HomeMy WebLinkAbout030121 m HARNETT COUNTY BOARD OF COMMISSIONERS Regular Meeting Minutes March 1,2021 The Harnett County Board of Commissioners met in regular session on Monday, March 1, 2021 at 9:00 am, in the Commissioners Meeting Room, Harnett County Resource Center and Library, 455 McKinney Parkway, Lillington,North Carolina. Due to COVID-19 citizens and staff were provided options to listen to the meeting live. Members present: W. Brooks Matthews, Chairman Lewis W. Weatherspoon, Vice Chairman Mark B. Johnson, Commissioner Matt B. Nicol, Commissioner Staff present: Paula K. Stewart, County Manager Dwight Snow, County Attorney Kimberly Honeycutt, Finance Officer Lindsey Lucas, Deputy Clerk Chairman Matthews called the meeting to order at 9:00 am and Commissioner Johnson led the Pledge of Allegiance and invocation. Chairman Matthews called for any additions or deletions to the published agenda. Vice Chairman Weatherspoon made a motion to approve the agenda as Published. Commissioner Nicol seconded the motion that passed unanimously. Vice Chairman Weatherspoon made a motion to approve the consent agenda. Commissioner Nicol seconded the motion that passed unanimously. 1. Minutes: January 19, 2021 2. Tax rebates, refunds and releases (Attachment 1) 3. Harnett Area Rural Transit System (HARTS)requests approval of the NCDOT/PTD additional documentation required to complete the FY 2022 Community Transportation Program (CTP) Grant Application. 4. Resolution to Schedule a March 15, 2021 Work Session of the Harnett County Board of Commissioners. (Attachment 2) 5. Legal Department requests approval of the amended Bylaws of Harnett Regional Jetport Committee. 6. Harnett County Sheriff's Office requests approval of a resolution to award a Glock Model 17 service weapon to Lieutenant Greg Taylor upon his retirement. (Attachment 3) 7. Harnett County Sheriff's Office requests approval of a new Administrative Assistant position, grade 17, salary$34,234. The new position would assist the administrative division of the Sheriffs Office. Harnett County Board of Commissioners March 1, 2021 Regular Meeting 1 of 2 Senior Staff Attorney Chris Appel came before the Board to discuss revising the special Board of Equalization and Review. Mr. Appel suggested adding 2 at large members. Chairman Matthews made a motion to approve adding 2 at large members to the Board of Equalization and review. Commissioner Johnson seconded the motion that passed unanimously. (Attachment 4) County Attorney Dwight Snow stood before the Board to discuss the sale of the old Veteran's Services building on 817 S. 8th Street in Lillington. Mr. Snow advised the Board that the building is no longer needed by the County and an appraisal had been conducted on the building by Tom Keith and Associates and as of February 5,2021 they placed a value of$125,000 on the property. Since the appraisal an offer has been made by Macias Enterprise LLC for$125,000 and they made a deposit of 5%of their price offer which is $6,250. Mr. Snow advised that pursuant to NC General Statue the property must go through the upset bid process. Mr. Snow asked that the Board adopt a Resolution and advertise the proposed sell of the property. Commissioner Nicol made a motion to accept the Resolution by the Harnett County Board of Commissioners to sell real property. Commissioner McKoy seconded the motion that passed unanimously. (Attachment 5) Director of Cooperative Extension Tim Matthews and his staff gave a very detailed and informative update on the Cooperative Extension Department. Mrs. Stewart gave the County Managers Report Commissioner Nicol moved to reconfigure the CCCC Board to remove Gordon Springle. Chairman Matthews seconded the motion that passed unanimously. Vice Chairman Weatherspoon moved that the Board go into closed session for the following purposes; To consult with the County's legal counsel in order to preserve attorney-client privilege concerning the handling of certain litigation or claims including the following case; U.S. vs. Thomas E. Tilley et al., civil action File No. 1:19-cv-626, out of the US District Court for the middle District of North Carolina; And to Discuss Certain Personnel Matters. Commissioner Nicol seconded the motion that passed unanimously Vice Chairman Weatherspoon made a motion to go into closed session. Commissioner Nicol seconded the motion that passed unanimously. Vice Chairman Weatherspoon moved that the Board come out of closed session at 10:33am. Commissioner Nicol seconded the motion that passed unanimously. Taylor, began his Harnett County