E. General Services/Harnett Area Rural Transit System (HARTS) requests the Board of
Commissioners consider and approve the North Carolina Department of Transportation
(NCDOT) FY2024 5311 Capital grant agreement in the amount of $405,973; total County match
is $40,598. This grant provides funding for the Capital expenses associated with providing public
transportation for the citizens of Harnett County. The Board of Commissioners approved the
application on December 5, 2022. Approved Fiscal Year 2024 budget contains the County match.
F. General Services/Harnett Area Rural Transit System (HARTS) requests the Board of
Commissioners consider and approve the North Carolina Department of Transportation
(NCDOT) FY2024 5311 Administrative grant agreement in the amount of $381,250; total County
match is $57,188. This grant provides funding for the administrative expenses associated with
providing public transportation for the citizens of Harnett County. The Board of Commissioners
approved the application on December 5, 2022. Approved Fiscal Year 2024 budget contains the
County match.
G. Harnett Regional Water requests approval of multiple services contracts for FY 24 including
Charles R. Underwood, Inc; Dun-Right Services, Inc; Huffstetler Group, Inc; Clearwater Sales, Inc;
and Temple Grading and Construction Co. Inc.

H. Harnett Regional Water requests approval of Write-offs for first half (two quarters) of 2022 in
the amount of $52,952.80. All these accounts have been delinquent for more than three years.
The facilitation of these write-offs is an important step in a continuing effort to effectively
manage our collections and bad debt. HRW is currently using the Local Government Debt Setoff
Program and On-Line Collections, Inc. to help collect our delinquent accounts. We are happy to
report that we have recovered over $850,000 in bad debt previously written off through the
Debt Setoff Program.
I. The Harnett County Public Library respectfully requests permission to apply for and if awarded,
receive annual state aid from the North Carolina Department of Cultural Resources, the State
Library. The State Library appropriates funds each year for local libraries intended to promote,
aid, and equalize public library services in North Carolina. The amount estimated for this fiscal
year is $191,144. There is no match required.
J. Solid Waste requests the approval of the contract amendment with Smith Gardner, Inc. The
contract amendment, if approved, will extend the contract for one year.
K. Parks and Recreation requests approval of the Neills Creek Park Development Project Ordinance.
The current funding of $70,000 is for the Site Master Plan and will be funded through the Parks
Capital Reserve Fund. Parks and Recreation also requests the approval of a contract with
WithersRavenel for Professional Landscape Architecture Services. WithersRavenel will develop
the Master Plan for Neill’s Creek Park based on input from citizens, park users, adjacent schools,
and staff. The Master Plan will guide staff with future development and renovation of the park.
The Contract for Design Services is $65,000.
L. Administration requests the Board of Commissioners approve the selection of Moseley
Architects for Department of Social Services upfit.
M. Finance requests the Board of Commissioners adopt a Resolution authorizing investment of idle
funds with NC CLASS.
N. Emergency Services is requesting the approval of the fireworks application from Pyro East Coast,
Inc. for Campbell University's football season fireworks displays. East Coast Pyrotechnics meets
all requirements and has met fire code compliance for the event. The events will take place on
8/31, 9/23, 10/21 and 11/11.
O. Administration requests the Board of Commissioners approve an amendment to the
Comprehensive Land Use Plan contract to include Retail Strategies.

Period of up to 30 minutes for informal comments allowing 3 minutes for each presentation. Speakers are
requested to signup prior to the meeting. Speakers may sign up by contacting the clerk at

The Harnett County Board of Commissioners met in regular session on Monday, August 7, 2023
at 9:00 am, in the Commissioners Meeting Room, Harnett County Resource Center and Library,
455 McKinney Parkway, Lillington, North Carolina.

Chairman Nicol called the meeting to order at 9:00 am.
Commissioner Weatherspoon led the Pledge of Allegiance and provided the invocation.
Chairman Nicol called for any additions or deletions to the published agenda. Vice Chairman
Morris made a motion to approve the agenda as published. Commissioner Matthews seconded the
motion. The motion carried unanimously.
Vice Chairman Morris made a motion to approve the consent agenda. Commissioner
Weatherspoon seconded the motion. The motion passed unanimously. The items on the consent
agenda were as follows:

B.Information Technology requests the Board of Commissioners approve a change in
licensing to the ESRI Small Government Enterprise Agreement. This license change
will allow GIS to increase services, specifically our web mapping tools and stay on
the latest ESRI software.
C.The Harnett County Public Library respectfully requests to continue our membership
of the NC Cardinal consortium. As a member of this consortium, the Harnett County
Library System has access to a shared catalog with other participating library systems
as well as an integrated library system and shared library materials. This collaboration
with the North Carolina State Library and other member libraries leverages federal

and local funds to achieve operational efficiencies and savings for the library while
providing more effective use of public library resources.
D. Solid Waste requests the Board of Commissioners approve an amendment to the
current service agreement with Republic Services for price increase due to the
extension of the operating hours at Harnett County Convenient Sites. The current
contract is based on convenient sites being open 5 days a week. In an effort to
increase our level of customer service for our citizens and make it more convenient
for individuals to dispose of their household garbage as well as recycling, we planned
and budgeted for extending the hours to six days a week for this fiscal year. To do so,
Solid Waste requests an amendment to the existing contract.
E. The Tax Administrator requests the Board of Commissioners accept and approve the
Tax Collection Settlement for FY 2022.
F. In accordance with North Carolina G.S. 105-321(b), the Harnett County Board of
Commissioners shall adopt and enter into the minutes an order directing the Tax
Administrator to collect the taxes charged for the 2023/2024 fiscal year. A motion is
requested to charge Christine L. Wallace, Tax Administrator, with the collection of
all real, personal, and public service company taxes for the 2023/2024 levy year, and
with the collection of delinquent taxes from 2013-2023. (Attachment 1)
G. Legal Department requests the Board approve a change in the Harnett County school
employee member. Currently Uriah Parker is named as the primary member and
Tommy Stewart named as the alternate. The Legal Department requests that Tommy
Stewart be appointed as the primary member and Uriah Parker be appointed as the
alternate.
H. Adopt a resolution to Request the North Carolina Department of Transportation to
Make Necessary Repairs to Buddy Barefoot Road. (Attachment 2)
I. Adopt a resolution to Partially Abandon a Public Road from North Carolina’s
Secondary Road System. (Attachment 3)
J. HRW requests the Board of Commissioners approve the service contracts for FY24.
K. Administration requests the Board of Commissioners adopt a Resolution requesting
NC Department of Transportation (NCDOT) add Wells Oak Drive, Afton Court, Dot
Court and Abaco Court in Atkins Village Phase 3 to the State’s Secondary Road
System. (Attachment 4)
L. Administration requests the Board of Commissioners adopt a Resolution requesting
NC Department of Transportation (NCDOT) add Barley Drive in Harvest Grove to

