HomeMy WebLinkAbout110623 mHARNETT COUNTY BOARD OF COMMISSIONERS Regular Meeting Minutes November 6, 2023 The Harnett County Board of Commissioners met in regular session on Monday, November 6, 2023 at 9:00 am, in the Commissioners Meeting Room, Harnett County Resource Center and Library, 455 McKinney Parkway, Lillington, North Carolina. Members present: Matthew B. Nicol, Chairman William Morris, Vice Chairman Barbara McKoy, Commissioner W. Brooks Matthews, Commissioner Lewis W. Weatherspoon, Commissioner Staff present: Brent Trout, County Manager Dwight Snow, County Attorney Kimberly Honeycutt, Finance Officer Melissa Capps, Clerk Chairman Nicol called the meeting to order at 9:00 am. Commissioner Matthews led the Pledge of Allegiance and provided the invocation. Chairman Nicol called for any additions or deletions to the published agenda. Commissioner Weatherspoon made a motion to approve the agenda. Vice Chairman Morris seconded the motion. The motion carried unanimously. Vice Chairman Morris made a motion to approve the consent agenda. Commissioner McKoy seconded the motion. The motion passed unanimously. The items on the consent agenda were as follows: A. Minutes i. Regular Meeting Minutes of October 16, 2023 ii. Work Session Minutes of October 31, 2023 B. Veterans Services requests the Board adopt a Resolution Supporting Operation Greenlight. (Attachment 1) C. Harnett County Health Department requests approval of $8,000 awarded by NCPHA for the Ann Wolfe Mini Grant to support Child Health and Infant Mortality projects. D. Harnett Regional Water requests the Board approve a Resolution adopting the 2022 Local Water Supply Plan for the Harnett Regional Water System. It is a state requirement that public water systems adopt a plan every year. (Attachment 2) E. Harnett Regional Water requests the Board agree to a Letter of Intent with the Town of Lillington for creation of an Urban Service Area (USA) north of the Town's current corporate limits. This letter of intent outlines mutual points of agreement between the Town and the County for the provision of future water and sewer service for the designated area. The Town has agreed to these provisions and said letter is attached for review. If both parties are in Harnett County Board of Commissioners November 6, 2023 Regular Meeting Minutes Pagel of 4 agreement on the general structure then a formal agreement will be created to solidify details on the creation and operation of the proposed USA. (Attachment 3) F. Anderson Creek Emergency Services is seeking Board approval for the purchase of a 2000 KME Aerial Cat 102 ft Platform Ladder Truck. They recently have been given the opportunity by the Town of Spring Lake to purchase their 2000 KME Aerial Cat 102 foot platform ladder truck for $70,000 (no financing needed). This will be an asset to the west side of Harnett County and they also have a large number of staff members who have spent a lot of their career on this truck and are trained and capable of operating it. They have obtained the records for this vehicle from the town and are satisfied it is in serviceability. They are requesting to replace the brush truck purchase that was in this year's capital projects with the purchase of this Ladder Truck to benefit their fire district and surrounding mutual aid districts. G. Harnett County Emergency Services is requesting Board approval to receive a total of $35,000 in EMPG funding from North Carolina Emergency Management. This recurring funding is utilized to assist in funding the Emergency Management Program. These are annual in -kind match funds for EM Staff salaries and funding operational budget and project needs. H. The Jetport requests the Board of Commissioners consider and sign the required NCDOT/Division of Aviation Airport Safety/Maintenance Letter of Commitment. This letter ensures Harnett Regional Jetport continues to receive support from the NCDOT/Division of Aviation's airfield maintenance program for another five (5) year term. Airfield maintenance activities include asphalt patching, crack sealing, pavement repair, joint sealing, rubber removal and airfield painting. This maintenance program is state -funded with no cost to the County. (Attachment 4) I. General Services / Community Development requests the Board of Commissioners review and approve a project ordinance allocating expenditures & revenues for the 2023 USDA Rural Housing Preservation Grant (HPG23) project. On May 15, 2023, the Board of Commissioners approved Community Development to apply for a grant in the amount of $85,000 with no local match required. The funds will be used to provide rehabilitation and general repairs to owner - occupied homes for homeowners who meet US Department of Housing and Urban Development (HUD) very -low-income and/or low-income standards. J. Pursuant to NCGS 105-378(a), the Tax Department requests the barring off the 2013 delinquent taxes. Per statute delinquent taxes that are more than ten years past due cannot be collected using enforced collection remedies. This statute of limitations