Adjourn Christopher Appel, Senior Staff Attorney, introduced Craig Schauer with Brooks Pierce and petitioned the Board for a public hearing regarding the proposed electoral districts boundaries for the Harnett County Board of Commissioners and the Harnett County Board of Education. Attorney Schauer reviewed changes to the proposed maps. Commissioner McKoy expressed concerns regarding District 1. Attorney Schauer stated he did not believe District 1’s footprint in Lillington had changed but he would look into and check the details. Chairman Matthews opened the public hearing and the following people spoke: 1. Roger Farina of 306 Pine Valley Lane, Sanford, NC. 2. Clara Jones with the Board of Elections. 3. Commissioner McKoy made a motion to convene into Closed Session to discuss certain personnel matters and to instruct the County staff concerning the position to be taken by the County in negotiating a contract for the acquisition of real property. This motion is made pursuant to NC General Statute Section 143-318.11 (a)(6) and 143-318.11 (a)(5). The motion was seconded by Commissioner Johnson and carried unanimously. Attorney Snow stated prior to going into Closed Session, the Board held a public hearing regarding the proposed electoral districts boundaries. The County’s legal staff would like direction on how to proceed since the deadline of the 17th is approaching. Chairman Matthews stated I believe the intent is to ask GIS to print maps of Map 5, make them available here for the public to review, make it an action item for the 15th. The Board discussed holding another public hearing and consensus was to schedule another public hearing. A vote to follow the public hearing. Consensus of the Board was to place this item on the next consent agenda. Brian Haney, Assistant County Manager, reviewed the revised County of Harnett Policies Governing the Use of the Harnett County Commons Area and Harnett County Resource Center & Library Training Rooms and proposed staffing requests for the revised rental policy. Consensus of the Board was to place this item on the next consent agenda. Mr. Haney also provided an update on the former Benhaven Campus. Consensus was to bring back at a later date. Commissioner Johnson introduced Carl Chuck Turnage, US Army Retired, President of the General William C. Lee Memorial Commission who shared information on the request to rename Fort Bragg, to Fort Major General William C. Lee. A draft list of the 2022 schedule of meetings for the Board of Commissioners was provided for review. The draft agenda for the November 15, 2021 meeting was reviewed, as well as the applications to serve on Boards and Committees. Chairman Matthews asked for an update on Wetland Solutions Report for the Riverside Community. Mr. Price stated he would ask for an update from Ms. Lambert. Members present: W. Brooks Matthews, Chairman Barbara McKoy, Commissioner Mark B. Johnson, Commissioner Lewis W. Weatherspoon, Vice Chairman Matt B. Nicol, Commissioner Staff present: George Wood, Interim County Manager Dwight Snow, County Attorney Kimberly Honeycutt, Finance Officer Melissa Capps, Clerk Chairman Matthews called the meeting to order at 6:00 pm. Commissioner Johnson led the Pledge of Allegiance and invocation. Chairman Matthews called for any additions or deletions to the published agenda. Chris Appel, Senior Staff Attorney stated on Item 9, I would ask that you add and a motion to approve a Resolution Finding Substantial Inequality for Redistricting Purposes and adopting new election district boundaries. Chairman Matthews asked that the Commissioners add budget amendment no. 1212b which was inadvertently left out of the agenda packet. Vice Chairman Weatherspoon made a motion to approve the agenda as revised. The motion was seconded by Commissioner Nicol and carried unanimously. Vice Chairman Weatherspoon made a motion to approve the consent agenda as revised. Commissioner McKoy seconded the motion. The motion passed unanimously. General Services Director requests the Board of Commissioners consider and approve position and budget for adding one additional Animal Control Officer (ACO) Position bringing total number of ACO positions to five (5). F. Administration requests the Board of Commissioners consider and approve Work Authorization (WA) 18-02 for Talbert & Bright to design new phasing plans that will reduce closure to hangar tenants at the Jetport during the expansion construction. G. Administration requests the Board consider approval of the revised County of Harnett Policies Governing the Use of the Harnett County Commons Area and Harnett County Resource Center & Library Training Rooms. H. Along with approval of the revised Policies Governing the Use of the Harnett County Commons Area and Harnett County Resource Center & Library Training Rooms, Administration requests the approval of the following two positions: Facilities Maintenance Technician (Grade 16) and Audio-Visual Technician/Trainer (Grade 20) which