Regular Meeting Minutes
August 7, 2023
The Harnett County Board of Commissioners met in regular session on Monday, August 7, 2023
at 9:00 am, in the Commissioners Meeting Room, Harnett County Resource Center and Library,
455 McKinney Parkway, Lillington, North Carolina.
Members present: Matthew B. Nicol, Chairman
William Morris, Vice Chairman
Barbara McKoy, Commissioner
W. Brooks Matthews, Commissioner

Chairman Nicol called the meeting to order at 9:00 am.
Commissioner Weatherspoon led the Pledge of Allegiance and provided the invocation
Chairman Nicol called for any additions or deletions to the published agenda. Vice Chairman
Morris made a motion to approve the agenda as published. Commissioner Matthews seconded the
motion. The motion carried unanimously.
Vice Chairman Morris made a motion to approve the consent agenda. Commissioner
Weatherspoon seconded the motion. The motion passed unanimously. The items on the consent
agenda were as follows:
A. Minutes
i. Work Session Minutes of July 11, 2023

iii. Work Session Minutes of August 1, 2023
B. Information Technology requests the Board of Commissioners approve a change in
licensing to the ESRI Small Government Enterprise Agreement. This license change
will allow GIS to increase services, specifically our web mapping tools and stay on
the latest ESRI software.
C. The Harnett County Public Library respectfully requests to continue our membership
of the NC Cardinal consortium. As a member of this consortium, the Harnett County
Library System has access to a shared catalog with other participating library systems
as well as an integrated library system and shared library materials. This collaboration
with the North Carolina State Library and other member libraries leverages federal

and local funds to achieve operational efficiencies and savings for the library while
providing more effective use of public library resources.
D. Solid Waste requests the Board of Commissioners approve an amendment to the
current service agreement with Republic Services for price increase due to the
extension of the operating hours at Harnett County Convenient Sites. The current
contract is based on convenient sites being open 5 days a week. In an effort to
increase our level of customer service for our citizens and make it more convenient
for individuals to dispose of their household garbage as well as recycling, we planned
and budgeted for extending the hours to six days a week for this fiscal year. To do so,
Solid Waste requests an amendment to the existing contract.
E. The Tax Administrator requests the Board of Commissioners accept and approve the
Tax Collection Settlement for FY 2022.
F. In accordance with North Carolina G.S. 105-321(b), the Harnett County Board of
Commissioners shall adopt and enter into the minutes an order directing the Tax
Administrator to collect the taxes charged for the 2023/2024 fiscal year. A motion is
requested to charge Christine L. Wallace, Tax Administrator, with the collection of
all real, personal, and public service company taxes for the 2023/2024 levy year, and
with the collection of delinquent taxes from 2013-2023. (Attachment 1)
G. Legal Department requests the Board approve a change in the Harnett County school
employee member. Currently Uriah Parker is named as the primary member and
Tommy Stewart named as the alternate. The Legal Department requests that Tommy
Stewart be appointed as the primary member and Uriah Parker be appointed as the
alternate.
H. Adopt a resolution to Request the North Carolina Department of Transportation to
Make Necessary Repairs to Buddy Barefoot Road. (Attachment 2)
1. Adopt a resolution to Partially Abandon a Public Road from North Carolina's
Secondary Road System. (Attachment 3)
J. HRW requests the Board of Commissioners approve the service contracts for FY24.
K. Administration requests the Board of Commissioners adopt a Resolution requesting
NC Department of Transportation (NCDOT) add Wells Oak Drive, Afton Court, Dot
Court and Abaco Court in Atkins Village Phase 3 to the State's Secondary Road
System. (Attachment 4)
L. Administration requests the Board of Commissioners adopt a Resolution requesting
NC Department of Transportation (NCDOT) add Barley Drive in Harvest Grove to
the State's Secondary Road System. (Attachment 5)
M. Administration requests the Board of Commissioners adopt a Resolution requesting
NC Department of Transportation (NCDOT) add Allwood Drive, Barn Loft Court,
Rawls Farm Lane, Rolling Field Drive, Piney Field Road, Wood Barn Court, Rawls
Meadows Lane, Old Barn Way and White Quartz Place to the State's Secondary

