COUNTY MANAGERS RECOMMENDATION:
The Harnett County Public Library respectfully requests permission to apply for
and if awarded, receive annual state aid from the North Carolina Department of
Cultural Resources, the State Library. The State Library appropriates funds each
year for local libraries intended to promote, aid, and equalize public library
services in North Carolina. The amount estimated for this fiscal year is
$191,144. There is no match required.

SUBJECT: Selection of BOE Temporary Staffing Agency for Election Workers
REQUESTED BY: Janice Lane
REQUEST:
The Human Resources Department is recommending the Board of
Commissioners select The Greer Group as part-time temporary staffing agency
to provide payroll services for part time seasonal election workers for the
County. The staffing agency would assume the responsibility for onboarding,
payroll and liability for any worker’s compensation claims. A RFP was placed
out for bid and four (4) bids were received. The Human Resources Department
The Greer Group and their markup is 23.6%. The staffing agency selected
currently works with another County BOE and has experience in this area.
This new process would not affect the appointment process for the judges. This
would not affect the recruitment process for election workers nor would it
affect the assigned location for each election worker.

Development Services staff recommends approval of the proposed zoning change based
on compatibility with the future land use plan. The property is located in an area that
has been identified as a development node on the future land use map. The Rural
Centers development node encourages small scale commercial centers, which is
compatible with the requested zoning district.
Additional Information:
At the August 7th Planning Board meeting, the board voted 4-0 to recommend approval
of the rezoning due to the compatibility with the County's future land use plan
-No one spoke in opposition.

Development Services staff recommends denial of the proposed rezoning based on the
incompatibility with the future land use map and the surrounding land uses in the
vicinity. The RA-20R zoning district allows for higher intensity uses and smaller lot
sizes than the current zoning district, RA-30, which could result in an unreasonable
impact to the surrounding community.
Additional Infomration:
On August 7th, the Harnett County Planning Board voted unanimously (4-0) to
recommend denial of the rezoning. The Planning Board stated that the desired
minimum lot size in the requested zoning district could be permitted in the current
zoning district if the applicant developed the property using other processes, such as
utilizing the County’s Compatibility Design Concept table or developing the property
as Planned Unit Development.
- One citizen expressed concern that development of the property would increase water
runoff and adversely impact his adjacent family farm, which is downhill from the
subject property.

Physical Characteristics
Site Description: The subject property is a large parcel currently used for agricultural purposes and a
rural homesite. A stream traverses the southern section before terminating in the Upper Little River just to
the south of the property. This section of the property surrounding the stream contains wetlands and a
small area located within the 100-year flood plain.
Surrounding Land Uses: Surrounding land uses include agricultural uses, single-family homes, and a
religious institution.
Background: The property has two zoning designations, RA-30 and RA-20R. A +/- 73 acre section of the
property is in the RA-30 zoning district, and the remaining +/- 23 acre portion is located within the RA-
20R zoning district.
A majority of the property is identified as Agricultural on the future land use map. The Agricultural land
use designation encourages low-density residential development at a density of up to 1 unit per acre.
The remainder of the property, a substantially smaller portion located along the southern property line, is
designated as Environmentally Sensitive Areas. The area identified as Environmentally Sensitive Areas
contai ns areas of wetland and 100-year flood plain around a branch on the property and the nearby Upper
Little River.

