This development began in 1989 prior to Zoning. It has varied setbacks throughout, and when this phase was recorded in 1996 specific setbacks were listed and recorded within its Restrictive
Covenants and Reservations. These are front=15’, rear= 15’, and sides =8’. However, only a front setback variance of 19’ is requested to allow for a 16’ front setback. This will ensure
the character of this Section remains aesthetically conforming.

Findings of Fact (The Board of Adjustment will evaluate the application to ensure that all of the following provisions are fulfilled)
Unnecessary hardship would result from the strict application of the ordinance. It shall not be necessary to demonstrate that, in the absence of the variance, no reasonable use can be
made of the property.
The hardship results from conditions that are peculiar to the property, such as location, size, or topography. Hardships resulting from personal circumstances, as well as hardships resulting
from conditions that are common to the neighborhood or the general public, may not be the basis for granting a variance.
The hardship did not result from actions taken by the applicant or the property owner. The act of purchasing property with knowledge that circumstances exist that may justify the granting
of a variance shall not be regarded as a self-created hardship.
The requested variance is consistent with the spirit, purpose, and intent of the ordinance, such that public safety is secured, and substantial justice is achieved
Note: There must be four (4) Board of Adjustment members present at the meeting to hear a request for a Variance. Four (4) out of the five (5) Board of Adjustment members must vote
in favor of granting a Variance. If only four (4) Board of Adjustment members are present at the meeting, then all four (4) members must vote in favor of granting the Variance. If
only three (3) members vote in favor of granting the Variance, the request is denied.
