Members present: William Morris, Chairman W. Brooks Matthews, Vice Chairman Barbara McKoy, Commissioner Lewis W. Weatherspoon, Commissioner Matthew B. Nicol, Commissioner Staff present: Brent Trout, County Manager Dwight Snow, County Attorney Kimberly Honeycutt, Finance Officer Melissa Capps, Clerk Chairman Morris called the meeting to order at 9:00 am. Commissioner Weatherspoon led the Pledge of Allegiance and provided the invocation. Chairman Morris called for any additions or deletions to the published agenda and noted staff has requested to add the approval of budget amendment 1331b. Commissioner Nicol made a motion to approve the agenda as amended. The motion was seconded by Vice Chairman Matthews. The motion carried unanimously. Commissioner Nicol made a motion to approve the consent agenda. Commissioner Weatherspoon seconded the motion. The motion passed unanimously. The items on the consent agenda were as follows: A.Minutes i.Regular Meeting Minutes of July 15, 2024 ii.Work Session Minutes of July 30, 2024 B.Adopt a Resolution requesting NCDOT add Folly Court in Sweetwater Subdivision to the State’s Secondary Road System. (Attachment 1) C.The Sheriff's Office requests approval to accept a grant from Building Bridges Implementation Funding issued by the Institute for Intergovernmental Research (IIR) on behalf of the U.S. Department of Justice, Bureau of Justice Assistance. The funding will be used to support efforts to enhance the Harnett County Sheriff's Office Opioid Treatment Program in the Detention Center. Grant funds will be used to pay for personnel, equipment and training. The grant is in the amount of up to $ 250,000.00. The grant will end July 31, 2025. Harnett Regional Water requests the Board of Commissioners adopt a Resolution approving the acceptance of grant funding and agreeing to follow the guidelines of the grant award from the North Carolina Department of Environmental Quality for the North Harnett Wastewater Treatment Plant Project. The Department of Environmental Quality has selected Harnett Regional Water to receive a grant in the amount of $14,775,000 for the construction of our expansion of the North Harnett Wastewater Treatment Plant. The grant will be used to pay for a portion of the cost for the $104 million dollar plant expansion. (Attachment 2) E. The Tax Administrator requests the Board of Commissioners accept and approve the Tax Collection Settlement for FY 2023.Harnett County Tax Administrator requests in accordance with North Carolina G.S. 105-321(b), the Harnett County Board of Commissioners adopt and enter into the minutes an order directing the Tax Administrator to collect the taxes charged for the 2024-2025 fiscal year. (Attachment 3) F. The Harnett County Board of Commissioners charge Christine L. Wallace, Tax Administrator, with the collection of all real, personal, and public service company taxes for the 2024-2025 levy year, and with the collection of delinquent taxes from 2014-2024. (Attachment 4) G. Legal requests the Board of Commissioners adopt a Resolution authorizing execution of Kroger Opioid Settlement and approving the second supplemental agreement for additional funds. (Attachment 5) H. Facilities requests the Board of Commissioners designate office space located at 5845 US Hwy 421S, Lillington, North Carolina for the purposes of relocating the Juvenile Court Counselor's Office. I. Administration is requesting approval to amend the Grant Project Ordinance for the $26,411,744 received from the American Rescue Plan Act - Coronavirus State & Local Fiscal Recovery Fund (ARPA/CSLFRF). This amendment shall recognize additional projects as previously approved by the Board in Project Ordinance format. (Attachment 6) J. Harnett Regional Water requests the Board of Commissioners approve contract/amendments for FY 25 in the amount of $3,395,738.00. • $500,000.00 Utility Service Co. Inc. Water Tank Maintenance • $725,500.00 The Huffstetler Group, Inc. Filter services and repairs • $2,170,238.00 CRU (Charles Underwood) Booster pump and Sewer lift station repairs. K. As discussed at the July 30, 2024 Work Session, consensus of the Board of Commissioners was to select Brent Trout, County Manager to serve as the North Carolina Association of County Commissioners Annual Conference voting delegate in Winston-Salem, NC. Commissioner Nicol read a Proclamation Recognizing the Month of August as Child Support Awareness Month. A copy of the Proclamation was presented to Harnett County Department of Social Services staff members. Chairman Morris opened the meeting for informal comments by the public, allowing up to 3 minutes for each presentation up to 30 minutes. Brent Trout, County Manager, shared Community Day is scheduled for August 7th from 4:00 pm to 7:00 pm, we will be monitoring the weather and some of the activities outside may be curtailed. The Career Fair is scheduled for August 8th. Emergency Services is monitoring the weather