A. Any use not specifically designated as either a permitted or Special Use in a zoning district or the use
appears to fit into two or more categories, the proposed use may be classified the same as the most
similar use listed. In utilizing this type of classification method, the Zoning Administrator shall utilize
the following factors : types of activities that will occur, types of equipment, and processes that will be
used; density; intensity of development; building and site arrangement; environmental effects;
anticipated traffic amount, parking demands; noise; light; vibration; odor; hours of operation; frequency,
number, and existence of residents, customers, or employees; and impacts on adjacent structures, uses,
or lands created by the proposed use is prohibited. Uses not listed or classified as a similar use may be
included by following the amendment process described elsewhere in this Ordinance. The following
uses shall be expressly prohibited:
1. Abandoned Manufactured Homes
a. Unless otherwise provided, manufactured homes that are considered to be abandoned according to the
definition for abandoned manufactured homes shall be prohibited in all zoning districts within Harnett
County. Once a determination has been made by the Administrator or his authorized agent that a
manufactured home is abandoned then the Administrator shall take action to abate the violation using any of
the enforcement procedures in Article “Enforcement & Penalties” of this Ordinance.
b. Harnett County may require the removal of junked or abandoned manufactured homes from public grounds,
including but not limited to public or private street right(s)-of-way or private property upon finding that such
removal is necessary and desirable to promote or enhance community, neighborhood, or area appearance or
to abate public health or safety nuisances.
B. Existing nonresidential development applying for permits to expand shall follow the requirements
indicated in the “Table of Use Types & Regulations”.

HARNETT COUNTY UNIFIED DEVELOPMENT ORDINANCE
WHEREAS, the Board of Commissioners of Harnett County adopted the UDO on October 17, 2011 for the
purpose of promoting the health, safety, and general welfare of the county residents; and
WHEREAS, this ordinance was adopted under authority granted by the General Assembly of the State of North
Carolina, particularly G.S. 153A-340; and
WHEREAS, the UDO contains provisions for amending said ordinance and those provisions have been followed;
and
WHEREAS, the Harnett County Planning Board has reviewed the amendment to the article of the UDO as
listed below and recommends the adoption of the following amendment.
NOW, THEREFORE BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF HARNETT
COUNTY, NORTH CAROLINA that Harnett County Unified Development Ordinance Article V: Use
Regulations, Section 1.1.A General Applicability; of the UDO shall be amended to read as indicated in
“Attachment”.
“Attachment” is filed with the Unified Development Ordinance in the Clerk to the Board’s Office.
Duly adopted this 21th day of August 2023 and effective upon adoption.

PREPARED FOR HARNETT COUNTY
A. PROJECT DESCRIPTION
WithersRavenel, Inc. (Consultant) is pleased to present this proposal to prepare a Master Plan for
improvements to Neill’s Creek Park for Harnett County (Client). The park site includes portions of three parcels.
One parcel, PIN 0662-53-2915.000 (35.05 acres) at 3885 Neill’s Creek Road in Angier, NC, includes Harnett
County High School. The second parcel PIN 0662-34-9584.000 (17.78 acres) fronts on NC 210 and the third
parcel, PIN 0662-33-9744.000 (20.07 acres) includes a portion of Harnett Central Middle School. All three
parcels are owned by Harnett County and/or the County Board of Education. Land use north of the park site is
residential.
The park area that will be included in the master plan is approximately 40 acres and while adjacent school uses
will be considered in the planning process, the master plan will not include school facilities outside the leased
park property. The park is currently home to 6 tennis courts, softball fields, 1 baseball field, a concessions /
restroom building and 2 open activity field. The park is used primarily by the high school’s women’s softball
program, middle school baseball and softball teams, travel teams, softball, and adult softball leagues. The park is
currently accessed by high school drives / parking areas connected to Neill’s Creek Road and Harnett Central
Road.
WithersRavenel will conduct a master planning process that includes meetings with various stakeholders and
the community, the preparation of alternative concepts for improvements, a draft master plan and a final
master plan based on county staff and stakeholder feedback. The master plan will illustrate proposed
improvements and will be accompanied by an Opinion of Probable Construction Cost, (OPCC). The master plan
will provide a solid foundation for the preparation of construction documents and the OPCC a guideline for
budgeting. In addition, WithersRavenel will prepare an application and supporting documentation for a PARTF
grant. Construction documents for the project are not included in this agreement.
The process / schedule for the project is structured to enable engagement of stakeholders and the community,
review of alternative, draft and final plans by stakeholders, staff and community and approval of the final
master plan by the Steering Committee, Parks & Recreation Advisory Committee, County Board of Education
and County Board of Commissioners.
For the purposes of this proposal and any subsequent agreements the following references shall apply:
Harnett County shall be known as the “Client”;
WithersRavenel shall be known as the “Consultant” or “WR”;
The property and overall project shall be known as the “Project”;
The executed proposal shall be known as the “Agreement”