affects the use of bank or rent attachment, the garnishment of wages, sheriff executions, debt setoff, or foreclosure in collecting delinquent taxes. Although forced collections is no longer permissible by law the delinquent taxes still remain a lien on the property and may be collected by other payment methods including private sale of the property. The amount of county taxes to be barred off for 2013 as of September 30, 2013 - Real and Personal Property $36,985.44 Motor Vehicles $42,215.01 K. Legal Department requests the Board of Commissioners approve the amendments to the School Bus Stop Arm Violations Ordinance. (Attachment 5) L. Benhaven Emergency Services requests the Board of Commissioners waive permit fees in the amount of $18,865 for the new Fire Station located at 13151 NC 27 W, Broadway, NC. M. The Board of Commissioners appoint Donna Johnson to the Historic Properties Commission as an alternate member. Hamett County Board of Commissioners November 6, 2023 Regular Meeting Minutes Page 2 of 4 Chairman Nicol opened the meeting for informal comments by the public, allowing up to 3 minutes for each presentation up to 30 minutes. The following person provided comments: 1. Jay Sills of Erwin, NC. 2. Rebekah Brock of 5220 Christian Light Road, Fuquay-Varnia, NC. No one else spoke. The public comment period was closed. An item was reviewed for a request for reimbursement of permit fees and sewer/water fees for a home built at 229 Sneed Lane, Fuquay-Varina, NC in honor of a Fallen US Army SSG Brent Trout, County Manager, stated at the last meeting, as stated, Garman Homes would be the recipient of the reimbursement. Commissioner Weatherspoon stated I believe legal staff and finance has been looking into if we could waive fees. Attorney Appel stated there is nothing in the statutes that would prohibit waiving or reimbursing fees. In reviewing this and talking with finance, we are developing a policy for reimbursement of these types of fees for certain categories. We will be presenting this at a later date. The item was discussed; however, no action was taken. Christine Wallace, Tax Administrator, presented an item requesting the Board consider awarding a contract for the 2026 Reappraisal to Vincent Valuations for $2,036,300. The item was discussed. Commissioner McKoy made a motion to award the contract for the 2026 Reappraisal to Vincent Valuations. Chairman Nicol seconded the motion for discussion. Discussion included other counties that Vincent Valuations has worked with. Commissioner Matthews stated I believe the sentiment as to put this out for a second time, was that this was the same company that just did our most recent re- evaluation in which all of us have received quite a bit of concern from constituents, citizens and stakeholders with regard to how much the evaluation increased, granted there were a lot of factors at play; record economy at the time the snapshot was taken, being an integral part of that I think but, I think the desire of this board in asking that this be put out a second time was to hopefully have interests from another company that could come in and do a re-evaluation and if it was in line with what we had from Vincent it was what it was but we would have more than one opinion. Commissioner Weatherspoon asked if the company doing Johnston and Sampson Counties were contacted. Ms. Wallace stated they were contacted, and they shared with me they did not see the email, that it went to their junk folder. Additional discussion included the market at which time the re-evaluation was completed, the number of appeals received and the length of time between the re-evaluation. Chairman Nicol and Commissioner McKoy voted in favor of the motion to award the contract to Vincent Valuations. Vice Chairman Morris and Commissioners Matthews and Weatherspoon voted against the motion. Motion failed 2:3. Commissioner Matthews stated it was stated that we did have some companies that may have applied if they had known about it, email went to spam; I think we open it back up, reach out to those that we know are in that line of work, to make sure they have an opportunity to submit a proposal. The motion was seconded by Commissioner Weatherspoon to reopen the request for bids. Chairman Nicol stated I do not know what more our staff can do on sending out these requests and holding people's hands, if we are trying to go out and handpick a certain company then why don't we just do that. Commissioner Matthews stated I don't know that we're trying to handpick a specific company, but I would like to see everyone in that line of work have a chance to submit. Mr. Trout stated Harnett County Board of Commissioners November 6, 2023 Regular Meeting Minutes Page 3 of 4 I believe there were 13 that are licensed to be able to do this type of work within the state, we will be sure to get a response from each on whether they would submit or decline to submit. Mr. Trout cautioned we need to get this back on the agenda next month or we may need to delay the reappraisal. Chairman Nicol called for a vote on