"'"s r. t _ rt' ,> Capital Project Ordinance Raw Water Pump Station Improvement Project WHEREAS,the City Council for the City of Dunn,on June 25,2024,adopted the annual budget ordinance number 02024-13 for the fiscal year beginning July 1, 2024; and, WHEREAS, the City Council, on June 25, 2024, adopted the capital improvements plan for fiscal year 2024-25; and, WHEREAS, the City Council, intends to make improvements to the raw water pump station near the Cape Fear River in Erwin; and, WHEREAS, the Federal Emergency Management Agency (FEMA) has approved a Building Resilient Infrastructure and Communities (BRIC) grant in the amount of$6,438,975; and, WHEREAS, the North Carolina General Assembly's Session Law 2023-134 appropriated $7,100,000 for City of Dunn water and wastewater projects; and, WHEREAS, on August 27, 2024,the City Council adopted a capital project ordinance for this project; and, WHEREAS, it is necessary and appropriate to amend this capital project ordinance to adjust the line items for expenditures, based on updated information from the grantor, to provide adequate funding to complete the project; and, ' BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF DUNN, NC, PURSUANT TO SECTION 13.2 OF CHAPTER 159 OF THE GENERAL STATUTES OF NORTH CAROLINA,THAT: Section 1: Expenditures necessary for the Raw Water Pump Station Improvement Project is authorized to be undertaken until all project activity is completed,and is adopted as follows: Section 2. Reimbursement requests should be made to the Federal or State grantor agency in an orderly and timely manner. Compliance with all federal and state procurement regulations is required. Section 5:Within five (5) days after this ordinance is adopted,the City Clerk shall file a copy of this ordinance with the Finance Director. The City Council does hereby find and determine as follows: (a) The City desires to finance the cost of various improvements to the City's sanitary sewer system, including, without limitation, the upgrading and replacement of the Eastside Pump Station (the"Project"). (b) The City is considering issuing revenue bonds in an aggregate principal amount not to exceed $8,626,000 to provide funds, together with any other available funds, to pay the costs of acquiring, constructing and equipping the Project. (c) The proposed revenue bonds are necessary to secure funds for adequate and reliable sanitary sewer service and to promote the present and future welfare of the residents of the City and its environs. (d) The amount of the proposed revenue bonds will be sufficient, but not excessive, for the purpose of paying the costs associated with the Project. (e) The proposed Project is feasible. (f) The annual audits of the City show the City to be in strict compliance with debt management policies, and the budgetary and fiscal management policies of the City are in compliance with law. (g) The proposed revenue bonds can be marketed at a reasonable interest cost to the City. (h) The projected rate increases, if any, for water and sewer service in connection with the issuance of the proposed revenue bonds will be reasonable. 'Mere communi 63ins! Section 2. The Mayor,the City Manager and the Finance Director of the City are each hereby authorized and directed to file an application with the Local Government Commission for approval of the issuance of revenue bonds for the purpose of providing funds, together with any other available funds, to (a) pay the costs of the Project, (b) pay all or a portion of the interest on such bonds during the period of construction of the Project, (c) fund any necessary debt service reserve fund and (d) pay certain costs associated with the sale and issuance of such bonds. Section 3. The Local Government Commission is requested to sell the proposed revenue bonds at a private sale without advertisement. Section 4. In connection with the Project,the City is also considering issuing revenue bond anticipation notes in anticipation of the proposed revenue bonds. The City Council hereby finds, determines and declares the following: (a) Section 1.150-2 of the Treasury Regulations (the "Regulations") prescribes specific procedures which will be applicable to certain bonds or notes issued by or on behalf of the City including,without limitation,a requirement that the City declare its official intent to reimburse certain expenditures with proceeds of debt to be incurred by the City prior to, or within sixty (60) days of, payment of the expenditures to be reimbursed. (b) The City intends to advance its own funds in order to pay certain capital costs (the "Original Expenditures") relating to the acquisition, construction, renovation and equipping of various improvements to the City's sanitary sewer system, including, without limitation, the upgrading and replacement of the Eastside Pump Station (the "Project"). (c) The City reasonably expects to reimburse itself for the Original Expenditures from the proceeds of debt to be incurred by the City. (d) $8,626,000 is the maximum principal amount of debt expected to be incurred for the purpose of paying the costs of the Project. (e) This declaration of official intent is made pursuant to Section 1.150-2 of the Treasury Regulations to expressly declare the official intent of the City to reimburse itself from the proceeds of debt to be hereinafter incurred by the City for certain expenditures paid by the City on or after the date which is sixty (60) days prior to the date hereof. (f) The funds heretofore advanced or to be advanced by the City to pay the Original Expenditures are or will be available only on a temporary basis, and do not consist of funds that were otherwise earmarked or intended to be used by the City to permanently finance the Original Expenditures. (g) All Original Expenditures to be reimbursed by the City were paid no more than sixty (60) days prior to, or will be paid on or after the date of, this declaration of official iierre communi 6 jzns! intent, except with respect to certain amounts incurred before such 60-day period not exceeding 20% of the issue price of the proceeds of the debt to be hereinafter incurred which are expended for "preliminary expenditures" within the meaning of Section 1.150-2 of the Treasury Regulations (the "Preliminary Expenditures"). The City understands that, except for the Preliminary Expenditures, such reimbursement must occur not later than eighteen (18) months after the later of(a) the date the Original Expenditures were paid and (b) the date the Project is placed in service or abandoned,but in no event more than three (3) years after the Original Expenditures were paid.
