HomeMy WebLinkAboutRheston Rezoning app EXPLANATION FOR ZONING REQUEST The property is currently zoned RA-20R. The applicant is developing the corner at the intersection of Nursery Road and Ray Road. The applicant is purchasing the property from Paul E Griffin. The property closest to the intersection is zoned Commercial. The applicant intends to construct a retail store with the associated parking. Nursery Road and Ray Road are both on the CTP improvement plan. As such, ROW dedication is required for the ultimate road section. With the additional ROW dedication and building setbacks, the commercial zoned portion of the property is no longer adequate for the store and parking. The property is being requested to rezone to Commercial to allow for the construction of the store and parking. The majority of the property is wetlands and will not be used for construction. 1. The proposed zoning change will be in accordance with the property to the north that is zoned commercial. The property is buffer by roads on two sides and wetlands to the south. 2. Rezoning the subject property to commercial is essential to the property to the north. The developable area of the subject parcel is small in comparison to the wetlands that exist on site. With the required ROW dedication, the property to the north isn’t large enough to be developed for a typical commercial use. 3. The request is not considered spot zoning. The rezoning request will make the property of like zoning to the adjacent northern parcel which is currently owned by the same person. 4. The character of the neighborhood will not be adversely impacted by the proposed change. It will help allow the owner to proceed based on the original intent for the purchase of the property. The property is buffered by two roads and wetlands. 5. The propose change is in accordance with the comprehensive plan and is sound planning practices.
