HomeMy WebLinkAbout060721 mHARNETT COUNTY BOARD OF COMMISSIONERS Regular Meeting Minutes June 07, 2021 The Harnett County Board of Commissioners met in regular session on Monday, June 07, 2021 at 9:00 am, in the Commissioners Meeting Room, Harnett County Resource Center and Library, 455 McKinney Parkway, Lillington, North Carolina. Members present: W. Brooks Matthews, Chairman Lewis W. Weatherspoon, Vice Chairman Barbara McKoy, Commissioner Mark B. Johnson, Commissioner Matt B. Nicol, Commissioner Staff present: George Wood, Acting County Manager Dwight Snow, County Attorney Kimberly Honeycutt, Finance Officer Lindsey Lucas, Interim Clerk Chairman Matthews called the meeting to order at 9:00 am and Vice Chairman Weatherspoon led the Pledge of Allegiance and invocation. Chairman Matthews called for any additions or deletions to the published agenda. Vice Chairman Weatherspoon moved to approve the agenda as published. Commissioner Nicol seconded the motion, which passed unanimously. Commissioner McKoy made a motion to approve the consent agenda as amended. Commissioner Nicol seconded the motion that passed unanimously. The items on the consent agenda were as follows: A. Minutes B. Budget Amendments (Attachment 1) C. Tax rebates and releases (Attachment 2) D. Harnett Regional Water requests approval of the write-offs for the fourth quarter of 2020 totaling $18,177.30. E. Sheriff Coats requests approval of a resolution to award a Glock Model 17, Serial number BGYD531, service weapon to Sergeant Joseph Coupee upon his retirement. (Attachment 3) F. Sheriff Coats request approval of a resolution to award a Glock Gen 5-9mm, serial number BGYD474, service weapon to Deputy Scott Kelly upon his retirement. Harnett County Emergency Services requests approval of the Carolina Lakes Fourth of July fireworks permit application. H. Harnett County Emergency Services requests approval of the Anderson Creek Club Fourth of July fireworks permit application. I. Resolution by the Harnett County Board of Commissioners Endorsing Safety Improvements in Harnett County by North Carolina Department of Transportation (Attachment 5) J. Soil and Water requests approval of the service agreement with J7J Environmental, LLC in the amount of $1,638,347 for stream debris removal from the Upper Little River, Lower Little River, and Anderson Creek. K. Harnett County Health Department requests approval to establish the following fee: CPT Code -90619 Description-Menquadfi (Meningitis) Recommended Price -$152 Chairman Matthews opened the meeting for informal comments by the public, allowing up to 3 minutes for each presentation up to 30 minutes. Citizens were allowed to call in and provide their public comments verbally during this period or submit their public comments in writing prior to the meeting to be read aloud during the meeting as time allowed. - Jerry Rivas of 364 Twin Ponds Road in Sanford - Margaret Mueller of Fuquay-Varina - Joe Langley of 298 Kirk Adams Road in Angier Vice Chairman Weatherspoon stated Larry Alexander was interested in being appointed to the Adult Care Home Community Advisory Committee and also stated that on May 11, 2021 at the Dunn City Council Meeting Gloria Gulledge was unanimously approved to continue as the Dunn representative on the Harnett County Library Board and Gary Beasley was unanimously approved to continue as ETJ representative on the Dunn planning Board both with a term set to expire June 30, 2024. Vice Chairman Weatherspoon made a motion to approve these recommendations. Commissioner Nicol seconded the motion that passed unanimously. George Wood, Acting County Manager brought before the Board Fiscal year 2021-2022 Budget and the Sheriff s Departments request to be reclassified two pay grades which would be a 10% increase for the Sheriffs Department. Vice Chairman Weatherspoon moved to approve the Fiscal year 2021-2022 Budget as amended and presented in the agenda packet be adopted, subject to the following amendment to cover the shortfall in funding the Sheriff s Office request to reclassify all sworn law enforcement personnel two grades higher on the pay plan, which is a 10% compensation: 1109800 598500 Reduce the transfer from the General fund to the Sheriff s Capital Reserve Fund (Fund 510) by $192,538 June 7, 2021 Regular Meeting Minutes Harnett County Board of Commissioners Page 2 of 7 1104310 502010 Budget an additional $192,538 in the Sheriffs Department Salaries and Benefits. These amounts will be distributed among departments 1104330, 1104350, 1104370, and 1104390 Increase the Sheriff s Asset Fund (Fund 217) appropriation $192,538 to pay for a portion of the Jail video surveillance equipment Commissioner Nicol seconded the motion that passed unanimously. Brian Haney came before the Board to request approval of an agreement with the School of Government Services to engage the UNC School of Government's Center for Public Leadership and Governance in the facilitation of a strategic planning process for the County. Commissioner Nicol moved to approve the agreement with the School of Government for the strategic planning process. Vice Chairman Weatherspoon seconded the motion that passed unanimously. The Board will get back with Mr. Haney on dates they are available for training. Mr. Wood stated the School Board has employed a Construction Manager at Risk and they need to bid out each individual component of the work. There is a request for approval of Guaranteed Maximum Price Contract (GMP) for the Northwest Harnett Elementary School Project. Tom Hughes with SLFA Architects reiterated what Mr. Wood said. Chairman Matthews moved to approve the Guaranteed Maximum Price Contract. Commissioner Nicol seconded the motion that passed unanimously. Mr. Wood asked that the Board