HomeMy WebLinkAbout092006r HARNETT COUNTY BOARD OF COMMISSIONERS Minutes of Reconvened Meeting September 20, 2006 (from regular meeting September 18, 2006) The Harnett County Board of Commissioners met in a reconvened session on Wednesday, September 20, 2006, in the conference room, Administration Building, 102 East Front Street, Lillington, North Carolina. Members present: Teddy J. Byrd, Chairman Beatrice B. Hill, Vice Chairman Dan B. Andrews Walt Titchener Commissioner Tim McNeill was absent. Staff present: Neil Emory, County Manager Jennifer Slusser, Staff Attorney Kay S. Blanchard, Clerk to the Board Rodney Tart, Director, Public Utilities Steve Ward, Assistant Director, Public Utilities Chairman Byrd called the meeting to order at 9:00 a.m. Mr. Tart presented an overview of proposed contracts in which Harnett County would provide water and wastewater service to Fort Bragg. The contracts shall be for a term of forty (40) years. Mr. Tart noted that this is the largest utility project in Harnett County’s history. The historic agreements will provide Harnett County with $55 million in infrastructure improvements. Fort Bragg and other military bases have been directed to pursue the privatization of water and wastewater services because of declining infrastructure. Fort Bragg’s system is almost 100 years old and it is difficult for the base to stay in compliance with state and federal regulations. Mr. Ward presented for the Board’s consideration, a proposed Water Services Contract between Public Works Commission (PWC) of the City of Fayetteville, United States of America, and the County of Harnett. Commissioner Titchener moved for Harnett County to enter into the contract as presented and to authorize the appropriate County officials to execute the document after review by the County Staff Attorney. Vice Chairman Hill seconded the motion and it passed unanimously. Mr. Ward presented for the Board’s consideration, a proposed Interlocal Agreement between the City of Fayetteville (acting through its Public Works Commission (PWC) and the County of Harnett. This agreement provides for the City of Fayetteville to be the sole agent of both the City of Fayetteville and Harnett County in all matters related to the water contract with Fort Bragg. The two entities are equal partners but the City will be the single contact with Fort Bragg regarding the water contract. Fort Bragg will pay Fayetteville and Fayetteville will in turn pay Harnett County its share. Commissioner Andrews moved for the County to enter into the Interlocal Agreement as presented and to authorize the appropriate County officials to execute the document after review by the County Staff Attorney. Chairman Byrd seconded the motion and it passed unanimously. Mr. Ward presented for the Board’s consideration, a proposed Wastewater Service Contract between the United States of America and Harnett County. This wastewater service contract is solely with Harnett County to design, construct, own, operate, and maintain the facilities needed to connect Fort Bragg to Harnett County’s wastewater system. Commissioner Andrews moved for the County to enter into the contract as presented and to authorize the appropriate County officials to execute the document after review by the County Staff Attorney. Commissioner Titchener seconded the motion and it passed unanimously. Mr. Ward presented for the Board’s consideration, a proposed Subcontract Agreement between the County of Harnett and American Water Operations and Maintenance, Inc. This subcontractor will work under Harnett County to operate the water and wastewater service for Fort Bragg until Harnett County is ready to take over, approximately two to three years. The subcontractor will begin October 1. Fort Bragg will pay Harnett County for any costs associated with the subcontractor. Vice Chairman Hill moved for the County to enter into the contract subject to any necessary changes approved by the Department of Public Utilities that do not substantially alter the terms of the contract; and to authorize the appropriate County officials to execute the document after review by the County Staff Attorney. Commissioner Titchener seconded the motion and it passed unanimously. There being no further business, Commissioner Andrews moved to adjourn. Vice Chairman Hill seconded the motion and it passed unanimously. The Harnett County Board of Commissioners’ reconvened meeting, September 20, 2006 adjourned at 10:00 a.m.
