Minutes of Regular Meeting
August 15, 2005
The Harnett County Board of Commissioners met August 15, 2005, in regular session
in Courtroom 6, Harnett County Courthouse, 301 West Cornelius Harnett Boulevard,
Lillington, North Carolina.

Chairman Byrd called the meeting to order at 7:00 p.m. and Commissioner Titchener
led the pledge of allegiance and invocation.
Commissioner Titchener moved to approve the agenda as published with the addition
of a resolution encouraging growing of beards for the Sesquicentennial Celebration.
Commissioner Andrews seconded the motion and it passed unanimously.
Upon motion by Commissioner McNeill and seconded by Commissioner Hill, the
Board unanimously approved the following items on the consent agenda:

4. Project ordinance for Rail Trails project (Attachment 2)
5. Resolution authorizing cooperative purchasing agreement with the City of
Jacksonville which will allow the County to purchase from Jacksonville’s convenience
contract with Cisco Systems. The term of the convenience contract is 2 years
beginning 8-31-04. Using this contract will allow a discount of 36% off the list price
of Cisco equipment and products and a discount of 25% off the price of maintenance
contracts. The Finance Officer and the County Attorney have reviewed the purchasing
agreement and contract and have recommended moving forward. (Attachment 3)
6. Authorized increase in Cell Tower Fees:
Concealed attached wireless communications facility - $4,250.00
Co-located or combined wireless communications facility - $4,500.00
Freestanding concealed wireless communications facility - $5,000.00
Non-concealed freestanding wireless communications facility - $6,000.00
7. Contract with The Wooten Company for administrative services for the 2005
Scattered Site Housing Grant – This grant which is non-competitive, pays for housing
rehabilitation of owner occupied dwellings. Owners must meet income qualifications
which are established by the State Division of Community Assistance. Proposals were
received from The Wooten Company, Raleigh, and Parker Management Group,
Fayetteville. Independent evaluations of both proposals were conducted by the
Assistant County Manager and the Planning Director. Both evaluators recommended
The Wooten Company be awarded the contract for administrative services for the
2005 Scattered Site Housing Grant. This project involves no County funds since all
expenditures are funded by the grant.
8. Resolution approving an agreement for a five-year Safety Preservation Program
created by the Division of Aviation to assist publicly owned and operated airports with
safety related improvements with 100% State funding. This agreement will allow the
State to make improvements to the Harnett County Airport without the requirement of
a new agreement each time. It will also allow the State to bid projects together in
order to receive more competitive proposals. (Attachment 4)
9. Resolution approving a block grant agreement to include “in-kind” contribution to
be used as the local match. NCDOT project #36237.25.7.1 -- Runway and Taxiway
Extension, Paving and Lighting, Rehabilitation of MIRL/MITL (Attachment 5)
10. Resolution to authorize staff to negotiate an installment financing contract and
submit an application to the Local Government Commission for the purchase of real
property. The resolution also directs that a public hearing regarding the matter be held
September 6, 2005. (Attachment 6)
11. Resolution encouraging growing of beards for Sesquicentennial Celebration
(Attachment 7)
In the informal comments portion of the meeting, the following citizens spoke:
1. Paula Pearson Hinton, 41 Pearson Road, Buies Creek, asked questions regarding
Harnett Health System.
2. Gail Gray, 326 Roy Adams Road, Angier, discussed fox issue in her neighborhood.
3. Ted Gardner, 3130 Ross Road, Lillington, who does wildlife damage control,
discussed North Carolina Wildlife regulations.
Commissioner McNeill moved for the appointments listed below. Commissioner
Andrews seconded the motion and it passed unanimously.
Adult Care Home Community Advisory Committee
Elizabeth Murchison and Kim Kolosky for 1-year terms to expire 8-31-06
nominated by Commissioner Hill
Harnett County Council for Women
Grace McLean Watts for a 3-year term to expire 8-31-08
nominated by Commissioner Andrews
Mid-Carolina Workforce Development Board
Sheley Eldridge reappointed for a 2-year term to expire 8-31-07
nominated by Commissioner Hill
Mark Locklear, Senior Planner, presented a zoning change request from George
Family Trust/Lloyd E. George, 2.46 acre tract located on US Hwy 401 South,
Lillington Township, from RA20R to Industrial zoning district. Although the
proposed zoning is not consistent with the Harnett County Land Use Plan, staff
believes that the proposal does enhance the public health, safety, and general welfare.
The industrial zoning classification for this area would be compatible with the
surrounding neighborhood and would allow the current illegal use of an auto storage
lot to come into compliance and recommends the request be approved. The Planning
Board voted unanimously to approve the request. Chairman Byrd called to order a
public hearing on the zoning change request and opened the floor for comments from
the public. No comments were offered and Chairman Byrd closed the public hearing.
Commissioner Titchener moved to approve the zoning change request as presented.
Commissioner McNeill seconded the motion and it passed unanimously.
Mark Locklear, Senior Planner, presented a zoning change request from William
Hessian, 9.92 acre tact on Old Stage Road, Neill’s Creek Township, from Industrial to
RA-30 zoning district. The proposed zoning is consistent with the Land Use Plan and
staff believes a residential zoning classification for this area would be compatible with
the surrounding neighborhood and recommends that the request be approved. The
Planning Board voted unanimously to approve the request. Chairman Byrd called to
order a public hearing on the zoning change request and opened the floor for
comments from the public. No comments were offered and Chairman Byrd closed the
public hearing. Commissioner McNeill moved to approve the zoning change request
as presented. Commissioner Andrews seconded the motion and it passed
unanimously.