and making preparations for Hurricane Debbie, looks like a large rain and wind event for us, please be diligent. Commissioner Weatherspoon made a motion to approve the budget amendments as requested by the Finance Officer. The motion was seconded by Commissioner Nicol and carried unanimously. (Attachment 7) Commissioner Weatherspoon made a motion to go into Closed Session to discuss certain economic development matters. This motion is made pursuant to NC General Statute 143-318.11 (a)(4). The motion was seconded by Commissioner Nicol and carried unanimously. Following a motion to come out of Closed Session, Chairman Morris called the meeting back into open session. Commissioner Weatherspoon made a motion to adjourn at 9:30 am. Next Steps • Timeline • Future Engagement HCBOC 081924 a Pg. 27 Harnett County Board of Commissioners Work Session Minutes August 13, 2024 Page 3 of 4 • Our next steps Additional discussion included: • Commissioner McKoy shared concerns regarding flooding roads along Bunnlevel-Erwin Road (Road Number 1779). • Vice Chairman Matthew shared concerns regarding increased traffic coming in from Wake County causing bottlenecks on two lane roads particularly along Hwy 401 in Lillington. • Commissioner McKoy also thanked NCDOT for improvements at Rawls Church Road and Piney Grove Road. Eric Truesdale, Veterans Services Director shared information regarding a request for approval of the acceptance of $50,000.00 from Alliance Health for Veterans Treatment Court Participants. Mr. Truesdale introduced Zane Campbell with Veterans Treatment Court. Mr. Campbell reviewed a request for permission to apply for a Governors Crime Commission Crisis Intervention Grant. This Grant is a 2-year Grant in the amount of $500,000. There is no County match required. Mr. Campbell provided information on how the funding would be used. Consensus of the Board was to place this item on the next consent agenda. Commissioner Weatherspoon made a motion to go into Closed Session to consult with the County’s Legal Counsel in order to preserve the attorney-client privilege concerning the handling of certain claims. This motion is made pursuant to NC General Statute Section 143- 318.11 (a)(3). The motion was seconded by Commissioner Nicol and carried unanimously. Following a motion to come out of Closed Session, Chairman Morris called the meeting back into open session. Commissioner Nicol made a motion to adjourn the Board of Commissioners at 9:50 am. With this solicitation North Carolina seeks best practices and innovations in the treatment court space. Applicants must work with AOC Specialty Courts Staff to ensure they have the capacity to manage the grant to start this October. Given the federal grant’s primary purpose is to address gun violence, SCIP funded specialty courts can accept participants with firearms violations. At a minimum applicants must show a programmatic and enrollment emphasis on reducing gun violence including lowering barriers of entry to those most likely to commit and/or be a victim of a firearms involved crime. Components for any application should include: 1) Specific resources and interventions the court will employ to address the impact of gun violence; 2) Methods to lower recidivism of participants; 3) Stakeholder agreements to ensure collaboration between attorneys, prosecution, judges, probation, and victim services; 4) Plans for individualized participant assessments and assistance; 5) Detailed projected timeline that specifies deliverables; 6) Goals, objectives and measurements for program evaluation; 7) Sustainability plan for keeping the program operational beyond the grant . Best practices, innovations and protocols may include but are not limited to: • Implementation of BJA approved Public Safety Risk Assessment Clearinghouse (PSRAC) criminal justice risk and needs assessments including evidence-based violence risk assessment tools to screen applicants prior to admission and at regular intervals through completion. • Establish partnerships with Medicaid funded entities to provide wrap around services including case managers, social workers, and peer support specialists. • Prioritizing individualized treatment plans to behavioral health and or substance abuse providers, job training, housing, transportation, and aftercare services. • Designating “special” judges, prosecutors, and or court clerks to work regularly in the treatment court space. • Regular monitoring and supervision of enrollees to include drug testing, court appearances, HCBOC 081924 a Pg. 67 4 and meeting with treatment providers and probation . • Trainings for court staff on topics including behavioral health, substance use disorder, trauma informed practices, adverse Childhood Experiences (ACES). • Address the health, cultural and ethnic diversity needs including sign and language interpreters and referrals to LGBTQ and BIPOC treatment providers. • Demonstrate adherence to Adult