we believe are necessary to effectively administer this policy as presented. I. Administration requests award of a bid for the demolition of the former Harnett County Detention Center and associated electrical, mechanical, plumbing, site, and architectural work to Spruill Construction, which was the low bidder for this project (Bid Recommendation Letter from Wooten Company is attached) with a base bid of $448,000. J. The Health Director requests, pending approval from the Board of Health at their November 18, 2021 meeting, establish the rates for the FY21-22 Flu Vaccines. K. The Sheriff’s Office is requesting approval to accept a donation of an enclosed trailer from the Angier Fire Department. The trailer will be used by the Sheriff’s Office to transport Dive Team equipment. Chairman Matthews presented the following Proclamation: Proclamation Recognizing Harnett Central High School Lady Trojans Varsity Volleyball Team. The Harnett County Board of Commissioners express its sincere gratitude and respect to the Harnett Central High School Lady Trojans Varsity Volleyball Team and Coaching staff for the team’s outstanding achievements and their inspiration to youth across North Carolina through their dedication, teamwork, and athletic prowess. Chairman Matthews opened the meeting for informal comments by the public, allowing up to 3 minutes for each presentation up to 30 minutes. The following people provided comments: 1. Commissioner McKoy shared comments regarding District 1 and representing every citizen in the county. No one else spoke. The public comment period was closed. Vice Chairman Weatherspoon made a motion to accept the resignation of Jim Roberts on the Triangle South Workforce Development Board, reappoint Kathy Wood and Stanley Price to the Planning Board, and approve Elaine Blackman’s appointment as the Town of Angier’s Liaison on the Harnett County Library Board of Trustees. Chris Appeal, Senior Staff Attorney introduced Craig Schauer with Brooks Pierce who reviewed the process gone through for the redistricting of electoral districts. Additional discussion included what would happen if new maps were not adopted by the November 17th deadline, Phase 5 and Phase 6 redistricting maps. Chairman Matthews opened the public hearing regarding the revised electoral district boundaries for the Harnett County Board of Commissioners and Harnett County Board of Education. Woody Lee of 217 Woodview Court, Fuquay-Varina, NC. 4. Rebecca Fuller 230 Morgan Farm Drive, Lillington, NC 5. Joe Langley of 298 Kirk Adams Road, Angier, NC. 6. Chairman Matthews summarized the process undertaken. Once we make our decision it will be up to the Board of Education to decide if they want to align with that or if they would like to do something differently. Vice Chairman Weatherspoon seconded the motion. Commissioner Nicol made a motion to table this motion, to allow more time and gather some more information and data. Commissioner McKoy seconded the motion. Commissioners McKoy, Johnson and Nicol voted in favor of tabling the motion. Chairman Matthews and Vice Chairman Weatherspoon voted against the motion. The motion passed 3:2. Vice Chairman Weatherspoon made a motion that rather than adjourn, recess and reconvene no later than the 17th at 9:00 am to continue discussion on this matter. Commissioner Nicol seconded the motion. The motion carried unanimously. The Board of Commissioners took a 10 minute recess at 8:05 p.m. The Board of Commissioners reconvened at 8:15 p.m. Jay Sikes, Assistant Development Services Director/ Manager of Planning Services, petitioned the Board for a Public Hearing on the Proposed Zoning Change: Case # PLAN2109-0003 Landowner / Applicant: Henry & Susie Elmore; 5.36 +/- acres; Pin # 1515-42-2598.000; From Commercial to Industrial Zoning District; SR # 1872 (Dixieland Road); Averasboro Township. The site is currently occupied by the applicant’s materials that have accumulated due to his business. Mr. Sikes stated staff’s evaluation as: - The IMPACT to the adjacent property owners and the surrounding community is reasonable, and the benefits of the rezoning outweigh any potential inconvenience or harm to the community. REASONING: The impact to the surrounding community is reasonable, as there are several nonresidential uses in this area. - The requested zoning district is COMPATIBLE with the existing Land Use Classification. REASONING: The requested zoning is compatible with the existing Land Use classification of Employments Mixed Use. This area is also within a Compact Mixed Use development node. These two designations highlight growing areas of the County that could include locations for employment and economic development opportunities, as well as have access to major thoroughfares and public utilities. - The proposal does ENHANCE or maintain the public health, safety and general welfare. REASONING: The requested rezoning to Industrial would maintain the public health, safety, and general welfare as