Members present: Teddy J. Byrd, Chairman Beatrice B. Hill, Vice Chairman Dan B. Andrews Walt Titchener Tim McNeill Staff present: Neil Emory, County Manager Wm. A. Blanchard, Clerk to the Board Chairman Byrd called the meeting to order at 7:00 p.m. and Commissioner Titchener led the pledge of allegiance and invocation. Commissioner Titchener moved to approve the agenda as published. Vice Chairman Hill seconded the motion and it passed unanimously. Upon motion by Commissioner McNeill and seconded by Commissioner Andrews, the Board unanimously approved the following items on the consent agenda: 1. Reclassification of two positions in the Sheriff’s Department: from Deputy III, grade 68 to Corporal , grade 69 (K-9 Corporal) from Patrol Deputy, grade 66 to Administrative Sergeant, grade 70 6. Date of Annual Surplus Sale changed from October 15, 2005 to October 22, 2005 7. Awarded contract for mapping services to Spectrum North Carolina, LLC for new orthophotography. Phases I and II have been completed and this agreement will cover the remaining phases of the project. At the end of the project, the County will have new color orthophotography available via the County’s web site or in digital format from the GIS Department. The agreed upon price to be paid to the contractor for the entire project is $124,950. 8. Authorized write-offs of delinquent Public Utilities accounts for the third quarter of 2005. All of these accounts have been in a delinquent status for more that three years and total $15,427.01. The Public Utilities Department has received over $80,000. in bad debt previously written off through the Debt Setoff Program. 9. Authorized implementation of a new Classification and Pay Plan for county employees which was recommended by Management And Personnel Services (MAPS) as a result of its study completed March, 2005. The new Classification and Pay Plan will be implemented October 1, 2005. 10. Amendment to the Personnel Ordinance: Article VI, Section 30 – Regular Employees are authorized 1 ½ hours of administrative leave each week to perform school in which an employee has a child volunteer work at a Harnett County school, , or any non-profit Harnett County organization of their choice (example: Food Pantry or Meals-on-Wheels). 11. Personnel Ordinance Article VIII, Section C (Medicare Supplement) – Expansion of the current Medicare reimbursement provision to include the cost of the Medicare Part D Prescription Plan in addition to the Supplement Plan. Currently the Medicare Supplement from the County provides for a pro-rated percentage of cost to be paid for eligible retirees over age 65. The current maximum reimbursement the County will pay is $200.00. As of January 1, 2006, Medicare supplements will no longer cover prescription drugs. Retirees will be required to purchase a Medicare Part D Prescription Drug plan from an insurer. The projected cost is approximately $30 - $40 per month. The $200 monthly maximum reimbursement will remain in effect. Commissioner Titchener moved for the appointments listed below. Commissioner Andrews seconded the motion and it passed unanimously. Harnett County Council for Women Elsa Sears re-appointed for a 3-year term to expire 9-30-08 nominated by Chairman Byrd Mid-Carolina Workforce Development Board Russel Hieb re-appointed for a 2-year term to expire 9-30-08 nominated by Commissioner Andrews Board of Health Dr. Richard L. Cotton re-appointed for a 3-year term to expire 9-30-08 nominated by Commissioner McNeill Joseph Jeffries, Chief Planner, presented a proposed resolution for a text amendment to the Manufactured Home Park Ordinance which would add new text: Article VIII, Section Q. Park Model Recreational Vehicles. Chairman Byrd called to order a public hearing on the proposed new text and opened the floor for comments from the public. Comments in favor of the new text were provided by Nancy Silvers, Crossing Mobile Home Park, Angier and Shelia Price, Franklin, NC. There being no further comments, Chairman Byrd closed the public hearing. Commissioner McNeill moved to adopt the addition to the Manufactured Home Park Ordinance as presented but with Q. b. to authorize the 1-year permit to be renewable by the Zoning Administrator or designee for 1-year periods not to exceed 3 additional years. Commissioner Hill seconded the motion and it passed unanimously. (Attachment 3) Mark Locklear, Senior Planner, presented a zoning change request from Michael and April Barefoot, 18.6 acres in Grove Township, from RA-40 to RA-30 zoning district. Planning Board voted six to one to recommend denial of the request. Chairman Byrd called to order a public hearing on the matter and opened the floor for comments from the public. No comments were offered and Chairman Byrd closed the public hearing. Chairman Byrd moved to approve the zoning change request as presented. Commissioner McNeill seconded the motion and it passed unanimously. Mark Locklear, Senior Planner, presented a zoning change request from Jackson and Angela Parrish, .50 acre in Buckhorn Township, from RA-30 to RA-20M zoning district. Planning Board voted unanimously