Legal requests acceptance of an $18,000.00 offer plus the cost publication fees and survey for the real property located at 87 Stone Wood Lane, Sanford, North Carolina, PIN number 03958601 0374 74. E. Finance requests the Board of Commissioners approve the updates to the Personnel Ordinance, Article VII. Employee Benefits, regarding Medicare Reimbursement. Effective January 1, 2025, revise the Medicare Supplement benefit from a reimbursement to a stipend with the following restrictions: • Retirees will receive a stipend equivalent to their retirement benefit, on or about the 10th of each month. • Retirees must, during open enrollment each year, verify contact information, as well as payee information, or the benefit will discontinue at fiscal year-end. If a retired employee fails to update such information, and the supplement is stopped, the retiree shall not be eligible for the supplement until the next open enrollment period. Requiring annual contact with the appropriate County staff will ensure that payments are not misdirected. Current retirees must elect to continue with a reimbursement or switch to a stipend; once an eligible retiree selects the “stipend method” they will not be allowed to switch back to a reimbursement. The items on the consent agenda were as follows: A.Minutes i.Regular Meeting Minutes of September 16, 2024 ii.Work Session Minutes of October 1, 2024 B.Foundation Forward, Inc. – Charters of Freedom is an educational non-profit that installs life-size replicas of the United States’ Charters of Freedom: The Declaration of Independence, the Constitution, and the Bill of Rights in communities across America. Foundation Forward, Inc. has requested the Board of Commissioners approval to install these replicas at no cost to the County in the Veterans Park. C.Parks and Recreation/Development Services requests authorization for the submission of a Great Trails State Program grant application for the land or easement acquisition of the South River Road Greenway. This segment of the South River Road Greenway will be located on an old rail corridor starting at the intersection of South River Road and Jim Christan Rd. and will run east towards the Town of Lillington. The County currently has the matching fund in the Capital Reserve-Greenway Fund. D. Development Services requests the Board of Commissioners approve the Fayetteville Area Metropolitan Planning Organization (FAMPO) Boundary Assessment Update and Memorandum of Understanding. E. Development Services seeks the Board's approval to begin negotiations for a contract with Kittelson and Associates for on-call transportation planning services. On May 6, 2024, the Board approved a request for Development Services to begin contract negotiations with the firm LJB Engineering to provide on-call transportation planning services for the county. However, following a change in leadership at LJB Engineering, staff determined that the firm is no longer the most qualified option. As a result, negotiations with LJB Engineering have been discontinued. Development Services is now requesting to begin negotiating a contract with the next most qualified firm, Kittelson & Associates. F. At the September 19, 2024 meeting, the Board of Health approved fee increases for the influenza and pneumonia vaccines. These rates are based upon the 2024-2025 Seasonal Flu Vaccine Pricing provided by CMS. An increase in a COVID vaccine was also approved. The Health Department requests the Board of Commissioners approve the fee increases as approved by the Board of Health. G. General Services/Harnett Area Rural Transit System (HARTS) requests the Board of Commissioners consider and approve the FY25 North Carolina Department of Transportation/Integrated Mobility Division (NCDOT/IMD) Rural Operating Assistance Program (ROAP) application as well as authorizing the County Manager and Finance Officer to sign aforementioned application. ROAP is a state funded public transportation program administered by NCDOT/IMD. ROAP funding includes project categories: Elderly and/or Disabled Transportation Assistance (EDTAP), Employment and Transportation Assistance Program (EMPL), and Rural General Public (RGP) programs. Programs are funded at 100%. Total FY25 ROAP Allocation is $281,152. H. General Services/Harnett Area Rural Transit System (HARTS) requests the Board of Commissioners consider and approve the North Carolina Department of Transportation (NCDOT) FY2025 5311/5339 Capital grant agreement in the amount of $220,000; total County match is $22,000. This grant provides funding for the Capital expenses associated with providing public transportation for the citizens of Harnett County. I. Chief Information Officer requests the Board of Commissioner approve the updated Technology Use Policy. According to recent legislation, Harnett County needs to update the Technology Use Policy around pornographic material. Harnett County IT has also updated wording around emailing personal identifiable information to inform users that email is an unencrypted form of communication, and that personal information of any type should not be shared with this medium. J. Legal requests the Board of Commissioners approve an option to purchase agreement with Samet Corporation. K. Legal requests the Board of Commissioners approve a lease agreement with Samet Corporation. Administration requests the Board of Commissioners approve a Professional Services Letter of Agreement with Parrish and Partners. The Harnett Regional Jetport Runway extension project will require the acquisition of property from an adjacent landowner. The process to complete the acquisition requires survey work, appraisals, environmental assessments and additional actions by our engineering consultant. The agreement with Parrish and Partners establishes the actions, steps and the cost of $99,473. The cost will be paid from the grant funds