HomeMy WebLinkAbout092021 mHARNETT COUNTY BOARD OF COMMISSIONERS Regular Meeting Minutes September 20, 2021 The Harnett County Board of Commissioners met in regular session on Monday, September 20, 2021 at 6:00 pm, in the Commissioners Meeting Room, Harnett County Resource Center and Library, 455 McKinney Parkway, Lillington, North Carolina. Members present: W. Brooks Matthews, Chairman Lewis W. Weatherspoon, Vice Chairman Matt B. Nicol, Commissioner Members absent: Barbara McKoy, Commissioner Mark B. Johnson, Commissioner Staff present: George Wood, Interim County Manager Christopher Appel, Senior Staff Attorney Kimberly Honeycutt, Finance Officer Melissa Capps, Clerk Chairman Matthews called the meeting to order at 6:00 pm. Chairman Matthews led the Pledge of Allegiance and invocation. Chairman Matthews called for any additions or deletions to the published agenda. George Wood, Interim County Manager, requested the Commissioners consider adding Workforce Innovation and Opportunities Act Funding for FY 2021-2022. Coley Price, Assistant County Manager, shared the Workforce Development Department would like to request permission to enter into a contract for FY 2021-2022 with Triangle South Workforce Development Board which administers the Workforce Innovation and Opportunities Act (WIOA) grant. A federal grant that provides funding for employment and training services to the citizens of Harnett County enrolled in the WIOA Youth, Adult, and Dislocated Worker Programs. The Sampson County WIOA Youth Program will also be included for this fiscal year. Vice Chairman Weatherspoon made a motion to add Item E. Workforce Innovation and Opportunities Act Funding for FY 2021-2022 to the Consent Agenda and approve the amended agenda. The motion was seconded by Commissioner Nicol. The motion carried unanimously. Vice Chairman Weatherspoon read the following Proclamation. Proclamation — Designating September 26, 2021 as Gold Star Mother's and Family's Day. The Harnett County Board of Commissioners does hereby express its profound gratitude and admiration for the sacrifices, strength, and resilience of the mothers and families who have lost a loved one in service to this nation. Harnett County Board of Commissioners September 20, 2021 Regular Meeting Minutes Page 1 of 5 The Harnett County Board of Commissioners designate September 26, 2021 as "GOLD STAR MOTHER'S AND FAMILY'S DAY" in Harnett County and encourages all citizens to observe and honor this day by performing acts of service and good will in the community, sharing the stories and offering support to members of the gold star family, and celebrating families in which loved ones have made the ultimate sacrifice to ensure the freedoms, safety, and security that all Americans have been blessed with in this nation. Commissioner Nicol made a motion to approve the amended consent agenda with the addition of Item E. Vice Chairman Weatherspoon seconded the motion. The motion carried unanimously. The items on the consent agenda were as follows: A. Minutes • Work Session Minutes of August 31, 2021 • Regular Meeting Minutes of September 7, 2021 B. Budget Amendments (Attachment 1) C. Adopt a Resolution to Change the Meeting Date and Location of the September 28, 2021 Work Session for the Harnett County Board of Commissioners (Attachment 2) D. Appointment of Lawrence Smith and Larry T. Smith (alternate) from the County and Uriah Parker and Tommy Stewart (alternate) from the School System to the Administrative Appeals Board for School Bus Stop Arm Violations. E. The Workforce Development Department requested permission to enter into a contract for FY 2021-2022 with Triangle South Workforce Development Board which administers the Workforce Innovation and Opportunities Act (WIOA) grant. Chairman Matthews opened the meeting for informal comments by the public, allowing up to 3 minutes for each presentation up to 30 minutes. The following people provided comments: 1. Susan Vuncannon of Kipling, NC. 2. Rosa Smith Williams of 3273 Bunn Level Erwin Road, Erwin, NC. 3. Marina Elliot of 52 Sawgrass Court, Bunn Level, NC. 4. Ronnie Kemp of 244 Chesley Lane, Lillington, NC. 5. Scott Parrish of Kipling, NC. No one else spoke. The public comment period was closed. Vice Chairman Weatherspoon made a motion to approve the following appointments: Administrative Anneals Board for School Bus Stop Arm Violations Nathan Hadley, Member Harnett County Board of Commissioners September 20, 2021 Regular Meeting Minutes Page 2 of 5 Kenneth Wells, Alternate Agricultural Advisor R. H. Byrd to be reappointed for a 3 year term expiring 7/1/2024. Dudley Langdon to be reappointed for a 3 year term expiring 7/1/2024. Commissioner Nicol seconded the motion and the motion unanimously carried. Sandhills Antique Farm Equipment Club President Alvin McArtan presented the Club's annual report. Jay Sikes, Assistant Development Services Director/ Manager of Planning Services, petitioned the board for a public hearing regarding proposed Zoning Change: Case # PLAN2107-002, Landowner / Applicant: Jay Ambe Shakti, LLC; 3.46 +/- acres; Pin # 0654-51-8196.000; From RA -30 to Commercial Zoning District; Intersection of US Hwy 401 N & SR # 1441 (Chalybeate Springs Road); Hector's Creek Township. Mr. Sikes reported the site is currently vacant. Area land uses consist of various nonresidential uses (commercial & industrial), residential developments and individual single family lots. Mr. Sikes stated staff's evaluation as: The IMPACT to the adjacent property owners and the surrounding community is reasonable, and the benefits of the rezoning outweigh any potential inconvenience or harm to the community. REASONING: The requested zoning change to Commercial will not have a negative impact on the community as it is similar in nature to existing zoning districts and development patterns