Capital Project Ordinance Highway 301 South Elevated Water Tower Project WHEREAS, the City Council for the City of Dunn, on June 25, 2024, adopted the annual budget ordinance number 02024-13 for the fiscal year beginning July 1, 2024; and, WHEREAS, the City Council, on June 25, 2024, adopted the capital improvements plan for fiscal year 2024-25; and, WHEREAS, the City Council intends to construct an elevated water tower south of the City near Highway 301; and, WHEREAS, the North Carolina General Assembly's Session Law 2023-134 appropriated $7,100,000 for City of Dunn water and wastewater projects; and, WHEREAS, it is necessary to create a capital project to account for the revenues and expenditures of this project; and, NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF DUNN, NC, PURSUANT TO SECTION 13.2 OF CHAPTER 159 OF THE GENERAL STATUTES OF NORTH CAROLINA, THAT: Section 1: The Project authorized is the Hwy 301 South Elevated Water Tower Project with funding from the North Carolina Department of Environmental Quality (DEQ) Division of Water Infrastructure (DWI) and is authorized to be undertaken until all project activity is completed. Section 2: The officers of this unit are hereby directed to proceed with the grant project within the terms of the council resolution, grant/loan documents, the rules and regulations of the Division of Water Infrastructure (DWI), and the budget contained herein. The amount of funding appropriated, and amounts budgeted for construction and related costs, are approved as follows: Fundine Aunronriations State Appropriations Funding $ 2,880,038 Water Fund Reserves $ 483,155 General Fund Operating Transfer $ 1,927,383 Total Funding $ 5,290,576 IV&re communi� 4nsl F I'" OF DUNN NORTH CAROLINA Expenditures: Administration $ 10,000 Engineering $ 298,000 Construction $ 4,745,311 Contingency $ 237,265 Total Expenditures $ 5,290,576 Section 3: The finance officer is hereby directed to maintain within the Hwy 301 South Elevated Water Tower Project Fund sufficient specific detailed accounting records to satisfy the requirements of the funding agency, the grant agreements, and federal regulations. Section 4: Funds may be advanced from the Enterprise Fund or General Fund for the purpose of making payments as due. Reimbursement requests should be made to the State funding agency in an orderly and timely manner. Compliance with all federal and state procurement regulations is required. Section 5: The finance officer is directed to report, on a quarterly basis, on the financial status of each project element in section 2 and on the total grant revenues received or claimed. Section 6: The Budget Officer is directed to include a detailed analysis of past and future costs and revenues on this capital project in every budget submission made to this city council. Section 7: Within five (5) days after this ordinance is adopted, the City Clerk shall file a copy of this ordinance with the Finance Director. The City was awarded a CDBG-I grant from NC Department of Environmental Quality (DEQ) Division of Water Infrastructure (DWI) in April 2021. The CDBG Program Manual was adopted in November 2021, containing initial compliance plans and policies designed to meet requirements for participation in the CDBG-1 program. Updated plans were adopted in March 2022 and March 2024. All plans were adopted with the intention of being current and active for the life of the city's CDBG project. DWI requested the City to update certain compliance plans that were adopted in 2021 and 2022. The DWI templates for these plans and policies have not changed since initial adoption. The information contained in the plans and policies has also not changed since initial adoption. Therefore, to satisfy DWI's request, the city is reaffirming that the existing plans and policies are current and active and will be implemented throughout the life of the city's CDBG project, through closeout.
