Regular Meeting Minutes
November 4, 2024
The Harnett County Board of Commissioners met in regular session on Monday, November 4, 2024 at
9:00 am, in the Commissioners Meeting Room, Harnett County Resource Center and Library, 455
McKinney Parkway, Lillington, North Carolina.
Members present: William Morris, Chairman
W. Brooks Matthews, Vice Chairman
Barbara McKoy, Commissioner
Matthew B. Nicol, Commissioner

Chairman Morris called the meeting to order at 9:00 am.
Vice Chairman Matthews led the Pledge of Allegiance and provided the invocation.
Chairman Morris called for any additions or deletions to the published agenda. Commissioner Nicol made
a motion to approve the agenda as published. The motion was seconded by Commissioner McKoy. The
motion carried unanimously.
Vice Chairman Matthews made a motion to approve the consent agenda. Commissioner McKoy seconded
the motion. The motion passed unanimously. The items on the consent agenda were as follows:
A. Minutes
i. Regular Meeting Minutes of October 21, 2024
ii. Work Session Minutes of October 29, 2024
B. The Jetport requests the Board of Commissioners to renew the hangar lease agreement with
Global Medical Response - Med Trans Corp for an additional three years. Tenant has been in
good standing with the Jetport and is eligible to extend the lease. Term will be from July 1,
2024 to June 30, 2027. The fee will continue to be paid at the rate of $1,500.00 per month.
C. Legal requests approval of a Memorandum of Understanding with I-95 / I-40 Crossroads of
America Economic Development Alliance.
D. Administration requests approval of an offer to purchase agreement with ABJ Investments,
LLC to purchase land for a buffer for the Wastewater Treatment Plant.
E. Administration requests the Board to approve a Resolution to adopt the 2025 Schedule of
Meetings for the Harnett County Board of Commissioners. (Attachment 1)

F. Appointments (As discussed at the work session on October 29, 2024, the Harnett County
Board of Commissioners would like to remove Pamela Williams from the Home and
Community Care Block Grant Committee due to inactivity)
Vice Chairman Matthews read the 2024 Adoption Awareness Month and Day Proclamation. The Harnett
County Board of Commissioners, proclaimed November 2024 as "ADOPTION AWARENESS MONTH"
and November 4, 2024, as "ADOPTION AWARENESS DAY" in Harnett County, and commended its
observance to all citizens
Chairman Morris opened the meeting for informal comments by the public, allowing up to 3 minutes for
each presentation up to 30 minutes. The following people spoke:
1. Larry Mitchell of 478 Century Drive, Cameron, NC.
2. Lenny Kalunzy of 5351 Marvin Drive, Spring Lake, NC.
3. Jerry Rivas of 234 Twins Pond Road, Sanford, NC.
No one else spoke and the public comment period was closed.
Hearing to consider a request for a refund of overpayment of excise tax paid on Lot 139, The Colony at
Lexington Plantation, Part 1, Ph B. Dwight Snow, County Attorney, welcomed the students from
Harnett Central. Attorney Snow provided information regarding excise tax laws and requirements for a
refund. Matthew Willis, Register of Deeds, reviewed a request from the Shoaf Law Firm requesting a
refund of an overpayment of excise tax paid on Lot 139, The Colony at Lexington Plantation, Part 1, Ph
B. The property was transferred by General Warranty Deed recorded in Book 4240, Page 1085, in the
Harnett County, North Carolina Register of Deeds. The Grantor was Miguel Santos and spouse, Sarah
Carpenter Santos and the Grantee was Daniel Vinson and spouse, Margaret Vinson. This General
Warranty Deed was submitted electronically on June 21, 2024 with the incorrect amount of excise tax in
the amount of $4,140.00 which was remitted to the Harnett County Register of Deeds. This calculation
was incorrect and only $690.00 should have been remitted. The "Correcting Instrument for Incorrectly
Recorded Documents" has been recorded in Harnett Register of Deeds in Book 4255, Page 1476, on
October 8, 2024. They are requesting that the overage in the amount of $3,450.00 be returned to The
Shoaf Law Firm. The request for refund was submitted to Melissa Capps, Clerk to the Board on October
9, 2024. We met shortly after, and they were notified a hearing would be held today. Mr. Willis stated
according to the general statute they have done everything they needed to do up to this point to request
the refund. Chairman Morris asked if in his opinion should it be refunded. Mr. Willis stated yes sir.
Commissioner Nicol made a motion to approve a Resolution authorizing refund of excise tax
overpayment. The motion was seconded by Commissioner McKoy and carried unanimously.