N. Administration requests the Board of Commissioners adopt a Resolution requesting

Q. Administration requests the Board of Commissioners adopt a Resolution requesting
NC Department of Transportation (NCDOT) add Moonlight Drive and Saddle Brook
Drive to the State's Secondary Road System. (Attachment 10)
R. Administration requests the Board of Commissioners adopt a Resolution requesting
NC Department of Transportation (NCDOT) add Hybrid Lane, Rainmaker Street,
Farrow Court, Folly Court and Harvest Court in Sweetwater to the State's Secondary
Road System. (Attachment 11)
S. The Harnett County Board of Commissioners appoint Matthew S. Willis to the
Historic Properties Commission.
T. Proclamation recognizing the Month of August as Child Support Awareness Month.
Chairman Nicol opened the meeting for informal comments by the public, allowing up to 3 minutes
for each presentation up to 30 minutes. The following people provided comments:
1. Elizabeth Longman of 234 Hamilton Road, Bunnlevel, NC.
2. Alan Longman of 234 Hamilton Road, Bunnlevel, NC.
3. Cheryl Prince of Anderson Creek, NC.
No one else spoke. The public comment period was closed.
Public Hearing concerning a proposed agreement to issue an appropriation of funds in the form
of debt forgiveness to the Harnett County Economic Development Partnership, a North Carolina
non-profit corporation (HCEDP). Dwight Snow, County Attorney provided background
information regarding the item. The proposed appropriation to HCEDP includes the forgiveness
by the County of the repayment of a Purchase Money Promissory Notice (Note) dated April 20,
2020, to Harnett County in the original amount of $1,567,500.00 plus interest at the rate of 3%
per annum from the April 20, 2020 Note date until paid. The current Note balance with accrued
interest as of August 7, 2023 is $1,722,617.47 with an accrued interest per diem of $128.836.
The Note is secured by a Deed of Trust on Lots 6 through 16 of the Brightwater Subdivision,
Phase III as shown on that survey plat recorded in Map #2019-78, 79 and 80, Harnett County
Registry. The proposed appropriation will include the cancellation by the County of the Note,
together with the cancellation of the above -referenced Deed of Trust. In exchange for said
appropriation, HCEDP shall go forward with its sale of the above -described Brightwater
Subdivision, Phase III real property lots to Harnett Health System, Inc. pursuant to that Real
Property Purchase and Sale Agreement dated April 27, 2023. Furthermore, HCEDP shall use the
real property sale proceeds to pay off in full its Operational Loan Promissory Note to Harnett
County in the original amount of $350,000.00 plus 2% per annum interest from the date of said
Note until paid, with the remainder of said real property sale proceeds to be retained by HCEDP
to be used for the public purpose of promoting and supporting economic development within

Harnett County pursuant to that Property Transfer and Appropriation Agreement dated April 6,
2020, between the County and HCEDP. Chairman Nicol opened the public hearing and the
following people spoke:
1. Elizabeth Longman of 234 Hamilton Road, Bunnlevel, NC.
2. Alan Longman of 234 Hamilton Road, Bunnlevel, NC.
Commissioner McKoy asked how many minorities were on the Board. Commissioner McKoy
stated she used to serve on the Board and spoke out several times about that. Commissioner
McKoy also expressed concerns regarding the need for jobs in the County.
No one else spoke and the public hearing was closed.
Commissioner Matthews made a motion to approve the proposed agreement for the issuance of
an appropriation of funds in the form of debt forgiveness to the Harnett County Economic
Development Partnership. Vice Chairman Morris seconded the motion. Attorney Snow stated
for clarification when you say you approve the agreement, there should be in front of you a
proposed Resolution which would authorize the appropriation and read the following into record:
"NOW, THEREFORE, BE IT RESOLVED BY THE HARNETT COUNTY BOARD OF
COMMISSIONERS AS FOLLOWS:
1. Pursuant to G.S. §153A-449 and the Property Transfer and Appropriation
Agreement dated April 6, 2020, between the County and HCEDP, the Board of
Commissioners does hereby authorize the issuance of an appropriation to HCEDP
in the form of the forgiveness of that debt evidenced by that Note dated April 20,
2020, from HCEDP to the County in the original amount of $1,567,500.00 plus
3% interest per annum from the date of Note until marked Satisfied by the
County.
This appropriation is made subject to the following conditions:
a) HCEDP shall close its real property conveyance transaction with Harnett
Health System, Inc. pursuant to that Real Property Purchase and Sale
Agreement dated April 27, 2023.
b) At the time of the above referenced closing, HCEDP shall pay in full to
the County that Operational Loan Promissory Note dated December 14,
2020, from HCEDP to Harnett County in the original amount of
$350,000.00 plus 2% interest per annum from date of Note until paid, at
which time the $1,567,500.00 Note shall be marked Satisfied and the Deed
of Trust shall be cancelled of record and further, the Operational Loan
Note of $350,000.00 shall be marked Satisfied.