to recommend approval of the request. Chairman Byrd called to order a public hearing on the matter and opened the floor for comments from the public. No comments were offered and Chairman Byrd closed the public hearing. Commissioner Andrews moved to approve the zoning change request as presented. Commissioner Hill seconded the motion and it passed unanimously. Mark Locklear, Senior Planner, presented a zoning change request from Rodney and Rhonda Bennett, 2.80 acres in Upper Little River Township, from RA-30 to Commercial zoning district. Planning Board voted six to one to recommend denial of the request. Chairman Byrd called to order a public hearing on the matter and opened the floor for comments from the public. The applicant, Rodney Bennett stated he plans to put an auto repair shop on the property. There being no further business, Chairman Byrd closed the public hearing. Commissioner McNeill moved to approve the zoning change request as presented. Commissioner Andrews seconded the motion and it passed unanimously. Mark Locklear, Senior Planner, presented a zoning change request from Joseph L. Rhodes, Jr., 3.11 acres in Anderson Creek Township, from RA-20R to Commercial zoning district. Planning Board voted unanimously to recommend approval of the request. Chairman Byrd called to order a public hearing on the matter and opened the floor for comments from the public. No comments were offered and Chairman Byrd closed the public hearing. Commissioner Titchener moved to approve the zoning change request as presented. Commissioner Andrews seconded the motion and it passed unanimously. Mark Locklear, Senior Planner, presented a zoning change request from Charter Communications, Roger N. Blanchard II, 1.41 acres in Anderson Creek Township, from RA-20M to Commercial zoning district. Planning Board voted unanimously to recommend approval of the request. Chairman Byrd called to order a public hearing on the matter and opened the floor for comments from the public. Comments were received from the applicant. There being no further comments, Chairman Byrd closed the public hearing. Commissioner Hill moved to approve the zoning change request as presented. Commissioner Andrews seconded the motion and it passed unanimously. Steve Ward, Assistant Director, Public Utilities, presented the discussion of bids for the Harnett/Fuquay Wastewater project contract. Mr. Ward also presented a proposed resolution for consideration by the Board which awards four separate contracts for the project. Commissioner Hill moved for adoption of the resolution. Commissioner Andrews seconded the motion and it passed unanimously. (Attachment 4) Jennifer Slusser, Staff Attorney, presented a proposed contract between Bragg Communities LLC and Harnett County to provide and maintain water distribution and wastewater collection facilities and water and wastewater treatment services for the Northern Training Area (NTA) Housing Project, a program under the Fort Bragg Residential Communities Initiative Program, located in southern Harnett County near the intersection of NC Highway 87 and NC Highway 24. Commissioner Hill moved to approve the agreement as presented by Attorney Slusser. Commissioner Titchener seconded the motion and it passed unanimously. Steve Ward, Assistant Director, Public Utilities, presented for the Board’s consideration a proposed Project Ordinance for Fort Bragg NTA Housing Water and Wastewater Extension Project. Commissioner McNeill moved for adoption of the project ordinance. Commissioner Andrews seconded the motion and it passed unanimously. (Attachment 5) Mr. Ward presented for the Board’s consideration a proposed agreement between Harnett County and Marziano & Minier, PA, Consulting Engineers, for professional services for the Fort Bragg Housing Water and Wastewater Extension Project. Commissioner McNeill moved to approve the engineering agreement as presented. Commissioner Hill seconded the motion and it passed unanimously. The following reports were filed with the Board by Mr. Emory: Sandhills Center Veterans Services Central Permitting Animal Control Soil & Water Conservation Commissioner McNeill moved that the Board go into closed session for the following purposes: 1) To discuss matters relating to the location or expansion of industries or other businesses in Harnett County; 2) To instruct the County staff in negotiating the terms on a proposed contract for the acquisition of real property; 3) To consult with the County staff regarding the handling or settlement of certain claims and litigation including the case of County of Harnett versus Danny O. Lee, et. als. File No. 05 CvS 1327. 4) To discuss a personnel matter. This motion is made pursuant to N.C. General Statute Section 143-318.11 (a) (4)(5)(3)&(6). Commissioner Andrews seconded the motion and it passed unanimously. Commissioner McNeill moved that the Board come out of closed session. Commissioner Andrews seconded the motion and it passed unanimously. There being no further business, Commissioner Titchener moved to adjourn. Vice Chairman Hill seconded the motion and it passed unanimously.
