Regular Meeting Minutes
March 20, 2023
The Harnett County Board of Commissioners met in regular session on Monday, March 20, 2023
at 6:00 pm, in the Commissioners Meeting Room, Hamett County Resource Center and Library,
455 McKinney Parkway, Lillington, North Carolina.
Members present: Matthew B. Nicol, Chairman
William Morris, Vice Chairman
Barbara McKoy, Commissioner
W. Brooks Matthews, Commissioner
Lewis W. Weatherspoon, Commissioner

Chairman Nicol called the meeting to order at 6:00 pm.
Commissioner Matthews led the Pledge of Allegiance and provided the invocation.
Chairman Nicol called for any additions or deletions to the published agenda. Commissioner
Weatherspoon made a motion to approve the agenda as published. Vice Chairman Morris seconded
the motion. The motion carried unanimously.
Commissioner Matthews made a motion to approve the consent agenda. Commissioner
Weatherspoon seconded the motion. The motion passed unanimously. The items on the consent
agenda were as follows:
A. Minutes

B. In the State of North Carolina's most recent budge[, $1.5 million was allocated to
Harnett County to be passed along to a list of 46 entities, which was created by
Senator Burgin. Our legal team is drafting funding agreements to be signed by
external recipients so they can receive their funds and begin their projects.
Administration requests approval of a funding agreement with Central Carolina
Community College.
C. Legal requests the Board accept the Deed for real property located at 145 Coats Road,
Linden, North Carolina as part of the DPS Hazard Mitigation Grant Program.

Chairman Nicol opened the meeting for informal comments by the public, allowing up to 3
minutes for each presentation up to 30 minutes. The following people provided comments:
1. Elizabeth Longman of 234 Hamilton Road, Bunnlevel, NC.
2. Alan Longman of 234 Hamilton Road, Bunnlevel, NC.
3. Roger Farina of 306 Pine Valley Lane, Sanford, NC.
4. Jerry Rivas of 364 Twin Ponds Road, Sanford, NC.
5. Richard Chapman of 5220 Christian Light Road, Fuquay Varina, NC.
6. Scott Tart of 7247 US Hwy 401 North, Fuquay Varina, NC.
No one else spoke. The public comment period was closed.
Jay Sikes, Assistant Development Services Director/ Manager of Planning Services, petitioned
the Board for a public hearing on Proposed Text Amendment: Case # PLAN2302-0003;
Applicant: Hamett County Development Services; Harnett County Unified Development
Ordinance; Article XII, Sections 2.6.1. General Land Use Plan Amendments. It is proposed to
add the following: These amendments shall be considered twice a year with at least a two month
staff review time period after an application has been received. Speck dates shall be published
by Development Services at the beginning of the calendar year. Development Services staff
recommends approval based on compatibility with the County regulatory documents. At their
Much 6d meeting, the Hamett County Planning Board voted unanimously (5-0) to recommend
approval of the text amendment as written, specifically because the County is undergoing the
process to update the Comprehensive Land Use Plan. Chairman Nicol opened the public
hearing. No one spoke and the public hearing was closed. Commissioner Weatherspoon made a
motion to approve the Text Amendment. The motion was seconded Commissioner Matthews
and carried unanimously. (Attachment 1)
Sarah Arbor, Planner IL Development Services petitioned the Board for a public hearing on
roposed Zoning Change: Case # PLAN2301-0001; Landowner / Applicant: Charles W Harwell;
9.15 +/- acres; Pin # 9576-43-9434.000; From Commercial/Conservation to RA-
20R/Conservation Zoning District; NC Hwy 87 S; Barbecue Township.
Ms. Arbor stated staffs evaluation is:
• The impact to the surrounding community is reasonable as there are several
nonresidential uses in this area
• The requested zoning to Commercial is compatible with Land Use classification,
Employment Mixed Use. The Employment Mixed Use land use classification
encourages economic development, and the uses permitted in the proposed zoning
support economic growth.
• The requested zoning would maintain the public health, safety and general welfare due
to area's existing commercial uses in the area, as well as the potential site
improvements that would be required.
• Due to the Land Use compatibility and the proximity of the proposed zoning to the
subject property, this rezoning request does not need to be evaluated for Small Scale
Rezoning.

