Jay,
Due to a recent change in legislation, we need to make a text amendment pertaining to code enforcement.
Session Law 2021-138 (Senate Bill 300) has been adopted and it takes away the criminal aspect of code enforcement.
The following amendments need to be performed.
Article XII. Enforcement & Penalties
* SECTION 2.0 AUTHORITY
Harnett County shall enforce this Ordinance under the authority of North Carolina General Status Statute 160D 153A -123.
(A type-o needs to be corrected to read – “North Carolina General Statute 153A-123”)
· Section 8.0 Penalties
8.2 Criminal Prosecution
Violations of this Ordinance may constitute a misdemeanor or infraction penalty and is punishable as provided in NCGS 14-4 and the maximum fine; term of imprisonment or infraction penalty
allowed by law is hereby authorized.
(This entire section must be removed from the UDO.)
With this section and language taken out, Sections 8.3 Injunction and 8.4 Order of Abatement would need to be bumped up to reflect 8.2 Injunction and 8.3 Order of Abatement.