the motion to put this back out for bid. The motion carried unanimously. Commissioner Matthews made a motion to appoint Michael Jackson as the District 3 representative to the Harnett County Board of Equalization and Review. The motion was seconded by Commissioner Weatherspoon and carried unanimously. Commissioner Matthews made a motion to table the consideration of an appointment of an at -large member of the Harnett County Board of Equalization and Review until November 20'h to allow time for commissioners to contact those individuals who are interested in serving in this role. The motion was seconded by Vice Chairman Morris and carried unanimously. Vice Chairman Morris made a motion to approve the budget amendments as requested by the Finance Officer. The motion was seconded by Chairman Nicol and carried unanimously. (Attachment 6) Commissioner Weatherspoon made a motion to go into closed session to consult with the County's legal counsel in order to preserve the attorney -client privilege concerning the handling of certain litigation including the following cases: 1. Bryant v. Grady, et al, Harnett County District Court, File No. 23CV3254-420; and 2. Ballentine v. Whitley, US Court for the Eastern District of NC, File No. 5:23-ct-3166. The motion was seconded by Chairman Nicol and carried unanimously. Following a motion to come out of closed session, Chairman Nicol called the meeting back into open session. Capps, Clerk Harnett County Board of Commissioners November 6, 2023 Regular Meeting Minutes Page 4 of 4 H a r n ett RESOLUTION NO.2023-46 C 0 U N T Y NORTH CAROLINA Resolution Supporting Operation Green Light for Veterans WHEREAS, the residents of Harnett County have great respect, admiration, and the utmost gratitude for all the men and women who have selflessly served our country and this community in the Armed Forces; and WHEREAS, the contributions and sacrifices of those who served in the Armed Forces have been vital in maintaining the freedoms and way of life enjoyed by our citizens; and WHEREAS, Harnett County seeks to honor individuals who have made countless sacrifices for freedom by placing themselves in harm's way for the good of all; and WHEREAS, veterans continue to serve our community in the American Legion, Veterans of Foreign Wars, religious groups, civil service, and by functioning as County Veterans Service Officers in 29 states to help fellow former service members access more than $52 billion in federal health, disability and compensation benefits each year; and WHEREAS, Approximately 200,000 service members transition to civilian communities annually; and WHEREAS, an estimated 20 percent increase of service members will transition to civilian life in the near future; and WHEREAS, studies indicate that 44-72 percent of service members experience high levels of stress during transition from military to civilian life; and WHEREAS, active military service members transitioning from military service are at a high risk for suicide during their first year after military service; and WHEREAS, the National Association of Counties encourages all counties, parishes and boroughs to recognize Operation Green Light for Veterans; and WHEREAS, the Harnett County appreciates the sacrifices of our United States military personnel and believes specific recognition should be granted; therefore be it RESOLVED, with designation as a Green Light for Veterans County, Harnett County hereby declares from November 6th 2023 through Veterans Day, November 11 th 2023 a time to salute and honor the service and sacrifices of our men and women in uniform transitioning from active service; therefore, be it further RESOLVED, that in observance of Operation Green Light, Harnett County encourages its citizens in patriotic tradition to recognize the importance of honoring all those who made Harnett COUNTY NORTH CAROLINA immeasurable sacrifices to preserve freedom by displaying green lights in a window of their place of business or residence from November 6ffi through the 12'', 2023. Capps, Clerk Harnett COUNTY NORTH CAROLINA RESOLUTION NO. 2023-47 RESOLUTION FOR APPROVAL OF HRW LOCAL WATER SUPPLY PLAN 2022 WHEREAS, North Carolina General Statute 143-355 (1) requires that each unit of local government that provides public water service or that plans to provide public water service and each large community water system shall, either individually or together with other units of local government and large community water systems, prepare and submit a Local Water Supply Plan; and WHEREAS, as required by the statute and in the interests of sound local planning, a Local Water Supply Plan for the Harnett Regional Water System, has been developed and submitted to the Harnett County Board of Commissioners for approval; and WHEREAS, the Harnett County Board of Commissioners finds that the Local Water Supply Plan is in accordance with the provisions of North Carolina General Statute 143-355 (1) and that it will provide appropriate guidance for the future management of water supplies for the Harnett Regional Water