As stated in the evaluation, the requested rezoning to RA-20R is compatible with the Harnett
County Land Use Plan and would not have an unreasonable impact on the surrounding
community because of the compatible existing residential land uses and the zoning classification
in this area. It is recommended that this rezoning request be APPROVED. On March 66, the
Harnett County Planning Board voted unanimously (5-0) to recommend approval of this
rezoning due to the nonresidential uses in this area. No one spoke in opposition.
Chairman Nicol opened the public hearing and the following person spoke:
• Alan Longman of 234 Hamilton Road, Bunnlevel, NC, spoke in opposition of the
proposed rezoning request.
No one else spoke and the public hearing was closed. Vice Chairman Moms made a motion to
approve the requested rezoning to RA-20R. Chairman Nicol seconded the motion. The motion
carried unanimously. (Attachment 2)
Ms. Arbor also petitioned the Board for a public hearing on Proposed Zoning Change: Case #
PLAN2302-0001; JPF Properties, LLC; 10.91 +/- acres; Pin #'s 1537-26-3967.000 & 1537-27-
3212.000; From RA-30 to Commercial Zoning District; SR # 1709 (Hodges Chapel Rd);
Averasboro Township.
Ms. Arbor stated staffs evaluation is:
• The impact to the surrounding community is reasonable as there are several
nonresidential uses m this area.
• The requested zoning to Commercial is compatible with Land Use classification,
Employment Mixed Use. The Employment Mixed Use land use classification
encourages economic development, and the uses permitted in the proposed zoning
support economic growth.
• The requested zoning would maintain the public health, safety and general welfare due
to area's existing commercial uses in the area, as well as the potential site
improvements that would be required.
• Due to the Land Use compatibility and the proximity of the proposed zoning to the
subject property, this rezoning request does not need to be evaluated for Small Scale

motion to approve the rezoning to Commercial Zoning District. The motion was seconded by
Vice Chairman Moms and the motion carried unanimously. (Attachment 3)
Ms. Arbor also petitioned the Board for a public hearing on a Proposed Zoning Change: Case #
PLAN2302-0002; JPF Properties, LLC; 8.88 +/- acres; Pin #'a 1538-32-2851.000; From RA-
20R to Commercial Zoning District; SR # 1840 (Robin Hood Rd); Averasbom Township.
Ms. Arbor stated staffs evaluation is:
• The impact to the surrounding community is reasonable due to the existing
nonresidential uses in this area.
• The requested zoning to Commercial is compatible with Employment Mixed Use Land
Use classification. The Employment Mixed Use land use is a development node that
encourages opportunities for economic development along major thoroughfares. The
uses permitted in the Commercial zoning district support the intent of the underlying
land use.
• The requested zoning would maintain the public health, safety and general welfare due
to area's existing non-residential uses, as well as the potential site improvements that
would be required.
• Due to the compatibility of the underlying land use with the requested zoning and the
proximity of the requested zoning district to the subject property, the request to rezone
this property from RA-20R to Commercial does not need to be evaluated for Small
Scale Rezoning.
As stated in the evaluation, the requested rezoning to Commercial would not have an
unreasonable impact on the surrounding community based on compliance with the County's
Land Use Plan, as well as the existing nonresidential uses in this area Therefore, it is
recommended that this rezoning request be APPROVED. On March 6, the Hamett County
Planning Board voted unanimously (5-0) to recommend approval of this rezoning due to the 1-95
location and the amount of existing nonresidential zoned parcels in this area. No one spoke in
opposition. Chairman Nicol opened the public hearing and the following person spoke:
• Alan Longman of 234 Hamilton Road, Bunnlevel, NC, expressed concerns with the
property not having any water.
Ms. Arbor stated it sounded to me, that the main concern was that there would be capacity for a
water line. Those questions would be better for Harnett Regional Water and those costs would
have to be absorbed by the developer.
Mark Locklear, Development Services Director stated all of the requirements for water, sewer,
all those things, are worked out with the site plan phase. I would remind you everyone, we are
talking about a rezoning request tonight. Water, sewer, those things, would come at a later date
when the property is actually developed.

