HomeMy WebLinkAbout041706m HARNETT COUNTY BOAR D OF COMMISSIONERS Minutes of Regular Meeting April 17, 2006 The Harnett County Board of Commissioners met in regular session on Monday, April 17, 2006, in Courtroom 6, Harnett County Courthouse, 301 West Cornelius Harnett Boulevard, Lillington, North Carolina. Members present: Teddy J. Byrd, Chairman Beatrice B. Hill, Vice Chairman Dan B. Andrews Walt Titchener Tim McNeill Staff present: Neil Emory, County Manager Wm. A. (Tony) Wilder, Assistant County Manager Jennifer Slusser, Staff Attorney Kay S. Blanchard, Clerk to the Board Chairman Byrd called the meeting to order at 7:00 p.m. and Commissioner Titchener led the pledge of allegiance and prayer. Commissioner Titchener moved to approve the agenda as published with addition to the consent agenda of a resolution recognizing the Clerk to the Board. Commissioner Andrews seconded the motion and it passed unanimously. Upon motion by Vice Chairman Hill and seconded by Commissioner McNeill, the Board unanimously approved the following items on the consent agenda: 1. Tax Refunds (Attachment 1) 4. Engineering agreement with Marziano & Minier for McKoy Town Road Waterline Extension Project in the amount of $17,000. 5. Engineering agreement with Marziano & Minier for Erwin Waste Water Improvements Project in the amount of $364,550 for technical work. 6. Project Ordinance for Erwin Waste Water Improvements Project (Attachment 2) 7. Authorization to increase Emergency Medical Service fees due to Medicare’s final implementation of the 6-year fee schedule for increase in Medicare reimbursement. (new fee schedule-Attachment 3) 8. Lease agreement with Stacy Williams and wife, Judy Williams, for a parcel of real estate used for a non directional beacon site for the Airport. The term is 5 years for a sum of $3,000 to be paid at the time of execution of this lease. 9. Contract for landscaping at the Agriculture Center awarded to low bidder, Jones Landscaping of Fuquay-Varina. (bid tabulation-Attachment 4) 10. Resolution of support to change name of Harnett County Airport to Harnett Regional Jetport (Attachment 5) 11. Authorization for Library to accept Gates Foundation Staying Connected Award of $26,076.27. The funds will be used to replace public access computers in the municipal libraries and the Anderson Creek Branch Library. At least four computers will be replaced in each library. 12. Authorization for Emergency Services to accept donation of Disaster/Biohazard Supplies from Good Hope Hospital. The supplies and equipment were obtained through the 2004 HRSA grant funds with a value between $6,000 and $8,000. 13. Change Order documents for Agricultural Center & Animal Control facility project (Attachment 6) 14. Resolution recognizing Clerk to the Board Kay Blanchard on her attainment of the Howard Holly Clerk of the Year award from the North Carolina Association of County Clerks (Attachment 7) Chairman Byrd presented the resolution to Ms. Blanchard. During the informal comments portion of the meeting, Jay Sills expressed concerns with safety of roads in his community. Bill Creighton encouraged the Board to approve proposed revisions to the Animal Control Ordinance. Vice Chairman Hill moved for the appointments listed below. Commissioner Titchener seconded the motion and it passed unanimously. Town of Angier Zoning Board of Adjustments Ted Altman and Roberts Surles representing Extraterritorial Jurisdiction nominated by Commissioner Andrews Home and Community Care Block Grant Committee Marie Sensintaffar nominated by Commissioner McNeill Harnett County Public Library Board of Trustees Renee B. Daughtry to fill an unexpired term which will expire 1/1/07 nominated by Commissioner Titchener Chairman Byrd called to order a public hearing regarding the proposed Rural Operating Assistance (ROAP) application. Ralph Thurman, Transportation Manager, summarized the program and noted that the Harnett Area Rural Transit System (HARTS) allocation for FY 2006-07 is $140,992 with a requirement of a 10% local match. Chairman Byrd opened the meeting for comments from the public. No comments were offered and Chairman Byrd closed the public hearing. No action is required by the Board at this time. Mark Locklear, Senior Planner, presented a zoning change request from Bobby and Lena Stewart, from RA-20 R to Commercial Zoning District, 6.88 acres, SR 2045-Elliott Bridge Road, Anderson Creek Township. The Planning Board voted 2 to 2 on a motion recommending denial of the request. Chairman Byrd called to order a public hearing on the matter and opened the meeting for comments from the public. No comments were offered and Chairman Byrd closed the public hearing. Commissioner Titchener moved for adoption of a resolution to approve the proposed rezoning request in that the rezoning is reasonable and in the public interest and that the rezoning is consistent with the Harnett County Land-Use Plan. Commissioner McNeill seconded the motion and it passed unanimously. (Attachment 8) Mark Locklear, Senior Planner, presented a proposed resolution amending the Harnett County Zoning Ordinance which would add an Office/Institutional District. Chairman Byrd called to order a public hearing on the matter and opened the meeting for comments from the public. No comments were offered and Chairman Byrd closed the public hearing. Commissioner Andrews moved to adopt the resolution amending the Zoning Ordinance as presented. Commissioner Hill seconded the motion and it passed unanimously. (Attachment 9) Wm. A. (Tony) Wilder, Assistant County Manager, reviewed proposed revisions to the Harnett County Animal Control Ordinance regarding dangerous dogs. Chairman Byrd called to order a public hearing on the matter and opened the meeting for comments from the public. Linwood Turner, Linden, encouraged the Board to adopt the revised ordinance. There being no further comments, Chairman Byrd closed the public hearing. Commissioner McNeill moved to adopt the revisions to the Animal Control Ordinance. Vice Chairman Hill seconded the motion and it passed unanimously. (Ordinance Book 2) Departmental reports were filed with the Board from the Health Department, Veterans Affairs, Animal Control, Emergency Medical Services, and Finance Office. (Attachment 10) There being no further business, Vice Chairman Hill moved to adjourn. Commissioner Andrews seconded the motion and it passed unanimously. ERWIN WASTE WATER IMPROVEMENTS PROJECT BE IT ORDAINED by the Board of Commissioners of Harnett County, North Carolina, sitting as the governing board of Harnett County. Section I. This project consists of converting the existing Erwin Waste Water Treatment Plant into a 2,800 gallon per minute regional pumping station to transport the waste from the Town of Erwin to the North Harnett Regional Waste Water Treatment Plant. It also consists of the construction of approximately 12 miles of 16 inch force main which will cross the Cape Fear and Little Rivers and continue up Titan Roberts and Ross Roads to the existing regional plant. This project will also consist of major collection system repairs to the existing Town of Erwin’s system to help alleviate inflow and infiltration problems. Section II. This project will be funded from Revenue Bonds, NC High Unit Cost Grant, NC State Revolving Loan, NC Rural Center Grant, an Interfund Transfer from Public Utilities, and a Clean Water Management Trust Fund Grant. The Interfund Transfer received from Public Utilities will provide the project with startup funding until other revenue sources are received. A portion of this Interfund Transfer will be repaid to Public Utilities upon receipt of grant funding. Section III. The following amounts are hereby appropriated for this project: Engineering $ 658,550 Construction 5,523,400 Legal & Administrative 5,000 Materials & Supplies 216,000 Land & Right-of-Way 15,000 Public Utilities 384,000 Contingency 374,175 Total $ 7,176,125 Section IV. It is estimated that the following revenues will be available for this capital project.
