Regular Meeting Minutes
April 4, 2022
The Harnett County Board of Commissioners met in regular session on Monday, April 4, 2022 at
9:00 am, in the Commissioners Meeting Room, Harnett County Resource Center and Library, 455
McKinney Parkway, Lillington, North Carolina.
Members present: Lewis W. Weatherspoon, Chairman
Matt B. Nicol, Vice Chairman
Barbara McKoy, Commissioner
Mark B. Johnson, Commissioner
W. Brooks Matthews, Commissioner
Staff present: Brent Trout, County Manager
Dwight Snow, County Attorney
Kimberly Honeycutt, Finance Officer
Melissa Capps, Clerk
Chairman Weatherspoon called the meeting to order at 9:00 am. Commissioner Matthews led
the Pledge of Allegiance and provided the invocation.
Chairman Weatherspoon welcomed Ms. Johnson and her Honor Civics' Class from Harnett
Central High School.
Chairman Weatherspoon called for any additions or deletions to the published agenda.
Vice Chairman Nicol made a motion to approve the agenda as published. Commissioner Johnson
seconded the motion. The motion carried unanimously.
Commissioner Matthews made a motion to approve the consent agenda. Commissioner McKoy
seconded the motion. The motion passed unanimously. The items on the consent agenda were as
follows:
A. Minutes

B. Budget Amendments (Attachment 1)
C. Approve the Finance Officer's request for the approval of the annual audit contract as
required by NC General Statute with Martin Starnes & Associates, CPA's, PA
D. Approve the acceptance of the North Carolina AOC Court Pilot Program Grant in the
amount of $200,000 annually from July 1, 2021 thru June 30, 2023 to Veterans
Treatment Court for the expansion of services, an additional case manager, incentives
for participants and crisis intervention.

E. Approve Veterans Treatment Court's request to apply for two (2) Bureau of Justice
Assistance (BJA) grants.
F. Harnett Regional Water requests approval of write-offs totaling $33,133.08 for the
second quarter of 2021.
G. Administration requests the Harnett County Board of Commissioners adopt a
Resolution approving the Mid -Carolina Workforce Development Consortium
Agreement. (Attachment 2)
H. Harnett County Health Department requests approval of Food and Lodging State
Funding provided through NCDHHS in the amount of $17,932 of which $7,500 was
budgeted at the beginning of fiscal year. These funds are allocated based upon
inspection percentages and 100% inspection rate. They will be used for food, lodging
and institution sanitation programs and activities.
I. Approve Revision to Rules of Procedure, Rule 29. Public Comment Period.
J. Administration requests the Harnett County Board of Commissioners appoint Christian
Lockamy as the Harnett County representation on the Board of Directors of the
Southeastern Economic Development Commission for a four year term effective May
1, 2022.
Chairman Weatherspoon opened the meeting for informal comments by the public, allowing up to
3 minutes for each presentation up to 30 minutes. The following people provided comments:
1. Taylor Davenport, 22 Hartman Drive, Angier, NC.
2. Patsy Carson, 202 E. D Street, Erwin, NC.
3. John Frank Smith, Sr., 1503 Lakeshore Drive, Dunn, NC.
No one else spoke. The public comment period was closed.
Chairman Weatherspoon shared he had spoken with Mr. Jaggers, and Mr. Jaggers will be unable
to attend the meetings of the Jetport since they are at noon during the work week. Chairman
Weatherspoon made a motion to remove Duncan Jaggers from the Jetport Committee. The
motion was seconded by Vice Chairman Nicol.
Commissioner McKoy made a motion to appoint Alicia Fleming from District 1 to the Harnett
County Commission for Women and Youth. Vice Chairman Nicol seconded the motion.
Commissioner McKoy made a motion to remove Jodi Hodges and added she is recommending
Alicia Fleming because she is from the western end of the county and we do not have
representation in that area. The motion to remove Alicia Fleming was seconded by
Commissioner Johnson.
Vice Chairman Nicol made a motion to reappoint Kenneth Shaw as the District 5 alternate to the
Board of Adjustment. Commissioner Johnson seconded the motion.
Chairman Weatherspoon called for vote on the motions for the above removals and
appointments. The motions carried unanimously.