Q. Administration requests the Board of Commissioners adopt a Resolution requesting

R. Administration requests the Board of Commissioners adopt a Resolution requesting
NC Department of Transportation (NCDOT) add Hybrid Lane, Rainmaker Street,
Farrow Court, Folly Court and Harvest Court in Sweetwater to the State’s Secondary

S. The Harnett County Board of Commissioners appoint Matthew S. Willis to the
Historic Properties Commission.
T. Proclamation recognizing the Month of August as Child Support Awareness Month.
Chairman Nicol opened the meeting for informal comments by the public, allowing up to 3 minutes
for each presentation up to 30 minutes. The following people provided comments:
1. Elizabeth Longman of 234 Hamilton Road, Bunnlevel, NC.
2. Alan Longman of 234 Hamilton Road, Bunnlevel, NC.
3. Cheryl Prince of Anderson Creek, NC.
No one else spoke. The public comment period was closed.
Public Hearing concerning a proposed agreement to issue an appropriation of funds in the form
of debt forgiveness to the Harnett County Economic Development Partnership, a North Carolina
non-profit corporation (HCEDP). Dwight Snow, County Attorney provided background
information regarding the item. The proposed appropriation to HCEDP includes the forgiveness
by the County of the repayment of a Purchase Money Promissory Notice (Note) dated April 20,
2020, to Harnett County in the original amount of $1,567,500.00 plus interest at the rate of 3%
per annum from the April 20, 2020 Note date until paid. The current Note balance with accrued
interest as of August 7, 2023 is $1,722,617.47 with an accrued interest per diem of $128.836.
The Note is secured by a Deed of Trust on Lots 6 through 16 of the Brightwater Subdivision,
Phase III as shown on that survey plat recorded in Map #2019-78, 79 and 80, Harnett County
Registry. The proposed appropriation will include the cancellation by the County of the Note,
together with the cancellation of the above-referenced Deed of Trust. In exchange for said
appropriation, HCEDP shall go forward with its sale of the above-described Brightwater
Subdivision, Phase III real property lots to Harnett Health System, Inc. pursuant to that Real
Property Purchase and Sale Agreement dated April 27, 2023. Furthermore, HCEDP shall use the
real property sale proceeds to pay off in full its Operational Loan Promissory Note to Harnett
County in the original amount of $350,000.00 plus 2% per annum interest from the date of said
Note until paid, with the remainder of said real property sale proceeds to be retained by HCEDP
to be used for the public purpose of promoting and supporting economic development within

Harnett County pursuant to that Property Transfer and Appropriation Agreement dated April 6,
2020, between the County and HCEDP. Chairman Nicol opened the public hearing and the
following people spoke:

Commissioner McKoy asked how many minorities were on the Board. Commissioner McKoy
stated she used to serve on the Board and spoke out several times about that. Commissioner
McKoy also expressed concerns regarding the need for jobs in the County.
No one else spoke and the public hearing was closed.
Commissioner Matthews made a motion to approve the proposed agreement for the issuance of
an appropriation of funds in the form of debt forgiveness to the Harnett County Economic
Development Partnership. Vice Chairman Morris seconded the motion. Attorney Snow stated
for clarification when you say you approve the agreement, there should be in front of you a
proposed Resolution which would authorize the appropriation and read the following into record:
“NOW, THEREFORE, BE IT RESOLVED BY THE HARNETT COUNTY BOARD OF
COMMISSIONERS AS FOLLOWS:
1. Pursuant to G.S. §153A-449 and the Property Transfer and Appropriation
Agreement dated April 6, 2020, between the County and HCEDP, the Board of
Commissioners does hereby authorize the issuance of an appropriation to HCEDP
in the form of the forgiveness of that debt evidenced by that Note dated April 20,
2020, from HCEDP to the County in the original amount of $1,567,500.00 plus
3% interest per annum from the date of Note until marked Satisfied by the
County.
This appropriation is made subject to the following conditions:
a) HCEDP shall close its real property conveyance transaction with Harnett
Health System, Inc. pursuant to that Real Property Purchase and Sale
Agreement dated April 27, 2023.
b) At the time of the above referenced closing, HCEDP shall pay in full to
the County that Operational Loan Promissory Note dated December 14,
2020, from HCEDP to Harnett County in the original amount of
$350,000.00 plus 2% interest per annum from date of Note until paid, at
which time the $1,567,500.00 Note shall be marked Satisfied and the Deed
of Trust shall be cancelled of record and further, the Operational Loan
Note of $350,000.00 shall be marked Satisfied.

c) That HCEDP shall use the balance of its net proceeds from the sale to
Harnett Health System, Inc. for the purpose of promoting and supporting
economic development in Harnett County, and pursuant to the terms of the
April 6, 2020, Property Transfer and Appropriation Agreement, the terms
of which are incorporated herein as part of this Resolution.
2. The Harnett County Manager is authorized to execute the Notes’ satisfactions and
any other necessary documents to effectuate this appropriation through debt
forgiveness.”
Commissioner Matthews amended his motion to recommend the approval of the proposed
agreement as outlined in the Resolution of the Harnett County Board of Commissioners
authorizing debt forgiveness to the Harnett County Economic Development Partnership. The
motion was seconded by Commissioner Weatherspoon and carried unanimously. (Attachment
12)
Chairman Nicol called for nominations for the Social Services Board. Vice Chairman Morris
nominated Ricky Day. Chairman Nicol nominated Craig McKinney. Vice Chairman Morris and
Commissioner Matthews voted for Mr. Day. Chairman Nicol, Commissioners McKoy and
Weatherspoon voted for Mr. McKinney. Chairman Nicol announced Mr. McKinney received
the most votes and will be reappointed to serve on the Social Services Board.
Vice Chairman Morris made a motion to approve the tax rebates, refunds and releases are
recommended by the Tax Administrator. The motion was seconded by Commissioner Matthews
and carried unanimously. (Attachment 13)
Vice Chairman Morris made a motion to approve the budget amendments as requested by the
Finance Director. The motion was seconded by Chairman Nicol and carried unanimously.