WithersRavenel will begin work upon receipt of the executed Agreement as Notice to Proceed. The project
through Task 5 will be completed in 6 months or the end of February with a NTP of September 1, 2023. The
estimated timeframe associated with basic services and deliverables as described is below:

following Scope of Services for the Project, consisting of Project Management, Concept Alternatives, and Final
Concept Plan.
Basic Scope of Services
Task 1 – Project Management, Meetings and Community Engagement
The Consultant will collaborate and coordinate with project team members including County staff and other
stakeholders including school representatives throughout the project. Bi-weekly project meetings will be held
with the County during the 6-month process (total 12 meetings) to coordinate the project. Most of these will
be virtual. However, we will conduct a minimum of 4 in person. Project Steering Committee meetings will be
held virtually with each task and prior to community engagement meetings (total 4 meetings). If the opportunity
arises these could also be in person if in conjunction with another task or activity which requires us to be in
Harnett County. The composition of the Steering Committee will be the responsibility of the County. It is
anticipated that some stakeholders will be represented on Project Steering Committee.
Programming will be based on information from the County, stakeholders and the community. The Consultant
will work to develop and refine the proposed program for outdoor spaces, site features, and facilities. The
Consultant will also ensure that the scope and schedule are clear prior to project start and that project schedule
is met throughout the process.

The community will be provided three in person opportunities to provide input during the process. The first
will occur at the completion of Task 2. At this meeting site analysis information will be presented and initial
thoughts on park use and development will be discussed. Information collected at this meeting will influence
alternative concept plan development.
The second opportunity will be held at the completion of Task 3. At this meeting, alternative concept plans will
be presented for input. Both meetings will be conducted in an Open House format.
The third opportunity input will be a Parks Advisory Committee meeting at the completion of task 4. At this
meeting a draft master plan will be presented for consideration. Draft Master Plan will also be presented to the
Harnett County Board of Education.
There will also be associated virtual opportunities for community input provided. In conjunction with each
community meeting, plans and a project survey appropriate to the task will be created by the consultant and
published through the county website. The survey must be widely distributed and available online and
hardcopy.
Public Input Survey will include:
Clear and unbiased questions, questions should not limit participants to choosing from a narrow list of
recreational opportunities
At least 3 of the following demographics to ensure a representative population of the jurisdiction (age,
gender, education level, race, ethnicity, household income or size). Results will be tallied in a summary
and the results will support the chosen project.

Task 2.1 – Data Review
The Consultant will work with the Client to identify and gather all relevant data for the project site. This includes
available GIS data, ortho imagery, property information, prior plans or studies, etc. Any gaps in data determined
by the Consultant will be noted and provided to the Client prior to the project kick-off meeting.
Task 2.2 – Site Visits
The Consultant will visit the site as needed to document existing conditions. Documentation of existing
conditions will include natural and cultural features that will influence the master plan recommendations.
Task 2.3 – Site Analysis Synthesis Mapping
Mapping will use Harnett County GIS information as a base. The Consultant will organize all observations and
other pertinent information into presentable maps and identify key assets and constraints of the site based on
these findings. A composite analysis map will be prepared to serve as a base for park master planning.