Law Enforcement career on July 22"d, 1994; and WHEREAS, after 30 years of distinguished service to Harnett County, Gregory C. NOW THEREFORE BE IT RESOLVED that the Harnett County Board of Commissioners does hereby revise the January 6, 1997 Resolution to Appoint a Special Board of Equalization and Review as follows: 1. EFFECTIVE DATE AND DURATION This Resolution shall be effective upon its adoption by the Harnett County Board of Commissioners and shall continue in effect until revised or rescinded by the Board of Commissioners. All other portions of the January 6, 1997 Resolution to Appoint a Special Board of Equalization and Review that have not been revised by this Resolution shall remain in full force and effect unless revised or rescinded by the Board of Commissioners. 2. MEMBERSHIP a. The Board shall consist of seven members, each having one vote. b. Four members shall constitute a quorum. 5. APPOINTMENT OF MEMBERS d. The Commissioners shall have the opportunity to nominate two individuals to fill the two additional seats upon adoption of this Resolution. Nominations shall be made by submitting the names and addresses of qualified individuals to the Clerk to the Board. 1 of 2 At the expiration of the initial term of these two at-large seats, qualified individuals interested in serving on the Special Board of Equalization and Review shall submit an application in accordance with the Harnett County Board of Commissioners Rules of Procedure for appointments. If the Commissioners do not select an individual to fill a vacancy or if the Commissioners do not receive a qualified candidate to fill a vacancy, the vacancy shall be filled by a Commissioner. 11. NOTIFICATION TO DEPARTMENT OF REVENUE A copy of this Resolution shall be forwarded to the North Carolina Department of Revenue within 15 days after its adoption. Duly adopted this the 15 day of March, 2021. :;�Q ,,.r...,,fi,2 ; Exhibit A RESOLUTION RESOLUTION TO APPOINT SPECIAL BOARD OF EQUALIZATION AND REVIEW Whereas,the Harnett County Board of Commissioners is authorized by North Carolina General Statutes,Section 105-322 to appoint a special Board of Equalization and Review to examine and review the listings and valuations assigned to property located in Harnett County,hear property owners' appeals concerning property listings and valuations,and make adjustments and necessary changes to insure that valuations meet standards established by State law;and Whereas, the Board of County Commissioners is authorized by North Carolina General Statutes Section 105-312 to delegate its authority to compromise,settle or adjust the County's claim for taxes and penalties arising from discovered property to a special Board of Equalization and Review;and Whereas,the Board of County Commissioners has determined that it is reasonable and desirable to appoint a special Board ofEgrtali7ation and Review to exercise those powers and perform those duties allowed by law; Now Therefore, Be It Resolved that the Board of County Commissioners for the County of Harnett does hereby establish a special Board of Equalization and Review as follows; 1. EFFECTIVE ,AND DURATION This resolution shall be effective upon its adoption by the Board of County Commissioners and shall continue in effect until revised or rescinded by the Board of County Commissioners. This resolution supersedes any previous resolutions adopted by the Board of County Commissioners regarding the establishment of a special Board of Equalization and Review in Harnett County. 2. MEMBERSHIP a. The Board shall consist of five members,each having one vote. b. Three members shall constitute a quorum. 3. QUALIFICATIONS Each member of the special Board of Equalization and Review shall: a. Be a real property owner in Harnett County; b. Be a registered voter in Harnett County; c. Be in current payment of all City and County property taxes,and d. Be familiar with the power and duties of the Board of Equalization and Review as set forth in North Carolina General Statutes Section 105-322(g). 4. TERM OF OFFICE The term of office for each member of the special Board of Equalization and Review shall be one year. 5. APPOINTMENT OF MEMBERS • ti a. Each Commissioner shall have the opportunity to nominate one member of the Board of Equalization and Review. Nominations shall be made by submitting names and addresses of qualified individuals to the Clerk to the Board no later than the third Monday in February, 1997. b. Appointment of members and designation of the chairperson of the special Board of Equalization and Review shall be made by the Board of County Commissioners from the slate of nominees presented by the Clerk to the Board at the second scheduled meeting of the Board of County Commissioners in February, I997. c. A Commissioner shall serve as a member of the special Board of Equalization and Review by either submitting his/her own name in lieu of some other qualified individual,or by failing to submit the name and address of a qualified nominee to the Clerk to the Board prior to the second scheduled meeting in February, 1997. 