System, as well as useful information to the Department of Environmental Quality for the development of a state water supply plan as required by statute; NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of Harnett County that the Local Water Supply Plan entitled, HRW LWSP dated 2022, is hereby approved and shall be submitted to the Department of Environmental Quality, Division of Water Resources; and BE IT FURTHER RESOLVED that the Harnett County Board of Commissioners intends that this plan shall be revised to reflect changes in relevant data and projections at least once every five years or as otherwise requested by the Department, in accordance with the statute and sound planning practice. Box 759 Lillington, NC 27546 Dear Mr. Ward: This Letter of Intent (hereinafter referred to as the '101") describes the general terms and conditions between the Town of Lillington and the County of Harnett through its Harnett Regional Water Department (collectively the "Parties") for certain services in connection with negotiating a written agreement to govern water and sewer services in the area identified as the Town of Lillington's Urban Service Area (USA) and/or area north of the river within the Town of Lillington's existing corporate boundaries. Following acceptance of this LOI, the Parties will endeavor to enter into a binding, definitive agreement which will set forth in detail the terms, provisions, and conditions that will govern the services to be provided. Except for the provisions of services, payment, and the Parties obligations to comply with State and Federal laws, rules, and obligations, this L01 is not intended to be, and shall not constitute, a binding and enforceable agreement between the Parties. 1. Term of LOI Pursuant to this LOI, services shall commence November 1, 2023 with the intention that the Parties enter into a contract no later than 12 months. This LOI shall be in effect until the earliest of either (1) the date upon which a fully -executed agreement is agreed to by both parties covering the services and requirements included in this LOI or 12 months from November 1, 2023 2. Contemplation of Future Agreement The Parties express in good faith their intent and willingness to negotiate the terms of a fully - executed agreement for the services included in this LOI, with an expected execution date 12 months from the date of this executed agreement, or earlier. The future agreement shall include: The Adoption of a Town of Lillington USA north of the Cape Fear River. The Transfer and Conveyance of the Town's existing sewer collection assets, infrastructure, property and customers located within its corporate town limits north of the Cape Fear River to the County. The Transfer and Conveyance of the Town's new proposed Hwy 210/Harnett Central sewer collection system, customers and lift station construction infrastructure north of the Cape Fear River to the County once funding obligations are met, final certification issued, and approval of USA agreement_ • The County will allow the Town to tie in said proposed sewer collection line along Matthews Road to Harnett Regional Water's (HRW) existing sewer collection line located at Crested Iris Drive. • The Town will allow the County to collect and own all Wastewater System Development Fees from the new proposed Hwy 210/Harnett Central sewer collection construction following Transfer and Conveyance as noted above. • The Town's USA boundary will be established. • The County will require all new connections/development that connect or utilize what is known as the Town of Lillington sewer system north of the Cape Fear River to be annexed into the Town. Any connections made to the Towns sewer collection system that are not annexed must be mutually agreed upon by the Town and County prior to approval. • The Town sewer collection system within the USA shall retain capacity to service the USA. Any additionai capacity aiiocated to the Towns sewer coiiection system outside of the u5A must be mutually agreed upon by the Town and County prior to approval. • The County will operate and maintain all utility assets within the USA. • In good faith, the County will account for the Town's future growth and expansion of utility service within the USA as part of this agreement. • Capacity for existing approved developments to include all projects currently under Conditional Zoning, Preliminary, and CD Approval shall be included in initial existing allocation. • Fire protection services within the USA will be defined and established. • The County will establish the same system of rates, fees, charges, and penalties as is applicable to the other HRW customers. 