received from the North Carolina legislature for the runway extension. M. Administration requests the Board of Commissioners approve the School Resource Officer (SRO) Agreement with the Town of Lillington. N. The Harnett County Board of Commissioners reappoint Stanley K. Price to the Southeastern Economic Development Commission and appoint Rev. Anthony Fairley as an alternate on the Harnett County Board of Adjustment. Chairman Morris opened the meeting for informal comments by the public, allowing up to 3 minutes for each presentation up to 30 minutes. The following people spoke: 1. No one else spoke and the public comment period was closed. Brent Trout, County Manager, stated we do still have some personnel that are serving to support over in Western North Carolina. We have had some crews and individuals to come back over the weekend and new individuals have gone out. We are on standby until we get a call from the state. Commissioner McKoy made a motion to approve the budget amendments as requested by the Finance Officer. The motion was seconded by Commissioner Nicol and carried unanimously. (Attachment 1) Derrick Remer, District Manager, NC Government and Community Relations, Duke Energy introduced himself and provided information on the restoration of services in Western North Carolina. Mr. Remer also shared information on what he does at Duke Energy. Mr. Remer provided information regarding various grant programs available through Duke Energy. Mr. Remer invited the Board to the key leader update on October 30th at Harnett County EOC. Chairman Morris shared the Alliance Health Board of Directors voted unanimously to recommend Brent Trout’s appointment to the Alliance’s Board. Commissioner Nicol made a motion to adjourn at 9:18 am. Adjourn Tim Mathews, County Extension Director shared Harnett County Cooperative Extension will host Ag Day on Saturday, November 16, from 10 a.m. until 2 p.m. to kick off Farm City Week. Farm City Week has been celebrated for over 25 years and aims to celebrate the importance of agriculture to the economy, quality of life, and foodways. This year’s celebration will take place from November 16-21. Ag Day will offer a farmers’ market with produce and meat, a concert, baking competitions, kid-friendly activities and more. Farm City Week will also include a Farm- Fresh breakfast on Wednesday, November 20, from 7:30 – 9:30 a.m. in the Resource Center and Library. Farm City Week will conclude with a Farm-City Banquet on Thursday, November 21, at 6:30 p.m. to recognize the farming community with awards and scholarships. The banquet will take place at Lin Shire by the Pond, 4239 Cokesbury Rd, Fuquay-Varina. Dean Garey Fox from NC State University will be the keynote speaker. Mr. Mathews recognized Selena McKoy, Extension Agent. Ms. McKoy shared we have been awarded $800,000 for a farmers market. The next time you will be hearing from us will be when we receive the contract and ask for permission to receive the grant. Mr. Mathews thanked Selena for a great job on the grant. Eric Truesdale, Veterans Services Director, reviewed a request for the Board to consider adopting a Resolution Supporting Operation Greenlight from November 4, 2024 to November 11, 2024. We will light the Resource Center and Library and Courthouse with greenlights to recognize the importance of honoring all those who made immeasurable sacrifices to preserve freedom. Employee Benefits, regarding Medicare Reimbursement. Effective January 1, 2025, revise the Medicare Supplement benefit from a reimbursement to a stipend. Employees who retire from Harnett County are provided, on a pro-rated basis for years of service, hospitalization coverage. Once a retiree becomes Medicare eligible, the County provides a Medicare supplement reimbursement, subject to certain requirements, based upon the same pro-rated basis. The standard amount of the supplement is determined by the Harnett County Board of Commissioners and is included in the annual budget ordinance. Due to the growing post-employment benefit liability, the County adjusted the service eligibility requirements effective July 1, 2015. Since that time, I have continued to monitor the impact of this change on the growing liability, as well as the efficiency of the current administrative procedures. Due to the growing number of retirees, as well as other issues mentioned later in this discussion, I would like to request that the Harnett County Board of Commissioners change the Medicare Supplement from a reimbursement to a stipend. The Board of Commissioners reviewed the application of Walter Massey for the reappointment to the Board of Adjustment as District 1 representative. The consensus of the Board was to place the reappointment of Mr. Massey on the next consent agenda. Brent Trout shared the Jetport Jamboree has been rescheduled to November 16th from 10:00 am – 2:00 pm. Commissioner Weatherspoon made a motion to go into Closed Session for the following purpose: to consult with the County’s legal counsel in order to preserve the attorney-client privilege concerning the handling of certain claims including the workers compensation cases of Adam Isbell IC File No 24-019805, and IC File No. 24-769400. This motion is made pursuant to NC General Statute Section 143-318.11 (a)(4). The motion was seconded by Commissioner Nicol and carried unanimously. Following a motion to come out of Closed Session, Vice Chairman Matthews called the meeting back into open session. Jay Sikes, Development Services Assistant Director/ Manager of Planning Services, introduced Shelby Powell, Deputy Director of North Carolina Capital Area Metropolitan Planning Organization (CAMPO). Ms. Powell provided information regarding CAMPO and regional transportation planning services. Current studies include the North Harnett Transit Study where we are looking for some options for providing public