Vice Chairman Morris made a motion to adjourn at 9:30 am. The motion was seconded by
Commissioner McKoy and carried unanimously.

Barry Blevins, General Services Director, reviewed a request regarding the approval of the North
Carolina Department of Transportation (NCDOT) FY2024 5311 Capital grant agreement in the

amount of $405,973; total County match is $40,598. This grant provides funding for the Capital
expenses associated with providing public transportation for the citizens of Harnett County. The
Board of Commissioners approved the application on December 5, 2022. Approved Fiscal Year
2024 budget contains the County match. Consensus of the Board was to place this item on the
next consent agenda.
Mr. Blevins also reviewed a request regarding the approval of the North Carolina Department of
Transportation (NCDOT) FY2024 5311 Administrative grant agreement in the amount of
$381,250; total County match is $57,188. This grant provides funding for the administrative
expenses associated with providing public transportation for the citizens of Harnett County. The
Board of Commissioners approved the application on December 5, 2022. Approved Fiscal Year
2024 budget contains the County match. Consensus of the Board was to place this item on the
next consent agenda.
Steve Ward, Harnett Regional Water Director, reviewed a request for requests approval of
multiple services contracts for FY 24 including Charles R. Underwood, Inc; Dun-Right Services,
Inc; Huffstetler Group, Inc; Clearwater Sales, Inc; and Temple Grading and Construction Co.
Inc. Consensus of the Board was to place this item on the next consent agenda.
Mr. Ward also reviewed a request for approval of Write-offs for first half (two quarters) of 2022
in the amount of $52,952.80. All these accounts have been delinquent for more than three years.
The facilitation of these write-offs is an important step in a continuing effort to effectively
manage our collections and bad debt. HRW is currently using the Local Government Debt Setoff
Program and On-Line Collections, Inc. to help collect our delinquent accounts. We are happy to
report that we have recovered over $850,000 in bad debt previously written off through the Debt
Setoff Program. Consensus of the Board was to place this item on the next consent agenda.
Angela McCauley, Library Director, reviewed a request for permission to apply for and if
awarded, receive annual state aid from the North Carolina Department of Cultural Resources, the
State Library. The State Library appropriates funds each year for local libraries intended to
promote, aid, and equalize public library services in North Carolina. The amount estimated for
this fiscal year is $191,144. There is no match required. Consensus of the Board was to place
this item on the next consent agenda.
Janice Lane, Human Resources Director, reviewed a request for regarding the selection of The
Greer Group as part-time temporary staffing agency to provide payroll services for part-time
seasonal election workers for the County. The staffing agency would assume the responsibility
for onboarding, payroll and liability for any workers’ compensation claims. A RFP was placed
out for bid and four (4) bids were received. The Human Resources Department chose The Greer
Group and their markup is 23.6%. The staffing agency selected currently works with another
County Board of Elections so they have experience in this area. This new process would not
affect the appointment process for the judges, the recruitment process for election workers nor
would it affect the assigned location for each election worker. In the future, the use of an outside

staffing agency could also afford the County a broader pool of election workers as the County
voter population increases. Ms. Lane also shared comments received from the Finance Officer:
“The use of an outside staffing agency for election worker activity would provide many benefits
to the County. Two significant benefits would be the reduced impact on the Human Resources
staff for onboard activity and the liability and internal control issues associated with the payment
of election workers by the Finance Department.” Additional discussion included voter ID cards.
Consensus of the Board was to place this as an individual action item on the next agenda.
Sarah Arbor, Planner II, Development Services provided a briefing on the following upcoming

Land Use Plan Study. Coley Price, Deputy Manager, reviewed a request to approve an
amendment to the Comprehensive Land Use Plan contract to include Retail Strategies in the
amount of $65,000. Mr. Price shared information regarding the company, their approach and
methodology, recruitment deliverables, and success stories with local governments in North
Carolina. Consensus of the Board was to place this item on the next consent agenda.
Chad Beane, Solid Waste Director, reviewed a request for the approval of the contract
amendment with Smith Gardner, Inc. The contract amendment, if approved, will extend the
contract for one year. Consensus of the Board was to place this item on the next consent agenda.
Carl Davis, Parks and Recreation Director, reviewed a request for approval of the Neills Creek
Park Development Project Ordinance. The current funding of $70,000 is for the Site Master Plan

Services. WithersRavenel will develop the Master Plan for Neill’s Creek Park based on input
from citizens, park users, adjacent schools, and staff. The Master Plan will guide staff with
future development and renovation of the park. The Contract for Design Services is $65,000.

Ally Fouts, Management Analyst, reviewed a request for approval of a contract with Moseley
Architects to create a design for the shell space in the second-floor extension of the Department
of Social Services building. This project will utilize ARPA funds, as approved in ARPA funding
plans. Consensus of the Board was to place this item on the next consent agenda.
Kimberly Honeycutt, Finance Officer, reviewed a request for approval of a Resolution
authorizing the investment of idle funds with NC CLASS. N.C. General Statute Section 159-30
authorizes the Finance Officer to invest idle funds of the County in a commingled investment
pool. North Carolina Cooperative Liquid Assets Securities System "North Carolina CLASS", is
such an investment pool and would be a good tool for the finance office to use to ensure that we
are maximizing our return on the investment of the County's idle funds in as safe a way as
possible. Adoption of the resolution authorizing the use of North Carolina CLASS as an
investment tool will not violate any statutes that restrict the investments that we are allowed to
utilize, as North Carolina CLASS only invest in those types of instruments with the proper credit
ratings as authorized by the NC General Statutes. Consensus of the Board was to place this item
on the next consent agenda.
Larry Smith, Emergency Services Director, reviewed a request for the approval of the fireworks
application from Pyro East Coast, Inc. for Campbell University's football season fireworks
displays. East Coast Pyrotechnics meets all requirements and has met fire code compliance for
the event. The events will take place on 8/31, 9/23, 10/21 and 11/11. Consensus of the Board was
to place this item on the next consent agenda.
Christopher Appel, Senior Staff Attorney reviewed a request to increase the county manager’s
signature authority. North Carolina General Statute §153A-12 requires that the rights granted to
counties are exercised by the board of commissioners or the board’s delegated representative.
The current delegation of authority pursuant to the Fiscal Year 2024 Budget Ordinance allows
for the County Manager to enter into contracts on behalf of the County for contracts that are less
than $100,000.00 and for a term of three years or less. Consensus of the Board was to place this
item on the next agenda as an individual item.
Brent Trout, County Manager, reviewed a request to approve a Resolution for a project to
signalize the intersection of US 401 and SR 1415 (Rawls Church Road). Consensus of the Board
was to place this item on the next consent agenda.
Mr. Trout reminded everyone that Community Day will be held Thursday, August 17th. Mr.
Trout also shared based on information received, the Board of Elections will be able to start
printing ID’s tomorrow.