3. Good Faith and Time is of the Essence This LOI is an expression of the good faith of the Parties. The omission of certain terms from this LOI is not to be construed so as to diminish the importance or materiality of such terms, and the Parties acknowledge that, in addition to the terms contained herein, additional material terms remain to be resolved. The Parties also acknowledge that time is of the essence, and agree to have ongoing discussions and work with diligence to pursue the execution of a contract as soon as reasonably practicable. WITNESSETH WHEREAS, the Sponsor is primarily responsible for maintaining the facilities of the Airport to protect and preserve the safety of flight operations at, from and to the Airport; and WHEREAS, and the Department shares the interest of the Sponsor in the prompt and adequate maintenance and repair of the paved surfaces of the Airport which support aircraft movements on the Airport; and WHEREAS, the Sponsor and the Department may, from time to time, mutually determine that certain paved surfaces and adjacent areas on the airport have aged and deteriorated and/or that other infrastructure is in need of maintenance or repair, and that the Sponsor could benefit from the assistance of the Department in accomplishing such maintenance and repair; and WHEREAS, pursuant to Article 7 of North Carolina General Statute 63, the Department is authorized to undertake safety improvements of aircraft movement areas, on publicly owned and operated airports in North Carolina; and WHEREAS, the Sponsor and the Department agree that upon the request by the sponsor and the acceptance by the Department, certain needed improvements at the Airport may be undertaken by the Department in conformance with the provision of North Carolina General Statute 63; and WHEREAS, the Department requires a Commitment and Release of Liability statement to be on file in its offices, in order to be able provide and oversee such maintenance and repair at the Airport; NOW THEREFORE, the Sponsor does hereby commit to the following measures: 1. This Letter of Agreement supersedes all prior agreements between the Department and Sponsor with respect to the subject matter of this Letter of Agreement. Page 1 of 5 2. Upon the Sponsor's approval, the Department, using NCDOT state forces and/or private contractor(s) under a Purchase Order Contract, may perform the requested maintenance and repair to the Airport. This work may include, but not be limited to; Joint and Crack Sealing, Pavement Repairs and Patching, Surface Treatments, Maintenance Overlays, Electrical, Grading, Drainage Improvements, Pavement Markings, or other infrastructure maintenance. 3. The Sponsor will receive notification from the Department of the Department's willingness to perform (or pay to have performed) any item or items of work approved by the Sponsor and a proposed schedule for performing the work and the force or contractor the Department proposes to perform the work. 4. If the schedule and the force or contractor proposed by the Department for performing the work is acceptable to the Sponsor, the Sponsor shall authorize the Department (or its contractors) to enter upon the property of the Airport during the scheduled time to perform the work. 5. If the schedule and the force or contractor proposed by the Department for performing the work is unacceptable to the Sponsor, the Sponsor shall inform the Department of the reasons for its objections and the Sponsor and the Department will engage in dialogue with the intent of determining if an alternative schedule or force or contractor is acceptable to both the Sponsor and the Department. If the Sponsor and the Department cannot reach agreement through the process described in paragraph 4 then the Department will withdraw its offer to perform the requested work. 6. The Sponsor hereby represents to the Department that the title to the pavement and adjacent areas of the Airport is vested in the Sponsor. 7. The Sponsor agrees to provide a duly authorized representative who will be present and/or available at all times the work is in progress (including nights and weekends, as applicable) to monitor project operations and assist the Department's representative. S. The Sponsor agrees to provide a duly qualified operator who will monitor the airport's UNICOM radio transceiver at all times the work is in progress (including nights and weekends, as applicable) and will issue airport advisories as necessary on the UNICOM radio transceiver. 9. The Sponsor agrees, when needed, to formally close any runway, taxiway, or apron at all times when the work is in progress on that pavement area and to take appropriate steps to prohibit use of such areas by aircraft and/or ground vehicles while the work is being performed or the subject pavement areas are in an unsafe or uncured condition due to the conduct of the work. 10. The Sponsor agrees to issue and keep current the necessary Notices to Airmen (NOTAMS) through the Federal Aviation Administration (FAA) until all work is completed and the Department's representative notifies the Sponsor's representative that the affected areas may be retumed to service. Page 2of5 11. The Sponsor agrees that the Department may, in its sole discretion, determine the design, scope of work, materials to be used, and methods of accomplishing the authorized work. The Department covenants that any and all such work as it performs or has performed at the Airport pursuant to this agreement will meet or exceed all relevant State of North Carolina and Federal Aviation Administration specifications for the type of pavement concerned and the type of maintenance or repair that is being performed. 