the proposed zoning district will allow for uses in a similar manner as the area’s existing development trends. REASONING: Since this parcel is adjacent to the same zoning district, this application does not need to be considered for a Small Scale rezoning. Suggested Statement-of-Consistency. As stated in the evaluation, the requested rezoning to Industrial would not have an unreasonable impact on the surrounding community based on the nonresidential uses and zoning districts in this area as well as compliance with the County’s Land Use Plan. Therefore, it is recommended that this rezoning request be APPROVED. On November 1st, the Harnett County Planning Board voted unanimously (4-0) to recommend approval of application based on the existing nonresidential uses in this area as well as the compatibility with the Land Use Plan. No one spoke in opposition. Chairman Matthews opened the public hearing and the following person spoke: - Woody Lee of 217 Woodview Court, Fuquay-Varina, NC. No one else spoke and the public hearing was closed. Commissioner Johnson made a motion to approve the rezoning request CASE # PLAN2109- 0003. Commissioner Nicol seconded the motion. The motion carried unanimously. In the original scope of work Cloud Wyze planned to install wireless equipment on 5 water towers and they were planning to use county owned fiber to connect their middle mile Internet connection in Lillington to the Lillington communication tower. It has been determined that the county is statutorily unable to lease out fiber to Internet Service Providers. CloudWyze will have to build fiber out to the tower to make this connection. Removing the cost of 3 water towers from the scope will cover the unforeseen fiber build out costs. The water towers that will be removed are mostly covering municipality areas and will not have a large impact on the overall project and the ability to reach underserved residents. Commissioner Nicol made a motion to approve the requested amendment to the Broadband Services Agreement Statement of Work with CloudWyze. Commissioner McKoy seconded the motion. The motion carried unanimously. RECITALS: A.Harnett County (“County”), the Town of Lillington (“TOL”) and the Harnett County Board of Education (“BOE”) are the title owners of certain real property tracts located within or in the vicinity of the Lillington Town limits; and B.The TOL is currently implementing a downtown revitalization plan which will include the procurement of certain downtown block real property tracts and a recreational expansion plan that will include the procurement of the Star Academy gymnasium and ball fields from the BOE; and C.The BOE has plans to relocate its administrative offices and other school system support facilities through the procurement of the former County Public Library Building property at 601 S. Main Street and the office building at 108 E. Front Street with surrounding parking from the County and TOL; and D.The County desires to obtain more warehouse storage space and potential office space through the procurement of the warehouse property at 125 Alexander Drive; and E.The three parties have negotiated and agreed to a basic framework of this real property exchange as previously summarized in A Joint Resolution For The Exchange of Certain Real Property dated April 30, 2021; that since the execution of said Joint Resolution there have been further real property exchange agreement modifications by the parties which are included in this instrument; that the parties deem said exchange terms and conditions of the exchange agreement to be wise and in the best interests of each party and the citizens that they each represent; that the parties desire through this instrument to set forth in detail the specific terms of their exchange agreement. HCBOC 120621 Revised Pg. 115 2 NOW, THEREFORE, in consideration of the covenants and promises among the parties and pursuant to the provisions of N.C. General Statutes §160A-274, the parties agree as follows: 1. CONSIDERATION It is stipulated that this Contract and Agreement is supported by fair and adequate consideration. 2. HARNETT COUNTY OBLIGATIONS As part of the real property exchange transaction, the County agrees to complete the following: (a) Conveyance of former library building real property to BOE The County shall convey by Special Warranty Deed to the BOE the former Harnett County Public Library facility at 601 S. Main Street, Lillington, NC 27546 composed of two tracts: 1) PIN 0650-50- 1631.000 and 2) PIN 0650-50-0531.000. The County and the BOE agree that prior to this conveyance that the subject real property shall be surveyed. The BOE shall be responsible to arrange and pay for the survey. The County and BOE acknowledge that an entrance and parking lot portion of the real property is subject to a public library use reversionary clause to the W. A. Johnson family heirs as set forth in that deed recorded in Book 1243, Page 199, Harnett County Registry. Any