HomeMy WebLinkAbout111521 mHARNETT COUNTY BOARD OF COMMISSIONERS Regular Meeting Minutes November 15, 2021 The Harnett County Board of Commissioners met in regular session on Monday, November 15, 2021 at 6:00 pm, in the Commissioners Meeting Room, Harnett County Resource Center and Library, 455 McKinney Parkway, Lillington, North Carolina. Members present: W. Brooks Matthews, Chairman Barbara McKoy, Commissioner Mark B. Johnson, Commissioner Lewis W. Weatherspoon, Vice Chairman Matt B. Nicol, Commissioner Staff present: George Wood, Interim County Manager Dwight Snow, County Attorney Kimberly Honeycutt, Finance Officer Melissa Capps, Clerk Chairman Matthews called the meeting to order at 6:00 pm. Commissioner Johnson led the Pledge of Allegiance and invocation. Chairman Matthews called for any additions or deletions to the published agenda. Chris Appel, Senior Staff Attorney stated on Item 9, I would ask that you add and a motion to approve a Resolution Finding Substantial Inequality for Redistricting Purposes and adopting new election district boundaries. Chairman Matthews asked that the Commissioners add budget amendment no. 1212b which was inadvertently left out of the agenda packet. Vice Chairman Weatherspoon made a motion to approve the agenda as revised. The motion was seconded by Commissioner Nicol and carried unanimously. Vice Chairman Weatherspoon made a motion to approve the consent agenda as revised. Commissioner McKoy seconded the motion. The motion passed unanimously. The items on the consent agenda were as follows: A. Minutes i. Work Session Minutes of October 26, 2021 ii. Regular Meeting Minutes of November 1, 2021 B. Budget Amendments (Attachment 1) C. Tax Rebates, Refunds and Releases — Motion to approve tax rebates, refunds and releases as requested by the Tax Administrator. Administration requests adoption of the North Carolina Local Government Records Retention Schedule Updates to the General Records Schedule and the Program Records Schedule. E. General Services Director requests the Board of Commissioners consider and approve position and budget for adding one additional Animal Control Officer (ACO) Position bringing total number of ACO positions to five (5). F. Administration requests the Board of Commissioners consider and approve Work Authorization (WA) 18-02 for Talbert & Bright to design new phasing plans that will reduce closure to hangar tenants at the Jetport during the expansion construction. G. Administration requests the Board consider approval of the revised County of Harnett Policies Governing the Use of the Harnett County Commons Area and Harnett County Resource Center & Library Training Rooms. H. Along with approval of the revised Policies Governing the Use of the Harnett County Commons Area and Harnett County Resource Center & Library Training Rooms, Administration requests the approval of the following two positions: Facilities Maintenance Technician (Grade 16) and Audio -Visual Technician/Trainer (Grade 20) which we believe are necessary to effectively administer this policy as presented. I. Administration requests award of a bid for the demolition of the former Harnett County Detention Center and associated electrical, mechanical, plumbing, site, and architectural work to Spruill Construction, which was the low bidder for this project (Bid Recommendation Letter from Wooten Company is attached) with a base bid of $448,000. J. The Health Director requests, pending approval from the Board of Health at their November 18, 2021 meeting, establish the rates for the FY21-22 Flu Vaccines. K. The Sheriff's Office is requesting approval to accept a donation of an enclosed trailer from the Angier Fire Department. The trailer will be used by the Sheriff's Office to transport Dive Team equipment. Chairman Matthews presented the following Proclamation: Proclamation Recognizing Harnett Central High School Lady Trojans Varsity Volleyball Team. The Harnett County Board of Commissioners express its sincere gratitude and respect to the Harnett Central High School Lady Trojans Varsity Volleyball Team and Coaching staff for the team's outstanding achievements and their inspiration to youth across North Carolina through their dedication, teamwork, and athletic prowess. Chairman Matthews opened the meeting for informal comments by the public, allowing up to 3 minutes for each presentation up to 30 minutes. The following people provided comments: 1. Commissioner McKoy shared comments regarding District 1 and representing every citizen in the county. No one else spoke. The public comment period was closed. Vice Chairman Weatherspoon made a motion to accept the resignation of Jim Roberts on the Triangle South Workforce Development Board, reappoint Kathy Wood and Stanley Price to the Planning Board, and approve Elaine Blackman's appointment as the Town of Angier's Liaison on the Harnett