12. To the maximum extent allowed by law, the Sponsor shall indemnify and hold harmless the Department and its officers and employees from all suits, actions, or claims of any character because of injury or damage received or sustained by any person, persons, or property resulting from work performed under this Commitment. This indemnity does not extend to causes of action arising from the negligence of the Department, its officers and employees or any of Department's contractors who performed the work. 13. Should Sponsor fail to comply with any material duty required of it under this Agreement the Department shall give written notice to the sponsor of the details of its non-compliance and provide a reasonable period in which the Sponsor can cure its non-compliance. Upon the expiration of said cure period without the Sponsor having come into compliance, the Sponsor agrees that, at its sole and unlimited discretion, the Department shall have the right to immediately stop all work being performed at the Airport and release the work area to the jurisdiction of the Sponsor. 14. Title This Ordinance shall be known and cited as the "Harnett County School Bus Stop Arm Violations Ordinance" (hereinafter referred to as the "Ordinance"). Section 2. Authority This Ordinance is adopted pursuant to North Carolina General Statute § 153A-246 and for the purpose of providing for the civil enforcement of North Carolina General Statute § 20-217 by means of an automated school bus safety camera installed and operated on any school bus located within Harnett County (hereinafter referred to as the "County"). Section 3. Notice of Violation A. The notice of violation shall be given in the form of a citation and shall be received by the registered owner of the vehicle no more than 60 days after the date of the violation. B. The citation shall include all of the following: 1) The date and time of the violation, the location of the violation, the amount of the civil monetary penalty imposed, and the date by which the civil monetary penalty shall be paid or contested. 2) An image taken from the recorded image showing the vehicle involved in the violation. 3) A copy of the statement or electronically generated affirmation from a Harnett County Sheriff's Office deputy or a law enforcement officer employed by a law enforcement agency with whom an agreement has been reached with the County pursuant to G.S. 115C-242.I(c) stating that, based upon inspection of the recorded images, the owner's motor vehicle was operated in violation of this Ordinance. 4) Instructions explaining the manner in which, and the time within which, liability under the citation may be contested pursuant to Section 3 of this Ordinance. 5) A warning that failure to pay the civil monetary penalty or to contest liability in a timely manner shall waive any right to contest liability and shall result in a late penalty of one hundred dollars ($100.00), in addition to the civil monetary penalty. 6) In citations issued to the registered owner of the vehicle, a warning that failure to pay the civil monetary penalty or to contest liability in a timely manner shall result in refusal by the Division of Motor Vehicles to register the motor vehicle, in addition to imposition of the civil monetary penalty and late penalty. C. The citation shall be processed by officials or agents of the County and shall be served by any method permitted for service of process pursuant to G.S. lA-1, Rule 4 of the North Carolina Rules of Civil Procedure, or by first-class mail to the address of the registered owner of the vehicle provided on the motor vehicle registration, or, as applicable, to the address of the person identified in an affidavit submitted by the registered owner of the vehicle. D. The registered owner of a vehicle shall be responsible for a violation unless the vehicle was, at the time of the violation, in the care, custody, or control of another person or unless the citation was not received by the registered owner within 60 days after the date of the violation. If the registered owner provides an affidavit that the vehicle was, at the time of the violation, in the care, custody, or control of another person or company, the identified person or company may be issued a citation complying the requirements of Section 3(B) of this Ordinance. Section 4. Penalties A. Violations of this Ordinance shall be deemed a noncriminal violation for which a civil penalty shall be assessed and for which no points authorized by G.S. 20-16(c) and no insurance points authorized by G.S. 58-36-65 shall be assigned to the registered owner or driver of the vehicle. B. The amount of the civil penalty shall be the following: 1) First Offense: Four Hundred Dollars ($400.00) 2) Second Offense: Seven Hundred Fifty Dollars ($750.00) 3) All Subsequent Offenses: One Thousand