HomeMy WebLinkAbout030623 m AIML HARNETT COUNTY BOARD OF COMMISSIONERS Regular Meeting Minutes March 6, 2023 The Harnett County Board of Commissioners met in regular session on Monday, March 6, 2023 at 9:00 am, in the Commissioners Meeting Room, Harnett County Resource Center and Library, 455 McKinney Parkway, Lillington,North Carolina. Members present: Matthew B. Nicol, Chairman William Morris,Vice Chairman Barbara McKoy, Commissioner W. Brooks Matthews, Commissioner Lewis W. Weatherspoon, Commissioner Staff present: Brent Trout, County Manager Dwight Snow, County Attorney Kimberly Honeycutt, Finance Officer Melissa Capps, Clerk Chairman Nicol called the meeting to order at 9:00 am. Commissioner Matthews led the Pledge of Allegiance and provided the invocation. Chairman Nicol called for any additions or deletions to the published agenda. Chairman Nicol made a motion to remove Item 7. Discuss a Resolution to discontinue membership in SEDC. The motion was seconded by Vice Chairman Morris and carried unanimously. Commissioner Matthews made a motion to approve the agenda as amended. Vice Chairman Morris seconded the motion. The motion carried unanimously. Commissioner Matthews made a motion to approve the consent agenda. Vice Chairman Morris seconded the motion. The motion passed unanimously. The items on the consent agenda were as follows: A. Minutes i. Work Session Minutes of February 14, 2023 ii. Regular Meeting Minutes of February 20, 2023 iii. Work Session Minutes of February 28, 2023 B. The Sheriff's Office requests permission to accept an extension for the Edward Byrne Memorial Justice Assistance Grant in the amount of$24,027.00 that expires 06/30/2023. The funds will be used to purchase laptops/tablets for the Sheriff's Office and computer equipment for the Sheriff's Office. The original Grant request was approved by the board on 12/06/2021. An extension for this grant was applied for and approved. The agency was unable to complete the funding initiatives outlined in the Harnett County Board of Commissioners March 6,2023 Regular Meeting Minutes Page I of 4 grant due to other projects and pending priorities. There are no matching funds required for this grant. C. The Sheriffs Office requests permission to accept the Edward Byrne Memorial Justice Assistance Grant in the amount of$22,856.00. These funds will be used to purchase a mobile camera system that can be strategically placed to capture vehicles traveling the streets and highway in high crime areas. There are no matching funds required for this grant. D. Harnett County Health Department requests approval to accept additional WIC Client Services funding in the amount of$17,513 from NC DHHS. This funding is based on the monthly participation caseload rising above the 103%base. E. Harnett Regional Water requests the Board award the sewer lift station and force main construction contract for the North West Harnett Elementary School Utility Extension Project Construction Contract to Eberhart Construction, Inc. from Willow Springs,NC in the amount of$846,720. F. In the State of North Carolina's most recent budget,$1.5 million was allocated to Harnett County to be passed along to a list of 46 entities,which was created by Senator Burgin. Our legal team is drafting funding agreements to be signed by external recipients so they can receive their funds and begin their projects. Administration is seeking approval of funding agreements with the following organizations: 1. Boys&Girls Club;2. City of Dunn; 3. Coats Chamber of Commerce; and 4. Town of Lillington G. Cooperative Extension requests the Board of Commissioners approve the donation of a van to the Harnett PAL Program. H. Legal requests the Board of Commissioners approve the appointment of Chance Torain to the Stop Ann Appeals Board to replace Larry Smith, Jr. as the County employee board member. I. Legal Department requests the Board of Commissioners approve a Resolution for the execution of Opioid Settlements and the Supplemental Agreement for Additional Funds between the State of North Carolina and Local Governments on Proceeds Relating to the Settlement of Opioid Litigation. The Resolution,if approved,will authorize the County Manager to execute all necessary documents related to the Opioid Settlements and the Supplemental Agreement. (Attachment 1) J. Legal Department requests the Board of Commissioners adopt a Resolution to Revise the Harnett County Jetport Committee and Amend the Jetport Committee Bylaws. The Resolution would allow for the name change of the Harnett County Jetport Committee to become the Harnett County Jetport Board and amend the bylaws to reflect the name