Chairman Weatherspoon read and presented the Proclamation announcing Keep Harnett
Beautiful Initiative and encouraging Harnett County Residents to participate in the Spring Litter
Sweep to Ms. Ashley Bauer, Community Relations Coordinator.
Vice Chairman Nicol stated I had previously tabled the proposed rezoning request (Case #
PLAN2201-0002 Marie Blackmon) off of Buffalo Lake Road on March 21, 2022. I would like
to make a motion now to take off the table. The motion was seconded by Commissioner McKoy
and carried unanimously. Vice Chairman Nicol stated the requested rezoning to RA -20R would
not have an unreasonable impact on the surrounding community based on the adjacent residential
zoning as well as being compatible with the County's Land Use Plan designation for this area;
therefore I make a motion to approve this rezoning request. The motion was seconded by
Commissioner McKoy and carried unanimously. Chairman Weatherspoon noted a public
hearing was previously held on March 21, 2022. A copy of the statement of consistency is
attached (Attachment 3).
Brian Haney, Assistant County Manager, provided information regarding the revised draft
funding plan for Harnett County's American Rescue Plan Act Allocation. Administration
requests the Board's adoption of the revised Draft Funding Plan for Harnett County's American
Rescue Plan Act allocation of $26,411,744 as reflected in the attached document (Attachment
4). The revised Draft Funding Plan reflects the Board's discussion from the March 29, 2022,
work session, during which the Board determined which items included in the Draft Funding
Plan they wished to authorize staff to move forward with. The revised Draft Funding Plan
includes $20,632,419 in potential expenditures, leaving a balance of $5,779,325, which the
Board will need to appropriate at a future date. There is also the potential for additional funds to
become available for appropriation as the County learns whether or not grants are awarded and
obtains more realistic costs of projects where estimates are currently provided.
Vice Chairman Nicol made a motion to approve the revised draft Funding Plan for Harnett
County's American Rescue Plan Act allocation. The motion was seconded by Commissioner
Matthews. Motion carried unanimously.
Mr. Haney also provided information regarding the Benhaven Parking Lot Project.
Administration requests the Board award the bid for the former Benhaven School parking lot
construction project to Bar Construction Company, as recommended in the Award
Recommendation Letter. Following the opening of bids on March 22, Bar Construction was
determined to be the low bidder. Once award has been approved, staff will route a contract for
staff review and Board approval. This project is time sensitive, as parking lot construction must
be complete in July to allow for Harnett County Schools to open an early college location on the
campus this fall as planned. The County is also planning to begin providing services to the
community in the form of outdoor recreation and a Community Center & Library in the former
Media Center along with an office where other County departments - including the Health
Department, DSS, Veterans Services, and the Sheriffs Office - can provide satellite service.
Commissioner Matthews stated based on the low bid and recommendation of Timmons Group, I

made a motion we award this to the Bar Construction Company. The motion was seconded by
Vice Chairman Nicol. Commissioner McKoy stated I am glad to see this come to surface. The
motion carried unanimously.
Brent Trout, County Manager, stated this is Brian's last meeting, many of you have known him
for the 8 years he has worked for the County, he truly has left an imprint on the County, I can tell
that from the various things I've seen and what he has been involved in. County residents got
good work out of him and I know he will do great things in Cumberland and he will be missed.
Chairman Weatherspoon stated thank you Brian for all your work on these projects and your
work with this Board. I appreciate it.
Commissioner Matthews stated if I may, since the students are here, Brian is a product of Harnett
County Schools, he graduated from Triton High School. He returned here to serve. I would
encourage you all to consider doing this. Thank you Mr. Haney for all you have done for us.
Commissioner McKoy stated I think Brian came on about the same time I did, in 2014. 1 know it
was a learning experience, but you just reached out and grasped on to everything the
commissioners were sending to you. I want the audience to know you have been my backbone
serving on this Board, and you have been an employee of this County that represented the whole
County. Thank you for your work. You will be a great asset to Cumberland County. I hate to
see you leave.
Mr. Haney stated thank you to the Board, Mr. Trout, the County staff for this opportunity to
serve the citizens of Harnett County. It was not any easy decision to make this move, I am proud
of the work that I have been able to do here to help try to move this County forward. I am
excited about the future of this County and the foundation that has been laid. It was not an easy
decision but I think Harnett County is in good hands and moving in a good direction.
Commissioner Matthews moved the Board go into Closed Session to discuss certain personnel
matters. The motion was seconded by Vice Chairman Nicol and carried unanimously.
Following a motion to come out of Closed Session, Chairman Weatherspoon called the meeting
back into open session.
Vice Chairman Nicol made a motion to adjourn at 9:57 am. The motion was seconded by
Commissioner Johnson and carried unanimously.

RESOLUTION APPROVING THE AGREEMENT FOR THE
MID -CAROLINA WORKFORCE DEVELOPMENT CONSORTIUM
Whereas, Harnett County desires to enter into workforce development consortium agreement
pursuant to North Carolina General Statues, Section 160A461 with the North Carolina counties of
Cumberland and Sampson to organize a workforce development area; and
Whereas, these contiguous units of local government agree to establish a consortium pursuant to
the provisions of North Carolina General Statues, Section 160A-464(1) to act jointly as a workforce
development area under the Workforce Innovation and Opportunity Act (WIOA), Public Law 113-128 as
enacted July 22, 2014; and
Whereas, this consortium shall be known as the Mid -Carolina Workforce Development
Consortium; and
Whereas, a copy of said consortium agreement is attached herewith.
Now, therefore, be it resolved by the Harnett County Board of Commissioners that it hereby
approves the attached consortium agreement by and between Cumberland County and Sampson County to
organize a workforce development area under the Workforce Innovation and Opportunity Act of 2014.