Coley Price, Deputy County Manager, reviewed a request to approve a resolution to direct the
expenditure of Opioid Settlement Funds to provide Recovery Support Services and Recovery Housing
Support. $20,000.00 will be allocated to open a Recovery Alive home and $15,000.00 will be allocated

to fund a part-time peer support worker position to establish and operate the home for a total not to
exceed $35,000.00.
Commissioner McKoy made a motion to approve a resolution to direct the expenditure of Opioid
Settlement Funds to provide Recovery Support Services and Recovery Housing Support. The motion
was seconded by Vice Chairman Matthews and carried unanimously. (Attachment 3)
Mr. Price also reviewed a request for approval of a resolution to direct the expenditure of $230,463.20 of
Opioid Settlement Funds to fund harm reduction outreach staff through the North Carolina Harm
Reduction Coalition ("NCHRC"). The funding request from NCHRC is $115,231.60 per year and
requires a three-year commitment to be able to hire such staff. The first year will be paid by Alliance
Health and the final two years will be paid using Opioid Settlement Funds for a total not to exceed
$230,463.20.
Commissioner Nicol made a motion to approve a resolution to direct the expenditure of $230,463.20 of
Opioid Settlement Funds to fund harm reduction outreach staff through the North Carolina Harm
Reduction Coalition ("NCHRC"). The motion was seconded by Commissioner McKoy and carried
unanimously. (Attachment 4)
Commissioner Nicol made a motion to adopt a Resolution requesting NCDOT add Carter Drive and
Reece Drive in West Ridge to the State's Secondary Road System. The motion was seconded by Vice
Chairman Matthews and carried unanimously. (Attachment 5)
Commissioner Nicol made a motion to approve the budget amendments as requested by the Finance
Officer. The motion was seconded by Commissioner McKoy and carried unanimously. (Attachment 6)
Commissioner Nicol made a motion to adjourn at 9:18 am. The motion was seconded by Commissioner
McKoy and carried unanimously.

ATTACHMENT 1
THAT WHEREAS, the Harnett County Board of Commissioners adopted on September 19, 1994
certain Rules of Procedure by which the Board would conduct its meetings; and
WHEREAS, Rule 6 of the Rules of Procedure concerning "Regular and Special Meetings" states
that the Board shall hold regular meetings the first Monday of each month at 9 a.m. and the third Monday
of each month at 6 p.m. It also states if a regular meeting day is a holiday on which county offices are
closed, the meeting shall be held on the next business and the Board may schedule regular work sessions.
NOW, THEREFORE, BE IT RESOLVED, by the Board of Commissioners of Harnett County

RESOLUTION BY THE HARNETT COUNTY BOARD OF COMMISSIONERS
AUTHORIZING REFUND OF EXCISE TAX OVERPAYMENT
WHEREAS, pursuant to N.C. Gen. Stat. § 105-228.37, the Harnett County Board of
Commissioners (hereinafter referred to as the "Board") is required to review any timely request by a
taxpayer for a refund of overpayment of excise tax on the conveyance of property and to make a timely
decision regarding the County of Harnett's (hereinafter referred to as the "County") portion of any
overpayment; and
WHEREAS, on June 21, 2024, the Shoaf Law Firm, PA., 8414 Falls of Neuse Road, Suite 104,
Raleigh, N.C. 27615, recorded a general warranty deed in Book 4240, Page 1085 with an erroneous excise
tax in the amount of $4,410.00, which was remitted to the Harnett County Register of Deeds; and
WHEREAS, the County received a timely written request for a refund of $3,450.00 in excise tax
overpayment from Missy Weeks with the Shoaf Law Firm, PA.; and
WHEREAS, Andrew Coleman with the Shoaf Law Firm, PA. recorded with the Harnett County
Register of Deeds a Corrective Deed in Book 4255, Page 1476, on October 8, 2024, which reflects the
correct amount of excise tax of $690.00; and
WHEREAS, on November 4, 2024, the Board held a hearing in accordance with N.C. Gen. Stat.
§ 105-228.37(b) and upon motion made, seconded, and duly adopted, the Board has determined that the
refund request should be granted.
NOW THEREFORE, BE IT RESOLVED that the Harnett County Board of Commissioners, based
upon the evidence presented at the hearing, hereby determines that the Shoaf Law Firm, PA. is entitled to
a refund of the overpayment of excise tax in the amount of $3,450.00, plus any applicable interest; and
BE IT FURTHER RESOLVED that the Harnett County Board of Commissioners authorizes the
County Manager or Finance Officer to make payment to the Shoaf Law Firm, PA. in the total amount of
$3,450.00.