change. The resolution would further amend Section 1 of the bylaws to change the membership from"One Harnett County Economic Development Council Member" to "One Harnett County Economic Development Partnership Director." (Attachment 2) K. Legal Department requests approval to advertise the lease between the County and Lamar for a billboard site located at 35.41077/-78.81134 at Main Street, Lillington, North Carolina. The lease is a ten year lease in the amount of$2,100 annually. Finance requests the Board of Commissioners approve the contract for the audit firm of Martin Starnes&Associates,CPA to audit the County's accounts for the period beginning July 1,2022 and ending June 30, 2023. M. Harnett County Board of Commissioners approve the following reappointments to the various Boards and Committees: • Board of Equalization and Review—Reappointment of Doug Godwin,District 2 representative. • Harnett County Public Library Board of Trustees—Reappointment of Patricia Walker-Smith,District 2 representative;Kathy Weeks, Town of Coats liaison. • Board of Adjustment—Reappointment of Jamey Sharlow;District 4 alternate • Historic Properties Commission—Reappointment of Melanie Collins, District 4 alternate N. Administration requests the Board of Commissioners adopt a Resolution to cancel the July 3,2023 Regular Meeting of the Harnett County Board of Commissioners. (Attachment 3) Chairman Nicol opened the meeting for informal comments by the public,allowing up to 3 minutes for each presentation up to 30 minutes. The following people provided comments: 1. Alan Longman of 234 Hamilton Road,Bunnlevel,NC. 2. Jerry Rivas of 364 Twin Ponds Road, Sanford,NC. 3. Linda Sunderman of 25 Spruce Lane,Lillington,NC. No one else spoke. The public comment period was closed. Parks and Recreation requests the approval of the Project Ordinance for renovation and construction of several projects identified in the Capital Improvements Program.The Project Ordinance includes the renovation and monumentalizing of the Old Boone Trail School Entryway,the creation of mountain biking trails and associated amenities at Anderson Creek Park, construction of new restroom facilities at Patriots Park and replacement and development of phase 1 of the Benhaven Community Park. Funding for this Project Ordinance comes from a State Capital Infrastructure Grant in the amount of$630,000 and$192,500 transferred from the Parks Capital Reserve Fund. Commissioner Matthews stated I asked this item to be placed separately on the agenda,at that time I did have some questions about this request,not about the projects,but some funding surrounding that,since that time, Carl,Mr. Trout and Ms. Honeycutt have answered those questions. Commissioner Matthews made a motion to approve the Parks Improvement Capital Project Ordinance for the renovation and construction projects identified in the capital improvements program. Commissioner Weatherspoon seconded the motion. Commissioner McKoy asked what Commissioner Matthews' concerns were. Commissioner Matthews stated back in December we had approved some SCIF funds for another recreation project to be paid for out of another fund, I wanted to make sure we would have enough funding to meet the needs for some of the other projects, I have been reassured that we have that, so I am Harnett County Board of Commissioners March 6,2023 Regular Meeting Minutes Page 3 of 4 ok with moving forward. Chairman Nicol called for a vote. The motion carried unanimously. (Attachment 4) Brent Trout, County Manager, introduced Desiree Patrick, our new Community Relations Director. Mr. Trout shared he was selected to participate in Leadership Harnett in the coming year. Kimberly Honeycutt, Finance Officer, stated I am proud to share S&P has upgraded Harnett County's bond rating to AA. Chairman Nicol thanked Ms. Honeycutt for her hard work. Commissioner McKoy also thanked Ms. Honeycutt. Commissioner McKoy made a motion to approve the budget amendments as requested by the Finance Director. The motion was seconded by Vice Chairman Morris and carried unanimously. (Attachment 5) Vice Chairman Morris made a motion to adjourn at 9:19 am. Capps, Clerk Harnett County Board of Commissioners March 6,2023 Regular Meeting Minutes Page 4 of 4 ATTACHMENT 1 Harnett RESOLUTION NO.2023-11 CM COUNTY NORTH CAROLINA A RESOLUTION BY THE HARNETT COUNTY BOARD OF COMMISSIONERS AUTHORIZING EXECUTION OF OPIOID SETTLEMENTS AND APPROVING THE SUPPLEMENTAL AGREEMENT FOR ADDITIONAL FUNDS BETWEEN THE STATE OF NORTH CAROLINA AND LOCAL GOVERNMENTS ON PROCEEDS RELATING TO THE SETTLEMENT OF OPIOID LITIGATION WHEREAS,as of 2021, the opioid epidemic had taken the lives of