conveyance by the County to the BOE shall be subject to said reversionary provision and the Special Warranty Deed shall list this matter as a title exception. It shall be the responsibility of the BOE to deal with this title encumbrance. At such time that the BOE is in a position to accept title to this real property then the BOE attorney will advise the County Attorney who will have 15 days to deliver the Special Warranty Deed to the BOE for recordation. The BOE and the County agree that time is of the essence in the BOE taking possession of the former Harnett County Public Library facility property. These two parties have entered into a Lease Agreement whereby the BOE (Tenant) has leased the library subject real property from the County (Landlord) at a zero rent amount with said lease term to extend to the earlier of July 31, 2022, or the Special Warranty Deed conveyance. HCBOC 120621 Revised Pg. 116 3 (b) County funding of former library facility renovations by BOE As part of the conveyance transaction of the former public library facility property to the BOE, the BOE and the County agree that funds will need to be allocated for renovations to the former library facility pursuant to the Capital Improvements Program (CIP) funding and budgeting process. (c) Lease portions of the 125 Alexander Drive warehouse property to TOL and to BOE At such time that the real property located at 125 Alexander Drive, Lillington, NC PIN 0650-57-1078.000 has been conveyed by the TOL to the County by Special Warranty Deed (pursuant to section 3(a) of this Agreement) then the County as Landlord shall enter into Lease Agreements which shall lease the northern 1/3 section of the warehouse property to the TOL and the southern 2/3 section of the warehouse property to the BOE as Tenants respectively for a rental amount of $1 per year. During the two separate lease agreement terms, the Tenants shall be responsible to divide the utilities obligations. The County shall maintain hazard insurance coverage on the warehouse building and the Tenants shall be responsible to maintain renter’s insurance on their personal property contents. The warehouse lease term for the TOL 1/3 section shall be 1 year. The lease term for the BOE shall be for 1 year with Tenant's option to extend until the BOE's new Auxiliary Services Facility is constructed. Other standard lease provisions shall be subject to negotiations between the respective Landlord and Tenant parties. 3. TOWN OF LILLINGTON OBLIGATIONS As part of the real property exchange transaction, the TOL agrees to complete the following: (a) Conveyance of 125 Alexander Drive warehouse property to County The TOL shall convey by Special Warranty Deed to the County the warehouse real property tract located at 125 Alexander Drive, Lillington, NC, PIN 0650-57-1078.000 free and clear of any mortgage indebtedness. Simultaneous to this real property conveyance, the County shall enter into Lease Agreements for portions of the warehouse property with the TOL and the BOE as set forth in section 2(c) of this Agreement. This conveyance and the leases shall be completed within 20 days from the date that the last party executes this Agreement. HCBOC 120621 Revised Pg. 117 4 (b) Conveyance of 108 E. Front Street property to the BOE The TOL shall convey by Special Warranty Deed to the BOE free and clear of any mortgage indebtedness that office building with one row immediate surrounding parking spaces real property located at 108 E. Front Street, Lillington, NC 27546, which is a portion of that tract designated as PIN 0559-59-2794.000. The parties acknowledge that a subdivision survey shall be completed in order to designate the deed real property portions to be conveyed and retained. The BOE shall be responsible to procure and pay the total expense for said survey. Any final survey must be approved by both parties. This conveyance shall be completed within 20 days from the date the survey is approved by both the TOL and the BOE. As part of this conveyance, the TOL and the BOE agree to negotiate and enter into a parking lot agreement for that paved parking lot area owned by the TOL and located to the rear of the TOL Administrative Building and the above described 108 E. Front Street property. 