6. VACANCIES a. Vacancies shall be filled by the Board of County Commissioners, with individuals qualified as described in Paragraph 3,above. An individual appointed to fill a vacancy shall serve until the end of the unexpired term. b. Any member appointed by the Board of County Commissioners may be removed from the special Board of Equalization and Review by the Board of County Commissioners with or without cause. A vacancy caused by such removal shall be filled as set forth above. c. Any Commissioner serving as member of the special Board of Equalization and Review may vacate his/her seat by requesting that the Board of County Commissioners appoint a replacement._ Such Commissioner shall continue to service on the special Board of Equalization and Review until such time as a qualified individual can be appointed by the Board of County Commissioners to fill the vacancy caused by Commissioner's resignation,as set forth above. 7. COMPENSATION The members of the special Board of Equalization and Review shall be compensated at a rate of S100 dollars per day. 8. POWERS AND DUTIES The special Board of Equalization and Review shall have those powers and duties set forth in North Carolina General Statutes,Section 105-312 and 105-322,and such other powers, duties and responsibilities as are contained in Chapter 105, Subchapter II,of the North Carolina General Statutes,known as the"Machinery Act" 9. CLERK TO THE BOAR1D AND MINUTES OF THE BOARD The Tax Assessor shall serve as Clerk to the Board of Equalization and Review,be present at all meetings,maintain accurate minutes of the actions of the Board,and give to the Board such information as he/she may have or can obtain with respect to the listing and valuation of taxable property in Harnett County. 10. STAFFASSISTANCE The special Board of Equalization and Review may call upon members of the Planning Department and Tax Administration for technical assistance in carrying out its duties and • • powers. The special Board of Equalization and Review may call upon the County Attorney's Office for advice and assistance interpreting and putting into effect Chapter 105,Subchapter II of the North Carolina General Stances as it relates to the Board's responsibilities and duties. 11. By motion properly made and seconded,adopted this the L.th day of January. 1997, Dan B.Andrews,Chairman ATTEST: I�K ,R y Cleric to a Board RESOLUTION BY THE HARNETT COUNTY BOARD OF COMMISSIONERS TO SELL REAL PROPERTY THAT WHEREAS,Harnett County is the owner of an approximate 27.833 ft.x 110 ft.real property tract with commercial building located at 817 S. 8th Street in Lillington,North Carolina 27524;this tract was conveyed to Harnett County in that Deed recorded in Book 1187, Page 367, Harnett County Registry with Parcel ID No.10065013150014; and WHEREAS, Macias Enterprises, LLC ("Macias") has made an offer to Harnett County to purchase the above described real property tract for the purchase price of$125,000.00 pursuant to the negotiated offer,advertisement and upset bids procedure set forth in N.C. Gen. Stat. §160A- 269; that the Harnett County Board of Commissioners has considered this offer and said Board desires through this Resolution to propose to accept the offer on the condition that Macias pay a 5% deposit($6,250.00) and that the further requirements of N. C. Gen. Stat. §160A-269 are met. NOW THEREFORE,BE IT RESOLVED that the Harnett County Board of Commissioners pursuant to the provisions of N.C. Gen. Stat. §160A-269 does hereby propose to accept the offer by Macias of$125,000:00 to purchase that real property tract at 817 S. 8th Street,Lillington,North Carolina upon its deposit of 5% of the offered price ($6,250.00)) and subject to any upset bids received after publication of the offer pursuant to the aforementioned statute. BE IT FURTHER RESOLVED that the County legal staff will ensure the compliance with the sale provisions of N.C.Gen. Stat. §160A-269 and will provide to the Board a proposed Special Warranty Deed at such time that a final bid has been received and accepted for said real property.