Dollars ($1000.00) C. If a citation is not contested pursuant to Section 5(A) of this Ordinance, the civil penalty shall be paid by the citation recipient within 30 days after receipt of the citation. If the citation recipient fails either to pay the civil penalty or to request a hearing to contest the citation in accordance with Section 5(A) of this Ordinance within 30 days after receipt of the citation, the citation recipient shall have waived the right to contest responsibility for the violation and shall be subject to a late penalty of one hundred dollars ($100.00) in addition to the civil penalty assessed under this Section. D. If the citation is contested pursuant to Section 5(A) of this Ordinance and the decision is adverse to the person contesting the citation, the civil penalty shall be paid within 30 days after receipt of the adverse decision, unless the citation recipient appeals the adverse decision pursuant to Section 5(D) of this Ordinance. A person wishing to contest a citation shall, within 30 days after receiving the citation, deliver to the officials or agents of the County a written request for a hearing accompanied by an affidavit stating the basis for contesting the citation, including, as applicable: 1) The name and address of the person other than the registered owner who had the care, custody, or control of the vehicle. 2) A statement that the vehicle involved was stolen at the time of the violation, with a copy of any insurance report or police report supporting this statement. 3) A statement that the citation was not received within 60 days after the date of the violation, and a statement of the date on which the citation was received. 4) A copy of a criminal pleading charging the person with a violation of G.S. 20- 217 arising out of the same facts as those for which the citation was issued. 5) A statement that there was not a violation of G.S. 20-217. B. If the person to whom a citation is issued makes a timely request for a hearing under Section 5(A), a summons shall be issued by any method permitted for service of process pursuant to G.S. lA-1 Rule 4 of the North Carolina Rules of Civil Procedure, directing the person to appear at a place and time specified in the summons in order to contest the citation at an administrative hearing. C. A nonjudicial administrative hearing shall be conducted by an administrative appeals board established by the County for contested citations or penalties issued or assessed under this Ordinance. The decision on a contested citation shall be rendered in writing within five days after the hearing and shall be served upon the person contesting the citation by any method permitted for service of process pursuant to G.S. lA-1, Rule 4 of the North Carolina Rules of Civil Procedure. If the decision is adverse to the person contesting the citation, the decision shall contain instructions explaining the manner and the time within which the decision may be appealed pursuant to Section 5(D) of this Ordinance. D. A person may appeal an adverse decision of the administrative appeals board to the Harnett County, North Carolina District Court by filing a notice of appeal with the Harnett County Clerk of Superior Court. Any such appeal shall name the County of Harnett as the adverse party to the appeal. Enforcement of an adverse decision shall be stayed pending the outcome of a timely appeal. Except as otherwise provided in this Section, appeals shall be in accordance with the procedure set forth in Article 19 of Chapter 7A of the General Statutes applicable to appeals from the magistrate to the district court. For purposes of calculating the time within which any action must be taken to meet procedural requirements of the appeal, the date upon which the person 4 contesting the citation is served with the adverse decision shall be deemed the date of entry of judgment. I I5C-242.I (c) to affirm a violation of this Ordinance. 2) After receiving notice that a person has been charged with a violation of G.S. 20-217, the County or a private vendor contracted with under G.S. 1I5C- 242.1 to process the civil citations shall not issue a civil citation imposing a civil penalty against that person arising out of the same facts as those for which the person was charged in the criminal pleading. 3) The County or a private vendor contracted with under G.S. I I5C-242.1 to process the civil citations shall issue a full refund of any civil penalty payment received from a person who was charged in a criminal pleading with a violation of G.S. 20-217 if the civil penalty arose out of the same facts as those for which that person was charged in the criminal pleading, together with interest at the legal rate as provided by G.S. 24-1 from the date the penalty was paid until the date of the refund. B. The County shall provide each law enforcement agency within its jurisdiction with the name and address of the County official or other law enforcement official employed by a law enforcement agency with whom the County has entered an agreement pursuant to G.S. 11 5C-242.