Commissioner Weatherspoon made a motion to convene into Closed Session for the following
purposes: to consult with the County’s legal counsel in order to preserve the attorney-client
privilege concerning the handling of certain litigation including the following case: Harnett
County versus CAD Enterprises, Inc. This motion is made pursuant to NC General Statute
Section 143-318.11 (a)(3). Vice Chairman Morris asked to add personnel and seconded the
motion. The motion carried unanimously.

DEVELOPMENT OF A PROJECT TO SIGNALIZE THE INTERSECTION OF
RAWLS CHURCH ROAD AND HIGHWAY 401
WHEREAS, the North Carolina Department of Transportation (“NCDOT”) owns many of the throughfares
throughout Harnett County and is responsible for ensuring that these thoroughfares are maintained in a manner that
safely moves people and freight; and
WHEREAS, Harnett County’s population has grown and that trend will continue into the future as Harnett County
continues to become a more desirable place to live and work; and
WHEREAS, for Harnett County to maintain its quality of life it must offer safe mobility options for its residents and
businesses that will keep up with its growth; and
WHEREAS, NCDOT requests the support of the Harnett County Board of Commissioners to signalize the
intersection of Rawls Church Road and Highway 401; and

PREPARED FOR HARNETT COUNTY
A. PROJECT DESCRIPTION
WithersRavenel, Inc. (Consultant) is pleased to present this proposal to prepare a Master Plan for
improvements to Neill’s Creek Park for Harnett County (Client). The park site includes portions of three parcels.
One parcel, PIN 0662-53-2915.000 (35.05 acres) at 3885 Neill’s Creek Road in Angier, NC, includes Harnett
County High School. The second parcel PIN 0662-34-9584.000 (17.78 acres) fronts on NC 210 and the third
parcel, PIN 0662-33-9744.000 (20.07 acres) includes a portion of Harnett Central Middle School. All three
parcels are owned by Harnett County and/or the County Board of Education. Land use north of the park site is
residential.
The park area that will be included in the master plan is approximately 40 acres and while adjacent school uses
will be considered in the planning process, the master plan will not include school facilities outside the leased
park property. The park is currently home to 6 tennis courts, softball fields, 1 baseball field, a concessions /
restroom building and 2 open activity field. The park is used primarily by the high school’s women’s softball
program, middle school baseball and softball teams, travel teams, softball, and adult softball leagues. The park is
currently accessed by high school drives / parking areas connected to Neill’s Creek Road and Harnett Central
Road.
WithersRavenel will conduct a master planning process that includes meetings with various stakeholders and
the community, the preparation of alternative concepts for improvements, a draft master plan and a final
master plan based on county staff and stakeholder feedback. The master plan will illustrate proposed
improvements and will be accompanied by an Opinion of Probable Construction Cost, (OPCC). The master plan
will provide a solid foundation for the preparation of construction documents and the OPCC a guideline for
budgeting. In addition, WithersRavenel will prepare an application and supporting documentation for a PARTF
grant. Construction documents for the project are not included in this agreement.
The process / schedule for the project is structured to enable engagement of stakeholders and the community,
review of alternative, draft and final plans by stakeholders, staff and community and approval of the final
master plan by the Steering Committee, Parks & Recreation Advisory Committee, County Board of Education
and County Board of Commissioners.
For the purposes of this proposal and any subsequent agreements the following references shall apply:
Harnett County shall be known as the “Client”;
WithersRavenel shall be known as the “Consultant” or “WR”;
The property and overall project shall be known as the “Project”;

WithersRavenel will begin work upon receipt of the executed Agreement as Notice to Proceed. The project
through Task 5 will be completed in 6 months or the end of February with a NTP of September 1, 2023. The
estimated timeframe associated with basic services and deliverables as described is below:

Additional Services ( Section B ) can be provided upon request by the Client. The Consultant shall furnish the
following Scope of Services for the Project, consisting of Project Management, Concept Alternatives, and Final
Concept Plan.
Basic Scope of Services
Task 1 – Project Management, Meetings and Community Engagement
The Consultant will collaborate and coordinate with project team members including County staff and other
stakeholders including school representatives throughout the project. Bi-weekly project meetings will be held
with the County during the 6-month process (total 12 meetings) to coordinate the project. Most of these will
be virtual. However, we will conduct a minimum of 4 in person. Project Steering Committee meetings will be
held virtually with each task and prior to community engagement meetings (total 4 meetings). If the opportunity
arises these could also be in person if in conjunction with another task or activity which requires us to be in
Harnett County. The composition of the Steering Committee will be the responsibility of the County. It is
anticipated that some stakeholders will be represented on Project Steering Committee.
Programming will be based on information from the County, stakeholders and the community. The Consultant
will work to develop and refine the proposed program for outdoor spaces, site features, and facilities. The
Consultant will also ensure that the scope and schedule are clear prior to project start and that project schedule
is met throughout the process.

The community will be provided three in person opportunities to provide input during the process. The first
will occur at the completion of Task 2. At this meeting site analysis information will be presented and initial
thoughts on park use and development will be discussed. Information collected at this meeting will influence
alternative concept plan development.
The second opportunity will be held at the completion of Task 3. At this meeting, alternative concept plans will
be presented for input. Both meetings will be conducted in an Open House format.
The third opportunity input will be a Parks Advisory Committee meeting at the completion of task 4. At this
meeting a draft master plan will be presented for consideration. Draft Master Plan will also be presented to the
Harnett County Board of Education.
There will also be associated virtual opportunities for community input provided. In conjunction with each
community meeting, plans and a project survey appropriate to the task will be created by the consultant and
published through the county website. The survey must be widely distributed and available online and
hardcopy.
Public Input Survey will include:
Clear and unbiased questions, questions should not limit participants to choosing from a narrow list of
recreational opportunities
At least 3 of the following demographics to ensure a representative population of the jurisdiction (age,
gender, education level, race, ethnicity, household income or size). Results will be tallied in a summary
and the results will support the chosen project.