transportation internal to Harnett County as well as counting you all to some of the services that are being provided in Wake County. Additional discussion included: • SPOT 7 Division Needs • NCDOT Funding • CAMPO boundaries, boundary update frequency and future potential expansions Commissioner Weatherspoon recognized Richie Hines, District Engineer with NCDOT. Mr. Hines introduced Rob Stone, Deputy Division Engineer, Lee Jernigan, Division Engineer, and Phillip Hart, Division Planning Engineer. Vice Chairman Matthews thanked CAMPO for an update and for visiting us this morning. I am excited that our 421 Corridor has been included in CAMPO. We have really sought to bring our Jetport to the point we believe it can be and ne the economic driver for our County. FINANCE OFFICER’S RECOMMENDATION: W COUNTY MANAGER’S RECOMMENDATION: Item 4B HCBOC 102124 Pg. 18 Resolution Supporting Operation Green Light for Veterans WHEREAS, the residents of Harnett County have great respect, admiration, and the utmost gratitude for all the men and women who have selflessly served our country and this community in the Armed Forces; and WHEREAS, the contributions and sacrifices of those who served in the Armed Forces have been vital in maintaining the freedoms and way of life enjoyed by our citizens; and WHEREAS, Harnett County seeks to honor individuals who have made countless sacrifices for freedom by placing themselves in harm’s way for the good of all; and WHEREAS, veterans continue to serve our community in the American Legion, Veterans of Foreign Wars, Disabled American Veterans, religious groups, civil service, and by functioning as County Veterans Service Officers in 29 states to help fellow former service members access more than $52 billion in federal health, disability and compensation benefits each year; and WHEREAS, approximately 200,000 service members transition to civilian communities annually; and WHEREAS, an estimated 20 percent increase of service members will transition to civilian life in the near future; and WHEREAS, studies indicate that 44-72 percent of service members experience high levels of stress during transition from military to civilian life; and WHEREAS, active military service members transitioning from military service are at a high risk for suicide during their first year after military service; and WHEREAS, the National Association of Counties encourages all counties, parishes and boroughs to recognize Operation Green Light for Veterans; and WHEREAS, Harnett County appreciates the sacrifices of our United States military personnel and believes specific recognition should be granted; THEREFORE, BE IT RESOLVED, with designation as a Green Light for Veterans County, Harnett County hereby declares from November 4th 2024 through Veterans Day, November 11th 2024 a time to salute and honor the service and sacrifices of our men and women in uniform transitioning from active service; therefore, be it further RESOLVED, that in observance of Operation Green Light, Harnett County encourages its citizens in patriotic tradition to recognize the importance of honoring all those who made HCBOC 102124 Pg. 19 immeasurable sacrifices to preserve freedom by displaying green lights in a window of their place of business or residence from November 4th through the 11th, 2024. The focus of today’s presentation will be on the Medicare supplement portion. Employees who retire from Harnett County are provided, on a pro-rated basis for years of service, hospitalization coverage. Once a retiree becomes Medicare eligible, the County provides a Medicare supplement reimbursement, subject to certain requirements, based upon the same pro -rated basis. The standard amount of the supplement is determined by the Harnett County Board of Commissioners and is included in the annual budget ordinance. Due to the growing post-employment benefit liability, the County adjusted the service eligibility requirements effective July 1, 2015. Since that time, I have continued to monitor the impact of this change on the growing liability, as well as the efficiency of the current administrative procedures. Due to the growing number of retirees, as well as other issues mentioned later in this discussion, I would like to request that the Harnett County Board of Commissioners change the Medicare Supplement from a reimbursement to a stipend. Growth of retirees: The County has approximately 208 retirees (as compared to 130 in 2015) of which 140 are eligible for a Medicare supplement. Financial impact: The current maximum reimbursement is $200 and is set each year as part of the budget. For budget purposes, the County allocates the full amount for all eligible retirees. As the number of Medicare eligible retirees has continued increase, so has the impact on staff resources: • Payments are often returned or misdirected due to account closure, change of address, etc. • Retiree confusion when providing supporting documentation due to multiple plans. • Lost contact due to a change of address, relocation to assisted living and/or to live with family members; family and caregivers are often unaware of the benefit. • Change in available plans which may now offer zero (or lower) monthly premiums that are attractive to retirees on fixed incomes; however, the risk of higher deductibles and out-of-pocket costs is greater. • Increase staff impact to ensure compliance with the ordinance as well as accounting standards. HCBOC 102124 Pg. 60 Requested solution: • Effective January 1, 2025, revise the Medicare Supplement benefit from a reimbursement to a stipend with the following restrictions: o Retirees will receive a stipend equivalent to their retirement benefit, on or about the 10th of each month. o Retirees must, during open enrollment each year, verify contact information, as well as payee information, or the benefit will discontinue at fiscal year-end. If