HomeMy WebLinkAboutOrdinance language Bike lanes, greenways, multi-use or side trails, and sidewalks, where required by the County’s Bicycle, Pedestrian, & Greenway Master Plan, shall be installed on developer-built or modified roadways in accordance with such regulations. Where a proposed development does not include new or widening of existing collector or thoroughfare streets, the developer shall reserve right-of-way sufficient to accommodate the appropriate bikeway facility. Bicycle and pedestrian facilities shall be provided in accordance with the Bicycle Master Plan,Comprehensive Pedestrian Plan, and Comprehensive Parks and Greenways Master Plan.  Where any portion of a proposed subdivision or other development lies within the proposed right-of-way of any public street or road that is included in an officially adopted Highway Plan of the County, or in the event the proposed development is located along, or contains a corridor associated with a County Greenway Plan, the prescribed right-of-way shall be dedicated in the location and at the width as adopted in the official plan. OR Where any portion of a proposed subdivision or other development lies within the proposed right-of-way of any public road that is included in an officially adopted County Comprehensive Transportation Plan the prescribed improvements shall be made and the prescribed right-of-way shall be dedicated in the location and at the width as adopted in the official plan. Off-road trail improvements must be provided whenever: (a) such improvements are shown on or otherwise required by the County’s Bicycle, Pedestrian, & Greenway Master Plan; or (b) the subject subdivision has access to or is adjacent to existing or designated greenway corridors, in which case, access to such corridors must be incorporated into the overall subdivision design; or (c) the subject subdivision is adjacent to another subdivision or development that includes off-road trail improvements that could be readily connected to similar improvements within the subject subdivision. Bike lane requirement: In accordance with the County’s Bicycle, Pedestrian, & Greenway Master Plan and Comprehensive Transportation Plan, bicycle improvements, in the form of wide outside travel lanes or dedicated bike lanes, within the right-of-way of collector and thoroughfare roads, must be provided whenever such improvements are shown on or otherwise required by such Plans. Active Recreation: At least one half (½) of the recreational open space shall be provided for active recreation purposes such as playgrounds, tennis courts, ball fields, volleyball courts, etc., and improved to accepted national or local standards for size and associated amenities. Areas including ponds, wetlands, floodplains, or easements for public utility transmission lines shall not receive credit in the computation for the amount of active recreational open space required. In addition, any improvement within the County’s Bicycle, Pedestrian, & Greenway Master Plan shall meet the requirements as stated in section… P&R Board review? The location of the proposed recreation and open space areas, its suitability for recreational use, and any recreational plans adopted by the County shall be considered in determining whether to accept dedication or payment-in-lieu. The decision shall be made by the County’s Parks & Recreation Committee as a component of preliminary subdivision plans or special use permits, or by the Planning Director as a component of site plans. Any decision of the Planning Director relative to this section may be appealed to the County Commissioners. Existing info in PUD regs Improved Open Space A minimum of 10 percent (10%) of the total open space provided shall include improved open space area(s) in primarily residential planned unit developments. Specific improved open space uses shall be proposed by the developer in the outline development plan. Proportionate to its size, each pod of the PUD shall include an area of improved open space. In no case shall open space include less area than the smallest lot of the pod in which the open space is located. Access to Open Space In cases where improved open space is located along a right-of-way where improved pedestrian access is not required, such access shall be provided to connect the open space to the nearest required pedestrian access. Existing Definitions Article XIV. Definitiosn & Certifications 2.0 General Definitions & Acronyms Open Space An area of land or water designed and intended for public or private use. Said area is typically left in its natural or undisturbed state if wooded, except for the cutting of trails for walking or jogging, or, if not wooded at the time of development, is landscaped for ball fields, picnic areas, or similar facilities. Open space, Common Land within or related to a development, not individually owned or dedicated for public use, that is designed and intended for the common use or enjoyment of the residents of the development and their guests and that may include such complementary structures and improvements as are necessary and appropriate. Open Space, Greenway A linear park network left in its natural state except for the introduction of trails used by pedestrians and bicyclists. Open Space, Improved A type of open space wherein the land is not left in its natural state, but is developed, to varying degrees, for the enhanced enjoyment of the community, including but not limited to: golf courses, swimming pools, miniparks, and sheltered picnic areas. Open Space, Minipark A type of open space, typically between 2,000 and 30,000 square feet in size, intended to serve the immediate surrounding neighborhood within a development, including but not limited to: tennis courts, tot lots, and clubhouses. Open, Space Preserve Open space that preserves or protects endangered species, critical environmental features, viewsheds, or other natural elements including but not limited to nature, wildlife, and forests, and is specifically intended for preservation of native species. Open Space, Recreation Area An area of land and/or water resources that is developed for active recreation pursuits with various man-made features that accommodate such activities. Also referred to as ‘Park’. Open Space, Recreational A type of improved open space whereby organized activities requiring equipment, often performed with others (including but not limited to basketball courts, swimming facilities, and tennis courts) are commenced. Open Space, Unimproved An area of land and/or water that is set aside for permanent preservation and left in its natural, undeveloped state. Open Space, Usable Any area that: Is not encumbered with any substantial structure; Is not devoted to use as a roadway, parking area (paved or peripheral), or sidewalk; Is left in its natural or undisturbed state, if such a state is compatible with use of the area or property planted and landscaped; (Facilities for the pursuit of passive types of recreation, such as picnic tables, are permissible.) Is capable of being used and enjoyed for purposes of informal and unstructured recreation and relaxation; and Is legally and practicably accessible to the residents of the development out of which the required open space is taken, or to the public if dedication of the open space is required.