Task 2 – Due Diligence / Site Analysis
Task 2.1 – Data Review
The Consultant will work with the Client to identify and gather all relevant data for the project site. This includes
available GIS data, ortho imagery, property information, prior plans or studies, etc. Any gaps in data determined
by the Consultant will be noted and provided to the Client prior to the project kick-off meeting.
Task 2.2 – Site Visits
The Consultant will visit the site as needed to document existing conditions. Documentation of existing
conditions will include natural and cultural features that will influence the master plan recommendations.
Task 2.3 – Site Analysis Synthesis Mapping
Mapping will use Harnett County GIS information as a base. The Consultant will organize all observations and
other pertinent information into presentable maps and identify key assets and constraints of the site based on
these findings. A composite analysis map will be prepared to serve as a base for park master planning.

Task 6 – PARTF Application
Consultant will prepare an application for a Parks and Recreation Trust Fund grant in conjunction with the
appointed project team, following the 2024 Parks and Recreation Trust Fund guidance. Consultant will act as
project manager for the application process and ensure that the scope of work and schedule are clear prior to
start of the application. Consultant will participate in funding agency application preparation training, general
conference calls, coordination meetings, and review meetings with the Client during the application preparation
process. Application and associated materials will be completed for review by the County by April 1 to allow
sufficient time for county review, coordination, and submittal around May 1. This timeline is dependent on
Task 5 being completed by March 1, 2024.
The PARTF application has numerous components, all of which are critical to preparing a competitive
application and obtaining funding. The Consultant proposes to provide the following services with the Client's
assistance:
Assemble all materials necessary for the application as outlined in the agency's 2024 Parks and
Recreation Trust Fund (PARTF) Grant Program guidance document.
Complete narrative, project purpose and justification, required forms, scoresheet, site vicinity map, site
plan (Task 5) and organize documentation according to PARTF submittal guidance.
Circulate information to the Client for review and approval.
Provide Client with application documents that will need Board action and approval.
Participate in any teleconferences needed with Agency and Client.
Provide status reports and frequent communication relating to progress and outstanding items.
Coordinate project materials with Engineer and Environmental Review Team.
Submit the applications by the deadline of May 1, 2024 (PARTF), using the prescribed methods in the
guidance.
Consultant will complete the Environmental Review as required by which requires a site visit to perform the
wetland delineation and to take photos of the existing conditions/buildings for historical resources.

Wetlands: The Regulatory Division of the U.S. Army Corps of Engineers that can assist in identifying
wetlands.
Floodplains: flood.nc.gov which has the most recent Federal Emergency Management Agency (FEMA)
floodplain data. The permitting process before construction of facilities will determine the applicable
stormwater requirements for the project.
Cultural Resources: North Carolina’s State Historic Preservation Office which can assist in identifying
historical and archaeological resources.
Client Responsibilities: The PARTF application requires additional action items to create a competitive
application. With Consultant’s guidance, the Client will be responsible for carrying out the following action
items and providing documentation:
Public Meeting: For PARTF application, the Client must conduct a public meeting exclusively for
discussing the PARTF grant project and obtaining comments. The meeting must be widely advertised
(newspapers ads, social media, community announcement, etc. and documentation must be provided for
the PARTF application. The minutes and comments must demonstrate that the public supports the
project. Meeting minutes, including discussion of the project, who was present, and public comments
must be provided to Consultant preparing PARTF application.
Client will organize and present Project to at least two (2) local groups and provide documentation, per
guidance, to be used in the application. Client will provide agendas, presentations, and documentation of
support for the Project to Consultant to use in the application;
Following presentation of the Project to the Parks and Recreation Advisory Board The Client will provide
documentation to Consultant of a motion of support for the Project (ex: meeting minutes);
Client will provide documents that Consultant will utilize to prepare the application such as the adopted
Master Plan, and Documentation of Survey/Public Involvement supporting the Project.

C. CLIENT RESPONSIBILITIES
The Client will provide the Consultant the following information as outlined below:
Designate in writing a person to act as the Client’s representative with respect to the work to be
performed under this Agreement.
Arrange for and make provision for the Consultant to enter the subject property as required for the
Consultant to perform services under this Agreement.
Provide and arrange a venue for all project meetings.
Provide all criteria and full information as to the Client’s requirements for the project, and furnish
copies of any prior survey documents, deeds, reports, master plans, and design and construction
standards.
Client shall be responsible for acquisition of all off-site utility and/or construction easements if they
become applicable for this project.
Give prompt written notice to the Consultant whenever the Client observes or otherwise becomes
aware of any development that affects the scope or timing of Consultant’s services, or any defect or
non-conformance of the work.
Direct the Consultant to provide Additional Services as stipulated in Section B of this Agreement or
other services as required; and
Consultant agrees to commence work upon receipt of written notice to proceed from Client. Consultant will
not be held responsible for any delays in time of completion resulting from:

Basic Services
The Consultant proposes to provide the Scope of Services outlined in Section A for a lump sum amount of
Sixty-Six Thousand Dollars ($66,000.00), including expenses as detailed below. Expenses will be invoiced as
incurred and will not exceed $1,000.00. This proposal has been provided in good faith and may not be
exceeded without being substantiated and mutually agreed by the Consultant and the Client.

Reimbursable Expenses
Reimbursable expenses are in addition to compensation for Basic Services and include expenses incurred by the
Consultant or the Consultant’s in the interest of the Project. Reimbursable expenses include but are not limited

In accordance with your request and the requirements of RFQ 6222023, Moseley
Architects is pleased to offer this proposal for architectural, interior design, and
engineering services for the above referenced Project.
Project Scope
Our proposal is based on the following Project Scope:
The Project site is located on the second floor of the recently constructed addition to
the Department of Social Services located at 311 West Cornelius Harnett Blvd,
Lillington, NC 27546. The conceptual plan provided by the county below shows the
project extents which are approximately 5,400 square feet.