Consultant will prepare an application for a Parks and Recreation Trust Fund grant in conjunction with the
appointed project team, following the 2024 Parks and Recreation Trust Fund guidance. Consultant will act as
project manager for the application process and ensure that the scope of work and schedule are clear prior to
start of the application. Consultant will participate in funding agency application preparation training, general
conference calls, coordination meetings, and review meetings with the Client during the application preparation
process. Application and associated materials will be completed for review by the County by April 1 to allow
sufficient time for county review, coordination, and submittal around May 1. This timeline is dependent on
Task 5 being completed by March 1, 2024.
The PARTF application has numerous components, all of which are critical to preparing a competitive
application and obtaining funding. The Consultant proposes to provide the following services with the Client's
assistance:
Assemble all materials necessary for the application as outlined in the agency's 2024 Parks and
Recreation Trust Fund (PARTF) Grant Program guidance document.
Complete narrative, project purpose and justification, required forms, scoresheet, site vicinity map, site
plan (Task 5) and organize documentation according to PARTF submittal guidance.
Circulate information to the Client for review and approval.
Provide Client with application documents that will need Board action and approval.
Participate in any teleconferences needed with Agency and Client.
Provide status reports and frequent communication relating to progress and outstanding items.
Coordinate project materials with Engineer and Environmental Review Team.
Submit the applications by the deadline of May 1, 2024 (PARTF), using the prescribed methods in the
guidance.
Consultant will complete the Environmental Review as required by which requires a site visit to perform the
wetland delineation and to take photos of the existing conditions/buildings for historical resources.

Wetlands: The Regulatory Division of the U.S. Army Corps of Engineers that can assist in identifying
wetlands.
Floodplains: flood.nc.gov which has the most recent Federal Emergency Management Agency (FEMA)
floodplain data. The permitting process before construction of facilities will determine the applicable
stormwater requirements for the project.
Cultural Resources: North Carolina’s State Historic Preservation Office which can assist in identifying
historical and archaeological resources.
Client Responsibilities: The PARTF application requires additional action items to create a competitive
application. With Consultant’s guidance, the Client will be responsible for carrying out the following action
items and providing documentation:
Public Meeting: For PARTF application, the Client must conduct a public meeting exclusively for
discussing the PARTF grant project and obtaining comments. The meeting must be widely advertised
(newspapers ads, social media, community announcement, etc. and documentation must be provided for
the PARTF application. The minutes and comments must demonstrate that the public supports the
project. Meeting minutes, including discussion of the project, who was present, and public comments
must be provided to Consultant preparing PARTF application.
Client will organize and present Project to at least two (2) local groups and provide documentation, per
guidance, to be used in the application. Client will provide agendas, presentations, and documentation of
support for the Project to Consultant to use in the application;
Following presentation of the Project to the Parks and Recreation Advisory Board The Client will provide
documentation to Consultant of a motion of support for the Project (ex: meeting minutes);
Client will provide documents that Consultant will utilize to prepare the application such as the adopted
Master Plan, and Documentation of Survey/Public Involvement supporting the Project.

C. CLIENT RESPONSIBILITIES
The Client will provide the Consultant the following information as outlined below:
Designate in writing a person to act as the Client’s representative with respect to the work to be
performed under this Agreement.
Arrange for and make provision for the Consultant to enter the subject property as required for the
Consultant to perform services under this Agreement.
Provide and arrange a venue for all project meetings.
Provide all criteria and full information as to the Client’s requirements for the project, and furnish
copies of any prior survey documents, deeds, reports, master plans, and design and construction
standards.
Client shall be responsible for acquisition of all off-site utility and/or construction easements if they
become applicable for this project.
Give prompt written notice to the Consultant whenever the Client observes or otherwise becomes
aware of any development that affects the scope or timing of Consultant’s services, or any defect or
non-conformance of the work.
Direct the Consultant to provide Additional Services as stipulated in Section B of this Agreement or
other services as required; and
Consultant agrees to commence work upon receipt of written notice to proceed from Client. Consultant will
not be held responsible for any delays in time of completion resulting from:

Basic Services
The Consultant proposes to provide the Scope of Services outlined in Section A for a lump sum amount of
Sixty-Six Thousand Dollars ($66,000.00), including expenses as detailed below. Expenses will be invoiced as
incurred and will not exceed $1,000.00. This proposal has been provided in good faith and may not be