County Library Board of Trustees. Chris Appeal, Senior Staff Attorney introduced Craig Schauer with Brooks Pierce who reviewed the process gone through for the redistricting of electoral districts. Additional discussion included what would happen if new maps were not adopted by the November 17t' deadline, Phase 5 and Phase 6 redistricting maps. Chairman Matthews opened the public hearing regarding the revised electoral district boundaries for the Harnett County Board of Commissioners and Harnett County Board of Education. Danna Vasquez of 230 Heather Brooks Circle, Spring lake, NC. 7. Rosa Smith Williams of 3273 Bunnlevel — Erwin Road, Erwin, NC. 8. Roger Farina of 306 Pine Valley Lane, Sanford, NC. 9. Richard Chapman of 5220 Christian Light Road, Fuquay-Varina, NC. 10. Elizabeth Crudup of 234 Hamilton Road, Bunnlevel, NC. No one else spoke. Chairman Matthews closed the public hearing. Chairman Matthews summarized the process undertaken. Once we make our decision it will be up to the Board of Education to decide if they want to align with that or if they would like to do something differently. Harnett County Board of Commissioners November 15, 2021 Regular Meeting Minutes Page 3 of 10 Chairman Matthews made a motion to accept Phase 5 as presented last Monday and has been available this week and adopt the Phase 5 County Commissioner District Map. Vice Chairman Weatherspoon seconded the motion. Commissioner Nicol made a motion to table this motion, to allow more time and gather some more information and data. Commissioner McKoy seconded the motion. Commissioners McKoy, Johnson and Nicol voted in favor of tabling the motion. Chairman Matthews and Vice Chairman Weatherspoon voted against the motion. The motion passed 3:2. Vice Chairman Weatherspoon made a motion that rather than adjourn, recess and reconvene no later than the 17a' at 9:00 am to continue discussion on this matter. Commissioner Nicol seconded the motion. The motion carried unanimously. The Board of Commissioners took a 10 minute recess at 8:05 p.m. The Board of Commissioners reconvened at 8:15 p.m. Jay Sikes, Assistant Development Services Director/ Manager of Planning Services, petitioned the Board for a Public Hearing on the Proposed Zoning Change: Case # PLAN2109-0003 Landowner / Applicant: Henry & Susie Elmore; 5.36 +/- acres; Pin # 1515-42-2598.000; From Commercial to Industrial Zoning District; SR # 1872 (Dixieland Road); Averasboro Township. The site is currently occupied by the applicant's materials that have accumulated due to his business. Mr. Sikes stated staff s evaluation as: The IMPACT to the adjacent property owners and the surrounding community is reasonable, and the benefits of the rezoning outweigh any potential inconvenience or harm to the community. REASONING: The impact to the surrounding community is reasonable, as there are several nonresidential uses in this area. The requested zoning district is COMPATIBLE with the existing Land Use Classification. REASONING: The requested zoning is compatible with the existing Land Use classification of Employments Mixed Use. This area is also within a Compact Mixed Use development node. These two designations highlight growing areas of the County that could include locations for employment and economic development opportunities, as well as have access to major thoroughfares and public utilities. The proposal does ENHANCE or maintain the public health, safety and general welfare. REASONING: The requested rezoning to Industrial would maintain the public health, safety, and general welfare as the proposed zoning district will allow for uses in a similar manner as the area's existing development trends. REASONING: Since this parcel is adjacent to the same zoning district, this application does not need to be considered for a Small Scale rezoning. Suggested Statement -of -Consistency. As stated in the evaluation, the requested rezoning to Industrial would not have an unreasonable impact on the surrounding community based on the nonresidential uses and zoning districts in this area as well as compliance with the County's Land Use Plan. Therefore, it is recommended that this rezoning request be APPROVED. On November 1 st, the Harnett County Planning Board voted unanimously (4-0) to recommend approval of application based on the existing nonresidential uses in this area as well as the compatibility with the Land Use Plan. No one spoke in opposition. Chairman Matthews opened the public hearing and the following person spoke: - Woody Lee of 217 Woodview Court, Fuquay-Varina, NC. No one else spoke and the public hearing was closed. Commissioner Johnson made a motion to approve the rezoning request CASE # PLAN2109- 0003. Commissioner Nicol seconded the motion. The motion carried unanimously. REASONING: Since this parcel is adjacent to the same zoning district, this application does not need to be