The Project shall be delivered in a single bid package using a design-bid-build
procurement method and constructed under a single, stipulated sum construction
contract pursuant to solicited competitive bidding. The Project will be constructed in a
single phase.
Proposed Services
Our proposed Basic Services consist of normal architectural; mechanical; electrical
engineering; and interior design services for Construction Documents, Bidding, and
Construction Phases as described herein and consistent with the AIA B101-2017
Standard Form of Agreement Between Owner and Architect with such modifications
are mutually agreeable to both parties.
These services can be summarized as follows:
Construction Documents Services
1. Conduct one (1) project kick-off meeting with County Project Manager and
building users. Review project scope and space program of spaces.
2. Prepare up to three (3) plan options. Meet with County to review and select the
option to proceed with. Conduct a site visit to observe existing conditions.
3. Prepare Working Drawings to 50% completion.
4. Conduct one (1) meeting with County representatives to review the Working
Drawings and receive comments. Meet with Building Official to review Project.
5. Incorporate comments and develop Working Drawings to 75% completion.
6. Prepare technical Specifications.
7. Develop Working Drawings to 100% and submit for review.
8. Incorporate comments and prepare the Bidding Documents.
9. Coordinate Bidding Documents and Construction Contract with the County.
10. Submit for building permit and incorporate building permit comments.
Bidding and Construction Contract Award Services
1. Conduct one (1) pre-bid conference with prospective bidders.
2. Issue necessary addenda to the Bid Documents.
3. Respond to pre-bid questions.
4. Evaluate substitutions.
5. Review bids received by the County and assist the County in determining the
successful bidder.
Construction Phase Services
1. Attend one pre-construction conference with the Contractor’s and Harnett
County’s representatives. Moseley Architects will conduct the meeting.
2. Review Contractor Submittals and Shop Drawings.
3. Prepare finish selections and conduct a meeting with the users to review the
proposed finishes and color selections.
4. Conduct not more than sixteen (16) construction site visits (two per month) during
construction to conduct on-site construction progress meetings with Harnett
County and the Contractor and to observe construction progress to determine, in
general, if it appears that, when completed, the construction will be in accordance
with the construction contract requirements. Provide written site visit reports for
each visit.

5. Review and certify Contractor’s monthly Applications for Payment.
6. Respond to Contractor’s Request for Information.
7. When the Contractor indicates that construction has reached Substantial
Completion, conduct not more than one (1) inspection to identify corrective
measures required for compliance with the requirements of the Construction
Contract; issue a Certificate of Substantial Completion of the construction when
merited.
8. Conduct not more than one (1) final inspection to determine whether corrective
measures have been completed.
9. Prepare Record Drawings based on the Contractor’s submitted As-Built
Drawings.
Furniture Design and Procurement Services
1. Prepare furniture Plans demonstrating the proposed layout of the finished spaces
and phased spaces including existing furniture to be reused and new furniture to
be procured.
2. Conduct one (1) meeting with the County representatives to review the furniture
Plans.
3. Revise furniture Plans based on comments received from the County at the
review meetings.
4. Assemble preliminary furniture selections for new loose furniture and
workstations.
5. Conduct one (1) meeting with County representatives to review the preliminary
furniture selections and make final furniture selections.
6. Revise furniture Plans based on comments received from the County at the
review meetings.
7. Assemble preliminary furniture finishes for new loose furniture and workstations.
8. Conduct one (1) meeting with building users to review the preliminary furniture
finish selections and make final furniture finish selections.
9. Revise furniture Plans to incorporate the selected finishes based on comments
received from the users at the review meetings.
10. Based on the selected furniture and finishes, prepare pricing documents for the
procurement of the loose furniture and workstations through fax quote, or use of
State contracts based on the estimated furniture value. Workstations will be
procured separately from chairs and other furnishings.
11. Assist the County with the procurement process. Services shall consist of
answering questions, issuing required clarifications, and review of furniture pricing
submitted.
12. Provide Construction Administration services consisting of site visits to confirm
installation of new furniture.
13. Prepare a Punchlist of the installed new furniture.
14. Back-punch the installed furniture.

Our proposal does not include the following services:
• Special Inspections and Special Inspections Testing services.
• Renovations of existing toilets or plumbing facilities.
• Changes to the building occupancy.
• Civil Engineering design services.
• Security Design services except as required to coordinate with the County’s
security electronics vendor.
• Document printing services for the County’s use.
• Measured drawings of the existing building.
• Modifications to existing utilities and services.
• Services related to modifications to the existing building to bring it into
compliance with current building codes.
• Other services not specifically included in this proposal.
The County will provide Record Drawings of the existing facility on which we can rely
to prepare our Documents. In the event there are no existing survey documents,
Moseley Architects will provide a proposal for preparation of existing building plans for
the preparation of Construction Documents.
Our proposal does not include investigation or testing of concealed or inaccessible
building conditions and Moseley Architects shall not be responsible for unanticipated
construction costs or other issues resulting from the discovery during construction of
concealed conditions that differ from those shown on record drawings of the building
provided by the County.
Moseley Architects shall have no responsibility or liability for the discovery,
identification, abatement, or removal of asbestos, lead paint, toxic mold, or any other
hazardous or regulated substances in relation to the Project, nor does our proposal
include any services related to hazardous materials. Separately from this Agreement,
Harnett County shall provide all necessary services related to hazardous materials.
Cost of Services
We propose a lump sum compensation for the services defined above. The lump
sum cost of the services for each phase, including our expenses for travel,
communication, and reproduction of documents for our own office use, is as follows:

The cost of the services is not tied to the construction cost. It is based on the level of
effort and professional time required to provide the services.
Our proposal assumes that the County will be responsible for preparing all “front end”
documents for bidding and construction; printing of all Bid Documents; soliciting and
obtaining bids; and preparing the Construction Contract and related documents.
We will invoice monthly in proportion to the progress of our services. The lump sum
amounts will not change unless Harnett County authorizes substantive changes in the
Project scope or in the scope or extent of our services, or unless additional
construction services are requested by the County. In such cases, adjustments to the
cost of services would be as negotiated and mutually agreed by Harnett County and
Moseley Architects.