engineering; and interior design services for Construction Documents, Bidding, and
Construction Phases as described herein and consistent with the AIA B101-2017
Standard Form of Agreement Between Owner and Architect with such modifications
are mutually agreeable to both parties.
These services can be summarized as follows:
Construction Documents Services
1. Conduct one (1) project kick-off meeting with County Project Manager and
building users. Review project scope and space program of spaces.
2. Prepare up to three (3) plan options. Meet with County to review and select the
option to proceed with. Conduct a site visit to observe existing conditions.
3. Prepare Working Drawings to 50% completion.
4. Conduct one (1) meeting with County representatives to review the Working
Drawings and receive comments. Meet with Building Official to review Project.
5. Incorporate comments and develop Working Drawings to 75% completion.
6. Prepare technical Specifications.
7. Develop Working Drawings to 100% and submit for review.
8. Incorporate comments and prepare the Bidding Documents.
9. Coordinate Bidding Documents and Construction Contract with the County.
10. Submit for building permit and incorporate building permit comments.
Bidding and Construction Contract Award Services
1. Conduct one (1) pre-bid conference with prospective bidders.
2. Issue necessary addenda to the Bid Documents.
3. Respond to pre-bid questions.
4. Evaluate substitutions.
5. Review bids received by the County and assist the County in determining the
successful bidder.
Construction Phase Services
1. Attend one pre-construction conference with the Contractor’s and Harnett
County’s representatives. Moseley Architects will conduct the meeting.
2. Review Contractor Submittals and Shop Drawings.
3. Prepare finish selections and conduct a meeting with the users to review the
proposed finishes and color selections.
4. Conduct not more than sixteen (16) construction site visits (two per month) during
construction to conduct on-site construction progress meetings with Harnett
County and the Contractor and to observe construction progress to determine, in
general, if it appears that, when completed, the construction will be in accordance
with the construction contract requirements. Provide written site visit reports for
each visit.

5. Review and certify Contractor’s monthly Applications for Payment.
6. Respond to Contractor’s Request for Information.
7. When the Contractor indicates that construction has reached Substantial
Completion, conduct not more than one (1) inspection to identify corrective
measures required for compliance with the requirements of the Construction
Contract; issue a Certificate of Substantial Completion of the construction when
merited.
8. Conduct not more than one (1) final inspection to determine whether corrective
measures have been completed.
9. Prepare Record Drawings based on the Contractor’s submitted As-Built
Drawings.
Furniture Design and Procurement Services
1. Prepare furniture Plans demonstrating the proposed layout of the finished spaces
and phased spaces including existing furniture to be reused and new furniture to
be procured.
2. Conduct one (1) meeting with the County representatives to review the furniture
Plans.
3. Revise furniture Plans based on comments received from the County at the
review meetings.
4. Assemble preliminary furniture selections for new loose furniture and
workstations.
5. Conduct one (1) meeting with County representatives to review the preliminary
furniture selections and make final furniture selections.
6. Revise furniture Plans based on comments received from the County at the
review meetings.
7. Assemble preliminary furniture finishes for new loose furniture and workstations.
8. Conduct one (1) meeting with building users to review the preliminary furniture
finish selections and make final furniture finish selections.
9. Revise furniture Plans to incorporate the selected finishes based on comments
received from the users at the review meetings.
10. Based on the selected furniture and finishes, prepare pricing documents for the
procurement of the loose furniture and workstations through fax quote, or use of
State contracts based on the estimated furniture value. Workstations will be
procured separately from chairs and other furnishings.
11. Assist the County with the procurement process. Services shall consist of
answering questions, issuing required clarifications, and review of furniture pricing
submitted.
12. Provide Construction Administration services consisting of site visits to confirm
installation of new furniture.
13. Prepare a Punchlist of the installed new furniture.
14. Back-punch the installed furniture.