in this area. The requested zoning district is COMPATIBLE with the existing Land Use Classification. REASONING: The requested zoning district is compatible with the existing Land Use classification of Employment Mixed Use. This whole area is also within the Compatibility Development Target area. These two designations highlight growing areas of the County that consist of planned residential areas mixed with a variety of nonresidential uses. The proposal does ENHANCE or maintain the public health, safety and general welfare. REASONING: The requested rezoning to Commercial would maintain or enhance the public health, safety, and general welfare due to the area's existing commercial uses as well as the potential site improvements that would be required. Due to the size of the tract and the proposed zoning district exists directly across the street, this application does not need to be evaluated for Small Scale Rezoning. On September 7th, the Harnett County Planning Board voted unanimously (5-0) to recommend approval of application based on compatibility to the County's Land Use Plan and the existing nonresidential uses in this area. One citizen spoke in opposition with concerns of potential access being very close to her property. Harnett County Board of Commissioners September 20, 2021 Regular Meeting Minutes Page 3 of 5 Suggested Statement -of -Consistency - As stated in the evaluation, the requested rezoning to Commercial would not have an unreasonable impact on the surrounding community based on being compatible with Harnett County Land Use Plan as well as the existing nonresidential uses in this area. Therefore, it is recommended that this rezoning request be approved. Mr. Sikes answered questions from the commissioners. Chairman Matthews called to order a public hearing on the matter and opened the meeting for comments from the public. Citizens were allowed to speak in person or were allowed to submit their comments in writing prior to the meeting. The following person spoke: Paul Stewart asked if there would be any changes to the current right-of-ways on the other side of the road. Mr. Sikes shared more than likely any improvements made would be on the side of the project location. Mark Locklear, Director of Development Services, reminded the commissioners, this is just the rezoning, not the site plan phase. No one else spoke and Chairman Matthews closed the public hearing. Vice Chairman Weatherspoon made a motion to approve the requested rezoning to commercial. Commissioner Nicol seconded the motion. The motion passed unanimously. Jay Sikes, Assistant Development Services Director/ Manager of Planning Services, petitioned the board for a public hearing regarding proposed Case # PLAN2107-0003, Landowner / Applicant: CEBO Construction Inc.; Donald Nordon & Patricia McKee / Rhetson Companies, Inc.; 1.2 acres (consisting of two parcels); Pin #'s 0610-97-0587.000 & 0610-87-8640.000; From RA -30 & RA -20R to Commercial Zoning District; US Hwy 421 N; Lillington Township. Mr. Sikes reported the parcels are now vacant except for a billboard on the smaller lot. Surrounding land uses consist of single family residences, two retail/ convenience establishments, a fire/ EMS station, a post office and a medical center. Mr. Sikes stated staff s evaluation as: The IMPACT to the adjacent property owners and the surrounding community is reasonable, and the benefits of the rezoning outweigh any potential inconvenience or harm to the community. REASONING: The requested zoning change to Commercial will not have a negative impact on the surrounding properties or the community as it is similar in nature to existing zoning districts in the area. The requested zoning district is COMPATIBLE with the existing Land Use Classification. REASONING: The requested zoning is compatible with the existing Land Use classification of a Rural Center development node. Rural Center development nodes are "small scale commercial centers". These areas can be suburban in nature and contain smaller, nonresidential uses. REASONING: The requested rezoning to Commercial, whose intent is to promote the development of business and institutional uses, would enhance or maintain the public health, safety, and general welfare due to the neighboring Commercial zoned parcels. Since the proposed zoning district exists on contiguous properties, this application does not need to be evaluated for Small Scale Rezoning. Suggested Statement -of -Consistency - As stated in the evaluation, the requested rezoning to Commercial is compatible with Harnett County Land Use Plan and would not have an unreasonable impact on the surrounding community based on the existing commercial in the area. Therefore, it is recommended that this rezoning request be approved. On September 7th, the Harnett County Planning Board voted unanimously (5-0) to recommend approval of application based on the existing Commercial in this area as well as the compatibility with the Land Use Plan. No one spoke in opposition. Chairman Matthews called to order a public hearing on the matter and opened the meeting for comments from the public. Commissioner Nicol made a motion to approve the rezoning to commercial. Vice Chairman Weatherspoon seconded the motion. The motion passed unanimously. Mr. Wood provided the County Manager's report. Vice Chairman Weatherspoon moved to go into Closed Session to instruct the county staff concerning the position to be taken by the county in negotiating a contract for the acquisition of real property. This motion is made pursuant to NC General Statute section 143-318.11 (a) (5). The motion was seconded by Commissioner Nicol and passed unanimously. Following a motion to come out of Closed Session, Chairman Matthews called the meeting back into open session. Vice Chairman Weatherspoon moved to adjourn the meeting at 7:11 pm.