Best Practice Standards such as those proffered by National Treatment Court Resource Center (NTCRC). ALLOWABLE EXPENSES The Commission seeks applications for the planning of new regional threat assessment teams. The model that is being is sought is the NC State Bureau of Investigation (NCSBI) Behavioral Threat Assessment (BeTA) unit. This unit is staffed by law enforcement officers, intelligence analysts and mental health professionals, to identify, evaluate and manage individuals identified as having motive and means to develop, or act on an opportunity to commit a targeted attack. This new regional unit must manage its own caseload from the area they are supporting and serve as a resource to regional partner agencies. Applicants should address the following elements: 1) Initial and ongoing training for investigators on threat assessment investigation models, assessment tools, interviewing skills, intelligence analysis and data collection; HCBOC 081924 a Pg. 68 5 2) Threat detection software and other technology including surveillance and digital footprint mining; 3) An estimated budget detail for program onset and year over year; 4) Staffing plan to include partnerships with non-law enforcement personnel from behavioral health, social work, case management, and administrative staff; 5) Regular community engagement with key stakeholders including courts, education, and social services; 6) Protocols for capturing and reporting performance measures and outcome data; 7) Implementation of evidence-based assessment tools for identifying, assessing, and managing individuals who may be on the pathway to violence. BEHAVIORAL HEALTH FOCUSED COMMUNITY VIOLENCE INTERVENTION (CVI) PROGRAMS IN HIGH VIOLENCE COMMUNITIES Funding Minimum $50,000/year Funding Maximum $250,000/year Length of Award Two year Eligible Subrecipients Non-Profits, Local Government, Hospitals One application under this priority per entity. Commission seeks applications from existing or new CVI programs in high violence localities. High violence localities are communities with high violent crime rate per capita as well as high firearm visits to the emergency room. Funding priorities are deploying community health workers, providing trauma informed care, hospital based violence interruption, violence interrupters intervening in community violence and working to prevent retaliation and reinjury. Applications should include: 1) Culturally competent case managers with backgrounds that reflect the communities they serve; 2) Goals and outcome measurements; 3) Planned partnerships and referrals to wrap around service providers , such as emotional and mental health, social work, substance abuse, workforce development, legal and housing assistance; 4) Staff training that is trauma informed and addresses adverse childhood experiences; 5) Existing local community partnership with multiple stakeholders such as: social services, schools, law enforcement, courts, healthcare, and non -profits including victims’ services. The Unique Entity ID is a 12-character alphanumeric ID assigned to an entity by SAM.gov. As part of this transition, the DUNS Number has been removed from SAM.gov. Entity registration, searching, and data entry in SAM.gov now require use of the new Unique Entity ID. This can take additional time. If your organization is not found in the system, you may need to provide additional information. Law Enforcement Agencies: Designee project staff responsible for overseeing the work of the project SETTING UP ORGANIZATIONAL ROLES The request for organization roles can come from any of a subrecipient’s representatives with access to the EBS System. Changing an organizational role is done via the submission of a Change Request in EBS. The user will click on the “Change Request” tile on their Agreement page in order to begin the request. They will complete the Officials Update at the “Officials Update” tab then enter the justification for the request. New officials will need and NCID login as explained previously. INDIRECT COST RATE Applicants that intend to charge indirect costs through the use of a Federally Negotiated Indirect Cost Rate (NICRA) must have a current, signed, federally approved indirect cost rate agreement. Documentation supporting the agency’s use of an indirect cost rate is required. HCBOC 081924 a Pg. 71 8 Since utilizing an indirect cost rate occurs at the organization level, the Financial Officer is responsible for the verification of an organization’s indirect cost rate (de minimis or Federally- negotiated rate). If an organization is utilizing an indirect cost rate, the required support documentation must be uploaded in EBS by the Financial Officer. Some subrecipients have the option of using a de minimis indirect cost rate set by law. This de minimis rate is available without the need to negotiate with the cognizant federal agency for indirect costs. The de minimis rate is an option only for