c) That HCEDP shall use the balance of its net proceeds from the sale to
Harnett Health System, Inc. for the purpose of promoting and supporting
economic development in Harnett County, and pursuant to the terms of the
April 6, 2020, Property Transfer and Appropriation Agreement, the terms
of which are incorporated herein as partof this Resolution.
2. The Harnett County Manager is authorized to execute the Notes' satisfactions and
any other necessary documents to effectuate this appropriation through debt
forgiveness."
Commissioner Matthews amended his motion to recommend the approval of the proposed
agreement as outlined in the Resolution of the Harnett County Board of Commissioners
authorizing debt forgiveness to the Harnett County Economic Development Partnership. The
motion was seconded by Commissioner Weatherspoon and carried unanimously. (Attachment
12)
Chairman Nicol called for nominations for the Social Services Board. Vice Chairman Morris
nominated Ricky Day. Chairman Nicol nominated Craig McKinney. Vice Chairman Morris and
Commissioner Matthews voted for Mr. Day. Chairman Nicol, Commissioners McKoy and
Weatherspoon voted for Mr. McKinney. Chairman Nicol announced Mr. McKinney received
the most votes and will be reappointed to serve on the Social Services Board.
Vice Chairman Morris made a motion to approve the tax rebates, refunds and releases are
recommended by the Tax Administrator. The motion was seconded by Commissioner Matthews
and carried unanimously. (Attachment 13)
Vice Chairman Morris made a motion to approve the budget amendments as requested by the
Finance Director. The motion was seconded by Chairman Nicol and carried unanimously.

RESOLUTION OF THE HARNETT COUNTY BOARD OF COMMISSIONERS
TO REQUEST THE NORTH CAROLINA DEPARTMENT OF TRANSPORTATION TO
MAKE NECESSARY REPAIRS TO BUDDY BAREFOOT ROAD
WHEREAS, SR 2049 (Buddy Barefoot Road) is an unpaved roadway in Harnett County that
is part of the North Carolina Department of Transportation's Secondary Road System; and
WHEREAS, Buddy Barefoot Road has been closed for several years due to a washout that
has made the road unsafe for travel by the general public; and
WHEREAS, Buddy Barefoot Road provides a significant and essential connection between
SR 2048 (Bethel Baptist Road) and SR 2050 (Shady Grove Road) and as such, it would be in the best
interest of the citizens of Harnett County for the North Carolina Department of Transportation to
repair and reopen Buddy Barefoot Road for public use.
NOW, THEREFORE, be it resolved by the Harnett County Board of Commissioners as
follows:
The Harnett County Board of Commissioners hereby acknowledge the importance of SR
2049 (Buddy Barefoot Road) to the citizens of Harnett County and respectfully requests
that the North Carolina Department of Transportation make the necessary repairs to the
State's Secondary Road System SR 2049 (Buddy Barefoot Road) as shown on the
attached Exhibit A.