RESOLUTION TO PARTICIPATE IN NORTH CAROLINA
COOPERATIVE LIQUID ASSETS SECURITIES SYSTEMS
A resolution authorizing County of Harnett, North Carolina (the "County") to join with other
political subdivisions of the State of North Carolina as a Participant ("Participant") in the North Carolina
Cooperative Liquid Assets Securities System (North Carolina CLASS) (the "Trust") to pool funds for
investment.
WHEREAS, the provisions of Section 159-30 of the General Statutes of North Carolina, as
amended ("N.C. Gen. Stat."), provide the guidelines for any local government or public authority of the
State of North Carolina (a "Local Government" or "Local Government Unit") to invest idle funds;
WHEREAS, under N.C. Gen. Stat. § 159-30(c)(10), moneys may be invested in a commingled
investment pool established by interlocal agreement pursuant to N.C. Gen. Stat. § 160A-460 through 160A-
464 (a "Local Government Investment Pool"), if the investments of the Local Government Investment Pool
are limited to those qualifying for investment under N.C. Gen. Stat. § 159-30(c) or other laws of the State
of North Carolina governing the investment of monies of a Local Government Unit ("Permitted
Investments");
WHEREAS, certain Local Government Units have executed an Interlocal Agreement dated March
1, 2023 (the "Original Interlocal Agreement" and as supplemented and amended the "Interlocal
Agreement") for the purpose of creating the Trust or executed a joinder agreement for purposes of joining
the Original Interlocal Agreement;
WHEREAS, the Trust is governed by the terms of an Indenture of Trust dated as of March 1, 2023
(as amended, the "Indenture"), which provides for the deposit of the pooled idle funds in the Trust and the
investment of such funds in only Permitted Investments;
WHEREAS, the County desires to become a party to the Interlocal Agreement and a Participant in
the Trust.
NOW, THEREFORE, it is hereby RESOLVED by the Board of Commissioners (the "Governing
Body") of the County as follows:
1. The Governing Body hereby approves the County becoming a party to the Interlocal
Agreement and its participation in the Trust, which is governed by the Indenture.
2. The Governing Body authorizes the execution and delivery of a joinder agreement to
Interlocal Agreement (the "Joinder Agreement") substantially in the form presented at this meeting, together
with such changes, modifications and deletions as may be approved by the County's Finance Officer (the
"Finance Officer"). The approval of the Joinder Agreement will be evidenced conclusively by the execution
and delivery of the Joinder Agreement by the Finance Officer.
3. The Finance Officer is hereby authorized to take or cause to be taken any and all such other
actions as they may determine in their discretion to be to be necessary or advisable or in the best interest of
the County in order to effectuate, complete and carry out the intent and purposes of the foregoing resolutions
and the management, supervision, and investment of the County's idle funds, including, but not limited to,
the execution of all depository forms or other documents required by the administrator, the custodian or the
investment advisor of the Trust and execution of amendments to the Interlocal Agreement entered into for
the purpose of (i) adding an additional Participant to the Trust or (ii) which do not have financial
implications for the County.

4. The Governing Body hereby approves the Finance Officer to serve as the County's
Authorized Representative under the Interlocal Agreement and the Indenture and in such capacity shall
remain responsible for the management, supervision, and investment of the County's idle funds.

This JOINDER AGREEMENT TO INTERLOCAL AGREEMENT (this "Joinder
Agreement") is dated ______, 2023, and is between the current Parties listed in Exhibit A (the "Existing
Parties"), and the COUNTY OF HARNETT, NORTH CAROLINA, a local government and body politic
and corporate of the State of North Carolina ("Harnett County");
A. The provisions of Section 159-30 of the General Statutes of North Carolina, as amended
("N.C. Gen. Stat."), enable any local government or public authority of the State of North Carolina (a "Local
Government" or "Local Government Unit") to invest idle funds.
B. Under N.C. Gen. Stat. § 159-30(c)(10), moneys may be invested in a commingled
investment pool established by interlocal agreement pursuant to N.C. Gen. Stat. § 160A-460 through 160A-
464 (a "Local Government Investment Pool"), if the investments of the Local Government Investment Pool

Cooperative Liquid Assets Securities System (North Carolina CLASS)" (the "Trust").
D. Certain of the Existing Parties were the Parties to the Original Interlocal Agreement and
the remaining Existing Parties joined the Interlocal Agreement by amendment or joinder agreement, and
Exhibit A is the list of the current Parties to the Interlocal Agreement.
E. The County of Harnett desires to become a Party to the Interlocal Agreement for purposes
of becoming Participant in the Trust.
F. The purpose of this Joinder Agreement is to comply with the requirements of Section 1.03
of the Original Interlocal Agreement which sets out the requirements to be satisfied as a condition of
becoming a Party to the Interlocal Agreement and a Participant in the Trust.
NOW, THEREFORE, the parties hereto agree as follows:
1. The County of Harnett agrees (i) to become a Party to the Interlocal Agreement, (ii) to
become a Participant in the Trust and (iii) to be bound by the terms and provisions of the Interlocal
Agreement and the Indenture.
2. The County of Harnett hereby represents and warrants that:
a. the County of Harnett has full power and authority to execute, deliver and perform
under this Joinder Agreement, which has been duly authorized by resolution approved by the
County of Harnett 's Board of Commissioners;
b. the representations contained in Section 3.01 of the Original Interlocal Agreement
are true and correct in all material respects with the same effect as though such representations and
warranties had been made on the date hereof; and

c. the County of Harnett has received and reviewed a copy of the Indenture of Trust
and the Information Statement.
3. Capitalized words and terms used in this Joinder Agreement and not defined herein shall
have the same meanings in this Joinder Agreement as such words and terms are given in the Interlocal

4. This Joinder Agreement may be executed in several counterparts, each of which when so
executed shall be deemed to be an original, and such counterparts together shall constitute but one and the
same instrument that shall be sufficiently evidenced by any such original counterpart.

Retail Strategies’ agreements are Annual with defined prices for up to two additional years of service.
The Client will have the option to extend or discontinue the agreement each year and is not locked in
to multiple years of service.
The total fee for completion of work is due upon execution of agreement. Project fees are due within
30 days of receipt of the invoice.
Should the Client request a special assignment, additional work, and/or additional travel needs not
specifically referenced in the contract, we will prepare written authorization to be signed by the Client
in advance of commencing any additional work. One trip to Client is included in pricing for Retail
Recruitment. Any additional travel will be approved by the Client (not to exceed $1,000 per trip).