subrecipients that do not have an approved NICRA. When the de minimis rate is used, costs must be consistently charged as either indirect or direct costs across all your agency’s federally funded projects. The de minimis rate is 10% of "modified total direct costs" (MTDC). The MTDC base includes: salary and wages, fringe benefits, materials and supplies, services, travel, and the first $25,000 of each contract. Excluded from the MTDC calculation are the following: equipment, capital expenditures, charges for patient care, tuition remission, rental costs, scholarships, and the portion of an y contracts in excess of $25,000. Double-charging is not permitted. If you elect to use de minimis in your projects, you must submit and upload a certification to each of your project applications. The De Minimis Certification Form can be found: https://www.ncdps.gov/about-dps/boards-and-commissions/governors-crime- commission/grant- forms#application OFFICE SPACE The Governor’s Crime Commission requires a written valuation of donated office space, as well as a floor plan detailing the space used as an upload to their attached documents. If there is a lease or rental agreement associated with this entity donating this space, it should also be attached as an upload to your grant application. CONTRACTS & CONSULTANTS The substance of the activity that has been contracted will be the major factor considered. If program activities are delegated to another entity that delegation will generally be considered a subaward and is not allowed. On the other hand, if goods or services are purchased or procured from another entity for the non-Federal entity’s own use, that activity will generally be considered a contract. For additional information on this topic, please refer to 2 C.F.R. § 200.331, subrecipient and contractor determination. Contracts must be approved by the GCC Grant Administrator before obligations can be made. Please note that the approval of the grant award by the Commission does not constitute the approval of a specific contract. See documentation table for possible forms and certifications required. Consultants HCBOC 081924 a Pg. 72 9 The limit for individual consultant rates is $650 per day or $81.25 per hour. Fees in excess of the Actual or sample contracts for the project must be uploaded (Attachment 03) to the application and approved by the assigned Grant Manager before being enacted. Reimbursements will not be approved for consultants unless their contracts have been approved by the assigned Grant Administrator. SUPPLANTING Supplanting, consistent with the DOJ Grants Financial Guide, is the deliberate reduction of State, local, or tribal government funds otherwise available, specifically because Federal funds are available (or expected to be available) to fund the same activity. Federal funds may be used to supplement existing State and local funds for program activities and must not supplant (replace) funds that have been appropriated for the same purpose. To avoid potential supplanting issues, the below guidelines should be followed: • Federal funds cannot be used to pay for existing employees unless the existing position is “back-filled” with a new hire. • Federal funds cannot be used to pay for items or costs that the award recipient is already obligated to pay with State, local, or tribal funds. • State, local, or tribal government funds previously appropriated, allocated, or budgeted for award purposes cannot be reduced or reallocated to other purposes because of the receipt of Federal funds. • Agencies must maintain documentation demonstrating that any reductions in non-Federal resources budgeted for award purposes is unrelated to the receipt or expected receipt of Federal funds. EXECUTIVE DIRECTOR SALARY Executive Directors cannot be 100% funded through subawards. Executive Directors have responsibilities that do not include or directly support the allowable activities (for example, fundraising, donor retention, board meetings, and executive administrative functions). Personnel costs that are directly related to providing direct services, supervision of grant staff, and supportin g grant activities are allowable costs. FOOD Food provision within the context of victim services is permissible if the food is necessary or integral to providing services to victims of crime for their safety (for example, providing food to victims at a shelter). Food for training and other events (not direct services) is generally unallowable but may be permitted with pre-approval from the US Department of Justice (DOJ). DOJ only approves requests when it deems food and beverage costs to be necessary. GIFT CARDS Funded projects that use gift cards (gas cards or bus passes) to support services must have written policies and internal controls regarding the purchase and use of such cards and must ensure that they are used only as reasonably necessary. Policies should address: o What approvals