Monica DeAngelis of 652 Old Stage Road, Coats, stated if Harnett County does not have enough
capacity to get new customers on board, unless we get it expanded, we cannot have new things
built here.
Chairman Nicol closed the public hearing. Commissioner Weatherspoon made a motion to
approve the requested rezoning to Commercial. The motion was seconded by Vice Chairman
Morris and carried unanimously. (Attachment 4)
Christopher Appel, Senior Staff Attorney, reviewed the following changes to the Memorandum
of Understanding between the Trustees of Central Carolina Community College, the governing
body of Central Carolina Community College and the County of Harnett regarding the Harnett
County Promise Program:
• Pg. 1 - WHEREAS, the Harnett County Promise program (hereinafter referred to as
the "Program") guarantees up to two (2) years of free in -state tuition and required fees
at the College for all eligible Harnett County residents who graduate from a public
high school, from a private school located within Harnett County or from a home
school while residing in Harnett County in 29492023, 29282024, 2024 2025 and
29222026;and
• Pg. 1 - Be a legal resident of Harnett County for at least a minimum of twelve (12)
continuous months prior to the beginning of the fall semester and maintain residency
in Harnett County while in the Program.
• Pg. 3 - This MOU shall remain in full force and effect for the a five-year period of the
Program beginning for the 2023 fall semester. Prior to the FY 2024 2028 budget
being completed and passed, the College will review all data related to the Program
(ex. number of graduates, success rates, transfer rates, etc.) and decide on future
appropriations to continue the Program. Shall the parties agree to continue the
Program, the parties shall enter into a new MOU at such time.
Vice Chairman Morris made a motion to approve the Memorandum of Understanding between
the Trustees of Central Carolina Community College, the governing body of Central Carolina
Community College and the County of Harnett regarding the Harnett County Promise Program.
The motion was seconded by Commissioner McKoy and carried unanimously.
Brent Trout, County Manager, reviewed a request for consideration of hiring Kairos Government
Affairs to perform lobbying services to assist Harnett County with lobbying services for two
years and then come back and evaluate and determine if it is something you feel we should
continue. In regards to the fee, I am seeking your approval to work with the firm and I will
negotiate with them to get the best price possible. Commissioner McKoy thanked Mr. Trout for
what he does for Harnett County, but expressed concerns regarding the hiring of a lobbying firm.
Commissioner McKoy stated I do not really see a need for a lobbyist, we have a great
relationship with our representatives. Commissioner Matthews made a motion to approve the
request, to hire Kairos Government Affairs. Commissioner Weatherspoon seconded the motion.
Commissioner Matthews stated I do know this is a direction that we have never pursued in this
County, at the same time, I do know how important is to follow up and keep track of what is
taking place in the legislature. I will agree our legislative representatives does an excellent job

of trying to keep us informed. Chairman Nicol, Vice Chairman Morris, Commissioners
Matthews and Weatherspoon voted in favor of the motion. Commissioner McKoy voted against
the motion. Motion carried 4:1.
Commissioner Matthews made a motion to approve the budget amendments as requested by the
Finance Director. The motion was seconded by Commissioner Weatherspoon and carried
unanimously. (Attachment 5)
Vice Chairman Moms made a motion to approve the tax rebates, refunds and releases as
requested by the Tax Administrator. The motion was seconded by Commissioner Matthews and
carried unanimously. (Attachment 6)
Attorney Appel requested the Board of Commissioners approve the renewal of the Blue Cross
Blue Shield contract for the 2024 Fiscal Year. Commissioner McKoy made a motion to approve
the renewal of the Blue Cross Blue Shield contract for the 2024 Fiscal Year. The motion was
seconded by Vice Chairman Morris and carried unanimously.
Vice Chairman Moms made a motion to adjourn at 7:02 pm. The motion was seconded by
Commissioner McKoy and carried unanimously.

ORDINANCE NO.2023-07
AN ORDINANCE AMENDING THE
HARNETT COUNTY UNIFIED DEVELOPMENT ORDINANCE
WHEREAS, the Board of Commissioners of Harnett County adopted the UDO on October 17, 2011 for the
purpose of promoting the health, safety, and general welfare of the county residents; and
WHEREAS, this ordinance was adopted under authority granted by the General Assembly of the State of North
Carolina, particularly G.S. 153A-340; and
WHEREAS, the UDO contains provisions for amending said ordinance and those provisions have been followed;
and
WHEREAS, the Harnett County Planning Board has reviewed the amendment to the article of the UDO as
listed below and recommends the adoption of the following amendment.
NOW, THEREFORE BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF HARNETT
COUNTY, NORTH CAROLINA that Harnett County Unified Development Ordinance Article VII:
Amendments, Hearing Procedures, Appeals, & Variances, Section 2.6.1 General Land Use Amendments; of the
UDO shall be amended to read as indicated in "Attachment".
"Attachment" is filed with the Unified Development Ordinance in the Clerk to the Board's Office
Duly adopted this 20i° day of March 2023 and effective upon adoption.

Amendments to the Land Use Plan shall be considered for approval following the same procedure for filing
a teat amendment of this Ordinance, as outlined herein. For the purposes of this Ordinance, an amendment
to the Land Use Plan shall be considered as such in regards to advertising, public hearings, and all other
similar requirements. These amendments shall be considered twice a year with at least a two month staff
review time period after an application has been received. Specific dates shall be published by Development