considered for a Small Scale rezoning. Suggested Statement -of -Consistency - As stated in the evaluation, the requested rezoning to Industrial would not have an unreasonable impact on the surrounding community based on the nonresidential uses and zoning districts in this area as well as compliance with the County's Land Use Plan. Therefore, it is recommended that this rezoning request be APPROVED. Commissioner Johnson made a motion to approve the rezoning request Case # PLAN2109-0004. Commissioner Nicol seconded the motion. The motion carried unanimously. Jay Sikes, Assistant Development Services Director/ Manager of Planning Services, petitioned the Board for a Public Hearing: Proposed Zoning Change: Case # PLAN2110-0001 Landowner / Applicant: Rita Cotton, Kevin Lofton, Keith Lofton; Jerome & Algireen Washington / Hamilton Monk, Inc; 1.74 & 1.03 +/- acres; Pin #'s 9594-26-3582.000 9594-26-4447.000 & From RA-20R to Commercial Zoning District; NC 24/87; Anderson Creek Township. Parcels are currently occupied by residential structures. Mr. Sikes stated staff s evaluation as: The IMPACT to the adjacent property owners and the surrounding community is reasonable, and the benefits of the rezoning outweigh any potential inconvenience or harm to the community. REASONING: In the vicinity of the subject property, non- residential development has progressed at a stable pace. The requested zoning change to Commercial will not have a negative impact on the surrounding properties or the community as it is similar in nature to existing and neighboring zoning districts in the area. The requested zoning district is COMPATIBLE with the existing Land Use Classification. REASONING: The requested zoning is compatible with the existing Land Use classification of a Compact Mixed Use, as well as within the Compatibility Development Target area. These two designations highlight growing areas of the County that consist of planned residential areas mixed with a variety of nonresidential uses. The proposal does ENHANCE or maintain the public health, safety and general welfare. REASONING: The requested rezoning to Commercial would enhance or maintain the Harnett County Board of Commissioners November 15, 2021 Regular Meeting Minutes Page 6 of 10 public health, safety, and general welfare due to the neighboring commercially zoned parcels. The request is not for a SMALL SCALE REZONING and should be evaluated for reasonableness. REASONING: Since the proposed zoning district exists on contiguous properties, this application does not need to be evaluated for Small Scale Rezoning. Suggested Statement -of -Consistency - As stated in the evaluation, the requested rezoning to Commercial is compatible with Harnett County Land Use Plan and would not have an unreasonable impact on the surrounding community based on the existing commercial in the area. Therefore, it is recommended that this rezoning request be APPROVED. On November 1st, the Harnett County Planning Board voted unanimously (4-0) to recommend approval of application based on the existing Commercial in this area as well as the compatibility with the Land Use Plan. No one spoke in opposition. Chairman Matthews opened the public hearing and the following people spoke: 1. Roger Farina of 306 Pine Valley Lane, Sanford, NC. 2. Scott Brown of 409 Chicago Drive, Suite 112, Fayetteville, NC. 3. David Vendetti with Due Diligence Research Group, LLC Raleigh, NC. No one else spoke. The pubic haring was closed. Commissioner Nicol thanked Mr. Vendetti for his efforts to spear growth. Commissioner Nicol made a motion to approve the rezoning request for Case # PLAN2110-0001. Commissioner Johnson seconded the motion. The motion carried unanimously. Jay Sikes, Assistant Development Services Director/ Manager of Planning Services, petitioned the Board for a Public Hearing: Proposed Zoning Change: Case # PLAN2110-0003 Landowner / Applicant: Allied Investors, Inc. / Timmons Group -Beth Blackmon; 7.50 +/- acres (out of 108.31 acres); Pin # 9586-98-1436.000; From RA-20R to Commercial Zoning District; SR # 1141(Alpine Drive); Barbecue Township. The site is currently vacant. Mr. Sikes stated staffs evaluation as: The IMPACT to the adjacent property owners and the surrounding community is reasonable, and the benefits of the rezoning outweigh any potential inconvenience or harm to the community. REASONING: The requested zoning change to Commercial will not have a negative impact on the community as it is the same zoning as the adjacent parcels. This would also coincide with the development patterns in this area. The requested zoning district is COMPATIBLE with the existing Land Use Classification. REASONING: The requested zoning is compatible with the existing Land Use classification of a Compact Mixed Use. These classifications incorporate commercial uses and often have complimenting office and civic