HARNETT COUNTY BOARD OF COMMISSIONERS Regular Meeting Minutes September 3, 2024 The Harnett County Board of Commissioners met in regular session on Monday, September 3, 2024 at 9:00 am, in the Commissioners Meeting Room, Harnett County Resource Center and Library, 455 McKinney Parkway, Lillington, North Carolina. Members present: William Morris, Chairman W. Brooks Matthews, Vice Chairman Barbara McKoy, Commissioner Lewis W. Weatherspoon, Commissioner Matthew B. Nicol, Commissioner Staff present: Brent Trout, County Manager Dwight Snow, County Attorney Kimberly Honeycutt, Finance Officer Melissa Capps, Clerk Chairman Morris called the meeting to order at 9:00 am. Commissioner Nicol led the Pledge of Allegiance and provided the invocation. Chairman Morris called for any additions or deletions to the published agenda. Commissioner Nicol made a motion to approve the agenda as published. The motion was seconded by Commissioner Weatherspoon. The motion carried unanimously. Commissioner Nicol made a motion to approve the consent agenda. Commissioner Weatherspoon seconded the motion. The motion passed unanimously. The items on the consent agenda were as follows: A. Minutes i. Regular Meeting Minutes of August 19, 2024 ii. Work Session Minutes of August 27, 2024 B. The Harnett County Public Library respectfully requests permission to apply for annual state aid from the North Carolina Department of Cultural Resources, the State Library. The State Library appropriates funds each year for local libraries intended to promote, aid, and equalize public library services in North Carolina. The amount estimated for this fiscal year is $207,149. There is no match required. C. Emergency Services is requesting the approval of the fireworks application from Pyro East Coast, Inc. for Campbell University's football season firework displays. East Coast Pyrotechnics meets all requirements along with fire code compliance for the events. The events will take place on 9/21,9/28,10/5,10/26,11 /9 and 11 /23. D. Administration is requesting the Board of Commissioners approve the Memorandum of Understanding (MOU) Completing Access to Broadband (CAB) Program with North Harnett County Board of Commissioners Regular Meeting Minutes September 3, 2024 Pagel of 4 Carolina Department of Information Technology (NCDIT). This agreement approval will provide the necessary action to establish this ARPA funding as obligated prior to the December 31, 2024 deadline. (Attachment 1) E. Administration is requesting the Board of Commissioners approve Exhibit J County Matching Funds using ARPA funds in the amount of $218,626 for this match for the GREAT Grant. (Attachment 2) F. The Harnett County Board of Commissioners would like to appoint Nichole Hamer to the Juvenile Crime Prevention Council and reappoint Chance Torain, Carl Davis, Tommy Stewart, Uriah Parker, and Nathan Handley to the Administrative Appeals Board for School Bus Stop Arm Violation. Vice Chairman Matthews read a Proclamation for the 1000' Anniversary of the Rotary Club of Dunn proclaiming September 3, 2024 as "ROTARY CLUB OF DUNN DAY" in Harnett County in honor of its 100d' anniversary and called upon all citizens of this County to recognize the Rotary Club of Dunn for 100 years of outstanding service to improve the community and their contribution to positive change across the world. A framed copy of the Proclamation was presented to Mark Johnson, Rotary Club President. (Attachment 3) Rhonda Narron, Southeastern Regional Manager, Seniors' Health Insurance Information Program and LeeAnn Blackmon, Volunteer Services Director/Medicare Coordinator, Harnett County Division on Aging recognized the Senior Health Insurance Information Program (SHIIP) Volunteers. In 2023, this team of SHIIP Counselors served 615 Medicare beneficiaries. This team saved those Medicare beneficiaries $388,950. They provide services to Medicare beneficiaries year-round. Chairman Morris opened the meeting for informal comments by the public, allowing up to 3 minutes for each presentation up to 30 minutes. The following people spoke: 1. Larry Mitchell of 487 Century Drive, Cameron, NC. 2. Jerry Rivas of 234 Twins Pond Road, Sanford, NC. No one else spoke and the public comment period was closed. Mark Locklear, Development Services Director, reviewed information regarding the Proposed Text Amendment Case #PLAN2407-0001 Applicant: Harnett County Development Services; Harnett County Unified Development Ordinance; Article III, Section 8.2.1 D. Harnett County Three -Year Rule for Minor Subdivisions. At the August 5, 2024 Planning Board meeting, the Planning Board voted unanimously (5- 0) to recommend approval of the text amendment as written. No one spoke in opposition. Since receiving the comments at the August 19, 2024 Board of Commissioners meeting, Development Services staff has worked with the Legal Department to compose additional text to allow for an individual subdividing land for an immediate family member to be exempt from the minor subdivision 3-year waiting period. Mr. Locklear reviewed the proposed text regarding the 3-year waiting period for a family member who needs to subdivide: Harnett County Board of Commissioners Regular Meeting Minutes September 3, 2024 Page 2 of 4 "The three (3) year waiting period shall not apply to an individual subdividing a parcel of land for an immediate family member within 3 years of the initial minor subdivision of the original tract of land. For the purposes of this section, "immediate family member" means a spouse, parent, child, brother, sister, grandparent, or grandchild. In no case shall the number of new lots created, combined with the number of lots created by the initial minor subdivision, exceed the maximum number of lots permitted by the minor subdivision process. All other requirements set forth by the minor subdivision process shall apply. To qualify for this exemption, the parcel to be subdivided must be owned in the individual's name and the individual shall submit a plat including the name and relation of the immediate family member on the lot and state the lot is being conveyed to that family member. The individual subdividing the land shall certify the following on the plat: I hereby certify the lot shown is created for the