RESOLUTION OF THE HARNETT COUNTY BOARD OF COMMISSIONERS
TO PARTIALLY ABANDON A PUBLIC ROAD FROM NORTH CAROLINA'S
SECONDARY ROAD SYSTEM
WHEREAS, pursuant to North Carolina General Statute §136-63, citizens may, on petition,
request the North Carolina Department of Transportation to change or abandon any road in the
Secondary Road System when the best interest of the people of the county will be served thereby;
WHEREAS, the North Carolina Department of Transportation, upon petition, investigated
and recommended the partial abandonment of a 0.5 mile stretch of SR 1445 (Currin Road) from SR
1141 (Chalybeate Springs Road) to SR 1443 (Lafayette Road) from the State's Secondary Road
System;
WHEREAS, the North Carolina Department of Transportation requested the Harnett County
Board of Commissioners to adopt a resolution approving the partial abandonment of SR 1445 (Currin
Road) from the State System if the Harnett County Board of Commissioners concurred with the
Department of Transportations' recommendation; and
WHEREAS, said Board of Commissioners concurs with the Depart of Transportations'
recommendation to partially abandon the portion of SR 1445 (Currin Road).
NOW, THEREFORE, be it resolved by the Harnett County Board of Commissioners as
follows:
The Harnett County Board of Commissioners hereby approves and adopts the
recommendation of the North Carolina Department of Transportation to partially abandon
from the State's Secondary Road System the public road or easement which heretofore
served as a portion of SR 1445 (Currin Road) as herein described. The public road or
easement to be abandoned is 0.50 mile portion of SR 1445 (Currin Road) from the
intersection of SR 1441 (Chalybeate Springs Road) to the intersection of SR 1443
(Lafayette Road), Harnett County, North Carolina shown on the attached Exhibit A.
Duly adopted by the Harnett County Board of Commissioners this 7th day of August, 2023.