Hardee, Jr., 1.40 acre tract on Barbecue Church Road, Barbecue Township, from RA-
20R to Commercial. Staff believes that the proposal does enhance the public health,
safety and general welfare. The commercial zoning classification for this area would
be compatible with the surrounding neighborhood and staff recommends that the
request be approved. The Planning Board voted unanimously to approve the request.
Chairman Byrd called to order a public hearing on the zoning change request and
opened the floor for comments from the public. No comments were offered and
Chairman Byrd closed the public hearing. Commissioner McNeill moved to approve
the zoning change request as presented. Commissioner Hill seconded the motion and
it passed unanimously.
Mark Locklear, Senior Planner, presented a zoning change request from Edward
Douglas Parks/Allan G. Casavant, 8.23 acre tract on Hwy 24, Johnsonville Township,
from RA-20R to Commercial. The predominant land use in the area is mixed. The
Harnett County Land Use Plan indicates that this area be used as compact mixed use.
Staff believes that the proposed request does enhance the public health, safety and
general welfare. A commercial zoning classification for this area would be compatible
with the surrounding neighborhood. There was an issue of spot zoning, however the
Planning Board determined it to be reasonable due to the lot size. Staff concludes that
the request does conform to the Harnett County Land Use Plan and recommends
approval. The Planning Board voted unanimously to approve the request. Chairman
Byrd called to order a public hearing on the zoning change request and opened the
floor for comments from the public. No comments were offered and Chairman Byrd
closed the public hearing. Commissioner Andrews moved to approve the zoning
change request as presented. Commissioner McNeill seconded the motion and it
passed unanimously.
Mark Locklear, Senior Planner, presented a proposed Zoning Ordinance text
amendment. The Planning Department requests the change to the Industrial Section of
the Zoning Ordinance. Article VI, Section 1.1L. Currently colleges, universities and
trade schools are not allowed within our industrial zoning district. The change would
allow these uses to locate within our industrial parks. The planning Board voted
unanimously to approve the proposed text amendment. Chairman Byrd called to order
a public hearing on the proposed text amendment and opened the floor for comments
from the public. No comments were offered and Chairman Byrd closed the public
hearing. Commissioner Titchener moved to adopt the resolution amending the Zoning
Ordinance as presented. Commissioner Hill seconded the motion and it passed
unanimously. (Attachment 8)
Major Gary McNeill, Sheriff’s Department, presented for the Board’s consideration, a
request for authorization to use the sole source purchasing option to upgrade the
Lillington communications tower paging system. The overriding consideration for
this exception to the bidding process is due to standardization and compatibility with
the current infrastructure. The Sheriff’s Department purchases most of its
communications equipment from Communications International, Inc. This upgrade
will enhance the paging system for emergency response personnel throughout the
County. The total cost of the project is $84,266.28 and will be funded through the
2004 Homeland Security Program. Commissioner Andrews moved to approve the
request as presented. Commissioner McNeill seconded the motion and it passed
unanimously.
Pat Cameron, Department of Social Services Director, introduced Joe Monk and Kelly
Blankenship to present a report on the World Changers’ projects this summer. Church
youth groups from across the South spend a week of their summer volunteering labor
for home renovation projects for low-income county residents. The county budgeted
$20,000 for materials this year and an additional $35,000 was raised through grants
and private contributions. In all, 392 youth completed 28 projects in Harnett County
this summer. Commissioner Titchener moved to waive landfill charges for debris
from the World Changers’ projects. Commissioner McNeill seconded the motion and
it passed unanimously.
Chairman Byrd called to order a public hearing on an installment financing contract
and deed of trust regarding financing for the renovation, refurbishment and furnishing
of improvements to 13 existing school facilities. This Qualified Zone Academy Bonds
(QZAB) project is in the amount of $789,500. No comments were offered and
Chairman Byrd closed the public hearing. Commissioner Titchener moved to adopt a
resolution approving an installment financing contract and a deed of trust, an agency
agreement, a lease agreement, a forward delivery agreement and a tax compliance
agreement with respect thereto and the execution and delivery thereof, and providing
for certain other related matters. Commissioner Andrews seconded the motion and it
passed unanimously.

Departmental reports were filed with the Board from Animal Control and Veterans
Affairs. The report showing a list of unpaid taxes, as of June 30, 2005 was filed with
the Board. (Attachment 10)
Commissioner McNeill moved for the Board to go into closed session for the
following purposes:
a) To consult with the County staff regarding the proposed settlement of a
claim; namely the worker’s compensation claim of Terry McKay; and
b) To instruct the County staff in negotiating the terms on a contract for the
acquisition of real property.
This motion is made pursuant to N.C. General Statute Section 143-318.11(a)(3)&(5).
Commissioner Andrews seconded the motion and it passed unanimously.
Commissioner McNeill moved for the Board to come out of closed session.
Commissioner Andrews seconded the motion and it passed unanimously.
There being no further business, Commissioner Andrews moved to adjourn. Vice
Chairman Hill seconded the motion and it passed unanimously. The Harnett County
Board of Commissioners regular meeting, August 15, 2005, adjourned at 8:35 p.m.