are required to purchase the cards? o How are the cards stored and accounted for? Grant funded purchases must be received not just obligated prior to the end of the grant period of performance. MODIFICATIONS GCC may request pre-award modifications after the application is submitted. Pursuant to Administrative Code 14B NCAC 05B .0203, after the award notice the subrecipient shall submit required grant compliance and modification information. An applicant may request an extension of no more than 60 days to submit the required modifications and documents. An applicant who does not provide the required information shall be ineligible for grant funding. For the purposes of this Rule, grant compliance and modification information include the following: •a list of grant conditions that were agreed to by an authorizing official of the Applicant; •a certification of non-supplanting; •a certification of filing of an Equal Employment Opportunity Program; •a memorandum of agreement or contract with any cooperating government agencies; •an original signature of all authorizing officials, implementing project director, and the Applicant's Chief Financial Officer; and •a signed agreement to submit to an annual fiscal audit or financial review of the program (as required by funding threshold). The rights granted herein include, but are not limited to, the following: HCBOC 081924 a Pg. 167 For Grantee’s Internal Use: Work Order #: 54277773-20 Page 2 of 3 1.Grantee shall have the right of ingress and egress over the Easement Area, Property, and any adjoining lands now owned or hereinafter acquired by Grantor (using lanes, driveways, and adjoining public roads where practical as determined by Grantee). 2.Grantee shall have the right to trim, cut down, and remove from the Easement Area, at any time or times and using safe and generally accepted arboricultural practices, trees, limbs, undergrowth, other vegetation, and obstructions. 3.Grantee shall have the right to trim, cut down, and remove from the Property, at any time or times and using safe and generally accepted arboricultural practices, dead, diseased, weak, dying, or leaning trees or limbs, which, in the opinion of Grantee, might fall upon the Easement Area or interfere with the safe and reliable operation of the Facilities. 4.Grantee shall have the right to install necessary guy wires and anchors extending beyond the boundaries of the Easement Area. 5.Grantee shall have the right to relocate the Facilities and Easement Area on the Property to conform to any future highway or street relocation, widening, or alterations. 6.Grantor shall not place, or permit the placement of, any structures, improvements, facilities, or obstructions, within or adjacent to the Easement Area, which may interfere with the exercise of the rights granted herein to Grantee. Grantee shall have the right to remove any such structure, improvement, facility, or obstruction at the expense of Grantor. 7.Excluding the removal of vegetation, structures, improvements, facilities, and obstructions as provided herein, Grantee shall promptly repair or cause to be repaired any physical damage to the surface area of the Easement Area and Property resulting from the exercise of the rights granted herein to Grantee. Such repair shall be to a condition which is reasonably close to the condition prior to the damage, and shall only be to the extent such damage was caused by Grantee or its contractors or employees. 8.The rights granted in this Easement include the right to install Facilities wherever needed on the Property to serve future development on the Property and adjoining lands. Portions of the Facilities may be installed immediately and other portions may be installed in the future as the need develops. Facilities installed in the future shall be installed at locations mutually agreeable to the parties hereto if they are to be located outside of the Easement Area. Upon any future installations of Facilities at mutually agreed locations, the Easement Area shall be deemed to include such future locations. 9.All other rights and privileges reasonably necessary, in Grantee's sole discretion, for the safe, reliable, and efficient installation, operation, and maintenance of the Facilities. The terms Grantor and Grantee shall include the respective heirs, successors, and assigns of Grantor and Grantee. The failure of Grantee to exercise or continue to exercise or enforce any of the rights herein granted shall not be construed as a waiver or abandonment of the right thereafter at any time, or from time to time, to exercise any and all such rights. TO HAVE AND TO HOLD said rights, privilege, and easement unto Grantee, its successors, licensees, and assigns, forever. Grantor warrants and covenants that Grantor has the full right and authority to convey to Grantee this perpetual Easement, and that Grantee shall have quiet and peaceful possession, use and enjoyment of the same.
