HomeMy WebLinkAbout2022-08 RESOLUTION AUTHORIZING THE FILING OF AN APPLICATION WITH THE STATE OF NORTH CAROLINAr ■ HARNETT REGIONAL RESOLUTION NO. 2022-08 rwww.harnethmter.org WATER 70 Box 1119 - " 0 McKinnev Parkway RESOLUTION BY HARNETT COUNTY BOARD OF COMMISSIONERS - .-gton, NC 27546 WHEREAS, The Federal Clean Water Act Amendments of 1987 and the North Carolina the WaMar910 893 7575 Infrastructure Act of 2005 (NCGS 159G) have authorized the making of loans and grafnts910-893.6643 to aid eligible units of government in financing the cost of construction and studies of (state whether a wastewater treatment works, wastewater collection system, stream restoration, stormwater treatment, other "green" project, drinking water treatment works, and/or drinking water distribution system), and WHEREAS, Harnett Regional Water has need for and intends to construct a nine million gallon per day (9 MGD) capacity upgrade of its North Harnett Regional Waste Water Treatment Plant. This a regional project that will be jointly funded by three other entities who own wastewater treatment capacity in the plant (Towns of Fuquay-Varina, Lillington & Angier). WHEREAS, Harnett Regional Water intends to request State grant and/or loan assistance for the project, NOW THEREFORE BE IT RESOLVED, BY THE BOARD OF COMMISSIONERS OF THE COUNTY OF HARNETT: That Harnett Regional Water, the Applicant, will arrange financing for all remaining costs of the project, if approved for a State grant and/or loan award. That the Applicant will adopt and place into effect on or before completion of the project a schedule of fees and charges and other available funds which will provide adequate funds for proper operation, maintenance, and administration of the system and the repayment of all principal and interest on the debt. That the governing body of the Applicant agrees to include in the loan agreement a provision authorizing the State Treasurer, upon failure of Harnett Regional Water to make scheduled repayment of the loan, to withhold from the County of Harnett any State funds that would otherwise be distributed to the local government unit in an amount sufficient to pay all sums then due and payable to the State as a repayment of the loan. That the Applicant will provide for efficient operation and maintenance of the project on completion of construction thereof. That Lewis Weatherspoon/Chairman of the Harnett Board of Commissioners, the Authorized Official, and successors so titled, is hereby authorized to execute and file an application on behalf of the Applicant with the State of North Carolina for a grant and/or loan to aid in the study of or construction of the project described above. That the Authorized Official, and successors so titled, is hereby authorized and directed to furnish such information as the appropriate State agency may request in connection with such application or the project: to make the assurances as contained above; and to execute such other documents as may be required in connection with the application. That the Applicant has substantially complied or will substantially comply with all Federal, State, and local laws, rules, regulations, and ordinances applicable to the project and to Federal and State grants and loans pertaining thereto. Project Description (see Instructions) This project consists of the construction of a 9 million gallon per day (MGD) capacity upgrade at the North Harnett Regional Waste Water Treatment Plant. The improvements include construction of three sequencing batch reactors with 3 million gallons of capacity each and the addition of several rotating disc filters and various other appurtenances for improved treatment capability. These improvements are part of a planned increase in permitted treatment capacity and discharge capability at the plant from 7.5 MGD to 16.5 MGD. Speculative Effluent Limits were received for the project on January 7, 2022 and the required engineering alternatives analysis has been submitted. Additional Information for Consideration This project has been deemed eligible to receive ARP funding from the State Fiscal Recovery Fund and is assigned Project No: SRP -W -ARP -0009 by DWI. The ARP Project Grant previously allocated in S.L. 2021- 180 totals $3,800,000. Hence, the funding amount requested of $20,000,000 to possibly receive the remaining $1,200,000 of the maximum construction grant amount available for systems not designated as distressed or categorized as at -risk, bring the total grant to $5,000,000 and a CWSRF loan of $15,000,000. This project is regional in scope in that the planned expansion of the North Harnett Wastewater Treatment Plant will be jointly funded by four different LGUs. Each already own a specific amount of wastewater capacity in the plant and the project will increase the allocations of this capacity to each. The four LGUs consist of Harnett Regional Water, Town of Fuquay-Varina, Town of Angier and the Town of Lillington. All with the exception of Fuquay-Varina received ARP Project Grant allocations from the Drinking Water Reserve and Wastewater Reserve in S.L. 2021-180 and it is our understanding that each plan to use those funds or a portion of them at a minimum for the funding of this project.
