HCBOC 050525 Pg. 2 Harnett County Board of Commissioners Regular Meeting Minutes April 21, 2025 Page 1 of 6 HARNETT COUNTY BOARD OF COMMISSIONERS Regular Meeting Minutes April 21, 2025 The Harnett County Board of Commissioners met in regular session on Monday, April 21, 2025 at 6:00 pm, in the Commissioners Meeting Room, Harnett County Resource Center and Library, 455 McKinney Parkway, Lillington, North Carolina. Members present: Matthew B. Nicol, Chairman William Morris, Vice Chairman Barbara McKoy, Commissioner W. Brooks Matthews, Commissioner Member absent: Duncan “Eddie” Jaggers, Commissioner Staff present: Brent Trout, County Manager Dwight Snow, County Attorney Kimberly Honeycutt, Finance Officer Melissa Capps, Clerk Chairman Nicol called the meeting to order at 6:00 pm. Commissioner McKoy led the Pledge of Allegiance and provided the invocation. Chairman Nicol called for any additions or deletions to the published agenda. Chairman Nicol stated he would like to postpone Item 9. Discuss fluoridation of County Water until the April 29th work session so that all members are present. Vice Chairman Morris made a motion to approve the agenda as amended. The motion was seconded by Commissioner Matthews and carried unanimously. Vice Chairman Morris made a motion to approve the consent agenda. Commissioner Matthews seconded the motion. The motion passed unanimously. The items on the consent agenda were as follows: A.Minutes i.Work Session Minutes of April 1, 2025 ii.Regular Meeting Minutes of April 7, 2025 iii.Work Session Minutes of April 15, 2025 B.Cooperative Extension requests approval to receive additional funds from the Chatham County Partnership for Children. These funds will increase the CCR&R budget by $1,553.02. C.Solid Waste requests the approval to amend the current services agreement with Gregory Poole due to an increase of costs. The original value of the contract was $275,000, however due to unforeseen circumstances the value of the contract has increased to $425,000, which will require Board approval. Soil and Water Conservation is requesting permission to accept Streamflow Rehabilitation Assistance Program funds in the amount of $116,327 from the North Carolina Department of Agriculture and Consumer Services. No matching funds are required. These funds will be used to clear vegetative debris from identified areas within Buies Creek and East Buies Creek. (Attachment 1) E. Soil and Water Conservation is requesting permission to apply for supplemental funding from the NCDA, Agricultural Development and Farmland Preservation Trust Fund for the Cotton Conservation Easement Project in the amount of $916,360. $500,000 has already been secured in cycle 16, however policies have been updated to allow for application for supplemental funds from projects being awarded less than 50% of the development rights value of the property to be conserved. The required project match will be provided by landowner development rights donation. F. Harnett Regional Water requests the Board adopt two resolutions authorizing grant and/or loan applications to NCDEQ to address preliminary engineering, design, and construction at the Harnett Regional Water Treatment Plant. This project will add the necessary changes needed to successfully remove PFAS/PFOA and other chemicals from the raw water supply. (Attachments 2 & 3) G. Administration requests the Board of Commissioner adopt the S-7 2024 Supplement to the Code of Ordinances. This supplement contains all ordinances of a general and permanent nature enacted since the prior supplement to the Code of Ordinances. (Attachment 4) H. The Harnett County Board of Commissioners would like to appoint Roger Farina to serve on the Southeastern Economic Development Commission (SEDC). I. As discussed at the April 15, 2025 Work Session, the Harnett County Board of Commissioners would like to appoint Ronnie Pleasants to the Mid-Carolina Aging Advisory Committee and reappoint Frankie Spivey to the Agricultural Advisory Board as District 5 representative. Commissioner Matthews read a Proclamation Celebrating Harnett County Resident Beatrice Bailey Hill on the Occasion of her 100th Birthday. The Harnett County Board of Commissioners recognized and congratulated Ms. Hill upon the celebration of her 100th birthday and extended its best wishes to her, wishing her continued health and happiness. A framed copy of the Proclamation was presented to Ms. Hill. Chairman Nicol opened the meeting for informal comments by the public, allowing up to 5 minutes for each presentation up to 1 hour. Sarah Arbour, Planner II, petitioned the Board for a public hearing on Proposed Zoning Change Case#PLAN2503-0001 Landowner/Applicant:1960 Properties, LLC / Chan Ho; 1.19 +/- acres; Pin # 9568-66-9087.000; From RA-20R to Commercial Zoning District; Barbecue Township; SR #1207 (Seawell Rosser Road) & NC Hwy 87 N. The property, formerly used for residential purposes, is vacant and fronts both Seawell Rosser Rd. and NC 87 N. The home and accessory structure previously located on the property were demolished in December 2024. Surrounding land uses include the Olivia Post Office, a convenience store, a communications station, a massage parlor, and single-family residences. Public water and sewer are available. Staff evaluation: • The subject property is located within a mixed-use area, characterized by both residential and non- residential land uses. The subject property is adjacent to property zoned Commercial and currently used for commercial purposes. • The requested zoning district is compatible with the underlying land use, Rural Center. This land use classification is a development node that encourages commercial land uses and economic development throughout the county. The uses permitted in the Commercial zoning district are compatible with the underlying land use. • There is a convincing demonstration that all uses permitted under the proposed zoning district