TO DIRECT THE EXPENDITURE OF OPIOID SETTLEMENT FUNDS
WHEREAS, the County of Harnett (the "County") has joined national settlement
agreements with companies engaged in the manufacturing, distribution, and dispensing of
opioids; and
WHEREAS, the allocation, use, and reporting of funds stemming from these national
settlement agreements and certain bankruptcy resolutions ("Opioid Settlement Funds") are
governed by the Memorandum of Agreement Between the State of North Carolina and Local
Governments on Proceeds Relating to the Settlement of Opioid Litigation ("MOA"); and the
Supplemental Agreement for Additional Funds from Additional Settlements of Opioid Litigation
("SAAF"); and
WHEREAS, the County has received Opioid Settlement Funds pursuant to these national
settlement agreements and deposited the Opioid Settlement Funds in a separate special revenue
fund as required by section D of the MOA; and
WHEREAS, section E.6 of the MOA states:
E 6 Process for drawingfrom special revenue funds.
a. Budget item or resolution required. Opioid Settlement Funds can be used for a purpose
when the Governing Body includes in its budget or passes a separate resolution
authorizing the expenditure of a stated amount of Opioid Settlement Funds for that
purpose or those purposes during a specified period of time.
b. Budget item or resolution details. The budget or resolution should (i) indicate that it is an
authorization for expenditure of opioid settlement funds; (ii) state the specific strategy or
strategies the county or municipality intends to fund pursuant to Option A or Option B,
using the item letter and/or number in Exhibit A or Exhibit B to identify each funded
strategy, and (iii) state the amount dedicated to each strategy for a stated period of time.
NOW, THEREFORE BE IT RESOLVED, in alignment with the NC MOA and SAAF, the
County of Harnett authorizes the expenditure of opioid settlement funds as follows:
Strategy authorized
a. Name of strategy: Recovery Housing Support.
b. Strategy is included in Exhibit A.
c. Item letters and/or numbers in Exhibit A to the MOA: Strategy 4
d. Amount authorized for this strategy: $15,000.00 for a part-time peer support worker
position to establish and operate a Recovery Alive home and $20,000.00 for funding
the opening of a Recovery Alive home for a total amount not to exceed $35,000.00.
Funding shall be a one-time, non -recurring allocation of Opioid Settlement Funds.
e. Period of time during which expenditure may take place:
Start date: November 4, 2024 through End date : November 3, 2025.
f. Description of the program, project, or activity: The settlement funds will be
expended to fund the establishment of a Recovery Alive home to serve as a safe
haven for individuals battling Opioid Use Disorder ("OUD"). To ensure compliance
with the MOA, at least 51 % of the residents shall be individuals recovering from
OUD and shall accept residents who are receiving Medication -Assisted Treatment for
OUD. Settlement funds will also be expended to fund a peer support worker who will
be responsible for the establishment and operation of the home to support the
residents in their recovery efforts.
g. Provider: Recovery Alive, Inc.
The total dollar amount of Opioid Settlement Funds appropriated across the above named and
authorized strategy shall not exceed $35,000.00.

expended to fund outreach staff that will partner with Harnett County's Community
Paramedics program to provide outreach services including naloxone education and
distribution, overdose prevention and harm reduction education, linkage to care, peer
support, and on -going coalition building.
g. Provider: North Carolina Harm Reduction Coalition.
The total dollar amount of Opioid Settlement Funds appropriated across the above named and
authorized strategy shall not exceed $230,463.20.

I. Background:
On March 11, 2021, the President signed into law the American Rescue Plan Act (ARPA) of 2021
(P.L. 117-2). ARPA provides additional relief to address the continued impact of the Coronavirus Disease
2019 (COVID-19) pandemic on the economy; public health; state, tribal, local, and territorial (STLT)
governments; individuals; and businesses. Under ARPA, the Centers for Disease Control and Prevention
(CDC) activated CDC-RFA-TP18-1802 Cooperative Agreement for Emergency Response: Public Health
Crisis Response' to support public health response to COVID-19. Funds from this act were designated to
recruit, hire, establish, expand, train, and sustain a public health workforce, which includes school nurses
and other school health professionals.
School health is a recognized component of the public health effort for the school aged population and
local community. Public health and education are necessary partners in the operation of safe and healthy
schools. Efforts should be taken to foster, grow and maintain the tie between public health and education
in support of both COVID-19 response programs and other activities that improve population and
individual health for students and school staff. In support of sustainable school health/public health
programs, 25% of the state funds awarded for public health workforce development are designated to
support school -based health program workforce development.