RESOLUTION OF THE HARNETT COUNTY BOARD OF COMMISSIONERS
AUTHORIZING THE ISSUANCE OF AN APPROPRIATION IN THE FORM OF DEBT
FORGIVENESS TO THE
HARNETT COUNTY ECONOMIC DEVELOPMENT PARTNERSHIP
THAT WHEREAS, Harnett County, North Carolina (the "County") is a valid existing
political subdivision of the State of North Carolina, existing as such under and by virtue of the
Constitution, statutes and laws of the State of North Carolina; and
WHEREAS, pursuant to G.S. § 158-7.1 the County has the authority to acquire and develop
land for business/industrial parks as a public purpose; as a result of this authority the County has
procured and developed certain real property known as the Brightwater Science and Technology
Campus ("Brightwater") located in Neills Creek Township, Harnett County, NC; and
WHEREAS, Harnett County Economic Development Partnership ("HCEDP") formerly
known as Harnett County Properties Corporation is a North Carolina non-profit corporation which
was formed to provide assistance to the County in furthering the public purpose of economic
development in Harnett County; that pursuant to G.S. § 153A-449 the County and HCEDP
negotiated and entered into a Property Transfer and Appropriation Agreement dated April 20,
2020, whereby the County conveyed by private sale to HCEDP Lots 6 through 16 of Brightwater
Phase III containing approximately 26.41 acres as shown on Map No. 2019-78, 79 and 80, Harnett
County Registry, in order that HCEDP could develop, market and sell said real property Lots and
assist the County in carrying out its public purpose of economic development; that the sale price
was $1,567,500.00; said purchase price was financed by the County for HCEDP in the form of a
Promissory Note ("Note") for $1,567,500.00 plus 3% per annum interest from the date of Note
until paid, secured by a Deed of Trust on the subject real property Lots; and
WHEREAS, HCEDP has been successful in developing, marketing and selling the subject
real property Lots through the negotiation and execution of a Real Property Purchase and Sale
Agreement dated April 27, 2023, with Harnett Health System, Inc. as Buyer of all of Lots 6 through
16 of Brightwater Phase III; that as part of the real property conveyance transaction, HCEDP has
made a proposal to the County requesting that the repayment of the Note of $1,567,500.00 plus
accrued interest, owed by HCEDP to the County, be forgiven as an appropriation of funds to
HCEDP thereby allowing HCEDP to use the Brightwater Phase III sale proceeds to promote and
support economic development in Harnett County, which would include the total lump sum payoff
to the County of an Operational Loan to HCEDP in the amount of $350,000.00 plus accrued
interest of 2% per annum; that pursuant to Section 5 of the Property Transfer and Appropriation
Agreement dated April 6, 2020, "the County Board may, in its sole discretion, on a case by case
basis, choose to forgive the repayment of all or a portion of any payment on the debt evidenced by
the Note as an appropriation of these funds to HCEDP. Any such appropriation of funds shall be
under the authority of and in compliance with G.S. §153A-449"; and
WHEREAS, after conducting a duly advertised public hearing on August 7, 2023, and after
further discussion and consideration, the County Board of Commissioners determined that in order
for HCEDP to carry out its chartered public purpose of assisting the County in providing economic
development in Harnett County, that HCEDP is in need of the net proceeds from the sale of the
Brightwater Phase III real property Lots to Harnett Health System, and therefore the County shall
grant HCEDP's request that the County forgive the April 20, 2020, Note debt as hereinafter set
forth.
NOW, THEREFORE, BE IT RESOLVED BY THE HARNETT COUNTY BOARD OF
COMMISSIONERS AS FOLLOWS:
Pursuant to G.S. §153A-449 and the Property Transfer and Appropriation Agreement
dated April 6, 2020, between the County and HCEDP, the Board of Commissioners does
hereby authorize the issuance of an appropriation to HCEDP in the form of the forgiveness
of that debt evidenced by that Note dated April 20, 2020, from HCEDP to the County in
the original amount of $1,567,500.00 plus 3% interest per annum from the date of Note
until marked Satisfied by the County.
This appropriation is made subject to the following conditions:
a) HCEDP shall close its real property conveyance transaction with Harnett Health
System, Inc. pursuant to that Real Property Purchase and Sale Agreement dated April
27, 2023.
b) At the time of the above referenced closing, HCEDP shall pay in full to the County that
Operational Loan Promissory Note dated December 14, 2020, from HCEDP to Harnett
County in the original amount of $350,000.00 plus 2% interest per annum from date of
Note until paid, at which time the $1,567,500.00 Note shall be marked Satisfied and
the Deed of Trust shall be cancelled of record and further, the Operational Loan Note
of $350,000.00 shall be marked Satisfied.
c) That HCEDP shall use the balance of its net proceeds from the sale to Harnett Health
System, Inc. for the purpose of promoting and supporting economic development in
Harnett County, and pursuant to the terms of the April 6, 2020, Property Transfer and
Appropriation Agreement, the terms of which are incorporated herein as part of this
Resolution.
2. The Harnett County Manager is authorized to execute the Notes' satisfactions and any other
necessary documents to effectuate this appropriation through debt forgiveness.

Aging will be $624,406 with a required match of $69,378. This is to be distributed $249,282 In -home Aide and
$375,124 Elderly Nutrition (Congregate and Home Delivered Meals).
The Division of Aging and Adult Services has a HCCBG Provider Packet on the N.C. Division of Aging and

GRANT PROJECT ORDINANCE Ordinance No. 2022-32
BE IT ORDAINED by the Board of Commissioners of Harnett County, North Carolina, sitting as the
governing board for Harnett County that, pursuant to Section 13.2 of Chapter 159 of the General Statutes
of North Carolina, the following grant project ordinance is hereby adopted.
Section 1. This ordinance is to establish a budget for grant allocations to be funded by the Office of State
Budget and Management. The County of Harnett has received $1,500,000 from the State
through contract number 20283. These funds are to be used for purposes referenced in the
Current Operations Appropriations Act, Session Law (S.L.) 2022-74.
Section 2. The following amounts are appropriated for the grant project and authorized for expenditure:

Section 6. Copies of this grant project ordinance shall be furnished to the Budget Officer, the Finance
Officer and to the Clerk to Board.
Section 7. This grant project ordinance expires on June 30, 2024, or when all the OSBM funds have been
obligated and expended by the county, whichever occurs sooner.