4. HARNETT COUNTY BOARD OF EDUCATION OBLIGATIONS As part of the real property exchange transaction the BOE agrees to complete the following: (a) Conveyance of downtown Lillington block tracts to the TOL The BOE shall convey by Special Warranty Deed to the TOL those real property tracts located in the downtown block of the Town of Lillington contain the BOE offices for finance, auxiliary services, custodial/IT warehouse and “Red Barn” more specifically identified as: PIN 0650-40-8407.000 PIN 0650-40-7494.000 PIN 0650-40-7481.000 PIN 0650-40-7404.000 PIN 0650-40-5498.000 PIN 0650-40-5412.000 PIN 0650-40-5346.000 PIN 0650-40-4689.000 The parties acknowledge that located in the "Red Barn" area of the above described downtown Lillington identified real property tracts currently owned by the BOE and to be conveyed to the TOL, there is located an abandoned underground storage tank (UST). The TOL agrees to accept the subject real property which contains this UST in an "AS IS" condition and basis with all faults and to assume any liability for said UST. These matters shall be noted as a title exception on the Special Warranty Deed. Furthermore, as part of the specific real property conveyance, the TOL shall enter into an Indemnity Agreement whereby the TOL will indemnify and hold HCBOC 120621 Revised Pg. 118 5 harmless the BOE and Harnett County from and against any and all claims, liability, penalties and costs, including attorney's fees, arising from any claim, demand, order or other action related in any way to said UST or a) the actual contamination of property by any hazardous substances from said UST or b) the generation, use, treatment, storage, disposal, release or discharge on the subject real property or neighboring properties of any hazardous substances from said UST in violation of environmental law. As used in this document, the term "hazardous substance" shall mean any substance defined as hazardous or toxic or otherwise regulated by any federal, state or local law, rule or regulation related to the protection of the environment or human health. The BOE and the TOL acknowledge that the first 3 PINS heretofore listed represent the tracts upon which are located the BOE finance offices. The BOE and the TOL agree that simultaneous to the conveyance of these tracts to the TOL, that the parties shall enter into a maximum 6-month lease of these finance offices tracts by the TOL (Landlord) to the BOE (Tenant). Other lease terms shall be subject to negotiations between the TOL and the BOE. This conveyance and the lease shall be completed within 20 days from the date that the last party executes this Agreement. (b) Conveyance of gymnasium, print shop, and ball field properties to the TOL The BOE shall convey by Special Warranty Deed to the TOL those real property tracts upon which is located the STAR Academy gymnasium, print shop, and the ball fields which are a portion of PIN 0559-29-7992.000. The parties acknowledge that a subdivision survey will need to be completed in order to designate the deed real property portions to be conveyed and retained. The TOL shall be responsible to procure and pay the total expense for said survey. The final survey must be approved by both the TOL and the BOE. This conveyance shall be completed within 20 days from the date that the survey work is approved by both the BOE and TOL. Simultaneous to the above-described conveyance, the BOE and the TOL shall enter into a written agreement concerning the future shared use of said recreational facilities. The BOE and the TOL also agree that simultaneous to the conveyance of these tracts to the TOL that the parties shall enter into a lease of the print shop facility at 501 West Ivey Street, Lillington, NC, and a lease of the P D Hut by the TOL (Landlord) to the BOE (Tenant) with rent at zero and a term which shall extend until the print shop function is relocated and the P D Hut is no longer needed. SITUS AND INTERPRETATION This Contract and Agreement shall be construed and governed according to the laws of the State of North Carolina. If any provision of this Agreement is held to be invalid or unenforceable, all other provisions shall nevertheless continue to be in full force and effect. 6. MODIFICATION AND ENTIRE AGREEMENT A modification or waiver of any of the provisions of this Agreement shall be effective only if made in writing and executed with the same formality as this Agreement. This Agreement contains the entire understanding of the parties, and there are no representations, warranties, covenants, or undertakings other than those expressly set forth herein. I felt that we had a positive impact. We trust that you and other County leaders are of the same opinion. We were rushed at the end of the meeting. But as I understand it, you agreed that an economic and fiscal impact analysis of the potential build out of Edgerton Industrial Park would be helpful in obtaining commitments from Dunn Town officials, and perhaps the County, to fund the necessary infrastructure to lift the wastewater treatment moratorium that the Town of Dunn is now under. Rocky and I are in full agreement. We think it is inevitable that this analysis will demonstrate a very large economic and fiscal return on investment. Consequently, we would urge that Harnett County engage Sanford Holshouser Economic Development Consulting, LLC (“SHEDC”) to undertake this economic and fiscal impact analysis. Please accept this as SHEDC’s proposal to perform an economic and fiscal impact analysis of the jobs and capital investments as a result of the buildout of the Edgerton Industrial Park. To perform this analysis, SHEDC will utilize the facilities that could be constructed upon the remainder of the available