MID -CAROLINA WORKFORCE DEVELOPMENT
CONSORTIUM AGREEMENT
ARTICLE I. TITLE AND PURPOSE
The contiguous units of local government listed below agree to establish a consortium to
act jointly as a local Workforce Development Area under the Workforce Innovation and
Opportunity Act (WIOA), Public Law 113-128 as enacted July 22, 2014. This consortium
shall be known as Mid -Carolina Workforce Development.
ARTICLE II. MEMBERSHIP
The Consortium shall be composed of the following independent and contiguous units of
general-purpose local government:
County of Cumberland
County of Harnett
County of Sampson
ARTICLE III. CERTIFICATION OF AUTHORITY
1. AUTHORITY UNDER STATE AND LOCAL LAW
The member units of government certify that they possess full legal authority, as
provided by state and local law, to enter into this agreement and to fulfill the legal
and financial requirements of operating as a local Workforce Development Area
under the Workforce Innovation and Opportunity Act for the entire geographic
area of Cumberland, Harnett, and Sampson Counties. Cumberland, Harnett and
Sampson Counties make this agreement as an interlocal agreement pursuant to
Article 20 of Chapter 160A of the North Carolina General Statutes, approved by
their respective governing boards and entered into the minutes of the meeting at
which approval was made.
2. SPECIFIC RESOLUTIONS TO ENTER INTO AGREEMENT
A copy of each duly executed resolution giving the respective counties specific
authority to enter into this consortium agreement will be attached to this document
and are incorporated herein by reference (optional).
3. DESIGNATION OF CHIEF ELECTED OFFICIALS FROM EACH MEMBER
UNIT OF GOVERNMENT
Each member unit of government designates as chief elected official for
Workforce Innovation and Opportunity Act purposes, upon whose representations
the State, the Workforce Development Board, the administrative entity, and the
other member units may rely, the duly elected Chair of each respective County
Board of Commissioners. Such person shall be the signatory of this agreement and
shall be authorized to execute such other agreements as are necessary for
Workforce Innovation and Opportunity Act purposes.
4. DESIGNATION OF CHIEF ELECTED OFFICIAL FOR LOCAL WORKFORCE
DEVELOPMENT AREA

The member units provide that the Chairs of the member units of government shall
select one chief elected official that shall be authorized to exercise the functions of
the local area chief elected official which are required under the Workforce
Innovation and Opportunity Act.
ARTICLE IV. DURATION
This agreement will become effective on July 1, 2022 or the date of the last chief elected
official's signature (whichever is the later date) and shall continue in effect until the local
Workforce Development Area is re -designated by the Governor of North Carolina or by
termination of this Agreement by a member unit of government as provided for in Article
XI.
ARTICLE V. ASSURANCES AND CERTIFICATIONS
The member units will comply with the requirements of the Workforce Innovation and
Opportunity Act, and regulations promulgated thereunder, all other applicable federal
regulations, the statutes of the State of North Carolina, and written directives and
instructions relevant to local workforce development area operation from the Governor of
North Carolina or his/her designee.
ARTICLE VI. FINANCING
It is anticipated that funding necessary to implement this agreement will be derived
from federal grant funds received through the Governor.
2. The units of local government acknowledge that they will share any liabilities
arising out of activities under the Workforce Innovation and Opportunity Act, on a
prorated basis in proportion to the respective population of each jurisdiction.
Liabilities include, but are not limited to, responsibility for prompt repayment
from non -program funds of any disallowed costs by the administrative entity of the
local workforce development area, or any of its sub -recipients or contractors, or the
Workforce Development Board.

4. Any entity or joint agency created or designated by this local workforce
development area, including the Workforce Development Board, and

Local Government Budget and Fiscal Control Act.
ARTICLE VII. ESTABLISHMENT OF A WORKFORCE DEVELOPMENT BOARD
The member units of government agree that the Workforce Development Board shall be
established in accordance with Section 107 of the Workforce Innovation and Opportunity
Act and applicable State of North Carolina laws including G.S. 143B-438.11.

The Chief Elected Official, as noted in Article III. 4., shall appoint members of the
Workforce Development Board from among persons nominated in accordance with the
Workforce Innovation and Opportunity Act.
ARTICLE VIII. APPOINTMENT OF PERSONNEL
Appointment of personnel shall follow the Mid -Carolina Regional Council's hiring and
recruitment process for regular full-time staff.
ARTICLE IX. REAL PROPERTY, EQUIPMENT AND SUPPLIES
The Mid -Carolina Workforce Development Consortium will follow all Workforce
Innovation and Opportunity Act requirements governing the title, use and disposition of
real property, equipment and supplies purchased with federal funds,
ARTICLE X. AMENDMENTS
The agreement may be amended at any time upon the consent of all the parties as
evidenced by resolution of the governing bodies of each member government and as
approved by the State.
ARTICLE XI. TERMINATION
The parties to this agreement may request termination at any time upon six months prior
written notice, such termination to be effective when the Governor considers local
Workforce Development Area re -designations or at the end of the then current grant
administration agreement program year, whichever should first occur.