Physical Characteristics
Site Description: The subject property is a large parcel currently used for agricultural purposes and a
rural homesite. A stream traverses the southern section before terminating in the Upper Little River just to
the south of the property. This section of the property surrounding the stream contains wetlands and a
small area located within the 100-year flood plain.
Surrounding Land Uses: Surrounding land uses include agricultural uses, single-family homes, and a
religious institution.
Background: The property has two zoning designations, RA-30 and RA-20R. A +/- 73 acre section of the
property is in the RA-30 zoning district, and the remaining +/- 23 acre portion is located within the RA-
20R zoning district.
A majority of the property is identified as Agricultural on the future land use map. The Agricultural land
use designation encourages low-density residential development at a density of up to 1 unit per acre.
The remainder of the property, a substantially smaller portion located along the southern property line, is
designated as Environmentally Sensitive Areas. The area identified as Environmentally Sensitive Areas

SECTION 1.0 USE TYPES & REGULATIONS
1.1 General Applicability
A. Any use not specifically designated as either a permitted or Special Use in a zoning district is prohibited.
Uses not listed may be included by following the amendment process described elsewhere in this
Ordinance. The following uses shall be expressly prohibited:
1. Abandoned Manufactured Homes
a. Unless otherwise provided, manufactured homes that are considered to be abandoned according to the
definition for abandoned manufactured homes shall be prohibited in all zoning districts within Harnett County.
Once a determination has been made by the Administrator or his authorized agent that a manufactured home
is abandoned then the Administrator shall take action to abate the violation using any of the enforcement
procedures in Article “Enforcement & Penalties” of this Ordinance.
b. Harnett County may require the removal of junked or abandoned manufactured homes from public grounds,
including but not limited to public or private street right(s)-of-way or private property upon finding that such
removal is necessary and desirable to promote or enhance community, neighborhood, or area appearance or to
abate public health or safety nuisances.
B. Existing nonresidential development applying for permits to expand shall follow the requirements
indicated in the “Table of Use Types & Regulations”.

The requested Text Amendment is compatible with Harnett County regulatory documents and the
benefits outweigh any potential inconvenience or harm to the community. Therefore, it is recommended
that this Text Amendment request be APPROVED
Additional Information
On August 7, 2023 the Harnett County Planning Board voted unanimously (4-0) to recommend approval
of this Text Amendment based on compatibility with Harnett County regulatory documents.

AN ORDINANCE AMENDING THE
HARNETT COUNTY UNIFIED DEVELOPMENT ORDINANCE
WHEREAS, the Board of Commissioners of Harnett County adopted the UDO on October 17, 2011 for the
purpose of promoting the health, safety, and general welfare of the county residents; and
WHEREAS, this ordinance was adopted under authority granted by the General Assembly of the State of North
Carolina, particularly G.S. 153A-340; and
WHEREAS, the UDO contains provisions for amending said ordinance and those provisions have been followed;
and
WHEREAS, the Harnett County Planning Board has reviewed the amendment to the article of the UDO as
listed below and recommends the adoption of the following amendment.
NOW, THEREFORE BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF HARNETT
COUNTY, NORTH CAROLINA that Harnett County Unified Development Ordinance Article V: Use
Regulations, Section 1.1.A General Applicability; of the UDO shall be amended to read as indicated in
“Attachment”.
“Attachment” is filed with the Unified Development Ordinance in the Clerk to the Board’s Office.
Duly adopted this 21th day of August 2023 and effective upon adoption.

SUBJECT: Selection of BOE Temporary Staffing Agency for Election Workers
REQUESTED BY: Janice Lane, HR Director
REQUEST:
The Human Resources Department is recommending the Board of Commissioners
select The Greer Group as a part-time temporary staffing agency to provide payroll
services for part time seasonal election workers for the County. The staffing agency
would assume the responsibility for onboarding, payroll and liability for any
workers’ compensation claims. A RFP was placed out for bid and four (4) bids
were received. The Human Resources Department chose The Greer Group and
their markup is 23.6%. The staffing agency selected currently works with another
County Board of Elections so they have experience in this area.
This new process would not affect the appointment process for the judges, the
recruitment process for election workers nor would it affect the assigned location
for each election worker.
In the future, the use of an outside staffing agency could also afford the County a
broader pool of election workers as the County voter population increases.

COUNTY MANAGERS RECOMMENDATION:
The use of an outside staffing agency for election worker activity would provide
many benefits to the County. Two significant benefits would be the reduced
impact on the Human Resources staff for onboard activity and the liability and
internal control issues associated with the payment of election workers by the
Finance Department.

AN ORDINANCE TO AMEND THE
DELEGATION OF CONTRACTING AUTHORITY
WHEREAS, North Carolina General Statute §153A-11 vests the counties with the right
to contract and be contracted with; and
WHEREAS, North Carolina General Statute §153A-12 requires that the rights granted to
counties are exercised by the board of commissioners or the board’s delegated representative;
and
WHEREAS, County of Harnett has delegated its authority to contract and be contracted
with to the County Manager with certain conditions and limitations; and
WHEREAS, the current delegation of authority pursuant to the Fiscal Year 2024 Budget
Ordinance allows for the County Manager to enter into contracts on behalf of the County for
contracts that are less than $100,000.00 and for a term of three years or less; and
WHEREAS, the Harnett County Board of Commissioners desires to amend the current
delegation of contracting authority to allow for more efficient and timely operations of the
County.
NOW, THEREFORE BE IT ORDAINED by the Harnett County Board of
Commissioners, the following ordinance is hereby adopted:
Section 1. Purpose and Intent
The provisions of this Ordinance are such as to delegate the County’s contracting
authority to the County Manager in circumstance and amounts sufficient to allow for the
seamless operation of ongoing County business.
Section 2. Authority
This Ordinance is adopted under the authority of N.C.G.S. § 153A-11 and § 153A-12.
Section 3. Delegation of Contracting Authority
Board of Commissioners delegates its authority to enter into agreements on behalf of the
County to the County Manager for any contract, memorandum, agreement, change order,
purchase order or other instrument that legally binds the County to another party, provided that
the funds for the contract have been approved as part of the annual budget, the cost of the
contract does not exceed the funds appropriated, the contract’s term does not exceed five years,
the contract terms adhere to all applicable State laws and County policies regarding purchasing,
and the contract does not exceed $250,000.00.

The Board of Commissioners delegates its authority to enter into any other contract,
change order, purchase order, or other instrument incurring any obligation which is specifically
approved by the Board of Commissioners.
This updated delegation of authority shall be reflected in any County policies and
procedures that make reference to the delegated authority to enter into contracts on behalf of the
County.
Section 4. Effective Date
This Ordinance shall be effective upon its adoption.
