CANVASS MEETING MINUTES
May 11, 2010
11:00 A.M.
Present were Chairman Walter Massey, Secretary James Currin and Member Louise Taylor.
Also present were various members of the citizenry and Sherre Toler, Director.
Chairman Massey called the meeting to order at 11:00 a.m.
Business:
Ms. Toler advised that a Board meeting would be necessary on June 1, 2010 for an absentee
meeting at 5:00 p.m. As this is a regular meeting day, Ms. Taylor moved to hold the regular
meeting at 5:00 p.m. along with the absentee meeting. Mr. Currin seconded. Approved without
dissent.
Ms. Toler advised that the audits and the hand -eye recounts were completed. In Boone Trail, 2
ballots were placed in the emergency bin and not run through the machine. Those numbers were
added to the tapes. On the hand -eye recount, 2 ballots had a vote that was counted as an under
vote on Election Day but actually had a faint check mark that indicated a vote for a candidate.
All other numbers matched correctly.
Ms. Toler reviewed the provisionals. There were 44 total. 27 appeared to be valid. 16 were
invalid. One ballot should be partially counted as they were given a District 1 ballot and should
have received a District 2 ballot. The Board reviewed that ballot and unanimously agreed that
one vote should be removed from the tapes for Lewis Bell. Mr. Currin moved to approve the
valid ballots and the partially counted ballot. Ms. Taylor seconded. Approved without dissent.
Mr. Taylor moved to reject the 16 invalid ballots. Mr. Currin seconded. Approved without
dissent. The provisionals were opened and fed through the machines. The Board reviewed and
signed the tapes and the canvass report was prepared.
Ms. Toler advised that she received a written request for a recount from Thomas Ellis. She
advised the Board that in order to qualify for a recount, the margin of votes must be within 1 %.
There was a 13% difference in that race. Mr. Ellis was not present at canvass to provide any
further information regarding his request. Ms. Taylor moved to deny the request. Mr. Currin
seconded. Approved without dissent.
Ms. Toler provided the Board with a proposed resolution regarding one -stop hours and dates for
the 2nd primary. The resolution provides that one -stop only be held at the Board of Elections
Office in Lillington and that regular hours be in effect, i.e. Monday — Friday from 8:00 a.m. to
5:00 p.m. beginning June 3, and Saturday June 19, 2010 from 8:00 a.m. to 1:00 p.m. Ms. Taylor
moved to approve the resolution. Mr. Currin seconded. Approved without dissent.
Ms. Toler advised that there was a legal matter that she needed to discuss with the Board in
closed session. She provided the Board with information provided by the County Attorney
indicating that a closed session could be held to discuss an ongoing criminal investigation. Mr.
Currin moved to go into closed session at 11:45 a.m.
The Board returned from closed session at 11:55 a.m. with no action being taken in the closed
session.
The Board reviewed the canvass reports and signed the abstracts.
The next meeting of the Board will be on June 1, 2010 at 5:00 p.m.
Mr. Currin moved to adjourn. Ms. Taylor seconded. The meeting was adjourned at 12:30 p.m.