more than 32,000 North Carolinians, torn families apart, and ravaged communities from the mountains to the coast; and WHEREAS,the COVID-19 pandemic has compounded the opioid crisis, increasing levels of drug misuse, addiction, and overdose death; and WHEREAS,the Centers for Disease Control and Prevention estimates the total "economic burden" of prescription opioid misuse alone in the United States is$78.5 billion a year, including the costs of healthcare, lost productivity, addiction treatment, and criminal justice involvement; and WHEREAS, Harnett County's drug overdose death rate in 2021 was 52.2 per 100,000 residents, which represents 71 total deaths for that year and the drug overdose emergency department visit rate in 2021 was 203.0 trips per 100,000 residents, which represents 276 total ED visits for that year; and WHEREAS,certain counties and municipalities in North Carolina joined with thousands of local governments across the country to file lawsuit against opioid manufacturers,pharmaceutical distribution companies, and chain drug stores to hold those companies accountable for their misconduct; and WHEREAS, settlements have been reached in litigation against Walmart, Inc., Teva Pharmaceutical Industries Ltd., Allergan Finance, LLC, Allergan Limited, CVS Health Corporation, CVS Pharmacy, Inc., and Walgreen Co., as well as their subsidiaries, affiliates, officers,and directors named in the these Settlements; and WHEREAS, representatives of local North Carolina governments, the North Carolina Association of County Commissioners, and the North Carolina Department of Justice have negotiated and prepared a Supplemental Agreement for Additional Funds("SAAF")to provide for the equitable distribution of the proceeds of these settlements; and WHEREAS,by joining the settlements and approving the SAAF, the state and local governments maximize North Carolina's share of opioid settlement funds to ensure the needed resources reach communities as quickly, effectively, and directly as possible; and WHEREAS,it is advantageous to all North Carolinians for local governments, including Harnett County and its citizens,to sign onto the settlements and SAAF and demonstrate solidarity in response to the opioid epidemic, and to maximize the share of opioid settlement funds received both in the state and this County to help abate the harm; and WHEREAS, the SAAF directs substantial resources over multiple years to local governments on the front lines of the opioid epidemic while ensuring that these resources are used in an effective way to address the crisis. NOW,THEREFORE BE IT RESOLVED, the Harnett County Board of Commissioners hereby authorizes the County Manager to execute all documents necessary to enter into opioid settlement agreements with Walmart, Inc., Teva Pharmaceutical Industries Ltd., Allergan Finance, LLC, Allergan Limited, CVS Health Corporation, CVS Pharmacy, Inc., and Walgreen Co, to execute the SAAF, and to provide such documents to Rubris, the Implementation Administrator. Melissa Capps, Cler to the Board *� ^�4,07 (SEAL) y� .;, �c. : I I I I ATTACHMENT 2 RESOLUTION NO. 2023-12 � Harnett �C" COUNTY NORTH CAROLINA RESOLUTION BY THE HARNETT COUNTY BOARD OF COMMISSIONERS TO REVISE THE HARNETT COUNTY JETPORT COMMITTEE AND AMEND THE JETPORT COMMITTEE BYLAWS WHEREAS,the Harnett County Board of Commissioners is authorized by §153A-77 of the North Carolina General Statutes to appoint advisory boards, committees, councils, and agencies; and WHEREAS, on December 6, 1993,the Harnett County Board of Commissioners established and approved the bylaws for the Harnett County Jetport Committee(hereinafter referred to as the "Jetport Committee"); and WHEREAS,on January 17, 2023,the members of the Jetport Committee voted to change the name of the Jetport Committee to the Harnett County Jetport Board with the approval of the Harnett County Board of Commissioners; and WHEREAS,the Harnett County Board of Commissioners desires to revise the name of the Jetport Committee to the Harnett County Jetport Board; and WHEREAS, on July 5, 2022, the Harnett County Economic Development Council was dissolved by the Harnett County Board of Commissioners and was thereafter supplanted by the Harnett County Economic Development Partnership; and WHEREAS, Section 1 of the Jetport Committee Bylaws states that membership of the Jetport Committee shall include One Harnett County Economic Development Council Member; and WHEREAS, the Harnett County Board of Commissioners desires to amend the bylaws to replace the Harnett County Economic Development Council Member with One Harnett County Economic Development Partnership Director.