II. Purpose:
This Agreement Addendum provides temporary funding for the Local Health Department (LHD) to
strengthen and maintain a strong and inclusive school health team to provide services to students.
School nurse positions serve as members of a school -based health team, collaborating with local school
health programs to provide COVID-19 response, recovery, and resiliency support in schools. They will
contribute to strengthening school health as part of a local health system ready for the next public health
challenge. To achieve this, the LHD may apply these funds to support a school nurse position.
III. Scope of Work and Deliverables:
The Local Health Department (LHD) shall:
Support the employment of one school nurse position created during state fiscal years 2021-22,
2022-23 and/or 2023-2024. Supporting this position may include supporting the salary of current
directly hired positions, and/or supporting existing contracts for positions that provide and support
school health program activities that foster healthy students who are in school and ready to learn.
a. Maintain a position description consistent with licensure/credentialling requirements for the
position and professional requirements and standards of practice. In addition to position specific
work expectations, descriptions should include:
1. COVID-19 response and recovery related engagement in student and school health/public
health efforts consistent with position type supported.
2. The provision and support of other school health program activities that foster healthy
students who are in school and ready to learn.
3. Description of how the position contributes to a strong and inclusive school health
workforce.

2. Adhere to the following service quality measures:
a. Services are provided in accordance with standards established by the North Carolina Nurse
Practice Act and the North Carolina Board of Nursing or licensing/credentialling agency of the
position type. The North Carolina School Health Program Manual, latest edition, shall be
consulted as a resource, as well as the Scope and Standards of School Nursing developed by the
National Association of School Nurses.
b. Services are provided in a culturally sensitive manner.
C. Services are provided with adherence to federal law in relation to privacy of student records,
following both HIPAA (Health Insurance Portability and Accountability Act) and FERPA
(Family Educational Rights and Privacy Act), as applicable. Where HIPAA and FERPA may
appear to be in conflict, FERPA shall be followed regarding records that become part of the
student's educational record; US Department of Education and North Carolina Department of
Public Instruction guidelines are resources.
IV. Performance Measures / Reporting Requirements:

a. Hiring
1. Supplement, employ, or contract for the employment of one RN school nurse workforce
position to provide and support school health program activities that foster healthy
students who are in school and ready to learn.
2. Share job description for RN School Nurse position supported in full or in part with these
funds with the Regional School Health Nurse Consultant.
2. Monthly Reporting Requirements:
a. Complete the following report via the Smartsheet dashboard, which can be accessed at
htt s:Ha .smartsheet.com/b/ ublish?E BCT=82018408e7b44ef9b44e113b6e536ffb. The due
dates for the report are posted on the Smartsheet dashboard.
Financial and Program Reports have been combined into one report for state fiscal year 2024-25.
The report will be completed monthly during the month following the expenditure of funds.
Entries will report on activity during the prior month, no later than the due date indicated on the
Smartsheet Dashboard. Invoices or other documentation that support the expenditures shall be
uploaded with the report and labeled with the county name at the start of the invoice title.
Required deliverable activity during the prior month will be included as indicated in the report.
The initial report shall note whether the position is hired directly, subcontracted with a
Community -Based Organization (e.g., a professional temporary employment agency) to fulfill
the function, otherwise contracted, or other.
b. School nurse activities shall also be reported on the 2024-25 North Carolina Annual School
Health Surveys in December 2024 and June 2025. The link to this report will be provided by the
Regional School Health Nurse Consultant (RSHNC).
V. Performance Monitoring and Quality Assurance:
1. The Division of Child and Family Well -Being will monitor the Local Health Department's
performance according to the following plan:
a. The RSHNC will review financial invoices and Aid -to -Counties draw -down reports to ensure
that funds are spent according to allowable use on a monthly basis.
b. The RSHNC will monitor recruitment and hiring for vacated positions including review of
position descriptions.
c. The RSHNC will maintain regular contact (email, phone, and on -site) with the Local Health
Department to review progress on contract deliverables at least quarterly.
d. Deliverables, as outlined in this Agreement Addendum, will also be monitored via reported data
provided through the 2024-25 North Carolina Annual School Health Surveys in December 2024
and June 2025.
e. An annual monitoring report will be completed by the DCFW RSHNC at the end of the year
(May 2024), and a copy made available to the Local Health Director.
VI. Funding Guidelines or Restrictions:
1. Requirements for pass -through entities: In compliance with 2 CFR §200.331 — Requirements for
pass -through entities, the Division of Child and Family Well -Being provides Federal Award
Reporting Supplements to the Local Health Department receiving federally funded Agreement
Addenda.
a. Definition: A Supplement discloses the required elements of a single federal award. Supplements
address elements of federal funding sources only; state funding elements will not be included in