a retired employee fails to update such information, and the supplement is stopped, the retiree shall not be eligible for the supplement until the next open enrollment period. Requiring annual contact with the appropriate County staff will ensure that payments are not misdirected. o This change may impact current participants. Current retirees must elect to continue with a reimbursement or switch to a stipend; once an eligible retiree selects the “stipend method” they will not be allowed to switch back to a reimbursement. Additional information: If approved, an effective date of January 1, 2025, will allow staff time to communicate with retirees regarding this change, prepare changes to the personnel ordinance and allow retirees to enroll in supplemental plans based on their needs. Insurance Benefits Revised Insurance Benefits Policy: All full-time employees hired on or after July 1st, 2015, or those employees who leave the employment of the County and return to work on or after July 1st, 2015, All full-time employees shall be eligible for insurance benefits in accordance with the following policy. A. The County will provide individual medical insurance to all full-time employees. All full-time employees shall be enrolled in the program in accordance with the provisions of the County’s insurance contracts on the first day of the month following a thirty (30) day waiting period. B. Any full-time County employee may so choose to have money deducted from his or her check to provide dental and vision insurance for him or herself and to provide health insurance, dental and vision insurance for any dependents he or she may have in accordance with the provisions of the County’s insurance contracts. C. Health benefits in retirement are provided on a pro-rated basis for years of service as listed below. Employees who are not eligible for the benefits as outlined below will not be allowed to remain on the County’s health insurance plan beyond any rights granted by the Consolidated Omnibus Budget Reconciliation Act (COBRA). D. Individuals must be County employees at the time of retirement to be eligible. If an eligible employee declines retirement health benefits at the time of retirement, the employee will not be eligible for the benefits at a later date. E. For employees retiring on or after December 16, 2019, an eligible employee must elect or decline the Medicare supplement at the time of retirement to receive the supplement upon turning 65 years of age or becoming Medicare eligible. If an eligible employee declines the Medicare supplement, the employee will not be eligible for the supplement at a later date. E.F. For retirements on or after January 1, 2025, an eligible employee that elects the Medicare supplement will receive a stipend equivalent to their retirement benefit. Any employee that retired prior to January 1, 2025 and elected the Medicare supplement will have the option to continue receiving the supplement in the form of a reimbursement or change to a stipend. Once a retired employee chooses the stipend option, the employee will not be permitted to change back to a reimbursement. For any retired employee that continues to receive the supplement as a reimbursement, the County will not reimburse the employee for receipts received for any prior years that the employee is eligible for the supplement. The standard amount of supplement is to be determined by the BOC, which will be included in the annual budget ordinance. F.G. For those retired employees receiving the Medicare supplement as a stipend, the Medicare supplement will begin upon turning 65 years of age or HCBOC 102124 Pg. 62 becoming Medicare eligible. For those receiving tThe Medicare supplement as a reimbursement, the supplement will commence upon the retired employee’s submittal of receipts for reimbursement for that fiscal year. The County will not reimburse the employee for receipts received for any prior years that the employee is eligible for the supplement. Standard amount of supplement is to be determined by the BOC, which will be included in the annual budget ordinance. To remain eligible for the supplement, retired employees must complete a annual certification during open enrollment period to verify current contact and banking information. If a retired employee fails to update such information and the supplement is terminated, the employee shall not be eligible for the supplement until the next open enrollment period. G.H. During retirement, health benefits premium payments are due by the first day of the month that coverage is effective. The premium payment deadline (hereinafter referred to as the “grace period”) ends thirty (30) days after the due date. Retired employees who do not pay their premiums in full or who do not have sufficient funds in their account for authorized bank drafts by the final day of the grace period will have their coverage canceled. If the unpaid premium amount due is only for dependent coverage, then only the dependent coverage will be canceled. However, if the unpaid premium amount due is for the retired employee and dependent coverage, then the retired employee and all dependents will have their coverage canceled. Such retired employees and/or dependents who have their coverage canceled for non-payment cannot be reinstated. However, if the premium payment is received after the coverage has been canceled due to non-payment, but the postmark date is on or before the last day of the grace period, then coverage will be reinstated. H.I. COBRA - Under the Consolidated Omnibus Budget Reconciliation Act (COBRA) of 1985, Harnett County offers employees and their eligible dependents the opportunity for temporary extension of continuous insurance coverage in instances where coverage under the plan would otherwise end. Eligible employees have sixty days from the date of the notice to elect COBRA coverage.