property in that Park, as shown on Samet Corporation’s site plan. SHEDC and its partner, Dr. Henry Lowenstein, will make conservative estimates as to what might be located within those facilities in terms of the levels of the number of jobs to be Item 10 HCBOC 120621 Revised Pg. 133 created, and the wage levels of those jobs, based upon customary industry standards. This will result in estimations of economic and fiscal impacts which will be conservative and supportable. Additionally, we will not make any assumptions as to the value of any machinery and equipment to be installed in the facilities because these can vary widely depending on the type of operation occupying the space. This further ensures that the impacts reported will be less than what will actually be realized. SHEDC has been involved in the field of economic development for over twenty years. Previously all our partners were experienced “frontline” economic developers who worked at the local, state, and regional levels. As we have in similar projects in the recent past, we will partner with Dr. Henry Lowenstein, a seasoned economist. Dr. Lowenstein has a broad background in business, academic, government, and public service organizations, and has done extensive work for a number of private and public entities. Using a proprietary economic and fiscal impact model, Dr. Lowenstein will analyze all aspects of the buildout of Edgerton Industrial Park, and will provide data which will include the following: 1. Estimated Ad Valorem tax revenue figures for the completed facilities as shown on the Samet conceptual layout on lots 4 and 5, and any additional fiscal impacts. If desired, we will prepare a conceptual layout for lots 1,2, and 3 and compute the total impacts for facilities on lots 1-5. 2. Economic Impact of the estimated construction cost of the completed facilities as shown on the Samet conceptual layout. Similarly, If desired, we will prepare a conceptual layout for lots 1,2, and 3 and compute the total impact for facilities on lots 1-5. 3. Economic Impact estimate once the facilities are completed and operational. 4. Estimated per capita fiscal impact based on employment in the facilities. SHEDC will manage the entire project and work with Lowenstein to gather all pertinent information and data for analysis. We will submit the report in draft form for your review and make any necessary revisions prior to producing the final report. The report will address each of the estimates noted above. For both the economic and fiscal impact estimates we will show the annual and a projected five-year total, with the exception of the Ad Valorem tax revenues, which will be projected for a ten-year period. A five-year time frame is the typical standard used by businesses when assessing return on investment. It is understood that the report will be good faith estimates and not guaranteed results. Economic and fiscal impacts are based on theoretical models used in economic development and are approximations, based on estimated, ideal conditions. HCBOC 120621 Revised Pg. 134 As we discussed, numbers used in the analysis for jobs, wages, and capital investment for the different elements will be developed from industry standards, similar projects in other locations, and input from you. As a deliverable, SHEDC will provide an integrated final report that quantifies the economic and fiscal impact of the build out of the Park. Barring any unforeseen delays, the final report should be available for delivery within 30 days. The 30-day period shall begin upon execution of this letter by you. The fee for the economic and fiscal impact analysis is $11,000, for the facilities located solely on lots 4 and 5; and $11,500 for facilities on lots 1-6, plus mileage and expenses. Mileage and expenses are expected to be minimal and would be associated with any trips to Lillington and any requested printing, etc. SHEDC will invoice for the project upon the presentation of the final report. As part of this Master Plan, Parrish and Partners will assist the County with determining the exact location of 25-50 acres of adjoining property for construction of hangars. The Jetport Committee recommends that T&B provide their schematic design for this. 3.The Jetport Committee recommends T&B finish the Airport Terminal design plans, specifications and bid documents, incorporating the previously discussed removal of the outside spiral staircase. The Jetport Committee recommends the Board of Commissioners forgo getting a professional construction estimator’s opinion, and instead move to bidding. 4.Talbert and Bright will be responsible for bidding, contract administration and inspections for the Jetport Terminal Project. However, the Jetport Committee would like to recommend that Parrish and Partners be hired by Harnett County as a separate third party inspector for the Jetport Terminal Project. Parrish and Partners will provide inspection reports directly to the County Manager’s Office.