approve a budget amendment for the fiscal year 2020-2021 budget covering the airport from June 17, 2021 -June 30, 2021. Commissioner Johnson moved to approve the budget amendment. Commissioner Nicol seconded the motion that passed unanimously. Mr. Wood recommends that the Board go forward with Diversity, Equity and Inclusion Training subject to being done in the framework of House Bill 324. Vice Chairman Weatherspoon made a motion to Table the Training until the General Assembly comes out with final outcome of their bill. Commissioner Johnson seconded the motion that passed unanimously. Mr. Wood recommends to the Board that the County reopen to the public and rescind the mask requirement except for certain county functions. Mr. Wood recommends that they also reopen all meetings to the public and that all county employees who have been teleworking return back to work unless that meet a certain criteria that would have to be approved by the County Managers office. Vice Chairman Weatherspoon made a motion to approve Mr. Woods's recommendation. Commissioner Johnson seconded the motion that passed unanimously. Mr. Wood gave an update on the selection of a County Manager and passed a booklet out to the commissioners for them to review to help with their decision. Mr. Wood reviewed the County Managers report. Vice Chairman Weatherspoon moved to go into closed session for the following purposes; June 7, 2021 Regular Meeting Minutes Harnett County Board of Commissioners Page 3 of 7 Consultation with the county's legal counsel in order to preserve the attorney client privilege concerning the handling of certain claims and litigation including the following case, the Estate of John David Livingston II et al vs. Kehaigas, et al. U.S. District Court Eastern District of North Carolina Western Division File#5CB00906BO this motion is made pursuant to NCGS 143-318.11A3 Commissioner Nicol seconded the motion that passed unanimously. The Commissioners came out of closed session Chairman Matthews recessed the meeting. Following the regular Board meeting several commissioners toured the Harnett County Resource Center and Library. Chairman Matthews reconvened the meeting of the Harnett County Board of Commissioners at 10:30 am. Commissioners hosted their 2021 Legislative Luncheon and the following Legislators and Legislative staff attended: - Senator Jim Burgin - Jessica Yovanovich from Senator Jim Burgin's Office - Congressman Richard Hudson - Robert Andrews from Congressman Hudson's Office - Joey Nelson from the Office of Senator Tom Tillis - Janet Bradbury from the Office of Richard Burr - Representative Larry Strickland - Representative Howard Penny - Drew Adams with Howard Penny - Representative David Rouzer Commissioners and staff discussed in detail the following top Harnett County 2021 Legislative Priorities: Assist Count i�panding Broadband Access to Underserved Areas Lack of access to high speed Broadband is a significant barrier to economic growth, and limits educational opportunities and outcomes for residents. Broadband access has become even more critical during the COVID-19 pandemic with more people teleworking and more students learning remotely. Harnett County completed a Broadband Survey in 2019 and entered into a partnership with an ISP in 2020 to expand Broadband availability in Harnett County, however additional funding is required to expedite expansion of this critical utility. We request funding to assist the County in creating a fiber optic network to provide reliable high speed Internet to the county's residents at an affordable price. Assist County with Economic Development Marketing Efforts Harnett County currently owns three industrial parks, which it is marketing for industrial and commercial development, along with a number of privately owned sites across the county. The County works with EDPNC, the Research Triangle Regional Partnership, and others to increase awareness of these properties. The County has seen varied success in selling these properties for June 7, 2021 Regular Meeting Minutes Harnett County Board of Commissioners Page 4 of 7 industrial and commercial use. We wish to make our legislators aware of Harnett County's economic development efforts and product, and ask that they assist us by advocating for Harnett County and sharing information regarding the availability of funding, grants, and other resources to enhance our ongoing economic development marketing efforts. Assist County in Creation of Industrial Parks and Sites for Economic Development Harnett County is committed to the development and marketing of industrial parks to expand the County's economy and provide quality jobs for the county's citizens. The County is currently seeking additional properties in strategic locations for the purpose of developing additional product to market for economic development purposes. While land is available in the county for economic development, additional amenities are necessary to make these sites attractive for industrial recruitment. The County is willing to pursue opportunities to take advantage of resources through EDA, Golden LEAF, CDBG, Utility Account, Rural Economic Infrastructure, and other programs. We seek additional assistance in developing sites for economic development to include utilities such as high-speed Internet (greater than 10 Gbps), natural gas, water and sewer, streets, power, and other necessary infrastructure. Assist County with Expanding and Enhancing Harnett Regional Jetport Harnett Regional Jetport is an economic engine for Harnett County. In the past decade, the County has rehabilitated runways and taxiways; and has improved the apron, taxiways and runways to accommodate larger aircraft to expand the airport's aviation and economic