Our proposal does not include the following services:
• Special Inspections and Special Inspections Testing services.
• Renovations of existing toilets or plumbing facilities.
• Changes to the building occupancy.
• Civil Engineering design services.
• Security Design services except as required to coordinate with the County’s
security electronics vendor.
• Document printing services for the County’s use.
• Measured drawings of the existing building.
• Modifications to existing utilities and services.
• Services related to modifications to the existing building to bring it into
compliance with current building codes.
• Other services not specifically included in this proposal.
The County will provide Record Drawings of the existing facility on which we can rely
to prepare our Documents. In the event there are no existing survey documents,
Moseley Architects will provide a proposal for preparation of existing building plans for
the preparation of Construction Documents.
Our proposal does not include investigation or testing of concealed or inaccessible
building conditions and Moseley Architects shall not be responsible for unanticipated
construction costs or other issues resulting from the discovery during construction of
concealed conditions that differ from those shown on record drawings of the building
provided by the County.
Moseley Architects shall have no responsibility or liability for the discovery,
identification, abatement, or removal of asbestos, lead paint, toxic mold, or any other
hazardous or regulated substances in relation to the Project, nor does our proposal
include any services related to hazardous materials. Separately from this Agreement,
Harnett County shall provide all necessary services related to hazardous materials.
Cost of Services
We propose a lump sum compensation for the services defined above. The lump
sum cost of the services for each phase, including our expenses for travel,
communication, and reproduction of documents for our own office use, is as follows:

The cost of the services is not tied to the construction cost. It is based on the level of
effort and professional time required to provide the services.
Our proposal assumes that the County will be responsible for preparing all “front end”
documents for bidding and construction; printing of all Bid Documents; soliciting and
obtaining bids; and preparing the Construction Contract and related documents.
We will invoice monthly in proportion to the progress of our services. The lump sum
amounts will not change unless Harnett County authorizes substantive changes in the
Project scope or in the scope or extent of our services, or unless additional
construction services are requested by the County. In such cases, adjustments to the
cost of services would be as negotiated and mutually agreed by Harnett County and
Moseley Architects.

RESOLUTION TO PARTICIPATE IN NORTH CAROLINA
COOPERATIVE LIQUID ASSETS SECURITIES SYSTEMS
A resolution authorizing County of Harnett, North Carolina (the "County") to join with other
political subdivisions of the State of North Carolina as a Participant ("Participant") in the North Carolina
Cooperative Liquid Assets Securities System (North Carolina CLASS) (the "Trust") to pool funds for
investment.
WHEREAS, the provisions of Section 159-30 of the General Statutes of North Carolina, as
amended ("N.C. Gen. Stat."), provide the guidelines for any local government or public authority of the
State of North Carolina (a "Local Government" or "Local Government Unit") to invest idle funds;
WHEREAS, under N.C. Gen. Stat. § 159-30(c)(10), moneys may be invested in a commingled
investment pool established by interlocal agreement pursuant to N.C. Gen. Stat. § 160A-460 through 160A-
464 (a "Local Government Investment Pool"), if the investments of the Local Government Investment Pool
are limited to those qualifying for investment under N.C. Gen. Stat. § 159-30(c) or other laws of the State
of North Carolina governing the investment of monies of a Local Government Unit ("Permitted
Investments");
WHEREAS, certain Local Government Units have executed an Interlocal Agreement dated March
1, 2023 (the "Original Interlocal Agreement" and as supplemented and amended the "Interlocal
Agreement") for the purpose of creating the Trust or executed a joinder agreement for purposes of joining
the Original Interlocal Agreement;
WHEREAS, the Trust is governed by the terms of an Indenture of Trust dated as of March 1, 2023
(as amended, the "Indenture"), which provides for the deposit of the pooled idle funds in the Trust and the
investment of such funds in only Permitted Investments;
WHEREAS, the County desires to become a party to the Interlocal Agreement and a Participant in
the Trust.
NOW, THEREFORE, it is hereby RESOLVED by the Board of Commissioners (the "Governing
Body") of the County as follows:
1. The Governing Body hereby approves the County becoming a party to the Interlocal
Agreement and its participation in the Trust, which is governed by the Indenture.
2. The Governing Body authorizes the execution and delivery of a joinder agreement to
Interlocal Agreement (the "Joinder Agreement") substantially in the form presented at this meeting, together
with such changes, modifications and deletions as may be approved by the County's Finance Officer (the
"Finance Officer"). The approval of the Joinder Agreement will be evidenced conclusively by the execution
and delivery of the Joinder Agreement by the Finance Officer.
3. The Finance Officer is hereby authorized to take or cause to be taken any and all such other
actions as they may determine in their discretion to be to be necessary or advisable or in the best interest of
the County in order to effectuate, complete and carry out the intent and purposes of the foregoing resolutions
and the management, supervision, and investment of the County's idle funds, including, but not limited to,
the execution of all depository forms or other documents required by the administrator, the custodian or the
investment advisor of the Trust and execution of amendments to the Interlocal Agreement entered into for
the purpose of (i) adding an additional Participant to the Trust or (ii) which do not have financial
implications for the County.