purpose of family ownership and is in no way intended to circumvent the minor subdivision provisions of the Harnett County Unified Development Ordinance. " For all other requests for exemptions to this three (3) year waiting period, the Planning Director or Designee may at any time refer the application to the Harnett County Planning Board for consideration to allow a second minor subdivision to occur within the allotted three (3) years if deemed necessary and appropriate. Subsequent to Planning Board approval, the application shall then be reviewed in accordance with the major subdivision review and approval process by the Development Review Board. Commissioner Weatherspoon made a motion to approve the Proposed Text Amendment Case #PLAN2407-0001 to the Harnett County Unified Development Ordinance. The motion was seconded by Commissioner Nicol and carried unanimously. (Attachment 4) Brent Trout, County Manager, stated we are having Benhaven Community Day, Saturday, September 71 from 10:00 am to 1:00 pm. Mr. Trout also shared he will be attending his first Alliance Health Board Meeting Thursday. Commissioner Nicol made a motion to approve the budget amendments as requested by the Finance Officer. The motion was seconded by Commissioner Weatherspoon and carried unanimously. (Attachment 5) Commissioner Weatherspoon made a motion to go into Closed Session to consult with the County's legal counsel in order to preserve the attorney -client privilege concerning the handling of certain litigation namely the case of "Frances Deach vs William Grady, et al US District Court for the Easter District of North Carolina Civil File No. 5:23-CV-00329-D-RN. This motion is made pursuant to NC General Statute 143-318.11 (a)(3). The motion was seconded by Commissioner Nicol and carried unanimously. Following a motion to come out of Closed Session, Chairman Morris called the meeting back into open session. Capps, Clerk Harnett County Board of Commissioners Regular Meeting Minutes September 3, 2024 Page 4 of 4 NC ©IT e`;'w<_ ATTACHMENT 1 COMPLETING ACCESS TO BROADBAND (CAB) PROGRAM MEMORANDUM OF UNDERSTANDING Purpose This Memorandum of Understanding (MOU) establishes an agreement and commitment between the North Carolina Department of Information Technology (NCDIT) and Harnett County (the County), regarding the transfer of funds from the County to NCDIT as the County's portion of the required financial match for the CAB project identified below. This MOU is subject to the provisions of all applicable Federal. State and local laws, regulations, policies, and standards. II. Background On May 3, 2024, NCDIT posted a County Scope of Work document requesting responses from pre -qualified vendors to build broadband infrastructure and provide broadband service to unserved and underserved locations within the County. NCDIT received proposals in response to the County Scope of Work, and an evaluation team, with members from NCDIT and the County, reviewed the proposals and agreed to award the broadband infrastructure project (CAB Project) to Connect Holding (Respondent) pursuant to its Application #1000022245. The total cost of this CAB Project is apportioned among NCDIT, the County, and the Respondent according to N.C.G.S. 143B-1373.1(d) or (e) and as set out in Section 3 of the County Scope of Work document. III. Fiscal Responsibility Within sixty (60) days of executing this MOU, the County agrees to send its portion of the required financial match in the amount of $1,941,785.30 to NCDIT to be used for the CAB Project. NCDIT agrees to use these funds solely for this CAB Project and to designate these funds in an account separate from other NCDIT funds. NCDIT will contribute a financial match to this CAB Project in the amount identified in the contract with the Respondent. The County shall transfer its portion of the required financial match to NCDIT by mailing a check payable to: NC Department of Information Technology Broadband CAB Program Accounts Receivable (AR) P.O. Box 17209 Raleigh, NC 27619-7209 Mailings must include a copy of this MOU and reference Broadband CAB Program on the check. In the event that the CAB Project is terminated and NCDIT seeks the clawback of funds from the Respondent, the County and NCDIT will share pro rata in any money returned by the Respondent. In the event of a cost underrun for the CAB Project, NCDIT will refund the County its pro rata portion of the total project cost. 1V. Source of Funding and Reporting NCDIT will use American Rescue Plan Act (ARPA) Capital Project Funds for its portion of the project cost. Pursuant to the CAB statute (N.C.G.S. 143b-1373.1), the County must use nonrestricted general funds or ARPA funds for its portion of the CAB Project. If the County is using ARPA funds, it is responsible for its own reporting to U.S. Treasury regarding these funds. Pursuant to the Scope of Work Special Term and Condition No. 1, NCDIT will provide the county with all progress reports, financial reports, audits, technical reports, and reports from site visits within 10 business days of their completion, including supporting documentation. Respondent is a contractor of NCDIT, and the contract between NCDIT and Respondent consists of the Broadband Expansion and Access RFP, the executed County Scope of Work, the Best and Final Offer document, the commitments made by Respondent in its proposal, and any amendments entered into between NCDIT and Respondent. Applicable provisions of 2 C.F.R. 200 and the State and Local Fiscal Recovery Fund Final Rule are included in that contract. V. Effective Period This MOU shall remain in full force and effect until the termination of the contract between NCDIT and the Respondent for the CAB Project or until superseded, terminated, cancelled, or revoked by law or by one of the parties herein. This MOU may be amended, if mutually agreed upon, to change the scope and terms of this MOU or as necessary to conform to changes in authorizing legislation. Such changes shall be incorporated as a written amendment to this MOU. VI. Notice All notices and information permitted or required to be given by one party to the other and all questions about the MOU from one party to the other shall be addressed and delivered to the person listed below.