capabilities. To fully take advantage of the Jetport's economic development potential, it needs additional hangars and more land to allow for future growth. Harnett County is preparing to make additional investments in the jetport in the form of additional and improved lighting, apron expansion; and a badly needed new terminal and site improvements. The current terminal was built in 1982 and is only 1,800 square feet, which does not meet the 4,500 -square -foot standard for the State's Airport Development Plan for Blue Airports. The terminal is more than 95% designed. We ask for additional appropriations to enhance what is currently available to offset the cost to the County of making these critical enhancements for future growth of this important resource. Support Four -Lane Highways into Wake County Harnett County does not have a four -lane highway into Wake County, which is a significant barrier to growth and economic development. U.S. 401 and N.C. 55 are natural candidates to be widened to four lanes. The Capital Area Metropolitan Planning Organization (CAMPO) has launched a high-level study of U.S. 401 from Harnett into Wake County, and a project that will widen N.C. 55 to four lanes going into Wake County and create a bypass around the Town of Angier is planned and set for funding in the coming years. Additional funding is required to extend the N.C. 55 widening project south to the Town of Coats. We ask for continued support and assistance in moving these projects up on the priority list. June 7, 2021 Regular Meeting Minutes Harnett County Board of Commissioners Page 5 of 7 Support Creation of Bypass around City of Dunn U.S. 421 is a major artery through Harnett County for commerce; however, travel slows considerably through Downtown Dunn, especially at certain times of the day. The construction of a bypass around Dunn that passes by Edgerton Industrial Park and the Food Lion Warehouse in Dunn would improve travel through this area and would also enhance the appeal for commercial and industrial development in this area. A bypass has been considered in the last several years and there is a project designation with NCDOT. We ask for assistance in pushing this project forward as a priority for design and funding. Support Expansion of CAMPO's Boundary within Harnett County Harnett County is split between the Capital Area Metropolitan Planning Organization (CAMPO), the Fayetteville Area Metropolitan Planning Organization (FAMPO), and the Mid -Carolina Rural Planning Organization (RPO). This split has made it difficult to obtain funding and support for priority transportation projects across the county. The 2020 U.S. Census presents an opportunity to expand CAMPO's boundary further into Harnett County to include locations that are strategic for the county's continued growth and development. We ask for continued support and assistance expanding CAMPO's boundaries within Harnett County to include the Town of Lillington, Campbell University and Harnett Regional Jetport. Increase Lottery Payout to Counties Since its inception, the North Carolina Education Lottery has provided valuable funding assistance to school districts across the State including Harnett County Schools. However, the percentage of lottery revenue school districts receive has continued to decline as more and more lottery funding is diverted for other uses. We ask that the lottery payout be restored to its initial level of 40% of revenue. We also ask that when counties receive grant funding through the Needs -Based School Capital Fund that counties are made whole for any funding they would have received from the lottery beyond the annual amount of the grant. Additional priorities provided include: - Appropriate Full Funding for the Federal Impact Aid Program (Federal) - Assist with Efforts to Expand Natural Gas Capacity (State) - Require Accurate County Assignment of Sales Tax for Delivered Goods (State) - Provide Additional Solutions to Assist with Funding Public Education (State & Federal) - Provide Funding to Help Counties Implement School Security Measures (State & Federal) - Preserve Funding for Local Health Departments (State) - Lower NCDOT Road Takeover Threshold to 60-65% percent Buildout (State) - Support Legislation to Assist Firefighters who Contract Disease Related to Service (State) - Expand Fire Prevention Grant Opportunities to include Counties (State & Federal) June 7, 2021 Regular Meeting Minutes Harnett County Board of Commissioners Page 6 of 7 Require Licensing & Permitting for Fire Extinguisher & Suppression System Installation (State) Give School Systems Flexibility in Establishing their K-12 Calendars (State) Provide Funding to Support and Establish Treatment Courts (State) Appropriate Recurring Funds to Support State Aid for Public Libraries (State) Increase Appropriation to Agricultural Development & Farmland Preservation Trust Fund (State) Legislators responded and discussions continued. WHEREAS, the proposed improvements will address the drainage and pavement issues that have resulted in several serious accidents at said intersection; and WHEREAS, the North Carolina Department of Transportation has requested a Resolution from the Harnett County Board of Commissioners endorsing the proposed safety improvements; and WHEREAS, the North Carolina Department of Transportation will provide the funing to make the proposed improvements with no matching funds required from the County of Harnett; and WHEREAS, The Harnett County Board of Commissioners believes that the proposed improvements are necessary to ensure the safety of motorists traveling along this route and encourages the North Carolina Department of Transportation to take the appropriate measures to address the safety issues of this intersection.
