MEMORANDUM OF AGREEMENT tl This Memorandum of Agreement made and executed as of the c.S: day
of !O,u4,,,.\,q..t , 2020, between Kevin M. Lynch and wife, Anne F. Lynch, with a mailing address
of 278 Troy Dr., Fuquay-Varina, NC (collectively, the "Grantor"); and Bethesda Association
L.L.C., a North Carolina limited liability company ("Bethesda").

WITNESS ETH
Pursuant to that certain Agreement Regarding Grant of Sanitary Sewer Easement dated
U:,c.: ..... be,c 5 , 2020 (the "Agreement"), Grantor has agreed to grant Bethesda a
temporary construction easement and to grant to Hamett Regional Water a permanent
sanitary sewer easement in the approximate location depicted as "Approximate Location
of Easement" on Exhibit A attached hereto, which shall encumber property owned by
Grantor that is more fully described on Exhibit B attached hereto, pursuant to the terms of
the Agreement.
Bethesda and Grantor desire to record this Memorandum for the purpose of placing the
public on notice of the Agreement, all of the provisions of which are incorporated herein
by reference with the same force and effect as if herein set forth in full. Nothing contained
in this Memorandum is intended to or does modify or expand in any way any of the terms
or provisions of the Agreement, and the Agreement shall determine and govern the rights
and duties ofGrantor and Bethesda in all respects.
This Memorandum may be signed in one or more counterparts (or with counterpart
signature pages) which, taken together, shall constitute a fully executed Memorandum and
shall be considered a single document.