uses with residential developments in close proximity. REASONING: The requested rezoning to Commercial would enhance or maintain the public health, safety, and general welfare due to the neighboring commercially zoned parcels. The request is not for a SMALL SCALE REZONING and should be evaluated for reasonableness. REASONING: Since the proposed zoning district is the same as immediately adjacent parcels, this application does not need to be evaluated for Small Scale Rezoning. Suggested Statement -of -Consistency - As stated in the evaluation, the requested rezoning to Commercial would not have an unreasonable impact on the surrounding community based compatibility with the Harnett County Land Use Plan as well as the existing commercial uses in this area. Therefore, it is recommended that this rezoning request be APPROVED. On November 1 st, the Harnett County Planning Board voted unanimously (4-0) to recommend approval of application based on the existing Commercial in this area as well as the compatibility with the Land Use Plan. No one spoke in opposition. A representative from the existing commercial property did ask several questions about future growth in this area, what type of commercial is planned, and future traffic patterns. Chairman Matthews opened the public hearing and the following person spoke: - Beth Blackman with the Timmons Group T 5410 Trinity Road, Suite 102 Raleigh, NC. No one else spoke and the public hearing was closed. Commissioner Nicol made a motion to approve the rezoning Case # PLAN2110-0003. Commissioner McKoy seconded the motion. The motion carried unanimously. Bill Tyson, Tax Administrator requested the Board of Commissioners approve and adopt the 2022 Schedule of Values. Vice Chairman Weatherspoon made a motion to approve and adopt the 2022 Schedule of Values. Commissioner Johnson seconded the motion. The motion carried unanimously. Steve Ward, HRW Director, requested for the Board to approve a $232,472 increasing change order to Temple Grading & Construction for additional work and equipment for the Schools Wastewater Extension Project. The additional work consisted of the connection of the schools' internal plumbing to the newly installed lift stations and the installation of backflow preventers. Harnett County Board of Commissioners November 15, 2021 Regular Meeting Minutes Page 8 of 10 Ira Hall, Chief Information Officer, reviewed a request from CloudWyze who has requested a few changes to the original statement of work. In the original scope of work Cloud Wyze planned to install wireless equipment on 5 water towers and they were planning to use county owned fiber to connect their middle mile Internet connection in Lillington to the Lillington communication tower. It has been determined that the county is statutorily unable to lease out fiber to Internet Service Providers. C1oudWyze will have to build fiber out to the tower to make this connection. Removing the cost of 3 water towers from the scope will cover the unforeseen fiber build out costs. The water towers that will be removed are mostly covering municipality areas and will not have a large impact on the overall project and the ability to reach underserved residents. Commissioner Nicol made a motion to approve the requested amendment to the Broadband Services Agreement Statement of Work with C1oudWyze. Commissioner McKoy seconded the motion. The motion carried unanimously. Vice Chairman Weatherspoon made a motion to approve a 10% raise for Sheriff Wayne Coats retroactive to July 16, 2021, the effective date all other sworn officers received a raise. Commissioner Johnson seconded the motion. The motion passed unanimously. Mr. Wood stated the following information was provided in the agenda packet: • Harnett County Finance Monthly Report • Harnett County Veterans Services Activity Report • Harnett County Department of Public Health Activities Summary • Interdepartmental Budget Amendments Attorney Appel provided an update on a presidential mandate regarding vaccinations for employers. Commissioner Nicol stated I would like the Board to consider and possibly made a resolution to speak with the legislature about the possibility of adding two new commissioner districts and two voting precincts. Chairman Matthews asked Mr. Wood and Attorney Appel look into that and add to a work session. Commissioner Johnson made a motion to convene into Closed Session to consult with the County's legal counsel in order to preserve the attorney -client privilege concerning the handling of certain litigation including the following case: IN RE: National Prescription Opiate Litigation US District Court for the Northern District of Ohio, Eastern Division, MDL No. 2804 CASE: 1: 1 7-md-02804. This motion is made pursuant to NC General Statute Section 143-318.11 (a)(3). Commissioner Nicol seconded the motion. The motion carried unanimously.