classification would be appropriate in the area included in the proposed change. The uses permitted in the Commercial zoning district are compatible with the surrounding and nearby commercial land uses. Additionally, the property has access to water and sewer utility services and is located within a Rural Center Development Node. • There is a convincing demonstration that the character of the neighborhood will not be materially and adversely affected by the uses permitted in the requested zoning district. The uses permitted in the Commercial zoning district are compatible with the nearby non-residential land uses. • The requested zoning district is compatible with the future land use classification, Rural Center. The Rural Center Use Future Land Use classification supports small scale, market-driven commercial centers. HCBOC 050525 Pg. 5 Harnett County Board of Commissioners Regular Meeting Minutes April 21, 2025 Page 4 of 6 As stated in the evaluation, the requested rezoning to Commercial would not have an unreasonable impact on the surrounding community based on compatibility with the future land use plan and the surrounding land uses. It is recommended that this rezoning request be APPROVED. At the April 7, 2025, Planning Board meeting, the Planning Board voted 5-0 to recommend approval for the request to rezone from the RA-20R to the Commercial Zoning district. The Planning Board found the requested rezoning is compatible with the future land use classification and the surrounding commercial land uses. An adjacent property owner spoke at the meeting to ask questions about the applicant's intended use of the property. There was no one present to speak in opposition. Chairman Nicol opened the public hearing. No one spoke and the public hearing was closed. Vice Chairman Morris made a motion to postpone action until the April 29, 2025 work session in order for all members to be present to vote. The motion was seconded by Commissioner Matthews and carried unanimously. Mark Locklear, Development Services Director, petitioned the Board for a public hearing on the stated I would like to Harnett Horizons 2040 Comprehensive Plan developed by Development Services staff and Stewart Engineering. The plan defines a framework for land use and development throughout the county, and addresses priorities including housing, transportation, economic development, and natural resource protection. The plan outlines the county's vision and strategic plan for its future and will guide land use policy, funding, resource decisions, and infrastructure investment for Harnett County over the next several years. Mr. Locklear thanked the Board, County leadership, citizens who came out to numerous meetings and our staff, especially Sarah Arbour, who was the lead on this as our long-range planner. He introduced Jake Petroski of Stewart Engineering. Corridor. -Updated median sold price and incorporated final resource agency recommendations. April 7, 2025 o The Planning Board voted to recommend adoption of the Harnett Horizons 2040 Comprehensive Land Use Plan 4-1, with no comment provided for the dissenting vote. Tonight o Board of Commissioners to consider adoption or adoption with amendments. The Board took a five (5) minute recess at 8:05 pm. Chairman Nicol called the meeting back to order at 8:10 pm. Chairman Nicol opened the public hearing and the following people spoke: 1. Richard Chapman of 5220 Christian Light Road, Fuquay Varina, NC stated it is a great plan and suggested adding a chapter regarding the Cape Fear River. Lynn Marshbanks of 3404 English Circle, Willow Springs, NC commented on the Village District design guide for Buies Creek East Village. 3.Jennifer Marrier read comments on behalf of Marge Moreton in support of the plan. No one else spoke and the public hearing was closed. Vice Chairman Morris made a motion to postpone action until the April 29, 2025 work session in order for all members to be present to vote. The motion was seconded by Commissioner Matthews and carried unanimously. Chairman Nicol stated please note on the April 29, 2025 work session that action may be taken on the Harnett Horizons 2040 Comprehensive Plan. Brent Trout, County Manager, shared we did close on the bonds Thursday to fund Flatwoods Middle School. Please save the date of May 31st at 9:00 am for the dedication of the Charters for Freedom site. Also, a reminder, we will have a Joint Session with the Board of Education following the work session on April 29th. Vice Chairman Morris made a motion to approve the budget amendments as requested by the Finance Officer. The motion was seconded by Commissioner Matthews and carried unanimously. (Attachment 5) Vice Chairman Morris made a motion to approve the tax rebates, releases and refunds as requested by the Tax Administrator. The motion was seconded by Commissioner Matthews and carried unanimously. (Attachment 6) Seann Byrd, Assistant Harnett Regional Water Director, reviewed a request to amend the project ordinance to reflect the updated costs of design and construction of the North Harnett Wastewater Treatment Plant Upgrade. Vice Chairman Morris made a motion to approve the amended project ordinance for the North Harnett Wastewater Treatment Plant Upgrade. The motion was seconded by Commissioner Matthews and carried unanimously. (Attachment 7) Mr. Byrd also reviewed a request to approve Change Order No. 3 for Capital Project NWW22 North Harnett Wastewater Expansion. This is an increase of $660,354 for an expansion in the blower horsepower and for electrical efficiency upgrades to enhance treatment process resiliency. Existing funds are available through project contingency. Vice Chairman Morris made a motion to approve Change Order No. 3 for Capital Project NWW22 North Harnett Wastewater Expansion. The motion was seconded by Commissioner Matthews and carried unanimously. (Attachment 8) Vice Chairman Morris made a motion to adjourn at 8:30 pm.