the Supplement. Agreement Addenda (AAs) funded by more than one federal award will receive
a disclosure Supplement for each federal award.
b. Frequency: Supplements will be generated as the Division of Child and Family Well -Being
receives information for federal grants. Supplements will be issued to the Local Health
Department throughout the state fiscal year. For federally funded AAs, Supplements will
accompany the original AA. If AAs are revised and if the revision affects federal funds, the AA
Revisions will include Supplements. Supplements can also be sent to the Local Health
Department even if no change is needed to the AA. In those instances, the Supplements will be
sent to provide newly received federal grant information for funds already allocated in the
existing AA.
2. Allowable uses of funds include salary and fringe benefits, recruitment and hiring costs, staff
development and training, IT hardware and software, equipment for the funded position needed to
perform the duties of the position, office supplies, utilities costs including internet, cell phones,
travel and other costs associated with support of the expanded workforce to the extent these are not
included in indirect costs.
3. Upload into the Smartsheet Dashboard all receipts and invoices for drawdowns that support the
allowable use expenses which include salary and fringe benefits, recruitment and hiring costs, staff
development and training, IT hardware and software, equipment needed to perform the duties of the
position, office supplies, utilities costs including internet, cell phones, travel and other costs
associated with support of the expanded workforce.
4. As the LHD is a subrecipient of a grant or cooperative agreement awarded by the Department of
Health and Human Services (HHS) with funds made available under the Coronavirus Preparedness
and Response Supplemental Appropriations Act, 2020 (P.L. 116-123); the Coronavirus Aid, Relief,
and Economic Security Act, 2020 (the "CARES Act") (P.L. 116-136); the Paycheck Protection
Program and Health Care Enhancement Act (P.L. 116-139); the Consolidated Appropriations Act
and the Coronavirus Response and Relief Supplement Appropriations Act, 2021 (P.L. 116-260)
and/or the American Rescue Plan of 2021 [P.L. 1]7-21 the LHD agrees as applicable to the award,
to:
a. Comply with existing and/or future directives and guidance from the Secretary regarding control
of the spread of COVID-19.
b. In consultation and coordination with HHS, provide, commensurate with the condition of the
individual, COVID-19 patient care regardless of the individual's home jurisdiction and/or
appropriate public health measures (e.g., social distancing, home isolation).
c. Assist the United States Government in the implementation and enforcement of federal orders
related to quarantine and isolation. In addition, to the extent applicable, Recipient will comply
with Section 18115 of the CARES Act, with respect to the reporting to the HHS Secretary of
results of tests intended to detect SARS— CoV-2 or to diagnose a possible case of COVID-19.
Such reporting shall be in accordance with guidance and direction from HHS and/or CDC. HHS
laboratory reporting guidance is posted at: https://www.hhs.gov/sites/default/files/covid-l9-
laboratory-data-reporting-guidance.pdf.
d. Consistent with the full scope of applicable grant regulations (45 C.F.R. 75.322), the purpose of
this award, and the underlying funding, the subrecipient is expected to provide to CDC, through
NC DHHS, copies of and/or access to COVID-19 data collected with these funds, including but
not limited to data related to COVID-19 testing.

e. This award is contingent upon agreement by the subrecipient to comply with existing and future
guidance from the HHS Secretary regarding control of the spread of COVID-19. In addition,
recipient is expected to flow down these terms to any subaward, to the extent applicable to
activities set out in such subaward.
2. In addition to their local procurement rules/policies, the LHD shall comply with the following rules,
applying the most restrictive standard where there is a difference between any of the standards:
