HomeMy WebLinkAbout041921mHARNETT COUNTY BOARD OF COMMISSIONERS Regular Meeting Minutes April 19, 2021 The Harnett County Board of Commissioners met in regular session on Monday, April 19, 2021 at 6:00 pm, in the Commissioners Meeting Room, Harnett County Resource Center and Library, 455 McKinney Parkway, Lillington, North Carolina. Due to COVID-19 this meeting was open to a limited number of the public to attend in person and citizens and staff were provided options to listen to the meeting live. Members present: W. Brooks Matthews, Chairman Lewis W. Weatherspoon, Vice Chairman Barbara McKoy, Commissioner Mark B. Johnson, Commissioner Matt B. Nicol, Commissioner Staff present: Paula K. Stewart, County Manager Dwight Snow, County Attorney Kimberly Honeycutt, Finance Officer Lindsey Lucas, Deputy Clerk Chairman Matthews called the meeting to order at 6:00 pm and Vice Chairman Weatherspoon led the Pledge of Allegiance and invocation. Chairman Matthews called for any additions or deletions to the published agenda. Vice Chairman Weatherspoon moved to approve the agenda as published. Commissioner Nicol seconded the motion that passed unanimously. Vice Chairman Weatherspoon made a motion to approve the consent agenda as amended. Harnett County General Services/Harnett Regional Jetport requests consideration and approval to approve a construction contract with Precision Approach, LLC for the Airfield/Lighting Rehabilitation Project. Funding agreement with NC Department of Transportation/Division of Aviation and project ordinance was approved by the Board of Commissioners on April 5, 2021. Total contract amount is $1,458,641.00. This project was approved under the FY2022-2028 Capital Improvement Program 4. Harnett County Health Department requests approval to accept additional COVID 543 funds in the amount of $1,089,044 to assist local health departments in testing and implementation of COVID-19 vaccines. Any funds not spent during FY 20-21 will carry forward into FY 21-22 A Resolution Authorizing The Purchase By Harnett County Of A Jetport Hangar (Attachment 1) Chairman Matthews opened the meeting for informal comments by the public, allowing up to 3 minutes for each presentation up to 30 minutes. Citizens were allowed to call in and provide their public comments verbally during this period or submit their public comments in writing prior to the meeting to be read aloud during the meeting as time allowed. Jerry Rivas of 364 Twin Ponds Road in Sanford Rose Teniente of 179 Tilden Howington Drive in Lillington Jay Sikes, Manager of Planning Services, petitioned the Board for a Public hearing on the proposed rezoning. Public Hearing: Landowner/Applicant: Fred Turlington, C/O Ray Womble/Hal Long; 20.06 +/- acres; Pin #'s 1508-08-2742.000 & 1508-08-1016.000; From Commercial to RA -30 Zoning District; Intersection of NC 55 E & SR # 2009 (Prospect Church Road); Grove Township. Mr. Sikes stated staffs evaluation as: The IMPACT to the adjacent property owners and the surrounding community is reasonable, and the benefits of the rezoning outweigh any potential inconvenience or harm to the community. REASONING: The impact to the surrounding community is reasonable, as the requested zoning district is the same as the remainder of these parcels and surrounding area - The requested zoning to RA -30 is compatible with the Land Use Classification of Low Density Residential. The LDR areas are intended for single family detached structures consisting of a suburban character. - The proposal does enhance or maintain the public health, safety and general welfare. REASONING: The requested zoning to RA -30 would maintain the public health, safety and general welfare due to the existing residential uses within the area, as well as this parcel being split -zoned with this same classification. - The request is for a Small Scale Rezoning and should be evaluated for reasonableness. Reasoning: Due to the same surrounding residentially zoned area this application does not need to be considered a Small Scale Rezoning. Suggested Statement -of --Consistency: As stated in the evaluation, the requested rezoning to RA - 30 would not have an unreasonable impact on the surrounding community and will maintain the public health, safety, and general welfare because of the existing residential uses within the area. Therefore, these existing uses lead to compliance with the adopted Land Use Plan. Thus, it is recommended that this rezoning request be APPROVED. Chairman Matthews called to order a public hearing on the matter and opened the meeting for comments from the public. Citizens were allowed to speak in person or were allowed to submit their comments in writing prior to the meeting or to call in and provide their comments verbally during the meeting. No one spoke in opposition. Chairman Matthews closed the public hearing. Vice Chairman Weatherspoon made a motion to approve the requested rezoning to RA -30 and Commissioner Johnson seconded the motion that unanimously. (Attachment 2) Mr. Sikes petitioned the Board for a public hearing on a proposed Text Amendment: Case# PLAN2103-0001-Harnett County Unified Development Ordinance: Article V, Sections 11.0 to amend Harnett County's U.D.O. where it pertains to allowing a covered addition on a home in a manufactured home park. Chairman Matthews called to order a public hearing on the matter and opened the meeting for comments from the public. Citizens were allowed to speak in person or were allowed to submit their comments in writing prior to the meeting or to call in and provide their comments verbally during the meeting. - Jerry Rivas of 364 Twin Ponds Road in Sanford NC spoke in favor of the Text Amendment. Chairman Matthews closed the public hearing. No Motion was made by the Commissioners. The request died. Mr. Sikes petitioned the Board for a public hearing on a proposed Text Amendment: Case# PLAN2103-0003-Hamett County Unified Development Ordinance: Article V, Sections 1.2 to amend Harnett County's U.D.O. use regulations that pertains to required parking spaces for public elementary and middle schools. Chairman Matthews called to order a public hearing on the matter and opened the meeting for comments from the public. Citizens were allowed to speak in person or were allowed to submit their comments in writing prior to the meeting or to call in and provide their comments verbally during the meeting. No one spoke in opposition. Chairman Matthews closed the public hearing. Vice Chairman Weatherspoon made a motion to deny the requested text amendment. Commissioner Nicol seconded the motion that passed unanimously. County Attorney Dwight Snow came before the Board to Discuss the Sale of land to the City of Dunn. The City of Dunn desires to purchase adjoining parcels of land near the City of Dunn's existing water treatment plant. City Manager Steven Neuschafer spoke and answered questions from the Board. No motion was made by the Commissioners. The request died. County Manager Paula Stewart gave her report. Commissioner Johnson requested that the Legal Department look into drafting Proclamations to honor 911 dispatchers and Frontline Medical workers during COVID-19. Commissioner McKoy also asked to include drafting a Proclamation to honor Harnett County Volunteers who have stepped in to help during the COVID-19 pandemic as well. Vice Chairman Weatherspoon moved that the Board go into closed session for the following poses; To discuss certain personnel matters. Commissioner Nicol seconded the motion that passed unanimously. Lucas, Interim Clerk ATTACHMENT 1 Harnett C O U N T Y NCRTH CARO''IKA www.harnettorp A RESOLUTION AUTHORIZING THE PURCHASE BY HARNETT COUNTY OF A JETPORT HANGAR THAT WHEREAS, Warren Investment Company of North Carolina, Inc., a North Carolina Corporation ("Warren Investment") was formerly known as Warren Investment Company of Alabama, Inc. until it changed its corporate name effective April 18, 2013; and, WHEREAS, Harnett County ("the County") is the owner of the Harnett Regional Jetport at 615 Airport Road, Erwin, North Carolina 28339 which is located off U.S. Highway 421 between the Town of Erwin and the Village of Buies Creek; that as part of its Jetport operations, the County issues ground leases to third parties for certain areas of the Jetport for the installation and operation of aircraft hangars; and WHEREAS, Warren Investment is the lessee in a Hangar Ground Lease with the County on an approximate 80 ft. x 80 ft. ground lease tract upon which stands an aircraft hangar structure which is contained within that area composed of 0.36 acre identified as "For lease purposes only" as shown on that plat recorded in Plat Cabinet D, Page 161-D, Harnett County Registry; and WHEREAS, Warren Investment has made the decision that it desires to sell its aircraft hangar at the Harnett Regional Jetport; that the Harnett County Board of Commissioners has determined that it would be conducive to its Jetport operations and in the best interests of the County to procure the aircraft hangar from Warren Investment together with the voluntary termination of any leasehold rights that Warren Investment may have pursuant to the previous ground lease agreement; that the parties have negotiated a purchase agreement based upon Warren Investment's unencumbered transfer of ownership of the aircraft hangar to the County and the strong roots • new growth termination of the ground lease for the purchase price of one hundred sixty thousand dollars ($160,000.00). NOW, THEREFORE, BE IT RESOLVED by the Harnett County Board of Commissioners that the Harnett County Manager and her staff are hereby authorized to enter into and close a purchase agreement with Warren Investment for the purchase of its aircraft hangar hereinabove described together with the release and termination of any leasehold rights that Warren Investment may have pursuant to that Hangar Ground Lease dated September 1, 1997, and any amendments, renewals, or extensions thereto for a purchase price of one hundred sixty thousand dollars ($160,000.00) which said sum shall be appropriated from the County's general fund balance.