4. The Governing Body hereby approves the Finance Officer to serve as the County's
Authorized Representative under the Interlocal Agreement and the Indenture and in such capacity shall
remain responsible for the management, supervision, and investment of the County's idle funds.

This JOINDER AGREEMENT TO INTERLOCAL AGREEMENT (this "Joinder
Agreement") is dated ______, 2023, and is between the current Parties listed in Exhibit A (the "Existing
Parties"), and the COUNTY OF HARNETT, NORTH CAROLINA, a local government and body politic
and corporate of the State of North Carolina ("Harnett County");
A. The provisions of Section 159-30 of the General Statutes of North Carolina, as amended
("N.C. Gen. Stat."), enable any local government or public authority of the State of North Carolina (a "Local
Government" or "Local Government Unit") to invest idle funds.

the remaining Existing Parties joined the Interlocal Agreement by amendment or joinder agreement, and
Exhibit A is the list of the current Parties to the Interlocal Agreement.
E. The County of Harnett desires to become a Party to the Interlocal Agreement for purposes
of becoming Participant in the Trust.
F. The purpose of this Joinder Agreement is to comply with the requirements of Section 1.03
of the Original Interlocal Agreement which sets out the requirements to be satisfied as a condition of
becoming a Party to the Interlocal Agreement and a Participant in the Trust.
NOW, THEREFORE, the parties hereto agree as follows:
1. The County of Harnett agrees (i) to become a Party to the Interlocal Agreement, (ii) to
become a Participant in the Trust and (iii) to be bound by the terms and provisions of the Interlocal
Agreement and the Indenture.
2. The County of Harnett hereby represents and warrants that:
a. the County of Harnett has full power and authority to execute, deliver and perform
under this Joinder Agreement, which has been duly authorized by resolution approved by the
County of Harnett 's Board of Commissioners;
b. the representations contained in Section 3.01 of the Original Interlocal Agreement
are true and correct in all material respects with the same effect as though such representations and
warranties had been made on the date hereof; and

and the Information Statement.
3. Capitalized words and terms used in this Joinder Agreement and not defined herein shall

4. This Joinder Agreement may be executed in several counterparts, each of which when so
executed shall be deemed to be an original, and such counterparts together shall constitute but one and the
same instrument that shall be sufficiently evidenced by any such original counterpart.

RAWLS CHURCH ROAD AND HIGHWAY 401
WHEREAS, the North Carolina Department of Transportation (“NCDOT”) owns many of the throughfares
throughout Harnett County and is responsible for ensuring that these thoroughfares are maintained in a manner that
safely moves people and freight; and
WHEREAS, Harnett County’s population has grown and that trend will continue into the future as Harnett County
continues to become a more desirable place to live and work; and
WHEREAS, for Harnett County to maintain its quality of life it must offer safe mobility options for its residents and
businesses that will keep up with its growth; and
WHEREAS, NCDOT requests the support of the Harnett County Board of Commissioners to signalize the
intersection of Rawls Church Road and Highway 401; and
WHEREAS, the Harnett County Board of Commissioners is of the opinion that it is in the best interest of the citizens
and residents of Harnett County to support this project.
NOW THEREFORE, BE IT RESOLVED that Harnett County Board of Commissioners does hereby support the
North Carolina Department of Transportation’s development of a project to signalize the intersection of Rawls
Church Road and Highway 401.

County be placed on the State’s Secondary Road System. Please be advised that these
street(s) have been investigated and our findings are that the below listed street(s) are
eligible for addition to the State System.

It is our recommendation that the above-named street(s) be placed on the State’s Secondary
