:
The City Manager is authorized to apply for a North Carolina Department of Commerce -
Rural Downtown Economic Development Grant on or before the April 28, 2025, deadline and
the City would match the grant funds by five percent (5%) if awarded the grant.
